The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 12, 1981.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notices authorized at meeting of
September 28, 1981, to consider condemnation of 13 structures or buildings on Condemnation
Group 66, Reports Numbers 81-1002 through 81-1014. The Chairman announced that the Commis-
sion would hear from property owners or representatives thereof. A review of each individu-
al report was as follows:

The City Manager. submitted a memo dated October 12, 1981, from the Building Official,
as follows:

He wanted to pull the building permit to repair the dwellings, but I explained
to him the reason he could not is that he is not the "owner-occupier" and he
would need to get a contractor to pull the permit.
He said he has had trouble finding a contractor who wanted to even bother with
repair work and explained to me that he owns approximately twenty-four (24)
houses in the city limits and there is repair work needed all the time. He
appealed to me to let him pull his own permits but I told him my hands are tied
and I advised him that I would see if he could go to the City Con~Lission and
ask t~e~ if he could pull building permits only, for his own houses.
After talking to the man and knowing a little about him, I think he is capable
of doing the work. He also assures me he is not just buying houses, fixing them
up and selling them.
I remember they did this for Garfield Walker. Please advise me on this.

Commissioner Fart moved to waive the restriction for the owner/occupant to receive
· the building permit, and to authorize Sanford Gould to purchase permits to repair two struc-
tures covered by Condemnation Reports Numbers 81-1004 and 81-1005. Seconded by Commissioner
Smith and carried.
Ronald McNeil, owner of property at 1219 West Eighth Street, Condemnation Report
No. 81-1011, appeared and stated he is trying to evict the tenant, and plans to repair the
house as soon as it is vacated.
Ruby Isaac, owner 'of property at 1009 Mangoustine, Condemnation Report No. 81-1009,
appeared and stated she didn't know it was in this condition, and will fix it within 90 days.
After consideration, Commissioner Farr moved that finding the buildings under
Condemnation Reports Numbers 81-1002 through 81-1014 to be unsanitary, unsafe and delapi-
dated, that said structures be condemned and the owners given 90 days in which to repair
or demolish said structures; and if the structures are not repaired or demolished within
90 days, to authorize the City to demolish same and levy a lien against the property. Secon-
ded by Commissioner Yancey and carried.

Susan Stewart, Vice President, Robert L. Ward Company, appea~ed to support the
rezoning, and stated they plan to develope a shopping center on the property.
On recommendation of the Planning and Zoning Commission, Commissioner Smith moved
to authorize the City Attorney ~o prepare the proper ordinance to' rezone the property. Secon-

The City Clerk reported that notice was mailed to the owners, Mr. and Mrs. Fredrick
DeRoose, on September 11, 1981 and the property posted on September 15, 1981.
Those appearing in opposition were as follows:
Aaron Thompson, 2815 Grove Drive, appeared and submitted a petition which he said
contained the signatures of 27 persons opposed to said rezoning.

Garold Page, Sr., 2835 Grove Drive.
Barbara Malls, 2838 Grove Drive, appeared and submitted a petition which she said
contained the signatures of residents objecting to the proposed rezoning.
Anthony Panzino, 607 East Mattie Street.
Those appearing in favor of the proposed rezoning were as follows:
Fred DeRoose, 710 Osceola, owner of the property being considered for rezoning,
appeared and stated he wanted the property rezoned so he could market it.
On recommendation of the Planning and Zoning Commission, Commissioner Farr moved
to deny the re~oning. Seconded by Commissioner Yancey and carried.

Commissioner Smith moved to authorize same. Seconded by Commissioner Yancey and carried.
Recommendations dated October 2, 1981 submitted from the Planning and Zoning Com-
mis sion as follows:
1. Recommended denial to rezone from SR-1 to MI-2, the property
located south of Depot St., east of Woodmere Park, 2nd.replat and
west of the SCL railroad. The planned use of the property is for
industrial use. (Rep.-Fre.derick L. DeRoosa)
Reason: Does not comply with the Comprehensive Plan for the
City of Sanford and no one was present to speak in favor..~
There were five property oWners present to speak in opposition.
2. Recommend approval of a conditional use for the sale of beer
and wine for consumption off the premises in the RC-1 zomed dis-
trict at 710 Lake Mary Boulevard. Approved a site plan of a con-
venience food store with self-service gas pumps for Little Food
Town Stores, Inc. in the RC-1 zoned district located at the
above mentioned address with the stipulation that driveway and
drainage permits are obtained from Seminole COunty and the septic
tank is approved by the Health Department. Rep.-Kenneth Calder.
Commissioner Farr moved to authorize package sale of beer and wine at the proposed Little
Food Town Store, 710 Lake Mary Boulevard. Seconded by Commissioner Smith and carried.
Commissioner Farr moved to appoint Commissioner Yancey as the Mayor's representa-

Resolution No. 1313 was read in full. The Chairman announced that the Commission
would hear from those persons present to speak in favor of, or in opposition to, the pro-
posed resolution ....
Bo Speir, 2400 DeCottes Avenue, appeared to voice concern about the position in
which the state legislature has put the City, and asked the City to try to ~find alternatives
in the future to stay at a stable millage rate.
On motion of Commissioner Yancey, seconded by Commissioner Smith and carried, Reso-
lution No. 1313 was adopted. Said resolution being in words and figures as follows:

CONFIRMING THE ADOPTION OF THE MILLAGE RATE
FOR TAXES OF REAL PROPERTY AT THE RATE OF
5.952 MILLS.
WHEREAS, the City Commission of the City of Sanford,
Florida, adopted Resolution No. 1309· on.September 28, 1981,
which said Resolution adopted a tentative budget of revenues
and expenditures for the City of Sanford, Florida, for the
fiscal year beginning October 1, 1981, and ending September
30, 1982; and
WHEREAS, Resolution No. 1309, adopted September 28,
1981, further adopted a millage rate of 5.875 mills for the
taxes of real property for the fiscal year beginning October
1, 1981, and ending September 30, 1982, in accordance with
House Bill 4-D, adopted by the 1980 session'of the Florida
Legislature; and
WHEREAS, it has been determined that it will be
necessary to adjust the millage rate previously adopted in order
to raise the necessary revenue for the budgeted expenditures for
the City of Sanford, Florida for the fiscal year beginning
October 1, 1981 and ending September 30, 1982,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COb~ISSION
OF THE CITY OF SANFORD, FLORIDA, that the millage rate of 5.875
previously adopted in Resolution No. 1310, dated Seotember 28~,
1981, be and th~ same is hereby adjusted and amended to a rate
of 5.952

introduced and placed on first reading at meeting of September 28, 1981, was next placed on
final reading. After being read by title, the Chairman announced that the Commission would
hear from those persons present to speak in favor of, or in opposition to, the adoption
of the ordinance. No one appeared.
Commissioner Yancey moved on the passage and adoption of Ordinance No. 1580.
Seconded by Commissioner Smith and carried.
Thereupon, the Chai~man announced that the City-Commission of the City of Sanford,
Florida, had passed and adopted said Ordinance No. 1580, entitled:

Commissioner Farr moved to authorize the Mayor and City Clerk to execute renewals
of agreements for use of city property by the Men's Softball Association and the Sanford
Youth Baseball Association. Seconded by Commissioner Yancey and carried.
The City Manager submitted a report of Mayfair Country Club gross income from
March 11, 1981 to June 30, 1981, in amount of $175,258.32.
The City Attorney submitted a statement for services for September, 1981, in amount
of $625.00. Commissioner Yancey moved to authorize payment of same. Seconded by Commis-
sioner Farr and carried.
Thomas Wilson III, appeared and stated his aunt, Eunice I. Wilson' had received
a lot mowing complaint on property that does not belong to her in Lot 5, Robinson's Survey.
The City Manager was authorized to direct staff to correct the notice. ~
Commissioner Fart moved to authorize the City Attorney to initiate foreclosure
proceedings on municipal liens as follows:

The City Manager reported that the new LTI fire truck requires large suction hose
and four-inch fire line hose for peak performance. Commissioner Yancey moved to authorize
to advertise for bids for same, and to authorize sale of the 1954 aerial ladder truck and
from which to increase the budget to provide for purchase of said hose and material. Secon-
ded by Commissioner Smith and carried.

As the rate changes in New York, the interest expense for the
City would change; ie today's prime is 19%, therefore, the City rate
would be 12.35% and remain so until changed in New York. This may mean
a new rate every few days, or weeks.
One estimate for next year's prime rate is as follows:

3/31/82 - 15.50%
6/30/82 - 15.507o
9/30/82 - 17.50%
Mr. Hodges stated they could submit a flat annual rate, but felt the
trend in financing was toward a variable rate.
65% of an average variable rate of 14.23% equals 9.2570.
Due to Budgeting requirements, and to prospects of continued high
interest rates, I recommend the bid of Flagship Bank in amount of 9.25%.
On recommendation of the City Manager, Commissioner Yancey moved to accept bid from Flagship
Bank of Seminole at annual rate of 9.25%. Seconded by Commissioner Smith and carried.
Commissioner Farr moved to authorize the Mayor to execute loan agreements with
the Flagship Bank of Seminole, for a loan in the amount of $247,000.00 for a period of five
years, with annual installments of $49,400.00, plus interest, to finance the purchase of an
85 foot WaterTower Aerial platform fire truck. Seconded by Commissioner Smith and carried.

Commissioner Yancey moved to table to October 26, 1981, consideration of merit
raises for department heads. Seconded by Commissioner Smith and carried.
The City Manager reported that Tom Rucker, holder of an option to purchase property
in the Lake Monroe Industrial Park, plans to close and start construction with his own group.
The Commission authorized the City Manager to present to the legislative delega-
tion at hearings on November 4 and 17, 1981, budgetary and taxation problems caused by state
mandated programs and exemptions.
On recommendation of the City Manager, Commissioner Fart moved to authorize salary
reclassifications as follows:
Frank Williams, Parks, from Maintenance Worker II E to F, $11,870.25 annual.
Albert Williams, Utility, Water Distribution, from Maintenance Worker I E to
F, $11,226.60 annual.
Warren Turman, Recreation, from Custodial Lead Worker D to E, $12,149.55 annual.
Seconded by Commissioner Smith and carried.
Request submitted for a street light at 22nd Street and Chase Avenue. On recom-
mendation of the City Manager, Commissioner Farr moved to authorize installation of two
street lights on Chase Avenue, between 20th Street and 22nd Street. Seconded by Commissioner
Yancey and carried.

nance No. 1581, entitled:

CODE KNOWN AS SWIMMING POOL CODE TO PROVIDE
FOR AN ENCLOSURE AT LEAST 4 FEET HIGH AROUND
SWIMMING POOLS; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.

The City Manager reported that due to a surveyor's error, the house located at
119 Wildewood Drive in the Ramblewood Subdivision was constructed 24 feet into a 20 foet
utility easement, and recommended vacating that portion under the house. Commissioner Farr
moved to authorize a public hearing to be held November 9, 1981, to consider vacating that
portion of the easement. Seconded by Commissioner Yancey and carried.
The City Manager reported that the State of Florida Department of Transportation
has requested the City to replace the emergency flashing light on 17-92 in front of the
No. 2 fire station, with a four-pedestal pedestrian signal, and that there is no pedestrian
