M. 19 82 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on June 14, 1982. A public hearing was held in accordance with notices authorized at meeting of May 24 1982, to consider condemnation of 13 structures or buildings on Condemnation Group No. 69, Reports Nos. 82-1039 through 82-1051. The Chairman announced that the Commission would hear from property owners or representatives thereof. Powell A representative for Whit and Rose Bishop, owners of the property at 202 West 20th Street, Condemnation Report No. 82-1040, appeared and stated the property is for sale "as is" and they have a contract for sale, with a closing date within 90 days. The City Manager reported that nearly all deficiencies have been cleared and that the new owner will re-do the electrical service and recommended the property be removed from the condemnation list. After consideration, Commissioner Fart moved to remove Report No. 82-1040 from the condemnation list and that finding the buildings under Condemnation Reports Nos. 82-1039 and 82-1041 through 82-1051 to be unsanitary, unsafe and delapidated, that said structures be condemned and the owners given 90 days in which to repair or<demolish said structures; and if the structUres are not repaired or demolished within 90 days, to authorize the City to demolish same and levy a lien against the property.. Seconded by Commissioner Smith and carried. Commissioner Fart introduced Resolution No. 1329, and after being read in full, moved to authorize the Mayor and City Clerk to execute same. The Mayor meported he will be unable to attend the July 1, 1982 East Central Florida Regional Planning Council Metropolitan Planning Organization meeting at Altamonte Springs City Hall. Commissioner Smith was designated to attend as the Mayor's representative Simpson S. Garland, 1104 West Third Street, Sanford, Florida, appeared to report 15 to 20 children living in an apartment across the street from his residence, using a hose outside to bathe, for many hours a day, and creating unsanitary conditions by using .the yard as a bathroom. The Mayor explained the City's water billing system, and told Mr. Garland that the Sanford Housing Authority would be notified of the water being wasted and also of the nuisance. The City Attorney reported that the City Manager had asked him to research the question of whether or not the City had any authority to deny a building permit .within an area that floods and does not have adequate area drainage to keep all tracts dry at all times. He reported he had researched the question and could see no basis whereby the City could deny the issuance of a building permit under said conditions. However, the City could determine by ordinance, areas subject to flooding and establish procedures to notify applicants that the area could be subject to flooding and the City can not do anything about it until and unless a majority of the voters vote for a referendum bond issue to finance drainage improvements. Commissioner Smith moved to remove from table, consideration of water conservation devices. Seconded by CommisSioner Yancey and carried over dissenting vote of Commissioner Fart. The Mayor reported the City of Orlando will have a report completed in October on a portion of that city using water conservation devices. Commissioner Smith moved to table consideration of same until Orlando's report is available. Seconded by Commissioner Yancey and carried. MINUTES City Commission, Sanford, Florid__ June 14 at 7~_0_=0 P._M~___I9 82 MIDSTA'r~; LEGAL ,SUPPLY COMPANY as to obtaining ownership from South Shore Club, Inc-,, of approximately eight and one-half acres of the former City-owned property in Lake Monroe Industrial Park. After discussion, Commissioner Fart moved to authorize the City Attorney to commence procedures to exercise the City's reverter clause as set forth in REVERTER I, dated November 30, 1981, recorded in ORB 1370, page 42, Public Records of Seminole County, Florida, with Thomas F. Rucker, Presiden South Shore Club, Inc. Seconded by Commissioner Smith and carried. The Commission authorized a meeting to be held at 12:00 Noon on June 28, 1982, with Dr. Mulrennen, to discuss mosquito control programs and possible state participation in same. The City Manager reported Sanford has received a state grant in amount of $12,500.0¢ to be used for constr.uction of the Marshall Avenue Park, located south of 25th Street at Marshall Avenue, with estimated total cost in.amount of $48,742-.00. Further, that the City is required to contribute $25,000.00 in cash, which could be transferred from the Pub- lic Projects Fund and the balance in kind. Commissioner Fart moved to adopt Resolution No. 1330, and to authorize the Mayor and CityiCterk to execute same, and to authorize the City Manager to execute the Project Agreement with the State of Florida Department of Natural Resources, and to transfer $25,000.£ from the Parks and Recreation funds in the Public Projects Fund. Seconded by Commissioner Smith and carried. Said Resolution No. 1330 being in words and figures as follows: RESOLUTION NO. 1330 A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A FLORIDA RECREATION DEVELOPMENT ASSISTANCE:PROGRAM GRANT AND THE EXECUTION OF AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF NATURAL RESOURCES, DIVISION OF RECREATION AND PARKS, REGARDING THE development OF Marshall Avenue Park. BE IT RESOLVED by the City of Sanford Florida, that the City of Sanford accepts the Florida Recreation Development Assistance Program grant from the Florida Department of Natural Resources, Division of Recreation and Parks, in the amount of $12,500.00 and authorizes the City Manager to execute all appropriate documents and serve as representative for the City of Sanford in the acceptance and administration of ghe grant. The City Manager submitted proposed policies and fee schedules for use of recrea- tional facilities, as follows: OUTDOOR RECREATION FACILITY FEE SCHEDULE PROPOSAL The City of Sanford finds itself in the position ~hi.¢h is common to all Municipalities and Governmental Agencies during this decade. M. 19_ 82 The above philosophy of the provider was echoed for many years and even had its formulation of ideals borne through college and university curriculum. However, whenever the time to "stand up and be counted" vote was presented the general population has said, "we want to pay taxes for only what we get" This of course changed the attitude of the elected official, because he~ being the policy maker for tax accessments, must then justify to the public the ex~ penditure of every tax dollar. To do this, the politician laid all the apples on the table with price tags on each and then let the public designate which apple to keep and which to turn back. There must have been many thousand polls taken to determine the level of services that the people want their tax dollar to support. Recreation and Parks did not score too well on this. Other polls have been taken to determine if Recreation, Parks and Leisure Time activities were needed or desired. The overwhelming answer was "yes". .We must ~hen interpret this to mean that "yes" we want a full Recreation, Parks and activity program, but "ri'o" we don't want pay for it through taxes. This should clearly indicate to the professional Recreation and Parks purists that a change in methodology must take place within their method of operation. This does not mean a change in the in- dividual's philosophy or end results that might be obtained by pro- fessional recreation adminstrators. The re-education does not only begin with the professional City Administrator, Recreation Administrator and Supervisors but it must also include the elected officials who daily receive criticism he- cause the changes that occur. For several years the City of Sanford through the wisdom of its elected officials and administrative staff hks recognized the writing on the wall and has done a good job in laying the groundwork for a fee and charge system for the City of Sanford Recreation and Parks Department. To relate.this message closer to home, the operational procedures for the City of Sanford will have two alternatives in the institution of a fee and charge system. A). One Procedure is to physically moniter all facilities to ensure total enforcement and collections. To provide this level of service it will mean the increasing of Recreation staff either by full-time or trained part-time em~yees. B). The other alternative zs the enforcement of a fee system that can be administered by assessing fees for services requested. Seminole County Parks and Recreation have been very successful in their fee and charge system because of three factors: 1. Ail Parks are enclosed with gates. 2. They have a resident ranger in each park. They also have Supervisors on Site to moniter and collect fees. The City of Sanford has a different Situation with the Philo- sophy of neighborhood parks -- '!that a park be provided within ~alking distance of all 'citizens", The neighborhood park is de~ signed as an area for family type walk in Recreation, With'out _having all advantage.s of fenced, controlled facilities with live in resident rangers I would suggest we in the City of Sanford look to areas of fee and Change where contrml and enforce- ment could be exercised without the cost of hirin, g and training of additional staff. In each case there.is always administrative cost to make reservations and record in- formation; there is impact cost for use of facility in cost of clean-up and disposal on trash and debris. In the case of service cost on cemtery space locations the ~ost of providing this service includes cost of manpower~ admini- stration and cost of equipment use. In normal situations it re- moves the Superintendent of Parks out of service for at least one (1) hour of time in addition to office administration, The City of Sanford is the 'custodian of'the Municipal Cemetery and if it is allowed to let private individuals locate their Own grave spaces without regard to the entire system it will then he- come an unmanageable Situation. This is why it should remain mandatory that all locations be handled by qualified city employees, If a fee system is authorized it will be a very unpopular item with local Funeral Directors and Monument Dealers~ It will not he possible to enforce the fee schedUle without solid support, of the City Administration. The Department of Recreation and Parks concur with the message contained herein and are ready to initiate ncessary action whenever it is approved. Letter of commendation for Police Officer Darrel Presley submitted from Mel Atkins, Manager, Scotty's Inc., for actions in recovering a ceiling fan stolen from the store. Letter submitted from Seminole Club, Inc., d/b/a Mayfair Country Club, Setting forth repairs and improvements in amount of $99,865.00 accomplished in the past 12 months. The City Manager reported that Lall barrels of chemical waste have been remnved from the storage site on Bevier Road, but some equipment and supplies remain, and that a letter has been sent to the owner setting forth that the property clean-up is the respon- sibility of the owner to work with the Department of Environmental Regulation. Further, the city's costs to date have been at least $18,465.79. The City Manager reported that staff is still trying to get the owner to clean-up 2497 Park Avenue (Feed Barn) and 329 Sanford Avenue (Mr. G's Warehouse Foods), and that the matter is being turned over to the Code Enforcement Board. On recommendation of the City Manager, Commissioner Fart moved to authorize Alpha Phi Alpha Fraternity to use the Civic Center, with alcoholic beverages on October 22, 1982. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, the Commission authorized staff to process applications from new, local groups or individuals to rent the Civic Center, as long as their function is known. The City Manager submitted a status report on a condemnation as follows: 82-1033, 1208 Myrtle -- no visable progress although a permit was pulled 4/30/82. 30 days remaining. The City Manager reported that a commercial refuse collection firm has requested to make a presentation to the City Commission on changing from city refuse collection to a private collection service. The Commission authorized the City Manager to respond that the City is not interested in going to a private collection service.
