Rotundo Deputy City Clerk March 24 and April 3, 1981 The Chairman announced that the Commission would hear from thos~ persons present to speak in favor of, or in opposition to, the proposed rezoning. The Planning and Zoning Commission submitted a recommendation to rezone the property. The City Manager reported that the owner and developer is working out'a new site plan. On recommendation of the City Manager, C6mmissioner Yancey moved to table the public hearin until the site plan and other information are submitted. Seconded by Commissioner Farr and carried. He stated he wants to convert the building from a restaurant to a rooming house with five rooms; the Zoning Ordinance requires five on site parking spaces, but from his experience in operating other rooming houses, he feels that three spaces woUld be more than adeqffate: ' and which he would be able to provide on site. On recommendation of the City Manager, Commissioner .Farr moved to deny the request. Seconded by commissioner Yancey aq~ carried Request submitted from Genevieve Barnes for a 90 day time extension on Condemnation Report No. 80-977, Group 61, 1710 West 16th Street. submitted a recommendation for 90 days extension. The Minimum Housing Code Inspector On recommendation of the City Manager, Commissioner Yancey moved to authorize same. Seconded by Commissioner Farr and carried. Request submitted from W. D. Gibson, Jr., owner, Big "10" Tires of Sanford, 2650 Sou Orlando Drive, to use a mobile trailer sign for 30 days for a Grand Opening. Commissione Farr moved to deny same. Commissioner Farr moved to authorize the City Attorney to prepare the proper ordinance to annex the property described in A. Seconded by Commissioner Yancey and carried. The City Manager reported he had received a call from people on Mattie Street,s. objecting to the property'being used to gt0re underground cable burying equipment. Commissioner Yancey moved to deny the request. The City Manager reported the alley is not open, On recQmmendation of the City Manager, Commission~ Farr moved to authorize the City Manager to ask the applicant to obtain in writing, the abutting property owners assention or objection to the proposed closing. Seconded by Commissioner Yancey and carried. The City Manager reported that the City sold the East 50 feet of Lot 8, Block G, A. D. Chappell's Subdivision to Geraldine Kirk for th~ amount of $995.00, and the lot has a t.arge sewer line th~ough~..it~ and cannot be used because of the sewer line. The City Manager recommended the City re-purchase the lot for $995.00, plus 5% interest, reimburse Mr. Kirk the amount of the taxes he has paid on the lot, and give Mr. Kirk an access easement over the East 20 feet of said Lot 8, Block G, to the North 40 feet of Lot 9, Block G, A. D. Chappell's Subdivision. Commissioner Yancey moved to authorize the purchas, as recommended. Seconded by Commissioner Farr and carried. The City Manages reported that the C~ty's appointment to the East Central Florida Regional Planning Council Metropolitan Planning Council is required by state law to be an elected official, and therefore, the Commission's appointment of Julian Stenstrom to same needs to be rescinded. Commissioner Farr moved to rescind same and to appoint Commissioner Yancey to the East Central Florida Regional Planning Council Metropolitan Planning Council. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, Commissioner Farr moved to direct the City Manager to administer, control and be responsible for, the remaining portion of the Community Development Block Grant for housing rehabilitation, currently administered by the Sanford Housing Authority. Commissioner Farr moved to authorize the City Attorney to prepare the proper resolution to th~eState of Florida Department of Transportation for the request. Seconded by Commissioner Yancey and carried. On motion of Commissioner Farr, seconded by Commissioner Yancey and carried, Resolution No. 1302 was adopted. Said'ReSolution being in words and figures as follows: Resolution No. 1302 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, SUPPORTING FRIENDS OF THE ST. JOHNS IN ITS EFFORTS TO INSURE THAT THE ST. JOHNS RIVER NORTH OF PUZZLE LAKE, SEMINOLE COUNTY, FLORIDA, IS INCLUDED WITHIN THE ST. JOHNS RIVER WATER MANAGEMENT PROGRAM. WHEREAS, the St. Johns River is an irreplaceable assetcfor the citizens of Seminole Comity for a variety of reasons ranging from enviromental to recreational, to agricul- tural, to economic, to asthetic, and Wt{EREAS, the St. Johns River is an important component of the region's natural heritage and is of historic significance, and WHEREAS, the protection of th~ St. Johns River basin is of great importance to the cities within Seminole County, including the City of Sanford, Florida, and WHEREAS, the St. Johns River north of Puzzle Lake in Seminole County may not be adequately protected by implementation of the proposed St. Johns River Water Management District Resolu- tion 81-2, and WHEREAS, the lack of adequate water flow in the St. Johns River north'~of Puzzle Lake in Seminole County is of increasing concern to Seminole County residents, and WHEREAS, Friends of th~St. Johns has devoted a great deal of time and energy trying to restore normal water flow conditions in the SB. Johns River, NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA, that the City of Sanford does support Friends of the St. Johns in its efforts to insure that'~lha St. Johns River Water Management District includes the St. Johns River north of Puzzle Lake in Seminole County within its proposed water management program as expressed in Resolution 81-2. Commissioner Farr moved to amend the third paragraph on page 2 to read "Mobile trailer signs, exclusive of the transportation mechanism, shall not exceed 50 square feet in area per face". Seconded by COmmissioner Yancey and carried. Commissioner Yancey moved to table further consideration of the ordinance until all members of the Commission are present. Seconded by Commissioner Farr and carried. The City Attorney reported that he had ordered surveys and title searches for the two parcels of property for sewer plant expansion. On recommendation of the City Attorney, Commissioner Farr moved to authorize the Mayor to execute Resolution No. 1303. Seconded by Commissioner Yancey and carried. Said Resolution being in words and figures as follows: RESOLUTION NO. 1303 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, DETERMINING THAT THE EXERCISE OF EMINENT DOMAIN POWERS FOR EXPANSION OF THE SEWER TREATMENT FACILITY IS FOR A PUBLIC USE AND PURPOSE, ESTAB- LISHING JUST COMPENSATION FOR THE PROPERTY TO BE CONDEMNED, DETERMINING THE APPRAISAL WAS PERFORMED' IN ACCORDANCE WITH APPLICABLE LAWS, DETERMINING THAT THE EXERCISE OF EMINENT DOMAIN POWERS TO BE IN ACCORDANCE WITH APPLICABLE LAWS AND ESTABLISHING A LEGAL DESCRIPTION OF THE PROPERTY AND IDENTIFYING ITS OWNERS OF RECORD, ESTABLISHING THAT FEE SIMPLE TITLE IS SOUGHT TO THE PROPERTY, DETERMINING THAT THE CITY IS EXERCISING POWERS GRANTED BY THE':iFLORIDA STATUTES, AUTHORIZING THE CITY ATTORNEY TO PROSECUTE EMINENT DOMAIN PROCEEDINGS AND ESTABLISHING AN EFFECTIVE DATE. M. 19 81 line or area of construction of the proposed expanded sewer treatment facility and intends in good faith to have portions of same constructed within, over, across and upon the hereinafter described parcels and through and across certain properties located in the City of Sanford, Florida; and WHEREAS, it is deemed an urgent public necessity for the preservation of health, safety and welfare of the citizens of Sanfdrd, Florida, and the public to construct and place in operation said proposed expanded sewer treatment facility as scheduled; and WHEREAS, it is necessary to acquire additional real property for the expanded sewer treatment facility; and WHEREAS, ~t has beem determined that the~Ci~Y of Sanford, Florida, acquire the fee simple absolute title to the property hereafter described for the aforesaid uses and purposes; and WHEREAS, efforts on the part of the City of Sanford, Florida, to obtain by negotiations and purchase the hereinafter described necessary and required parcels of land have been unsuc- cessful and it is the opinion of the City Commission of the City of Sanford, Florida, that said necessary and required lands should be appropriated as rapidly as possible under the laws of the State of Florida by eminent domain and in the manner described by law. WHEREAS, the City of Sanford, Florida, states that, based upon a valid appraisal, its estimate of just compensation (fair market value) for those parcels is: Parcel i $53,040.00 (Fifty- three Thousand Forty Dollars) and Parcel II $24,8130.00 (Twenty-four Thousand Eight Hundred Thirty Dollars); and WHEREAS, ~he City of Sanford, Florida, certifies that the work of its appraiser with respect to the property hereinafter described has been performed in a competent manner and in accordance? with applicable laws. Keith ACTING MAYOR AS THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA The City Manager reported he had photographed the trailer operation at the old Toyota building at 185 West Airport Boulevard on April 10, 1981. The City Attorney stated that if the City desires to enfOrce the stipulations for the conditional use, the matter should be delegated to the Code Enforcement Board, but that once it is given to the Board, the City Commission does not have control over the procedure On recommendation df the City Manager, Commissioner Parr moved to authorize the City Attorney and the City Manager to notify the owners and lessees by Certified Return Receipt Requested mail, of a public hearing to be held April 27, 1981, to reconsider the conditiona use granted at the meeting of ;February .23, 1981, and to notify other property owners within 300 feet of 185 Airport Boulevard that they will be able to speak at the public hearing. On recommendation of the City Manager, Commissioner Yancey moved to authorize install- ation, on a trial basis through thelremaining budget~:year, of 552 air diffusers which will pay for themselves within one year,by conserved electric power in the sewer plant aerators, and if they perform~as stated, to purchase same. in. amount of $]~3,800.00, with transfer from Reserve for Renewal. and Replacement, in the ]~981-82 budget. Also, to authorize installation cost in amount of $1,300.00 to $1,632.00 for materials, and to use City labor for install- ation. Seconded by-Commissioner Farr and carried. The City Manager submitted a proposed new Longevity Pay Plan, and stated ~hat the Department Heads and Staff all concur that the pr.esent longevity ptan needs to be rescinded and the Extended Service Pay Plan be adopted as follows: EXTENDED SERVICE PAY PLAN Policy: POLICY MANUAL Rescind previous "Longevity Pay Program" and establish "Exended Service Pay Plan" Employees are eligible for Extended Service Pay when: ~. The employee has reached "F" step in at least one position and has completed at least eight (8) yeats of continuous, full-time, service with the City of Sanford, or; The mmployee has been in two (2) or more positions, but has not reached "F" step, yet has advanced through the merit system as far as possible in each position within the scheduled minimum allocated time and has at least eight[~8) yea=s of continuous full-time service with the City of Sanford. Extended Service Pay will be awarded on the following basis: $1.00 per year of service with the City per month, i.e.: 8 Years service - $1 x~Syrs, x 12 months 9 Years(Service - $1 x 9 yrs. x ]2 months 10 Years service - $1~:~x 10 yrs. x 12 months ..... and so forth. = $ 96.00 = 108. O0 = 120. O0 Extended Service Pay is paid once annually on or about December 15th, of each year. December 15th is the date from which time in service is computed from for purposes of the Extended Service~Pay Plan. The City Manager stated that the Commission had given their word that no employee would receive less longevity pay under the new plan than they ~ld under the old plan. Commissioner Farr moved to table consideration of same until meeting of April 27, 1981. Seconded by Commissioner Yancey and carried. Commissioner Farr moved to adppt a resolution to authorize the Mayor to exeCute an agreement to install and maintain a six-inch pipe under the Seaboard Coast Line Railroad on Cornwall Road, for water service at the Harcar plant. M. 19 81 4 Be it resolved by the City Commission of the City of Sanford, Florida in regular meeting assembled that the Mayor-Commissioner be, and he hereby is, authorized .to enter into an agreement with the SEABOARD COAST LINE RAILROAD COMPANY, and' to sign same on behalf of said City whereby said Railroad Company grants unto said City the right or license to install and maintain, for 'the purpose of conducting WATER, a line of 6-inch DUCTILE IRON pipe across the right of way and under the main track of said Railroad Company at Cornwall Road, at Hunt, near Sanford, Florida; as more particularly described in said agreement, which agreement is dated March 17, 1981, a copy of which agreement is filed with this City Commission. On recommendation of the City Manager, Commissioner Farr moved to authorize use of the Civic Center, with alcoholic beverages and after payment of proper fee, as follows: Disco Dance on April 17, 1981. Scholarship Dance on April 10, 1981. Seconded by Commissioner Yancey and carried. The City Manager reported that he had visited a truck repair garage at 1214 Elm Avenue,s'and the operators are planning to .close.~the purchase-of other property on which. to locate their business. The City Manager rePorted that he had visited the business selling cordwood at 2597 Orlando Drive, and they will refrain from cutting and splitting wood. On request of the City Manager, Commissioner Farr moved to authorize transfer from Contingency in amount of $3,910.00 to pUrchase 25 high pressure sodium street light units to replace obsolete units. Seconded by Commissioner Yancey and carried. The City Manager reported that the public official liability insurance coverage is through Vanguard Insurance Company, effective March 16, 1981, with annual premium in amount of $4,949.63. .. The City Manager reported that the City has been notified by the U. S. Bankruptcy Court that a case has been filed by the Longwood Traveler Corporation, 185 West Airport Boulevard. The City Manager reported receipt of memo dated March 24, 1981, from the Florida Secretary of AdministratiOn, stating that the contribution to the Florida Retirement System for General Employees will increase from 9.1% to 10.51%, effective October 1, 1981. The City Manager reported that the bicycle rack ordered for installation in front of the public library had arrived, but that Seminole County had alceady 'installed one there and that the City bike rack was installed at the parking lot at First Street and Park Avenue. The City Manager reported that the U. S. Environmental Protection. Agency personnel had been unable to take samples of chemical waste, stored in Sanford at Jewe'tt Lane and Airport Boulevard, because the Florida Department of Environmental Regulation has nOt enforced the court requirementilfOr City Chemicals Industries, Inc., to keep a manifest. He further stated the Florida Department of Environmental Regulation will take chemical samples April 21, 1981, and that the Department of Environmental Regulation did not know of the problem until today. The City Manager reported that various excess City equipment will be sold at auction on April 25, 1981~at 10:00 A. M. The City Manager reported ~hat the new golf course lease has not b~em executed by the new operators. ~- The City Manager reported he will be in Tallahasseee~April 26 through May 2 and May 17 through 23, 1981, for legislative matters and the Commission authoriZed ~same. The City Manager reported that the City and the Seaboard Coast Line Railroad had exchanged parcels of property in the Lake Monroe Industrial Park on November 27, 1961, but the County records do not reveal railroad ownership, and that the City is proceeding to determine the ownership of the parcels involved. The City Manager reported that the Step I sewer work is halted due to the Florida Department of Environmental Regulation's review for a wasteload allocatiOn, that the City is applying for $250,000.00 in federal funds for sewer line repair work as an extension of MI'NUTES City Commission, Santord, Floricla April 13 at 7:00 P.. M. 19 81 The City Manager reported receipt of a letter from Stephen T.-McMahon, Regional Manager, American Television Communications Corporation, requeSting information on how tc proceed under the cablevision franchise, on installation of a two-way cable system.
