A public hearing was held in accordance with notice published in the Evening Herald on June 2 and 12, 19815 as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on June 22, 1981, 'to consider changes and amendments to the Zoning Ordinance, and amending the Future Land Use Element of the Comprehensive Plan of the City of Sanford, Florida, as follows: A portion of that certain property lying North of and abut- ting West 27th~Street and between Laurel Avenue and Elm Ave- nue is propose4 to be rezoned from SR-1 (Single-Family Residen- tial Dwelling) District to GC-2 (General Commercial) District. Said property being more particularly described as follows: Lot 17, Pinecrest Heights Replat, Plat Book 9, Page 77, Public Records of Seminole County, Florida. Clerk Publish: June 2 and 12, 1981. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. The City Clerk reported that the property owners were notified of the public hearin on May 19, 1981 and the property was posted on May 19, 1981. Those appearing in opposition were as follows: John C. Brown, 2634 Elm Avenue, Sanford, Florida. Frank C. Huhn, 2633 French Avenue, Sanford, Florida. Jack Elam, 2635 South French Avenue, Sanford, Florida. On recommendation of the Planning and Zoning Commissiog, Commissioner Fart moved to deny the rezoning. Seconded by Commissioner Smith and carried. Bill Murphy appeared to support a request to waive the Sanford City Code Section 8-25, requiring underground wiring and street lighting in subdivisions, and ipermit him to MINUTES City Commission, Sanford, Florida Mr. Murphy stated this is an old subdivision with overhead service, and it would cost an tional $300.00 per unit to put in underground utilities. Commissioner Fart moved to' deny the request. Seconded by Commissioner Keith and carried. Linda Nellons appeared to protest the Sanford HoUsing Authority's placement of per- sons in public housing. The Chairman informed Ms. Nellons that the operation of the Sanford HoCsing Authority was under the jurisdiction of the Sanford Housing Authority Board of Com- missioners and she would have to take her problem to them. Request submitted for an Exempt Going Out of Business Sale License from Forrest R. or Dolly Foggin d/b/a Hobby Depot, 1910 South French AvenUe, to begin June 22, 1981. Commis- sioner Yancey moved to authorize same. Seconded by Commissioner Keith and carried. Condemnation Group 63, Reports Nos. 81-988 through 81-997 submitted from the City Manager. Commissioner Fart moved to authorize a public hearing to be held July 13, 1981 .to consider same, and notices to be sent to the owners as extended on the last tax roll. Secon- ded by Commissioner Yancey and carried. Commissioner Yancey moved to remove from table, consideration of appointment of two members to the Sanford Housing Authority Board of Directors. Seconded by Commissioner Farr and carried. Commissioner Fart moved to appoint Mrs. Eliza C. Pringel, 1114 Cypress Avenue, San- ford, Florida. Seconded by Commissioner Yancey and carried. Ms. Hannah Pinkney, 39 William Clark Court, Sanford, appeared and stated the tenam had sent a petition containing the names of two individuals, Samuel Wright and Joseph Cald- well, for appointment to the Sanford Housing Authority Board of Directors. Other persons appearing to support the petition were as follows: Barbara Wyche, 26 Edward Higgins Terrace, Sanford, Florida. Edna Watson, 26 Lake Monroe Terrace, Sanford, Florida. Reverend Eubanks, 98 Redding Gardens, Sanford, Florida. Commissioner Smith moved to appoint Joseph Caldwell to the Sanford Housing Authori~ Board of Directors. Seconded by Commissioner Fart and carried. The City Manager reported that the Florida Highway Patrol is revising its wrecker regulations, and the City expects to receive a copy in mid-July. The Commission authorized to leave same on table, until the revised regulations are received. On motion of Comm~sioner Yancey, seconded by Commissioner S~i~h and carried, Minutes of June 8, 1981 were approved. T. B. Ball appeared to support reconsideration of a request denied at meeting of June 8, 1981, for water service to his property lying south of West First Street and west of and abutting Airport Boulevard, which is outside and not contiguous to the City. Com- missioner Fart moved to reconsider action taken at meeting of June 8, 1981, and authorize the water service as requested, with the stipulation and agreement that when the property becomes contiguous to the City, Mr. Ball will sign an annexation petition. Seconded by Commissioner Smith and carried. The City Manager submitted a memo from the Building Official stating that Ordi- nance No. 1525, adopted on September 22, 1980, requires all sWimming pools to be completely enclosed with a fence or wall at least five feet high.. He further stated that many people already had four foot fences which have to be replaced with a five foot fence upon installa- tion of a pool. The Building Official recommended either grandfather existing fences, or require a minimum four foot fence around pools. The City Manager recommended to grandfather existing four foot fences. Commissioner Farr moved to authorize the City Attorney to pre- pare the proper ordinance to'amend the Sanford City Code Chapter 25, to require only a four foot minimum fence around pools. Seconded by Commissioner Yancey and carried over dissent- ing vote of Commissioner Keith. The City Manager reported ~hat the radio monitor in his office is no longer work- ing and cannot be repaired because it is obsolete. Commissioner Yancey moved to authorize transfer in amount of $300.00 from Contingency to purchase a replacement unit. The City Manager reported.that:Sanford-is 24th on a.list offs, 51 applicants to the State of Florida Department of Natural Resources~for~a Recreation Development Assistance Program for a grant to develop a park on Marshall Avenue, and that currently there are funds available for the first 21 applicants. The City Manager reported that the Planning and Zoning Commission felt shopping' centers should be a permitted use in GC-2 zones, the same as commercial retail and service stores. The Commission authorized the City Manager to report to the Planning and Zoning Commission that shopping centers do not need to be a conditional use in a GC-2 zone. The City Manager submitted a statement in amount of $400.00 from City Attorney William L. Colbert, for services rendered in May, 1981, re: City Chemicals, Downtown De- velopment and Condemnation. Commissioner Keith moved to authorize payment of s ~ame. Secon- ded by Commissioner Fart and carried. On recommendation of the City Manager, Commissioner Yancey moved to authorize the Civic Center to be used for a wedding reception on June 27, 1981, with alcoholic beverages, after payment of the proper fee. Seconded by Commissioner Smith and carried. Mr. Julian Suso, Seminole Employment Economic~Development Corporation, appeared and stated they plan to develop as an Industrial Park, the property presently occupied by City Chemical Industries, Inc., west of Airport Boulevard and south of West First Street, which was annexed into the City in February, 1980. The Mayor reported that Mr. Suso had talked with him, about rezoning the property from Agricultural to Industrial, and wanted to know how the City would feel about the rezoning. The City Attorney stated that prior to holding a public hearing is not an appropriate time to make a committment. The Commission referred same to the Planning and Zoning Commission. The City Manager submitted a request from the Police Department for the City Com- mission to consider a review of City Occupational License No. 1667, issued to William Lip- thrott, owner-operator of American Auto Sales, 2615 South Orlando Drive, Sanford, Florida. The Commission authorized to discuss same at a Special Meeting to be held at 4:00 P. M. on June 23, 1981 in the City Manager's Conference Room. Seconded by Commissioner Smith and carried. The City Manager submitted a memo dated June 19, 1981, from the Zoning Inspector, as follows: The following.members will be rotating'off the P &_Z CommisSion on June 30, Cliff Miller P.O. Box 608 George M. Willis, Jr. 218 W. 20th St. John Morris 201 Dogwood Drive (unexpired term of Bart Gallagher) These members have all agreed to serve another term if reappointed. Commissioner Smith moved to re-appoint the members. Seconded by Commissioner Yancey and carried. The City Manager reported that the Seaboard Coast. Line Railroad has stated a fair market price for the railroad's'abandoned right-of-way from Magnolia Avenue to the City LJmaits is approximately $125,000.00. The Commission stated it has no interest in the prop- erty at that price, andauthorized the City Manager report to the state taxing authorities the valuation stated by the railroad officials. The City Manager submitted a request from Conklin, Porter and Holmes, Engineers, Inc., to subcontract to them the 201 planning, Sewer System Evaluation Survey and Repair work, as successors to Clark Dietz and Associates, Engineers. Commissioner Fart moved to authorize same. Seconded by Commissioner Yancey and carried. The City Manager reported that on November 6, 1980 the Planning and Zoning Commis- sion had approved the plats for Hidden Lake Phase II, Units II, III, IV and V, and that a performance deposit in amount of $4,907.03 had been received to be held until the park area can be dedicated in one contiguous area. Commissioner Fart moved!jto authorize the Mayor and City Clerk to execute the plats. Seconded by Commissioner Smith and carried. The City Manager submitted plats for Groveview Village First Addition, Second Addition, and Third Addition, and stated that the Engineering Division has certified they have made the required changes to the plats. He further reported that the plats show dedi- cated open space but that the City.~should require a deed for same. Commissioner Farr moved to authorize the Mayor and City Clerk to execute same, upon receipt of a deed to the open space property. Seconded by Commissioner Smith and carried. The City Manager submitted a request for a street light at the corner of Court Street and palmway, and recommended installation of a street light on the south side of Court Street, between Palmway~and Rose.
