Ma~ 24 at 7:00 P.M. .1982 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on May 24, 1982. Request submitted from James Ray Crockett, for an occupational license to operate a mobile food service unit at the corner of Commercial Street and Park Avenue, for sale of sandwiches, soft drinks, coffee, donuts, and hot chocolate, between the hours of 7:00 A. M. and 5:00 P. M., Monday through Friday, and also, to serve people at sporting events in the Sanford area.~at the various public parks. Commissioner Smith moved to authorize a special license, under the "unclassified" category, for the operation of the business at the corner of the intersection of Commercial Street and Park Avenue. Seconded by Commissioner Fart and carried. The City Manager reported that an electric permit has been pulled for the property at 804 Bay Avenue, Report No. 82-1018, and he now recommends a 90 day extension. Feather, Realtor, Florida Real Estate Ventures of Orlando, Inc., appeared to present'plans for a proposed life care center, utilizing property in Lake Monroe Indus- trial Park, which the City sold to Tom Rucker, as recorded in ORB 1370, Pages 41 and 42, with a reverter clause whereby the City could buy back the property if construction was not begun within 180 days from November 30, 1981. Mr. Feather also stated he had approximately 1~ acres to the West of this property under contract for purchase and requested the City not to exercise the reverter option from Tom Rucker, d/b/a South Shore, Inc. GAI, ,~IIPPI,Y After discussion, Commissioner Smith moved as follows: a) Not to execute the reverter clause on the lakefront property held by Mr. Tom Rucker under the condition that Mr, Feather obtain P.~ss®ssion of the property and provide the City with proof of that possession. b) With Mr. Feather having ownership of this parcel, agreed to a nine .(9) month period from May 24, 1982 as the new reverter period in which construction must be underway. c) The reverter would be exercised February.26, 1983 if work is not underway on this project and~ the City of Sanford would have the option to repurchase the entire parcel at a figure of $100,000.00. d) Ail? the City's actions.conditioned upon Mrs. Feather proceeding with this project as presented, including feasibility report to be completed about the middle of June, 1982. Seconded by Commissioner Yancey and carried. Mr. Feather proposed to finance the project with fl. tax-exempt industrial revenue bonds, and requested the City to authorize same. Commissioner Fart moved to authorize said industrial revenue bond issue, and to authorize the City Attorney to prepare the proper ordinance for same. Seconded by Commissioner Smith and carried. COmmissioner Yancey moved to remove from table, consideration of storm drainage improvements. Seconded by Commissioner'Smith and carried. Commissioner Fart moved.to table, for an indefinate period, consideration of said storm drainage improvements. Seconded by Commissioner Keith and carried. Recommendations dated May 21, 1982 submitted from the Planning and Zoning Commis? sion, as follows: RECOMMENDATIONS Recommend rezoning from RMOI to GC-2, the property generally!located at the SE corner of W. First St. and Mangoustine Ave., addressed at 1315 W. First St. for a gas station and convenience store. Rep. Bobby Jackson. 2. Recommend rezoning from RMOI to GC-2, the property generally located east of Terwilliger Lane and north of First St. (S.R. 46) for a pro- posed shopping center. Rep. Steve Cahill. The City Clerk reported that the public hearings to consider same had been advertised for June 14, 1982. The Mayor reported on a meeting with the County Commission held on May 18, 1982, at which was considered the location and the expansion of county office facilities. Com- missioner Smith moved to authorize the Mayor to execute Resolution No. 1328. Seconded by Commissioner Yancey and carried. Said Resolution being in words and figures; as follows: RESOLUTION NO. 1328 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, ENDORSING THE CONCEPT OF MAIN- TAINING ALL OFFICES OF COUNTY GOVERNMENT IN DOWNTOWN SANFORD AND PLEDGING COOPER- ATION WITH SEMINOLE COUNTY. WHEREAS, the City.of Sanford has bee,-the County Seat of Seminole County since the County was created in 1913; and WHEREAS, the downtown area of the City of Sanford- has been the traditional location of all offices of County government and the Court system; and WHEREAS, there exists in the downt~own area adequate room for expansion of existing facilities and parking areas; and WHEREAS', the downtown location is mutually beneficial to the Sanford merchants and County government employees; and WHEREAS, the City Commission of the City of Sanford believes it is in the best interest of the citizens of the City and County for all offices of County government to remain in the downtown area. /278 MINUTES City Commission, sanford, Florida May 24 at 7:00 P. BE IT FURTHER RESOLVED that the City Commission of. the City of Sanford pledges its continuing cooperation to the COunty CommisSion of .Seminole County in assisting in resolving parking space requirements and other items of mutual interest. BE IT FURTHER RESOLVED that a copy of this Resolution be presented to the Seminole County Commission and that a copy of same be entered in the minutes of the proceedings of the City Commission of the City of Sanford, Florida. Easterby, for a cost of living adjustment to the pensions for the four retired employees under the City pension plan. Commissioner Fart moved to authorize a 7.1% increase, effective June 1, 1982. Seconded by Commissioner Keith and carried. Commissioner Yancey introduced Resolution No. 1327, and after being read in full, moved on its passage and adoption, and to authorize the Mayor to execute same. Seconded by Commissioner Fart and carried. IN PROMOTING THE CITY OF SANFORD BY SPONSORING THE MISS SANFORD SCHOLARSHIP PAGEANT. The Mayor voted in favor of the motion, and announced he is the sole owner of Sunniland Corporation, which is the owner of the property being annexed. On motion of Commissioner Fart, seconded by Commissioner Yancey and carried, con- sideration of mosquito spraying was removed from table. The City Manager reported costs for a one time aerial spraying would be 50¢ per acre, or $3,250.00, plus chemicals, $2,100.00 and if done on a schedule, the cost would be 40¢ per acre, $2,600.00, plus chemicals. Fur- ther, that since aerial spraying does not have a residual effect, five or more applications per year would be necessary, for total annual cost of $23,000.00. Commissioner~:Farr moved to authorize a one-time aerial spraying for mosquitos in amount of $5,300.00, and transfer from Contingency to provide for same. Seconded. by Commissioner Smith and carried over dis- senting vote of Commissioner Keith. Request submitted from the Sanford Rotary Club for free use of the Civic Center with alcoholic beverages, for a Country/Western dance on July 17, 1982, with proceeds to be used for community charities and service. Commissioner Keith moved to authorize same. Seconded by Commissioner Yancey and carried. ,--, -. The City Manager reported that the term of Donald Jones, a City Commission ap- pointee to the Civil Service Board, will expire on June 30, 1982, and that Mr. Jones is wil- ling to serve another two-year term, if re-appointed. On recommendation of the City Manager, Commissioner Farr moved to adopt a Civic Center rental policy as follows: POLICY MANUAL Civic Center rental The City of Sanford shall no longer rent the Civic Center; except: To local, community service organizations and individuals that are conducting a known, local, function and who have previously contracted with the City of Sanford for use of the Civic Center. Ma~ 2~_~O P.M. _ 19 82 All other parties or organizations:that may desire to rent the Civic Center must: a) Submit a written appllcation to the City Commission through the Recreation Office. b) The application must be submitted at least sixty (60) days in advance of the event date. c) The application shall contain all the information re- quired by the City Commission and shall include the name, address, and telephone~number of the sponsor of the event; the name and description of the event; and the name, address, and telephone number of all parti- cipants in the event. d) The application shall show the exact and detailed specifi- cations of the event as the event will be presented in the Civic Center. The City Commission reserves the right to approve or disapprove the applications listed in Section ~. above and may require further conditions or information of any individual or organization renting the Civic Center. Further, the City Commission reserves the right to set and approve a rental fee for the use of the Civic Center and to require a bond of the amount stipulated by the City Commission. The City Manager r'eporte& the City had received a check in the amount of $107,431.00 from the insurance company for storm damage, but it will not'cover all expenses for repairs. On recommendation of the City Manager, Commissioner Fart moved to authorize repair work for storm damage to the civic center and to amend the budget for the insurance claims and trans- fer the balance from Contingency~on' items as follows: The City has received an insurance check for building damages but it will not cover all expenses. The City Manager reported receipt of'a .preliminary estimate from the League of Cities for State Municipal Revenue Sharing for 1982-83, in amount of $939,933.00. Letter submitted from Cliff Guillet, Executive Director, East Central Florida Regional Planning Council, stating the FY 83 East Central Florida Regional Planning Council Assessment for Sanford will be $3,210.00. Commissioner Keith moved to authorize payment of same, from the 1982-83 Budget. Seconded by Commissioner Farr and carried. The Commission next authorized installation of a street light at the corner of Oleander Avenue and West First Street, on the north side of West First Street, an entrance to the new hospital.
