The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. Gerald Braley, 1943 Green Meadow Lane, Orlando, representing Dreyfus Interstate Development Corporation, appeared and reported they feel a mobile home park is the best use of the land, and plan to develop 451 mobile home spaces, with recreation and laundry facili- ties, vehicle storage and a tot playground. Bob Gregory appeared and reported he is in the mobile home business, and feels the proposed mobile home park would be a good use for the property. David Lance, representing Mobile Home Brokers in Orlando, 2565 Colonial Drive, Or- lando, appeared to support the proposed rezoning. Those appearing in opposition were as follows: Albert Starke, President, Carriage Cove Owners and Tenants Association, appeared and voiced concern about traffic problems, especially if the easterly extension of Lake Mary Boulevard is not opened. Ernest Stewart, 302 Pathway Court, Carriage Cove, Chairman, Carriage Cove Owners and Tenants Association, appeared to oppose the proposed rezoning. He reported the lack City Commission, Sanford, Florida March 8~_at 7~0~ P M_._ 1982 Mel Mendich, Scarsdale, New York, General Partner, Mod Properties, appeared and reported they own 65 to 70 acres contiguous to the property being considered for rezoning, and feel the proposed development of the property as a mobile home park would adversely affect their plans for future development of their property. On recommendation of the Planning and Zoning Commission, Commissioner Keith moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. Secon- ded by Commissioner Farr and carried. Barbara Hughes, Seminole County Extension Agent-Ho~e Economics, appeared to request a waiver to use a mobile trailer sign for two weeks in each month, for the next 12 months to advertise free educational programs for the public at the Agricultural Extension Center, with the sign to be at the entrance to the County Agricultural Center, off 17-92, on county property. The City Manager reported that the City Code does not permit use of a mobile trail er sign as requested. Commissioner Yancey moved to table consideration of the request until meeting of March 22, 1982, and authorize the City Manager to discuss same with Ms. Hughes, to try to work out a solutiOn. Seconded by Commissioner Smith and carried. William Hutchison, Attorney, 230 North Park Avenue, representing The Law Company, appeared and asked the City to adopt a resolution approving the concept of a iow income hous- ing project to be located north of Seminole High School, said project to be financed by the issuance of a three million dollar tax-exempt bond issue through the City with The Law Com- pany acting as a public housing agency instrumentality of the City for the purpose of financ- ing this project. Dudley Morris, Wichita, Kansas, appeared and reported this federally subsidized housing project would have elderly, handicapped and family unit,s, and be managed by a full time manager and a maintenance person would be on site. Commissioner Fart moved and Commissioner Smith seconded the adoption of the fol- lowing Resolution: RESOLUTION NO. 1324 RESOLUTION EXPRESSING THE INTENT OF TIlE C1TY OF SANFORD, FLORIDA TO PROVIDE A METHOD OF BOND FINANCING OF A CERTAIN IIOUSING PROJECT AND EXPRESSING THEIR INTENT TO CONSENT TO CERTAIN DETERMINATIONS TO BE h~DE BY THE UNITED STATES DEPARTMENT OF UOUSING AND URBAN DEVELOPMENT. WUEREAS, the City of Sanford, Florida (the "City") has determined that there exists a shortage of safe and sanitary housing for persons of low income and elderly, handicapped and disabled persons of low income in the City of Sanford; and WIlEREAS, such shortage will be partially alleviated by the development by a private owner of a low-income housing project known as Georgia Arms (which shall be subject to ad valorem real estate tax) to consist of approximately..90 units (the "Project"); and WHEREAS, in order to finance the development of the housing project, the City has been informed that a non-profit corporation to be known as the Sanford- Georgia Arms IIousing Development Corporation, Inc, (the "Corporation") will issue its obligations in the approximate amount of $3,000,000; and MINUTES City Commission, Sanford, Florida. WHEREAS, this City Co~ission has been informed that it is necessary that the Department of Housing and Urban Development ("HUD") determine that the Corporation, when created, will constitute an "instrumentality" of the City and will constitute ~ "public housing agency" solely for the purposes of Section 316) of the United States Housing Act of 1937, as amended, and HUD Regulations 24 C.F.R., Part al1, Subpart A, for the purpose of financing the aforementioned housing project through the issuance of its obligations; and WHEREAS, the City, based upon its present knowledge of the arraqgements, intends to approve the Articles of Incorporation and Bylaws of the Corporation, to approve the financing of the Project and to accept ~ne aforesaid determination of HUD; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, a lawful quorum of which is duly assembled, as follows: SECTION 1. The members of the City Co~ission for and on behalf of the City hereby express their intention to approve at a later date, by appropriate Resolution, the Articles of Incorporation and By-laws of a non-profit corporation to be known as the Sanford-Georgia Arms Housing Development Corporation, Inc., which Corporation will finance the development of the Project, which financing this City Commission also intends to approve. SECTION 2. The members of this City Commission for and on behalf of the City hereby express their intention to approve and consent, by appropriate Resolution or Ordinance, to the determination to be made by HUD that the Corporation will, when created,-constitute an "instrumentality" and a "public housing agency" within the meaning of applicable law, as hereinabove set forth. The City of Sanford shall not be liable for any repayment of the obligations. SECTION 2. The subsequent actions described by Sections 1 and 2 are subject To execution of instruments in form and substance acceptable to the Commissioners which will assure that the Project will not become exempt from ad valorem real estate taxes for a period continuing until retirement of the obligations of the Corporation issued to permanently finance the Project or thirty (30) years, whichever shall be longer. The Sanford City Conmission may consent to this property being tax exempt at any future date. SECTION 4. All Resolutions and orders or parts thereof in conflict herewith are, to the extent of such conflict, hereby repealed, and this Resolut$on shall take effect from and after its passage, the public welfare requiring it. SECTION 5. That it is found and determined that all formal actions of this City Commission concerning and relating to the adoption of this Resolution were taken in an open meeting of the members of this City Commission and that all deliberations of the members of this City Commission and of its committees, if any, w~ich resulted in such' formal action were taken in meetings open to the public, in full compliance with all legal requirements. The roll being called on the question of adoption of the Resolution, the vote thereon resulted as follows: AYES: all 5 members; unanimous ~AYS: none ABSIENTIONS: none The presiding officer thereupon declared said Resolution adopted and approved in open meeting. Commissioner Fart moved to approve same for period not to exceed six months,~at which time the silos will be made a part of the plant. Seconded by Commissioner Smith and carried. Recommendation dated March 5, 1982 submitted from the Planning and Zoning Commis- sion as follows: RECOMMENDAT IONS 1. Recommend approval to rezone from AD (Agricultural District) to MI-2 (Medium Industrial District) the property generally described as located east of Mellonville Ave. extended; south of Silver Lake Drive and north of Pineway. The planned use of the property is for an Industrial Park. ReP.-Tom McDonald. Approved a final plat for a group housing project, "The Country Place", for twelve (12) single-family dwellings, located at 119 Upsala Rd. in the SR-1A zoned district represented by Ken- neth Steeves for Gallamore Homes. ADAMSON TELEPHONE President 203 EAST THI RD STREET (305) 322-FOOD SANFORD, FLORIDA 32771 February 26, 1982 Honorable Lee Moore Mayor of Sanford Sanford, FL 32771 Dear Mayor Moore: The writer is a resident of 900 Silver Lake Drive, Sanford, Florida, and while this property is in Seminole Country and not Tn the city, I own and control seven pieces of real estate in the city of Sanford. Therefore, ! respectfully ask that the City Commission consider the contents of this letter very carefully. In the coming weeks the City Zoning Board will be approached for a change of zoning for eighty acres immediately across the street from 900 Silver Lake Drive. The Silver Lake area is made up of distinctive residential properties. This pro- posed zoning change will be from agricultural to industrial. The owners of the eighty acres have received the endorsement of the Greater Sanford Chamber of Commerce with a proviso that extra care should be made as to maintaining the aesthetics of the surrounding residential community. Mrs. Adamson and I have worked diligently and with loving care with respect to the upkeep of our property on Silver Lake Drive. An industrial park immediately across the street from same would have a tremendous adverse affect on our property's value. Therefore, I would ask the City Commissioners and the City Zoning Board to consider any development after a change of zoning, if same comes to pass, to ask the developer to include a maintenance and upkeep plan in their overall plans (s~ch as an industrial park) offering policing of the vari'ous businesses in the park as to the upkeep of their properties. I have been advised that the city has site plan approval, and this will take care of the problem. Certainly, site plan approval does not allow for any continuing inspection of the properties. Such an industrial park concept could allow for an entrance to be at the Mellonville Road/Silver Lake Drive area near the new Rush Hampton plant with no access from Silver Lake Drive and in fact MINUTES City Commission, Sanford, Florida. The City Manager submitted a memo dated March 3, 1982, from the City Engineer/ Utility Director, as follows: MEMORANDUM MARCH 3, 1982 TO: CITY MANAGER FROM: CITY ENGINEER/UTILITY DIRECTOR SUBJECT: WATER CONSERVATION SUMMARY- "Typical Customers" could reduce their water, sewer, and electric bills in a range from $3.64 per month to $15.13 per month. The City of Sanford could "save" in water and ~sewer expan- sion cost from $112,950 to $555,000. The City of Sanford could theoretically collect from $103,400 to $435,600 in water, sewer, and drainage connection and control charges without adding additional plant capacities. If 90% of the residential customers took full advantage of the water saving fixtures, there would be an estimated re- duction of water demand by 380,000 gallons (6.85% of average). In capital costs this equals to $456,000 at the wastewater plant (based on advanced waste treatment, AWT) and $19,000 at the water plant. Even if only 40% of the City's customers use these saving devices the capital costs equals to $108,000 and $4950 reSpectiVely. This' means' the total capital savings could be from $112,950 to $555,000. In reality these figures are somewhat only theoretical because water supply and treatment facilities are deSigned and constructed using additional criteria, whereby you never put in ½ a well, etc.. There is a real cost benefit, however,~when one considers that with a certain capacity you could service~more customers if each used less. These figures are interesting. Based on a reduction in demand of from 90,000 gallons per day to 380,000 gallons per day, this equates to 188-792 equivalent housing units; each paying $550 in water, sewer, and drainage connec- tion and control charges. In money that is $103,400 to $435,600. Commissioner Yancey moved to authorize the City Attorney to prepare the proper ordinance to require water conservation measures in new construction, effective immediately. Seconded by Commissioner Smith and carried. The Mayor reported he will be unable to attend the East Central Florida Regional Planning Council Metropolitan Planning Organization meeting on March 25, 1982 in the Orange County Commission Chambers. On motion of Commissioner Farr, seconded by Commissioner Smith and carried, Ordi- nance No. 1595, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, RESCINDING ORDINANCE NO. 1578, SAID ORDINANCE ADOPTING A SALARY CLASSIFICATION PLAN EFFECTIVE APRIL 1, 1982; PROVIDING FOR SEVERABILITY; CON- FLICTS, AND EFFECTIVE DATE. was introdUCed andl-placed on first reading. On recommendation of the City Manager, Commissioner Keith moved to authorize pay- ment in amount of $1,233.33 to Kelton and Associates, Inc., for double taxation study. Seconded by Commissioner Smith and carried. Commissioner Yancey moved to authorize salary reclassifications as follows: Milton Smith'~ Jr., from Maintenance Worker C to D, $9,927.75 annual. Albert Payne, from Building Inspector E to F, $16,151.10 annual. Seconded by Commissioner Farr and carried. Commissioner Smith moved to .authorize the Mayor and City Clerk to execute an agree- ment with the Seaboard Coast' Line Railroad Company to install an-eight inch water main and a six inch sewer force main under the railroad~crossing on Silver Lake Drive, and to adopt Resolution No. 1325 for same. Said resolution being in words and figures as follows: RES.OLUTION NO. 1325 Be it resolved by the City Commission of the City of Sanford, Florida, in regular meeting assembled that the Mayor-Commissioner be, and he hereby is, authorized to enter into an agreement with the SEABOARD COAST LINE RAILROAD COMPANY, and to ~sign same on behalf of said City whereby said Railroad Company grants unto said City the right or license to install and maintain, for the purpose of conducting WATER and SEWAGE two lines of pipe across the right of way and under the main track of Railroad Company, at MINUTES City Commission, Sanford, Florida March 8 at 7:00 P. Said reso~lution being in words and figures as follows: RESOLUTION NO. 1323 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, SETTING THE FEE SCHEDULE FOR CERTIFICATES OF REGISTRATION FOR THOSE PLACES SELLING ALCOHOLIC LIQUORS, WINES AND BEERS WITHIN THE CITY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 3-1 of the Sanford City Code provides for the establishment of a certificate of registration to all establishments selling alcoholic liquors, wines and beers within the City, NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY OF THE CITY OF SANFORD, FLORIDA, AS FOLLOWS: 1. The charge for the certificate of registration for the sale of alcohol liquors, wines and beers within the'City of Sanford shall be: (a) Class 1 (b) Class 2 (c) Class 3 (d) Class 4: (2) (3) (4) (e) Class 5 $ 35.00 per year $ 50.00 per year $ 100.00 per year Less than 50 seating capacity 50 to 100 seating capacity 101 to 150 seating capacity Over 150 seating capacity $ 35.00 per year $ 50.00 per:year $ 75.00 per year ~.$ 100.00 per year $ lO0.O0 per year The holder of any certificate or a new holder of any certificate wishing to transfer said certificate of registration to a new owner or to another location shall first pay to the City of Sanford a transfer fee of $25°00 for each transfer of a certificate.
