110882-Regular Session MINUTES City Commission, Sanford, Florida November 8 at 7:00 P. M. 19. 82 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 8, 1982. Present: Mayor-Commissioner Lee P. Moore Commissioner Milton E. Smith Commissioner Edward A. Yancey Commissioner David T. Fart Commissioner Edwin O. Keith City Attorney William L. Colbert City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. Commissioner Yancey moved to remove from table, discussion of benches at bus stops. Seconded by Commissioner Farr and carried. The City Manager reported that Metro Systems, Inc. has installed only 53 of the 173 benches under ~the originm~ii~:agreement and will renew the agrement, including a performance bond. Commissioner Yancey moved to remove from table, discussion of the City's mowing policy. Seconded by Commissioner Smith and carried. The City Manager submitted a report as follows: PROPERTY MOWING SURVEY OCTOBER 19, 1982 All jurisdictions surveyed except the City of Lake Mary, have an ordinance relating to property mowing and maintenance. Sever~ (5) Jurisdictions require mowing based on a written complaint from a neighbor or abutting property owner,others do it on an as needed basis as the--City deems necessary. Property owners are notified of compliance by the City by certified letter, with return receipt requested, after an inspection by City Code Enforcement Inspectors. e Upon return of receipt, most Cities allow 14 days to meet ordinance requirements; if property owner fails to take action, the City enforces the ordinance as follows: (A) 4 turn the mowing over to a private contractor, (Altamonte Springs, Maitland, Winter Park, and New Smyrna) and then City bills owner to collect. (B) 6 Cities do their own mowing and bill by labor and materials based on lot size. (Casselberry, Lake Mary, Longwood, Oviedo, Winter Springs, and Kissimmee.) NOTE: The City of Kissimmee charges $125.00 hour for mowing and cleanup. This is the most costly program for the the public. Winter Park charges contractor cost plus $50.00 administration fee; the City of Maitland charges contractor cost plus 10% administration fee. Seminole County: Does not mow, but files a complaint with the State Attorney's Office of those' lot owners, who refuse to comply with the County Ordinance. Sanford requires written complaint; reviewed by City as to.~n~ed; letter requiring compliance within 10 days; if not, CitY does work and bills owner; failure to pay and City files lien against propety; foreclosure proceeding filed'if lien not cleared; Presently Sanford's charge is $30. per fifty foot frontage or any fraction thereof. M. 19. 82 MIDSTATI~ LEC4-AL SUPPLY COMPANY On recommendation of the City Manager, Commissioner Keith moved to authorize the City Attorney to prepare the proper amendment.to Sec. 11-29 (a) of the City Code to establish the cost for the City to mow private property as $2.00 per front foot of the lot, with depth up to 150 feet; lot depth in excess of 150 feet and up to 300 feet to be $4.00 per front foot; and to add $2.00 for each '150 foot increment for lot depth in excess of 300 feet. Seconded by Commissioner Fart and carried. Commissioner Keith moved to remove from table, consideration of a proposed lease of city warehouse property on West Sixth Street. Seconded by Commissioner Smith and car- ried. The City Manager reported that Tommy Peterson has a client who Wants to purchase the property through exchange of a warehouse built on city property. MINUTES City Commission, Sanford, Florida. November 8 at 7:00 P. M. 19.82 The City Manager reported that Barnett Bank of Central Florida's site plan was approved by the Planning and Zoning Commission on November 4, 1982, and use of a temporary facility was authorized, in accordance with conditions in a letter dated November 2, 1982 as follows: a) Initially installing a temporary bank facility using a mobile home type structure, and b) Obtain site plan approval for the temporary facility in November, 1982, and c) Move the temporary facility onto the site in December, 1982, and which this letter hereby authorizes, and d) Submit plans for a permanent structure so as to pull a building permit by June 30, 1983, and e) Initial construction of the permanent structure at the usual and normal construction schedule; estimated to be four months barring unexpected delays, and f) The temporary facility shall not be used beyond twelve months and shall be reviewed by the city manager if this time frame is not met. The City Manager reported that the Florida Department of Environmental Regulation still will not agree to a wasteload allocation for Sanford, even though secondary treatment is satisfactory for the federal government regulations. The Commission authorized to con- tinue with Dr. O'Conner, and requested a copy of his detailed program. The City Manager reported on a magazine article indicating the national average of gross revenue from video games is $174.00 per week, with the more popular machines generating $300.00 per week. The Commission authorized the City Manager to submit a fee schedule for each machine and for game rooms.
