A public hearing was held in accordance with notice published in the Evening Herald on April 24 and May 4, 1984, as follows: NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY OF SANFORD, FLORIDA. The City Clerk reported that notice was sent to the property owners on April 13, 1984 and the property was posted on April 19, 1984. On recommendation of the Planning and Zoning Commission, Commissioner Smith moved to authorize the City Attorney to prepare the proper ordinance to rezone the property to Modified PUD. M. on May 14, 1984, to consider an Appeal of the approval by the Planning and Zoning Commission, of a Conditional Use for an Auto Parts and Salvage Yard, on a portion of the property lying south of Albright Road and abutting the west right-of-way line of Airport Boulevard, more particularly described as follows: Block A, AFG Vegetable Tract, (less Road and Railroad), Plat book 7, page 14, Public Records of Seminole County, Florida. The City Clerk reported that notice was sent to the property owners on April 24, 1984. Those appearing in opposition were as follows: William Leffler, Attorney, appeared and reported he represents J. W. Alford, Seminole Petroleum Company, that Ordinance No. 1682 is not in the best interests of the City of Sanford, it is inconsistent with the Master Plan as it has been applied, it grossly diminishes the property values of the property near it, the salvage yard is a blight, Ordinance No. 1682 was an amendment to the Zoning Ordinance because it applied to this specific site and therefore was a zoning change for this piece of property, and the neighbors had a right to know about it. Mike Gray, Attorney for David Redwine, stated that any testimony as to the enactment of Ordinance No. 1682 was not timely and that the only consideration should be to the conditional use. Eula D. Martin, 101 Academy Avenue, appeared and reported she lives directly across the street from the subject property and does not want a salvage yard there. Further, that she had not received notice of the public hearings. The Mayor reported one of the conditions of the conditional use was an aesthetic and appealing site proof fence around the property, and the salvage yard operation will not be visible driving on Airport Boulevard or from across the street. Velveen Hollie, 116 Bethune Circle, appeared and reported she lives across the street from the subject property and that the use as a salvage yard will attract rats. Carolyn Johnson, 127 Academy Avenue, appeared and reported that people dump unwanted articles in their area and she doesn't want the salvage yard in their area. Those appearing in support of the conditional use were as follows: Mike Gray, Attorney with the firm of Cleveland, Bridges and Gray, appeared and reported he represents DaVid Redwine, owner of the subject property. He summarized the numerous times he and/or his client have appeared before the Planning and Zoning Commission and the City Commission, reported they had requested to talk to the Academy Manor Homeowner's Association but were turned down. Further, that the autos stored outside will be neat and orderly and on a prepared surface, carcasses must be removed at least every 90 days, and spare parts will be stored inside. David Redwine appeared and showed slides of a salvage yard operation similar to what he proposes, showed a drawing of his proposed stucco building and stucco and stockade fence, which he reported will be a minimum of seven feet high, and might be as high as eight feet, along Airport Boulevard and around the corner, and the rest of the fence will be regular stockade. Further, the hours of operation would be 8:00 A. M. to 5:30 ?o M., there would be no loud equipment other than a forklift, and the operation will not Pollute the air. Carolyn Johnson appeared and asked what guaranty do they have that the property will be kept up to comply with codes and special conditions. The Mayor reported the Code Enforcement Board would enforce the codes and special conditions. Alfred DeLattibeaudiere, 807½ Sanford Avenue: appeared and asked if the City Code permits seven foot high fences. 'Further, that he has a vested interest in 80 acres of property near the subject property, and opposes a junk yard there. Doris Thomas, 129 Bethune Circle, appeared and reported she had not received notice of the public hearings, but her two neighbors did. After discussion, Commissioner Smith moved to table consideration of the Appeal of the Conditional Use until it can be determined that proper notices were provided° Seconded by Commissioner Yancey and carried. Tatum, Jr. ~ City Clerk The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the Appeal of the Denial of the Conditional Use. The City Clerk reported that notice was sent to property owners on April 24, 1984. Dennis Shipp appeared and reported he represents James J. Mullins, the owner, and that since all the lots do not have public access, they do not deem it economically feasible to build single-family residences on the lots, and they will install private driveways to the landlocked properties. Those appearing in opposition were as follows: Ronald Brooks, 1000 Douglas Avenue, Altamonte Springs, appeared and reported that Bammack, Inc. owns the lots abutting the subject property, the subject property is low, and asked how the developers plan to drain the property. Dennis Shipp reported they plan to carry the water to the' road ditch. John McMakin, 601 Mattie Street, appeared and reported they had selected their property because it was single-family, and multi-family would lower the price of their property. Robert Brown, 507 Mattie Street, appeared and reported his property is directly across the street from the subject property, and he is not in favor of a change from single- family. Richard Oulette, 705 Mattie Street, appeared and reported that rental units are a business, and that they have low water pressure there now. Anthony Panzino, 706 East Mattie Street, appeared and reported he has added to and improved his house, and plans to stay there. James W. Dunlap, 605 Mattie Street, appeared to oppose the conditional use. Grady Pickel appeared and reported his property is across the street from the subject property, and he opposes the conditional use. Cheryl Shaver, 703 East Mattie Street, appeared and reported she doesn't want rental units there, and doesn't feel it would help the neighborhood. Commissioner Keith moved to deny the conditional use. Seconded by Commissioner Yancey and carried. The City Manager reported that the property owner has satisfactorily worked out with the power company a relocation of the existing power line. Mr. Donald Jones, seat expires July 1, 1984. He is appointed by the City Commission every two years. Mr. Jones has stated that if reappointed he will serve on the Civil Service Board. Mr. Bill McQuatters seat expires July 1, 1984. His seat is appointed by the Civil Service Board members every year. Mr McQuatters has stated that if reappointed he would serve on the Board. Dr. Luis Perez's seat expires July 1, 1984. His seat is appointed by the employee election process every two years. Dr. Perez has stated that if reappointed he would serve on the Civil Service Board. After being read by title, the Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed adoption of the Ordinance. M. 1984 269 MEMORANDUM DATE: TO: FROM: SUBJECT: April 25, 1984 City Manager Licensing Official & Building Official Box-Car Bar-B-Que On April 25, 1984 we inspected a mobile trailer concession with Sheriff Polk. The trailer meets necessary codes for the Building Dept. requirements and has been inspected and approved by the County Health Dept. The concession consisted of a trailer completely equipped as a kitchen, including barbeque grill,'commercial appliances and sinks with running water supplied by tanks located within the trailer. There are no rest room facilities. Sheriff Polk states the concession wishes to be located on one location permanently. He states the concession would be located on property where the property o~vner would allow the use of restrooms to owner or employee of concession and the public. He was informed that adequate off-street parking requirements must be met and our inspection department furnished with information on the type of facilities for electrical hookup. Our present licensing schedule does not address a classification to cover such a use. Peddler, Restaurant and Service From a Vehicle are all inappropriate. The Licensing Dept. would like to request a new classification, set of standards, and license fee for this use from the City Commission, and that any use of the concession stand before this decision is reached be on a temporary condition, pending approval by the City Commission.
