The City Commission of the City of Sanford, Florida,met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on December 13, 1982.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notice published in the Evening
Herald on November 23 and December 3, 1982, as follows:
NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND
USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY
OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held at the
Commission Room in the City Hall in the City of Sanford, Florida, at
7:00 o'clock P. M. on December 13, 1982, to consider changes and amend-
ments to the Zoning Ordinance, and amending the Future Land Use Ele-
ment of the Comprehensive Plan of the City of Sanford, Florida, as
follows:
A portion of that certain property lying South of and abut-
ting the Seaboard Coast Line Railroad right-of-way and be-
tween Myrtle Avenue extended Southerly and Elm Avenue is
proposed to be rezoned from SR-1A (Single-Family Residential
Dwelling) District to GC-2 (General Commercial) District.
Said property being more particularly described as follows:.
Section 36, Township 19 South, Range 30 East, Begin
10 Chains South and 670 feet East of the Northwest
corner of the Northeast 1/4, Run East 109 feet
north to Railway, Northwester!y to a point North
of the Beginning, South to Beginning, Public Records
of Seminole County, Florida.
Ail parties in interest and citizens shall have an opportunity
to be heard at said hearing.

Request submitted for a 90 day time extension on Condemnation Report No. 82-1051,
907 West 12th Street, William Dingle, owner. On recommendation of the Minimum Housing Code
Inspector and the City Manager, Commissioner Farr moved to authorize same. Seconded by
Commissioner Keith and carried.
The City Clerk~epo~ted that a;test of the election tabulating equipment would
be held December 17, 1982 at 3:30 P. M. in the Office of the Supervisor of Elections, and
that the Canvassing Board may designate a member to attend said test. Commissioner Yancey
moved to authorize Commissioner Farr and Commissioner Smith as the Canvassing Board's repre-
sentative for the test. Seconded by Commissioner Keith and carried.

The Commission authorized to meet at 1~2 00 o'clock Noon on December 22, 1982 to
canvass the votes of the Municipal Run-Off Election to be held December 21, 1982.
William Hutchison, Attorney, appeared to represent the owners of the HOliday Inn,
and request the City's approval of a Consent of Assignment of lease to Seminole Resorts,
Inc; consent to subordinante interest to refinancing not to exceed $1,600,000.00 to play
off existing debt, for improvements and approximately $130,000.00 to'refurbish the motel,
and approval of a modification of the lease agreement to provide for same. Commissioner
Keith moved to authorize the Mayor and City Clerk to execute the %hree instruments. Seconded
by Commissioner Yancey and carried.
Charles Volk, Marina lessee, appeared to discuss dredging the east marina harbour
and entrance; to extend the east bulkhead north approximately 300 feet and the installation
of 85 additional boat berths.
The City Manager reported the operation has obtained financing for the 85 new
berths, but not the $100,000.00 needed for the maintenance d~edging and the bulkhead exten-
sion.
On recommendation of the City Manager, Mayor Moore moved to authorize the City
toparticipate in the dredging and bulkheading work and co-sign on the loan for same. Seconde
by Commissioner Smith and carried. Commissioner Farr moved to waive the marina lease fee
in an amount equal to the annual franchise fee, but said amOunt not to exceed $10,000.00,

due on said dredging and bulkhead. Seconded by Commissioner Smith and carried.
A. B. (Tommie) Peterson, Jr., St. Johns Realty Company, Inc., appeared to discuss
an offer to construct a new warehouse on City property, in exchange for the City warehouse
and property on West Sixth Street. He submitted plans for the new warehouse. Commissioner
Farr moved to accept Mr. Peterson's offer to exchange the City-owned warehouse and property
on West Sixth Street for the construction of a new warehouse constructed at the Public Works
Complex, subject to the new warehouse meeting city plans and specifications. Seconded by
Commissioner Keith and carried.
The City Manager reported that The Holy Cross Episcopal Church has requested a
zoning ordinance amendment to provide for the interment'i~: of cremains on church property,
enclosed and secured by a wall, as a conditional.use in the RMOI District. Fat'he~ Leroy
D. Soper appeared to support the request' and reported the use of the proposed 30 foot by
30 foot area would be restricted to members of the church. On recommendation of the City
Mana. ge~,Commissioner Smith moved to authorize a public hearing to be held January 10, 1983
to consider the amendment, and to request a recommendation from the Planning and zoning Commis
sion. Seconded by Commissioner Yancey and carried.
On recommendation of the City Manager, Commissioner Farr moved to authorize the

The City Manager reported that work on condemned property at 819 West Third Street
is very slow. Commissioner Farr moved to authorize the City Manager to request Mr. Lee
to be present at the meeting on December 27, 1982. Seconded by Commissioner Yancey and
carried.
On recommendation of the City Manager, Commissioner Farr moved to authorize salary
reclassifications as follows:
Gary L. Winn, Building Division, from Building Official E to F, $24,938.40 annual.
Fred Robinson, Street Division, from Maintenance Worker I D to E, $11,419.26
annual.
George Cole, Street Division, from Maintenance Worker I C to D, $10,097.33 annual.
Seconded by Commissioner Yancey and carried.
The City Manager submitted a recommendation to change the position of Assistant
to City Manager from Salary Schedule II, pay~grade 15 to Administrative Salary Schedule
I, Pay grade 2, range $23,795.00 to $34,611.20, and to transfer Steve Harriett to grade
C at $28,121.60 annual. Commissioner Farr moved to authorize the recommendation, and further,
to change the name of the position to Assistant City Manager. Seconded by Commissioner
Smith and carried.

of eight holidays per year, and emergency personnel an '.additional three floating holidays

SECTION 9-12
The Fire PreventS. on Code, 1970 edition, as prepared b~ the
American InsuraDce AssociatiOn be amended by replacing it with The 1982
edition of the Standard Fire Prevention Code as published by the Southern
Building Code Congress, except that Chaoter 15 of this code. shouild.be ex-
Eluded. 'After researching this code,,-I find that there are conf!licts with
the Life Safety Code and therefor recommend ~hat Chapter 15 'of th'~-'Southern
Building ~ode Congress' 1982 edition, Standard Fire Prevention ~de be ex-
cluded and the following adopted as an amendment thereto in its place:

In every building means of egress shall be installedland
maintai.ned in accordance with the provisions of the Life Safety!Code as

Commissioner Fart moved to authorize the City Attorney to prepare the proper ordinance for
same. Seconded by Commissioner Yancey and carried.
The Commission moved to support the action taken by CALNO, to route coal trains
through the least populated areas and schedule them around peak vehicle traffic and to autho-
rize the Mayor to direct a letter to the railroad, requesting the coal trains be run through
Sanford at night
The City Manager reported that the Seminole County Traffic Engineer conducted
a traffic study at the intersections of SR 46A and Ridgewood Avenue and at 46A and Georgia
Avenue, and neither location meets the warrants for traffic signals ~-~.

The City Manager submitted a request from Herbert E. Stenstrom, representing USA
Petroleum Corporation, to rezone property located at 1501 South Frengh Avenue from RC-1
District to GC-2 District, said property further described as fol~ows:
Lots 1, 2 and 3, Amended Plat of Orange Heights, Plat Book 4, Page 84,
Public Records of Seminole County, Florida.
On recommendation of the City Manager, Commissioner Smith moved to authorize a public hearing
to be held January 24, 1983 to consider si~ame. Seconded by Commissioner Yancey and carried.
Statement in amount of $4,474.35 submitted from the City Attorneyfor services
for November, 1982. Commissioner Smith moved to authorize payment of same. Seconded by
Commissioner Yancey and carried.
On recommendation of the City Manager, Commissioner Keith moved to authorize to
budget Law Enforcement Trust Fund monies as follows:
a) Pay off lien on 1979 Cadillac Seville so that it
can be sold and funds placed in Trust Fund $4,500.00
b) 12/9/82 request for:

street light at 1403 South Roosevelt Avenue. Seconded by Commissioner yancey and carried.
The City Manager reported he had received no respons.e from Tom Youngblood, Agent
for Sunbelt Property, Greenville, North Carolina, owner of the condemned property at 2933
Orlando Drive, Condemnation Group 69, Report No. 82-1043. Commissioner Farr moved to autho-
rize the City Manager to direct a letter to the owner, with a copy to Tom Youngblood as
Agent, that if the City doesn't receive a plan of action by December 27, 1982, the City
will authorize to remove the building and pu~ a lien on the property. Seconded by Commission~ r

RESOLUTION NO. 1341
A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
PROVIDING FOR A METHOD OF COMPUTING THE EX-
PENSE OF LOT MOWING; PROVIDING FOR SEVERABILITY,
CONFLICTS, AND EFFECTIVE DATE.
WHEREAS, Section 11-29.3 of the City Code of the
City of Sanford, Florida, provides for "unpaid costs incurred
by city's abatement to be lien on subject property; enforcement;"
and
WHEREAS, the City of Sanford provides the service of
lot mowing an as as-needed basis; and
WHEREAS, it is the policy of the City of Sanford
not to compete with private businesses; and
WHEREAS, the City of Sanford desires to continue to
be able to maintain property located within the City free of
debris, weeds, trash or other items of a dangerous and
unsightly nature; and
WHEREAS, Section 11-29.3 (a) provides that the City
Manager shall certify to the City Clerk expenses incurred in
remedying the situation and provides no special form for
determining said expenses; and
WHEREAS, the City Commission desires to establish
a formula to specifically establish costs.
NOW, THEREFORE, BE IT RESOLVED .BY THE CITY COMMISSION
OF THE CITY OF SANFORD, FLORIDA:
SECTION 1: That the method of computing the expenses
of lot mowing will be as follows:
"Two dollars ($2.00) per front foot of the
lot width with a depth not to exceed one
hundred and fifty (150) feet and to add two
dollars to the original two dollars per foot
rate for each one hundred and fifty (150)
feet or fraction thereof, of depth of the
lot being mowed.
SECTION 2: If any section or a portion of a section
of this Resolution proves to be invalid, unlawful, or unconstitu-
tional, it shall not be held to invalidate or impair the validity
force or effect of any section or part of this Resolution.
SECTION 3: That all resolutions or parts of
resolutions in conflict herewith, be and the same are hereby
repealed. ·
SECTION 4: .That this Resolution shall become
effective immediately upon its passage and adoption.
