Commissioner Keith moved to remove from table, a public hearing tabled at meeting of March 12, 1984, to consider rezoning a portion of the property lying South of Airport Boulevard and between Live Oak Boulevard and U.S. Highway 17-92 (S.R. 15-600) from MR-1 (Multiple-Family Residential Dwelling) District to MR-2 (Multiple-Family Residential Dwelling) District, BML Investments, et al, owners. Seconded by Commissioner Yancey and carried. No one appeared, in favor of or in opposition to, the proposed rezoning. On recommendation of the Planning and Zoning Commission, Commissioner Smith moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. The City Clerk reported that notice was sent to the owner, Kevin~ J. Spolski,~ on February 23, 1984 and the property was posted on February 28, 1984. John Spolski appeared to represent his brother, Kevin, and reported they plan to construct mini-warehouses on the property. On recommendation of the Planning and Zoning Commission, Commissioner Keith moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. Box 1028 Sanford, Florida 32771 (305) 322-1652 12 March 1984 City Commissioners City of Sanford Sanford, Florida 32771 Dear Sirs: Campbell-Lossing post 53 requests waivers of existing alcohol laws applicable to sunday openings, and asks that consideration be given to the post, allowing members be served alcoholic beverages commencing at 9:00 a.m. providing a bit of background, it is sad but true that the post has failed in recent years to fulfill its charter purpose of sup- porting and engaging in community affairs, whether this failing has been a result of inadequate funds or indifference on the part of various preceeding administrations is somewhat moot; however, the first partial explanation, that of inadequate funds, remains valid. During the past few months, we, the post, haVe assumed sponsorship of Boy Scout Troop 84 and its attendant Cub Scout pack, agreed to field an American Legion:Senior Baseball team in the City of SanfordAmerican Legion Baseball League, and have increased our,quota of~ financing young men and women to attend Boy's and Girl's State. Obviously, the fore- going endeavors are.costly, and have resulted in our hosting frequent Turkey-Shoots, field days, and carnivals in the recent past. The foregoing measures have assisted considerably, but many many of our members are either aged or infirm, and their sole occasion to visit the post is Sunday mornings when they may obtain rides from fellow- members or friends. Responding to this call, we are resuming Sunday morning breakfasts, with service from 9:00 to 12:00, commencing the first Sunday in April. Food service, and, if approved, alcohol service, will be limited to members and their guests, parenthetically, it is difficult to adequately explain the tradition which historically (and currently, where legal) exists among the several service clubs relative to Sunday Brunch, but it has long served the clubs and posts an opportunity to exchange tales - lies if you will - as our older, infirm members reminisce about "The Big One" and "WW TWO." But, it is a hallmark of veteran's organizations. Members, unreceptive to a "lay,, breakfast when other service clubs outside sanford City ordinances, are reluctant to attend our gatherings, and their financial support is dearly required if we are to continue our current obligated community endeavors and, indeed, expand, as we wish to do. In the immediate future, post 53 is hosting all community veteran's club participants in Memorial and Independence Day celebrations, and other material events are in the offing. Needless to say, proceeds from Sunday morning gatherings, anticipated as substantial, would contribute significantly towards furtherance of community services as identified herein, and such other programs as we are able to participat',sin. your thorough, thoughtful consideration of the proposal set forth in this letter would be most appreciated. Commissioner Keith moved to adopt threshold building requirements recommended by the City Manager in a memo dated March 12, 1984, as follows: a) No permit until the plans and the design are certified by the architect and engineers as to complying with all current applicable codes in the City of Sanford and the State of Florida. This should be a certification form provided by the City that requires the architect-of-record.and the enginner-of-record to physically sign the certificate and the signature be notorized. The certificate must contain an accurate description of the project and specify the plan to which this certificate must be affixed. A City of Sanford requirement that the certified inspeCtor-of-record must be on the project site at all times that any building construction work takes place and said inspector must view all phases of the building construction. b) 231 City Commission, Sanford, Florida March 26 at 7:00 P. After being read by title, the Chairman announced that the MINUTES ·- · City Commission, Sanford, Florida March 26 at 7:00 P. M. 1984 233 Commissioner Keith moved on the passage and adoption of Ordinance No. 1687. Seconded by Commissioner Farr and carried. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1687, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 28 OF THE SANFORD CITY CODE CONCERNING WATER AND SEWER SERVICE CHARGES TO ELIMINATE SECTIONS 28-33, 28-43, 28-44, 28-45, 28-46 AND 28-47 AND ORDINANCE 1664, AND TO PROVIDE A NEW SECTION 28-43 REGARDING CONNECTION FEES; NEW SECTION 28-45 PROVIDING FOR ADDITIONAL CHARGES WHEN USE OF PROPERTY CHANGES; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. On motion of Commissioner Yancey, seconded by Commissioner Smith and carried, Minutes of March 12 and 23, 1984 were approved. The City Manager reported that the Dollar Store building on First Street encroaches on city sidewalk right-of-way up to six inches in sections; sale of the building is pending on an agreement from the City to allow this encroachment, further, that the City Attorney has approved the form of the proposed agreement. On recommendation of the City Manager, Commissioner Smith moved to authorize the Mayor and the City Clerk to execute said agreement. Seconded by Commissioner Yancey and carried. The City Manager reported that the City had previously agreed to pay for the dredging work at the Marina by waiving up to $10,000.00 per year of the franchise fee with the stipulation that the Marina lessee/operator use the $10,000.00 for repayment of the loan for same. On recommendation of the City Manager, Commissioner Keith moved to authorize the City to pay up to $117,200.00 upon completion and release of liens of the dredging, from the general government budget uncommitted excess funds, and for the Marina operator to finance any remaining improvements without municipal involvement. On recommendation of the City Manager, Commissioner Yancey moved to authorize salary reclassification of Milton Smith, Jr., from Maintenance Worker I D to E, $12,185.32 annual. Seconded by Commissioner Farr and carried. On recommendation of the City Manager, Commissioner Yancey moved to adopt a non- discrimination policy as follows: POLICY MANUAL S~Ject, Nondiscrimination on the Basis of Race, Color, National Origin, Sex, Age, Religion, or Handicap. Policy: The City of Sanford, Florida recognizes that no person in the United States shall, on the ground of race, color, national origin, sex, age, handicapped status or religion, be e~luded from participation in, be denied the benefits of, or be subjected to discrimination in employment or promotion, or under any program or activity of this unit of.local government, funded in whole or in part by Federal Revenue Sharing funds and all State and-Local funds. Regarding 'nondiscrimination policy, thee City Of Sanford Personnel Officer shall be the contact person to coordinate efforts to comply with these regulations. Seconded by Commissioner Farr and carried. The City Manager reported John Dickey has requested to table the second reading and adoption of Ordinance No. 1686, pending the sale of the property, and the Commission noted that a public hearing for the second reading and adoption of the ordinance was advertised to be held on April 9, 1984. The City Manager reported that Robert G. Feather, who purchased property in the City Commission, Sanford, Florida March 26 at 7:00 P. M. 235 1984 due March 1, 1984. Letter dated March 26, 1984 submitted from Mr. Feather stating that "The City will be receiving the $10,000.00 shortly." Commissioner Keith moved to authorize the City Attorney to proceed under the provisions of the agreement between the City and Mr. Feather for the purchase of said property, and levy a lien against the property and foreclose, if necessary. Seconded by Commissioner Smith and carried. The City Mana§er reported the state has submitted to the City an easement with the corrected legal description of the Marina property. The City Manager reported a newspaper story had stated Seminole County would not apply for a sewer grant for the Midway area, because a sewer system without a water system under the same authority would not be financially feasible, and asked if the city would consider offering to relinquish to the County the furnishing of water to the Midway area if it will strengthen the County's position to finance an independent water and sewer system for that area. The Commission authorized the City Manager to discuss same with Duncan Rose, Seminole County Administrator. The City Manager reported that Monday, May 28, 1984 is Memorial Day, a City Holiday, and a Regular City Commission Meeting.. Commissioner Smith moved to hold the May 28, 1984 meeting on Tuesday, May 29, 1984 at 7:00 P. M. Seconded by Commissioner Keith and carried. The City Manager reported that the Florida Highway Patrol has notified the City that all drivers of city-owned vehicles over 80 inches in width, including mirrors, must have a chauffer's license, that the Police Chief has exempted current employees from this requirement, but that the job descriptions for several positions need to be changed to require a chauffeur's license as a job qualification at the time of employment. On recommendation of the City Manager, Commissioner Farr moved to authorize payment of the City Attorney's statement in amount of $2,390.00 for extra legal work in February, 1984. Seconded by Commissioner Yancey and carried. The City Manager reported Mr. Chuck E. Guess has requested to make payment in lieu of open space for a one acre tract on which he plans to develop fOur duplex units. On recommendation of the City Manager, Commissioner Smith moved to accept payment in amount of $1,320.00 for same. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, Commissioner Farr moved to authorize transfer in amount of $44,850.00 from general government excess funds for erosion control material costs for the Marina Beach. M. 19 84 The Commission discussed requiring City of Sanford contract water users receivin§ water under the Lake Mary, Midway-Canaan Water Association or Indian Mound Water Association to pay the City's normal connection fee for each new hook-up. On motion of Commissioner Farr, seconded by Commissioner Smith and carried, Resolution No.. 1369 was read in full and adopted. Said resolution being in words and figures as follows: RESOLUTION NO. 136. 9 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, EXPRESSING'ITS APPRECIATION TO AND COMMENDING PATRICIA STENSTROM FOR HER SPIRIT OF COOPERATION AND CIVIC MINDEDNESS DURING AN EMERGENCY. W~REAS, the Department of Environmental Regulation of the State of Florida determined that Ethylene Dibromide (EDB) in water in quantities in excess of 0.1 parts per billion (PPB) was an unacceptable level, and WHEREAS, testing of the City's water supply disclosed :concentrations of EDB in excess of accepted levels, and WHEREAS, the capacity of the City to furnish sufficient quantities of water .to its citizens had been thereby diminished and the City determined that a state of emergency existed, an~ '° WHEREAS, the City desired to ob'tain an emergency supply of water until corrective measures could be taken, and WHEREAS, PATRICIA STENSTROM owned a twelve inch irrigation well located in the vicinity of the City's main water plant, and WHEREAS, PATRICIA STENSTROM in a spirit of 6ooperation and civic minded~ess volunteered t° permit the City to utilize her well to provide an emergency Supply of water without cost to the City, and WHEREAS, the selfless action on the part of PATRICIA STENSTROM insured an adequate supply of water to the approximate 30,000 users of the City's water system during the emergency and at'the same time saved the expenditure of additional~public funds, j NOW, THEREFORE,.BE IT RESOLVED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION I: That the City of Sanford, Florida, appreciates and commends PATRICIA STENSTROM for her spirit of cooperation and civic mindedngss during the emergency described above.
