M. 19 84 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on APril 9, 1984. Knowles The meeting was called to order by the Chairman. A public hearing was held in accordance with notice published in the Evening Herald on March 6 and 16, 1984, as follows: NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on April 9, 1984, to consider changes and amendments to the Zoning Ordinance, and amending the Future Land Use Element of the Comprehensive Plan of the City of Sanford, Florida, as follows: A portion of that certain property lying between East 24th Place and East 25th Street (East S.R. 46) and between Grandview Avenue and Poinsetta Avenue is proposed to be rezoned from SR-1 (Single-Family Residential Dwelling) District to RMOI (Multiple-Family Residential, Office and Institutional) District. Said property being more particularly described as follows: Lot 20, Gardenia, Plat Book 5, Page 77, Public Records of Seminole County, Florida. Tamm, Jr. City Clerk Publish: March 6 and 16, 1984. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. The City Clerk reported that notice was sent to the owner, Ione Maybarduk, on March 21, 1984 and the property posted on February 29, 1984. John Butner, Stenstrom Realty, appeared and reported he represents the owner, and they plan to construct two quadraplex units on the four lots directly South of the lot requested to be rezoned, they need the lot rezoned to provide the proper set backs, and probably will not need it for a building. David Stump, Winsong Development Corporation of Central Florida, appeared and reported that developing the lots with two quadraplex units will generate less water run-off than if they are developed with single family houses, and that the development will generate tax monies. Joseph LeBlanc, 2439 Poinsetta Avenue, Sanford, Florida, appeared to support the proposed rezoning. 2'40 MINUTES City Commission, Sanford, Florida April 9 at 7:00 P. M. 19 84 James Knight, 2437 Poinsetta Avenue, Sanford, Florida, appeared and reported he owns Lots 38/44 and 62/68, Gardenia Subdivision, and that the area has flooded during heavy rains and he opposes the proposed rezoning. Commissioner Smith moved to deny the rezoning. Seconded by Commissioner Keith and carried over the dissenting vote of Commissioner Farr. Requests submitted from the American Legion to waive occupational license fees for a Turkey Shoot on April 21, 1984 and for a Carnival April 2 through 7, 1984. April 3, 1984 submitted from the City Manager, as follows: Memo dated April 3, 1984 MEMORANDUM To: From: Sanford City Commission City Manager Re: American Legion , license for carnival The American Legion is now requesting a waiver of a license fee ($625.00) for the second time in three weeks. This is for a second carnival to use their property from April 2nd through 8th, 1984. With the timing of this, I became concerned and requested a meeting with Commander Roberts and requested he produce the agreement for the land use. It turned out these carnivals are not sponsored by the American Legion but the Legion is approached by the carnival to use the Legion land. The carnival agrees to pay for the use of the land by a percentage with a guarantee ($1,000.- on this current one; providing the Legion obtains the license; supplies the water and electricity.). The Legion utilizes its' own money for the license and waivering the fee does not increase the Legion's funds or share from the carnival. It was Legion funds to begin with. In talking with them, I learned their concern is to raise funds to pay old debts and operating expenses. After which;they will be fiscally able to participate in community service efforts. I have never known the City to be asked to waiver fees for organization's operational costs as those are the responsibility of the organization members. ' The City has always been receptive to assist and to waiver fees when funds are to be used for community service or charitable work. I informed the Commander of this and suggested he was putting the Legion in a position of paying the license fee and the Legion not getting it back;' that many organizations would like the taxpayers to subsidize the association's organizational expenses but that was [' not what municipal funds are for. I told him that this carnival method does nothing but take money out of any community and certainly is not the best fund raising method to use if they were truly interested in their community. The local American Legion Post requests the City Commission waiver this second license fee in the amount of $625.00 and to return this to the Legion. I recommend it be approved; as the final, such action this year for the American Legion. The benefit of doubt would indicate they 'stepped into this situation because they did not realize what they were doing and they sincerely wanted to straighten out the Legion's fiscal difficulties and get the organization operations into the black. fha City Manacer. I'm interested in pursuing plans concerning the construction on your land of a multi-story office building. It's my belief that the future of Sanford has so many positive possibilities. A new and modern office structure with an adjoining parking ramp could well portray a strong and positive surge of forward move- ment. Commissioner Yancey moved to appoint the City Manager to discuss same with Mr. Doelle and report to the City Commission. Seconded by Commissioner Smith and carried over dissenting votes of Mayor Moore and Commissioner Keith. M.19 84 The City Manager'reported that the contractor has completed the dredging work in the Marina East basin. On recommendation of the City Manager, Commissioner Smith moved to authorize payment of same in amount of $67,200.00 from General Government Excess Funds. Seconded by Commissioner Yancey and carried. The City Manager reported that Russ Harper, owner of the Pinecrest Shopping Center, requested the status of the notices served on Kondracki for junk yard violations. Commissioner Keith moved to refer same to the Code Enforcement Board. Seconded by Commissioner Smith and carried. Letter of commendation submitted from Elizabeth Faust, for actions taken by Police Officer Aaron Keith on March 15, 1984. The City Manager reported the deed from Welaka Group, Inc., to the City for the East 14.6 feet of Lot 7, Block 2, Tier 5, E. R. Trafford's Map of the Town of Sanford, has been executed and the deed from the City to Welaka Group, Inc., for the West 14.6 feet of Lot 7,. Block 2, Tier 5, E. R. Trafford's Map of the Town of Sanford is ready to be executed. commissioner Farr moved to authorize the Mayor and City Clerk to execute said deed. Seconded by Commissioner Smith and carried. Commissioner Smith moved to authorize transfer in amount of $755.00 from Contingency to the Building Division for certified postage for notices for the Hidden Lake rezoning. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, Commissioner Yancey moved to authorize salary reclassifications as follows: Roger Menefee, Public Works Department, Refuse Division, from Refuse Collector C to D, $12,125.94 annual.
