After consideration, Commissioner Yancey moved that finding the buildings under Condemnation Reports Numbers 82-1066 through 82-1075 to be unsanitary, unsafe and delapidated that said structures be condemned and the owners given 90 days in Which to repair or demolish said structures; and if the structures are not repaired or demolished within 90 days, to authorize the City to demolish same and levy a lien against the property. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. Recommendation submitted from the Planning and Zoning Commission at meeting of November 8, 1982, to rezone the property. The Mayor reported receipt of letters in favor of the rezoning from Mrs. Helen J. 5'2 MINUTES City Commission, Sanford, Florida November 22 at 7:00 P. M. .19 82 John Cullum, 412 Editha Circle, appeared and submitted a petition in opposition to the rezoning. Joyce Nikkola, 14910 Lake Forest Drive,r~Lutz, Florida, appeared to support the proposed rezoning, and reported that in 1949, 1, 2 and 3, Block 1, Highland Park, at the southeast corner of 20th Street and French Avenue, were zoned Commercial-l, and that is equivalent to present day GC-2 zoning. Commissioner Keith moved to. deny the rezoning. Seconded by Commissioner Smith and carried over dissenting vote of Commissioner Farr. 'The City Clerk reported that FS 101.5612(1) provides for a test of the election tabulating equipment, and that the canvassing board may designate a member to represent it. Commissioner Fart moved to appoint Commissioner Yancey and Commissioner Keith to represent the canvassing board at the Office of the Supervisor of Elections of Seminole County. Seconded by Commissioner Smith and carried. Rep.-Remedious Rutledge Approved a site plan of a Monument Company to'be located at 2208 W. 25th St. in the GC-2 zoned district on the stipu!ation that the City Commission approve the parking and landscaping shown on the site plsm. Rep.-Glen or Brent McCall. Commissioner Keith moved to authorize a public hearing to be held December 13,' 1982 to consider item no. 1. Seconded by Commissioner Farr and carried. Commissioner Farr moved to authorize the City'Manager to work with Mr. Glen McCall to develop an acceptable landscaping plan for property leased from the City on West 25th Street, and to approve the site plan subject to said landscaping plan, and with no paving. Seconded by Commissioner Smith and carried. Request submitted from A. K. M. on November 22, 1982, to consider the adoption of an ordinance by the City of Sanford, Florida, title of which is as follows: ORDINANCE NO. 1619 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING THE CHARTER OF THE CITY OF SANFORD, FLORIDA, PROVIDING FOR REFERENDUM ELECTION BY CITY ELECTORS, EFFECTIVE DATE, CONFLICTS, AND SEPERABILITY. After being read by title, the Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the adoption of the ordinance. No one appeared. Commissioner Smith moved on the passage and adoption of Ordinance No. 1619. SecondE by Commissioner Yancey and carried. The City Manager reported that the Sanford Youth Baseball Association had terminate¢ their agreement of the past three years to operate the Youth Baseball program, and the Recre- ation Department will handle the activity within the budget. On recommendation of the City Manager, Commissioner Smith moved to authorize trans- fer from Contingency for employees 3.17o cost of living salary adjustment and related FICA tax and pension ~o~be effective April 1, 1983. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, Commissioner Yancey moved to authorize pay- ment to the City Attorney in amount of $3,179.24 for legal services for October, 19821 Seconded by Commissioner Fart and carried. Type of Event Dance Christmas Party Christmas Party Dance The City Manager reported that the developers of The Country Place, 119 Upsala Road have not provided adequate open space, and the payment in lieu thereof would be $7,112.0£ On recommendation of the City Manager, Commissioner Smith moved to authorize the City Manager to notify the developer that the City will accept payment of $7,112.00 in lieu of open space. Seconded by Commissioner Fart and carried. Commissioner Fart moved to authorize salary reclassification for Joe Dillard, Police Department, from Sergeant D to E, $20,330.94 annual. Seconded by Commissioner Yancey and carried. The City Manager submitted a report ~on ~Double Taxation:iStudy Co~ttee meeting held November 17, 1982 in the Sanford City Hall, and a proposed resolution to accept the recommendations of the Double Taxation Study Committee. Commissioner~Keith moved to commend this Committee for their work and to adopt Resolution No. 1340, and to authorize the Mayor and City Clerk to execute same. Seconded by Commissioner Smith and carried, Said Resolu- tion being in words and figures as follows: RESOLUTION NO. 1340 A RESOLUTION OF THE CITY OF SANFO.RD~ 'FLORIDA ACCEPTING THE RECO14bIENDATIONS OF THE DOUBLE TAXATION STUDY COMMITTEE AND REQUESTING THE SEMINOLE COUNTY COMMISSION TO UNDERTAKE MEANS TO RESOLVE THE DIFFERENCES IN LAW ENFORCEMENT SERVICES OF PATROL AND INVESTIGATION AND SETTING FORT}{ A TIME FRAME FOR COOPERATIVE WORK TO DISSOLVE THE DOUBLE TAXATION ISSUE. WHEREAS, the several Cities of Seminole County have undertaken a review and have developed a report on Double Taxation through the services of the consulting firm of Kelton and Associates, and WHEREAS, said Double Taxation Study Committee has reviewed in depth the County operations as to the question of Double Taxation, and WHEREAS, said Double Taxation Study Committee has also reviewed in depth the. County operations as to the question of equity, and WHEREAS, it was fhe initially expressed wishes of the Double Taxation Study Committee to avoid entering into litigation to resolve any question, and WHEREAS, the Committee did find points of Double Taxation in the law enforcement field of patrol and investigation, and '/ /456 MINUTES City Commission, Sanford, Florida_ November 22 at 7:00 P.M. 19 82 WHEREAS, the Double Taxation Study Committee has unanimously recommended a procedure to resolve this difference in the law enforcement service by a cooperative system of all municipalities working with the Seminole County, and WHEREAS, this cooperative a~proach will enable the Seminole County Commission to ~hase in the needed correc~[iVe steps, as developed by the County, and WHEREAS, all the municipalities ~ill work cooperatively with Seminole County in the resolution of this service difference in law enforcement, NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION that the City of Sanford, Florida accepts the recommen- dations of the Double Taxation Study Committee; unanimously adopted by said Committee on November 17, 1982, an~ as presented J.n the report of said Committee, dated November 19, 1982. BE IT FURTHER RESOLVED that the City of Sanford, Florida will work cooperatively with the Seminole County Commission to resolve the differences in law enforcement as reported by the Study Committee and shall withhold the resolution of notice on double taxation previously sent to the County. BE IT FURTHER RESOLVED that the City of Sanford, Florida undertakes this cooperative posture with the understanding that the Seminole County Commission will respond to the findings of the Committee by January 15, 1983 and to out]ine their approach to the resolution of this difference of services in ].aw enforcement Of the Sheriff's Depart- ment as set forth in the time schedule of the Double Taxation Study Committee's Report, dated November 19, 1982. BE IT FURTHER RESOLVED that the City of Sanford, Florida urges CALN0 to bring before the Seminole County legislative delegation that the double taxation question also should be considered jointly with the question of equity on a state wide basis and there is a need to resolve the joint approach to both "equity" and to "real and substantial." On recommendation of the City Manager Commissioner Smith moved to instruct the City Manager to investigate the acquisition of a site for an elevated water~ tankin the Silver Lake Drive area. Seconded by Commissioner Fart and carried. The City Manager reported that Slim Galloway had submitted the name of R. C. Whit- mire to serve on the Code Enforcement Board. Commissioner Smith moved to appoint R. C. Whit- mire as a member of said board. Seconded by Commissioner Yancey and carried. The City Manager reported that a 90 day time extension with special conditions, was granted to the owner of property at 819 West Third Street, and that the owner was attempt- ing to comply, and submitted a report from the Minimum Housing Code Inspector as follows: MEMORANDUM · DATE: TO: FROM: SUBJECT: NOV. 22, 1982 City Manager Housing Code Inspector 819 W. 3rd St. - Gr. 59/80-960 I reinspec[ed 819 W. 3rd St. at 4:00 P.M. this afternoon and found the following conditions: Shed has been demolished but debris has not been removed. 2. 3. 4. Fire truck has not been removed. Grass & weeds have been cut. Pile of metal debris on south side of property has not been hauled away. On recommendation of the City Manager, Commissioner Yancey moved to authorize a 30 day extension. Smith and carried. Commissioner Yancey moved to authorize the Mayor, City Attorney and City Clerk access to Safe Deposit Box No. 177 at the Atlantic Bank, for the annual audit.
