The City Commission of the City of Sanford, Florida, met in Regular Session in the

A public hearing was held in accordance with notice published in the Evening Herald
on November 24, and December 4, 1981, as~ follows:

THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND
USE ELEMENT OF THE COMPREHENglVE PlAN OF THE CITY
OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held at the
Commission Room in the City Hall in the City of'.'Sanford, Florida, at
7:00 o'clock P. M. on December 14, 1981, to consider changes and amend-
ments to the Zoning Ordinance, and amending the Future Land Use Ele-
ment of the Comprehensive Plan of the City of Sanford, Florida, as
follows:
A portion of that certain property lying between 24th Street
and 25th Street and betweenZGeorgia Avenue and Hartwell Ave-
nue is proposed to be rezoned from SR-1 (Single-Family Resi-
dential Dwelling) District to MR-2 (Multiple-Family Residen-
tial Dwelling) District. Said property being more particular-
ly described as follows:
Lots 5 through 16, Block 1 and Lots 1 through 20,
Block 2, Dreamwold 3rd Sec., PB 4, page 70, Public
Records of Seminole County, Florida.
Ail parties in interest and citizens shall have an opportunity
to be heard at said hearing.

Mr. Stephen Bondorowsky appeared to speak in favor of the rezoning and stated he
plans to build duplexes on the property.
Mr. Ronald Gilbert, 2408 Marshall Avenue, appeared to speak against the rezoning.

On recommendation of the Planning and Zoning Commission, Commissioner Farr moved
to authorize the City Attorney to prepare the proper ordinance to rezone the property.

Requests to reconsider applications for sale of beer and wine for consumption on
the premises at the BBQ Rib Ranch, 2545 South French Avenue, and for sale of alcoholic bever-
ages for consumption on the premises at 2700 Sanford Avenue. were next considered. Commis-
sioner Smith moved to approve same. Seconded by Commissioner Yancey and carried over dis-
senting vote of Commissioner Keith.
Commissioner Yancey moved to approve a 60 day moratorium to consider any other
requests for sale of alcoholic beverages for consumption on the premises, pending amendments
to the applicable regulations and adoption of the ordinance. Seconded by Commissioner
Smith and carried.

raw sewage in the back yard.
Mr. King stated that the Health Department had come to his house and found his
facilities in satisfactory condition.

The City Manager submitted a proposed lot clearing policy.
He stated that higher
costs would be an incentive for owners to do the work or hire private firms for the work.

The City Manager submitted a letter from the State of Florida Department of Trans-
portation, re: Railroad crossing signals. Commissioner Smith stated that he did not see
where the City would benefit and moved to table same. Seconded by Commissioner Yancey and
carried.
Commissioner Smith moved to appoint Commissioner Fart to the Citizen Advisory
Committee for Lake Mary Boulevard Corridor Study. Seconded by Commissioner Yancey and car-
tied.

Commissioner Yancey~:moved to ~pprove the negotiated bid from single souffce supplier
of $1,314.85 for tennis court coating and paint to match existing in use for two courts at
Chase Park. Seconded by Commissioner Smith and carried.
The Commission reviewed the lighting service agreement between Mr. Wes Rinker and
Musco Sport Lighting, Inc. and authorized the City Manager to inform Mr. Rinker that the
lights to be installed will remain property of the City of Sanford in accordance with his
lease of the facility.
The City Manager submitted an estimate of costs for material of $653.20 and total
cost of $1,195.03 for the City to install alst~or~id~ina~ge systemat 24th Place and French
Avenue. Commissioner Smith moved to authorize ·same~with·the·City to provide the labor and
equipment and the abutting property owners to pay for materials. Seconded by Commissioner
Fart and carried.
The City Manager reported the 1981 Legislative Session ~provided a one-time grant
to police departments for law enforcement, and Sanford has received $23,794.69. The police
department requested to upgrade their radio system at a cost of $27,389.00. The City Manager
recommended approval with $6,594.31 deficit to be made up from funds generated by confis-
cated materials and the budget for same. Commissioner Farr moved to approve same. Seconded
by Commissioner Smith and carried.
The City Manager reported that Mayor'Owen Shephard had informed him that Cassel-
berry will be initiating the first action on the Double Taxation study. The cost Of $24,500.(0
for the six municipalities interested in participating. Oviedo will not participate. Mayor
Shephard reported the three smaller communities will each pay the minimum of $2,000.00, and
the remaining three larger cities will split the difference which would be $6,166.00 each,
for Casselberry, Altamonte and Sanford. Commissioner Smith moved to authorize a transfer
from contingency to provide for same. Seconded by Commissioner Yancey and carried.
Commissioner Fart moved to authorize Acting Mayor Keith, and the City Clerk to exe-
cute a loan from the Flagship Bank of Seminole in the amount of $185,000.00 to finance three
(3) Refuse Packers over a period of five (5) years, with annual payments of $37,000.00, plus
interest at the rate of 9.25 per cent. Seconded by Commissioner Smith and carried.

~EREAS, the property tax is an inadequate source of revenue for local govern-
ments facing exploding demands for public services in such essential areas as law
enforc~m=_nt, transportation and waste treaL~ent and disposal; and
WHEREAS,. in view of %he exemptions for purchases of essential items such as
food and medicine, %he sales tax is more equitable than the property tax and is
paid by all ttxpse who benefit fr~n public services in Florida including tourists,
who pay as much as 30% of %he sales tax; and
?~3LF~AS, the sales tax is an appropriate means for relieving the property tax
burden of Floridians and for providing local governments with a growing source of
revenue; and
I.~REAS, the Florida League of Cities has esemblished a Strike Force for Property
Tax Relief for the purpose of securing property tax relief and state assistance to
local govem~c~nts through a 1¢ statewide increase in the sales tax.

The City Attorney stated that he would have a proposed ordinance by the meeting of
December 28, 1981, regarding alcoholic beverages, and would research the number of alcoholic
beverage licenses that can be issued within a City.
Commissioner Fart moved to~!.authorize the Mayor, City Attorney and City Clerk to
enter, for the annual audit, the Safe Deposit Box No. 177 at the Atlantic Bank of Seminole.

The City Manager meported estimated cost of $1,126.25 to send notices for spring

Mr. George Willis, Callbart Real Estate, submitted a request for water outside
the City at the southeast corner of Lemon Street and Sanford Avenue. The Commission moved
to deny same until proper annexation into the City.
Commissioner Smith moved to authorize the City Attorney to prepare a letter to Mr.
Tom Rucker setting a time limit of 60 days for the City to re~cquire property if construction
did not commence within 180 days, and to authorize the Mayor and City Clerk to execute same.
Seconded by Commissioner Yancey and carried.
