M.___19. 82 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00'o'clock P. M. on January 11, 1982. Present: Mayor-Commissioner Lee P. Moore Commissioner Milton E. Smith Commissioner Edward A. "Ned" Yancey Commissioner David T. Fart Commissioner Eddie O. Keith City Attorney William L. Colbert City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. A public hearing was held in accordance with notice published in the Evening Herald on December 22, 1981 and January 1, 1982, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in .the City of Sanford, Florida, at 7:00 o'clock P. M. on January 11, 1982, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as fol- lows: A portion of that certain property lying between East First Street and East Second Street and between Cypress Avenue and Pine Avenue is proposed to be rezoned from RMOI (Multiple- Family Residential, Office and Institutional) District to GC-2 (General Commercial) District. Said property being more particularly described as follows:' ,: Ail that. part of the west 100 feet of Block 14, lying south of First Street and the north one-half of vacated East Street. abutting on the south, Chap- man & Tucker Addition to Sanford, Plat Book 1, page 24, Public Records of Seminole County, Florida. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. David Suellau appeared to support the request. The City clerk reported that notices of public hearing were sent to the owners, Mr. and Mrs. David J. Suellau and Mr. Charles F. Cantrell on December 3, 1981, and the prop- erty was posted on December 17, 1981. On recommendation of the Planning and Zoning Commission, Commissioner Farr moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. Seconded by Commissioner Keith and carried. Tenzer, owner. The City Manager submitted a recommendation to decline to annex only one lot, and to require the applicants to obtain the signatures of the owners of the property in the block. Commissioner Yancey moved to authorize the City Attorney to prepare the proper ordinance to annex the property described in Item (a), and to authorize the City Manager to inform the owners of said property, of the Commission's reqUirement to obtain the signatures of the other owners of the property in the block, prior to annexation. Seconded by Commis- sioner Smith and carried. Phil Logan, Attorney, appeared to support the request for annexation of property described in Item (b). Commissioner Keith moved to authorize the City Attorney to prepare the proper ordinance to annex said property. Seconded by Commissioner Farr and carried. Request submitted from Joetha Jones, owner of property at 1201½ West 12th Street, Condemnation Group 66, Report No. 81-1007, for a 90 day time extension to repair same. On recommendation of the Minimum Housing Code Inspector and the Acting City Manager, Commissione~ Keith moved to authorize a 90 day time extension. Seconded by Commissioner Smith and carried over dissenting vote of Commissioner Keith. Commissioner Smith moved to remove from table, consideration of an appointment to the Board of Adjustment and Appeals. Seconded by Commissioner Yancey and carried. Commissioner Fart moved to appoint Jesse F. "Rick" Graham, 122 West 19th Street, Sanford, to said board. Seconded by Commissioner Smith and carried. Commissioner Smith moved to remove from table, consideration of drainage at 24th Place and French Avenue. Seconded by Commissioner Yancey and carried. The City Manager reported that there was no drainage problem in that area until the owner constructed the second building on his property, and filled in the natural dra.inage. After discussion, ~ the Commission authorized to affirm the City's offer to install a storm drain, if the owner of the property to the north will pay the .cost of the materials. The Mayor reported he will be unable to attend the East Central Florida Regional Planning Council Metropolitan Planning Organization meeting on January 14, 1982 at 3:30'P. M. in the Orange County Court House. The Commission appointed Commissioner Fart to be the Mayor' s representative at said meeting. · On motion of Commissioner Smith, Seconded by Commissioner Yancey'and carried, Ordi- nance No. 1589, entitled; AN ORDINANCE OF THE CITY OF SANFORD, i FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT CHANGING THE ZONING OF A PORTION OF..THAT CER- TAIN PROPERTY LYING BETWEEN 24TH STREET AND 25TH STREET AND BETWEEN GEORGIA AVENUE AND HARTWELL AVENUE FROM SR-1 (SINGLE-FAMILY RESIDENTIAL DWELLING) DISTRICT TO MR-2 (MULTIPLE-FAMILY RESIDENTIAL DWELLING) DISTRICT; PROVIDING FOR SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE. was introduced and placed on first reading and read in full. The City Attorney reported that any existing business not in compliance with the new ordinance would be "grand- fathered" in, and permitted to continue in operation unless they go out of business, which would be defined as letting their state license lapse in SePtember of a given year, and not renewing same by December 31 of that. same year. The City Attorney reported that the ordinance limited the Class. 3 vendors for con- sumpt'ion on the .premises ~of b~verages regardless ~o.f..alcoholic.. cont~ents, ~n'ot_ to: be located within 1,000 feet of another Class 3 vendor, nor within 2,000 feet of a school or church. Request submitted from Seminole County, for temporary use of the downstairs office space in City Hall, for library facilities during the renovation work at the downtown public library, for approximately four to six months. Mr. Tom Otero, Architect, appeared and submitted plans for the proposed renovation of the public library building at First Street and Palmetto Avenue. The City Manager reporte that everything they are planning to do to the building is an improvement. Commissioner Keiti~ moved to approve the proposed renovations as submitted. Commissioner Yancey moved to authorize a temporary lease of the downstairs office space in City Hall, to Seminole County, for use as a library facility, with payment at the annual rate of $1.51 per square foot for utilities. M. ___19 82 The City Manager reported that City Staff is working with Wes Rinker and Musco Sports Lighting on clarification in the agreement to install new stadium lights in accord- ance with the stadium lease. After discussion, Commissioner Keith moved to table same. Seconded by Commissioner Smith and carried. The City Manager reported he had received a request from Frank Mebane, Mutual Con- cert Association, to be on the Agenda to request a reduction of rent for use of the Civic Center. After discussion of the Civic Center Fees, Commissioner Smith moved to table same until January 25, 1982. Seconded by Commissioner Yancey and carried. The City Manager reported that the State of Florida Department of Transportation proposeS: to upgrade the traffic signals at 17-92 and FlOrida Avenue (27th Street). Com- missioner Smith moved to authorize the Mayor and City Clerk to execute the standard resolu- tion no. 1318 for the utility indemnification agreement and forms for relocation of city utilities. Seconded by Commissioner Yancey and carried. Letter submitted from the Fla§Ship Bank of Seminole, citing problems encountered with the State of Florida Department of Health and RehabilitatiVe Services, which leases the first floor of The Welaka Building, 105 North Oak Avenue, directly across the street from the doWntown office of the bank. Some of the complaints are as follows: 1) long lines of pedestrians blocking the sidewalk area on Oak Avenue and First Street 2) traffic congestion on Oak Avenue 3) Health and Rehabilitative Services clients parking on the bank property 4) people climbing on a bench to get into a tree 5) the breaking and removal without permission of a "Do Not Walk On The Grass'" sign 6) persons urinating in the shrubbery in front of the bank 7) litter left by the human congestion blowing over on the bank premises The City Manager reported he had discussed the matter with Ms. Margaret Anderson, of the Sanford Office of the Florida Health and Rehabilitative Services, and that she said they had discontinued the services of their security officer, and asked for city police to handle it, but did not want to pay for the special service officer. The Commission authorized the City Manager to contact the Tallahassee office of Health and Rehabilitative Services to endeavor to work out a solution. M. 19 82 The CitY Attorney reported that the Notice of Dismissal with Prejudice had been filed with the court, in the suit Gustafson vs. City of Sanford, and that the suit is finished Commissioner Yancey moved to appoint Commissioner Smith as the City's Representa- tive on the Chamber of Commerce Board of Directors for 1982.
