010681-Special Organizational M499 MINUTES City Commission, Sanford, Florida January 6, at 7:00 P. M. 19 81 The City Commission of the City of Sanford, Florida, met in Special Organizational Session in the City Commission Room of the City Hall at 7:00 o'clock P. M. om January 6, 1981. Present: Mayor-Commissioner Lee P. Moore Commissioner Milton Smith Commissioner Julian L. Stenstrom 'Commissioner David T. Fart Commissioner Edwin O. Keith City Manager W. E. Knowles City Clerk H. N. Tatum, Jr. Commissioner-Elect Edward A. "Ned" Yancey The meeting was called to order by the Chairman. There being no old business to be transacted by the outgoing board, Commissioner Stenstrom moved that the meeting adjourn sine die. Seconded by Commissioner Keith and carried The City Clerk then administered the Oath of Office to Mayor-Commissioner-Elect Lee P. Moore, Commissioner-Elect Milton Smith, Commissioner-Elect Edward A. "Ned" Yancey, and Com- missioner-Elect Eddie O. Keith; each signed the Oath and Acceptance of OffiCe and were seated, respectively, as Mayor-Commissioner, and Commissioners, of the City of SanfOrd, Florida. The Mayor introduced and read in full Resolution No. 1296, and presented same to Com. missioner Julian L. Stenstrom. Said Resolution being in words and figures as follows: ~ RESOLUTION OF THE CITY OF SANFORD, FLORIDA, COMMENDING JULIAN L. STENSTROM FOR HIS FAITHFUL SERVICE TO THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA. WHEREAS, Julian L. Stenstrom, on January 6, 1981, has completed his elect- ed term of office as a member of the City Commission of the City of Sanford, Florida; and, WHEREAS, Julian L. Stenstrom was elected in December, 1970, assumed office on January 5, 1971, and has served faithfully and diligently as a City Commissioner since that time; and, WHEREAS, in addition to his duties as City Commissioner, JuLian L. Sten- strom was appointed by the Sanford City Commission and served as a member of the Board of Directors of the Seminole Community Action for a one year te=m from Decem- ber 11, 1978 to December 11, 1979,; and, WHEREAS, Julian L. Stenstrom, from time to time, served as '!Acting Mayor" in behalf of the Mayor's absence from the City, attending certain ceremonies and chair- lng the City 'Commission Meetings; and, WHEREAS, all of the service of Julian L. FOR HIS FAITHFUL SERVICE TO THE CITY COMMISSION OF 'THE CITY OF SANFORD, FLORIDA. WHEREAS, C. Vernon Mize, Jr. has submitted his resignation as the.' City Attorney of the City of Sanford, Florida, in order to accept the po- sition of Judge of the 18th Judicial Circuit on December 30, 1980; and WHEREAS, C. Vernon Mize, Jr. was appointed by the Sanford City Commission on January 8, 1973 and has merved faith'fully and deligently as a City Attorney since that time; and, WHEREAS, C. Vernon Mize, Jr. has spent many, many hours of his time and efforts in his responsibility in preparing tremendous amounts of City documents, and advising .and defending the City of Sanford; and, WHEREAS, C. Vernon Mize, Jr. has attained this worthy judgeShiplin behalf of. our County of Seminole; and which this position bears great re- sponsibility, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that the City Commission of the City of Sanford, Flo- rida, hRr~by acknowledges and commends C. The City Manager reported that the Florida Department of Community Affairs has stat- ed their report is about to be sent in printed f~rm and recommended to table, pending receipt of same. The Mayor stated he wanted additional information as follows: a) list of each individual by job title b) Salary paid, by job description, as of October 1, 1980 c) January 1, 1981 proPosed salary, by job description. The City Manager.was authorized to obtain the information Commissioner Keith moved to table consideration of the Department of Community Af- fairs Plan. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, Commissioner Farr moved to authorize use of · the Civic Center, with alcoholic beverages, for the Champagne Ball on January 31, 1981, with payment of proper fees. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, Commissioner Farr moved to authorize salary reclassifications as follows: a) Jos~e Beall, from Custodial Worker C to D, $8,373.92 annual. b) Janice Black from PoliCe Officer D to E, $14,909.42 annual. Seconded by Commissioner Keith and carried. M. 19 81 Temperly, at $2,350.42 per acre,''upon conditions as follows: a) Action of the County Commission that "this sale will not jeopardize the borrow pit permit issued to the City of Sanford for so long as the borrow pit use remains as a City of Sanford function", and b) Use corrected legal for County action, and c) Instruct the City'Attorney to draft the deed, and d) Authorize the sale of the 0.32 acres for the price of $800.00 (.32 x 2,500) plus costs. Seconded by Commissioner Keith and carried. The. City Manager reported receipt of a fifthi~application for the City Attorney's position, from Mr. Abbott M. Herring. The City Manager submitted a report of Florida cities, shoWing population, total budget, and whether the City Attorney is full-time, part-time, or on a retainer. The City Manger submitted a letter from City Attorney C. Vernon Mize, Jr., atating that he has worked an average of approximately one-fourth of each week on City business, and that he felt that the appointment of a full-time attorney for the City would be premature. The Commission ; agreed, that based on the information presented, it would not be timely to appoint a full-time City Attorney. Commissioner Yancey moved to appoint as City Attorney, William L. Colbert, of the firm of Stenstrom, McIntosh, Julian, Colbert & Whigham. Seconded by Commissioner Sm~h and carried over dissenting vote of Commissioner Keith. Commissioner Smith moved to make the appointment~Unanimous- Seconded by Commission er Yancey and carried over dliS, Sent~.ng votes of Mayor Moore and Commissioner Keith. The City Manager reported that the State of Florida Department of Environmental Re- gulation will ask Judge Leffler to reconsider Section 2(A) of his order, regarding moving drums of chemical waste to and from the chemical storage site. He also stated that, so far, SEEDCO has not joined the City suit, and has not filed a landlord/tenant suit. Patrick Tally, a resident living near the chemical storage site, appeared and sta- ted he was spokesman for other residents living near the site, to express their concern for the decline of their, property valuation, and contamination' of the water supply. He said they feel the City has done an extremely good job so far ~.Commission informed Mr. Tally that the individuals might be further ahead to file their own lawsuit against City Chemicals Industries, Inc., instead of joining the City's suit. The. City.Manager reported that an additional street light is, needed on Mangoustine Avenue, between First Street and Seminole Boulevard, and that an additional light is needed and the other lights need to be resPaced, on East 24th Street.
