The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the CitY of Sanford, Florida, at 7:00 o'clock P. M. on August 13, 1984.

The meeting was called to order by the Chairman.

Florida, will consider and determine whether or not the City will
close, vacate and abandon any right of the City and the public in
and to that certain easement lying West of Airport Boulevard and
between West 25th Street and Country Club Road, further described
as follows:
The West 10 feet and the North 10 feet of the West 90
feet of the following: Begin 6½ chains East of the
Southwest corner of Section 35, Township 19 South,

Request submitted from Keith Abney for an Open-Air Restaurant, the Rib Runner II,
at 818 French Avenue. Commissoner Farr moved to deny the request on the basis that the
site is not large enough for the proposed restaurant in addition to the current uses.
Seconded by Commissioner Yancey and carried over dissenting vote of Mayor Moore.
Requests for annexation submitted as follows:
(a). For a portion of the property lying South of and abutting West 25th Street
and West of and abutting Old Lake Mary Road. Harry Lee, Jr., Trustee, owner.
Said property being further described as follows:
Begin 14.86 Chains East of the Northwest corner of Section 2,
Township 20 South, Range 30 East, thence run East 4.96 Chains,
South 3.28 Chains, West 4.96 Chaihs, North 3.28 Chains (less
the North 40 feet for road), Public Records of Seminole
County, Florida.
(b). For a portion of the property lying North of and abutting West 27th Street

The City Clerk reported that the Petition in Item (a) has been certified by the
Seminole County Property Appraiser. On recommendation of the City Manager, Commissioner
Farr moved to authorize the City Attorney to prepare the proper ordinance to annex same.
Seconded by Commissioner Yancey and carried.
On recommendation of the City Manager, Commissioner Farr moved to deny the request
for annexation in Item (b). Seconded by Commissioner Yancey. Motion failed to carry over
dissenting votes of Mayor Moore and Commissioner Smith.
Commissioner Farr moved to table same. Seconded by Commissioner Smith and
carried.
Request submitted from Huey P. McFarland to close, vacate and abandon an alley
between Magnolia Avenue and Park Avenue and between 25th Place and 26th Street.
Commissioner Yancey moved to authorize a public hearing to be held August 27, 1984 to
consider same, and proper notice. Seconded by Commissioner Smith and carried.
On motion of Commissioner Farr, seconded by Commissioner Yancey and carried,
Resolution No. 1374 was read in full and adopted. Said Resolution.being in words and
figures as follows:

A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
ESTABLISHING A PROCEDURE FOR THE INVES~/qENT '
OF SURPLUS PUBLIC FUNDS PURSUANT TO §166.261
FLORIDA STATUTES.
WHEREAS, §166.261 F. S. authorizes the governing body of each
municipality to adopt a Resolution establishing procedures for the
investment and reinvestment of surplus public funds; and
WHEREAS, the City Ccranission of the City of Sanford, Florida,
desires to adopt a procedure for the investment of such funds.
NOW, THEREFORE, BY IT RESOLVED BY THE P~OPLE OF THE CITY OF

S~CTION 1: Tbs Finance Director of the City of Sanford,
Florida, or the Acting Finance Director, is hereby authorized and directed
to invest and reinvest any surplus public funds of the City of Sanford,
Florida, in obligations as follows:
(a) The Local Government Surplus Funds Trust Fund;
(b) Negotiable direct obligations of, or
obligations the principal and interest of which are unconditionally
guaranteed by, the United States Governmant at the then prevailing market
price for such securities;
(c) Interest-bearing time deposits, money market,
or savings accounts in banks organized under the laws of this state,
in national banks organized under the laws of the United States, in
savings and loan associations which are under state supervision, or in
federal savings and loan associations organized under federal law and
federal supervision, provided that each such firm shall be doing business
and situated in the City, and further provided that any such deposits
are secured by collateral as may be prescribed by law.
(a) All securities Shall be properly recorded on

the City books.
(b) The City may also receive bank trust receipts
in return for investment of surplus funds in securities. Any trust
receipts received must enumerate the various securities held, togett~r
with the specific number of each security held. The actual securities
on which the trust receipts are issued may be held by any bank depository
chartered by the United States Government or the State of Florida or their
designated agents.
SS~TION 3: When the money invested in such securities is
needed in whole or in part for the purposes originally intended, the
Finance Director is authorized to sell such security or securities at the
then prevailing market price and to pay the proceeds of such sale into the
proper account or fund of the municipality.
SECTION 4: For t_he purposes of this program, the term
"surplus funds" is defined as funds in any general or special account or fund
of the City, held or controlled by the governing body of the City, which
funds in reasonable contemplation will not be needed for the purposes
intended within a reasonable time fr~n the date of such investment.
S~CTION 5: Any surplus public funds subject to any contract
or agreement on the date of this enactment shall not be invested contrary
to said contract or agreemmnt.
SECTION 6: The provisions of this resolution are supplemental
to any and all other laws relating to the legal investments of the City.

SSETION 7: The objective of the City shall be to maximize
the earnings on the surplus funds while maintaining the prudent protection
of the necessary capital to fulfill the obligations of the City.
SECTION 8: The program of the Finance Director shall be
subject to review by the City Manager and/or the City COnlaission to assure
the funds are adequately invested to the best interest of the City of
Sanford.
SECTION 9: That this Resolution be recorded in the Official
minutes of the City of Sanford, Florida.

extension of Lake Mary Boulevard, as follows:
RESOLUTION
WHEREAS, The Greater Sanford Chamber of Commerce is dedicated to promoting good
industry for the City of Sanford and Seminole County and
WHEREAS, adequate roads and traffic ways are necessary to accomodate industry
and its related services and
WHEREAS, the extension of Lake Mary Boulevard is considered critical in the
overall traffic circulation for the Sanford Industrial Park and other new industries
in the Southeastern quadrant of Sanford and
WHEREAS, the City of Sanford and Seminole County are currently working toward the
extension of Lake Mary Boulevard and
WNEREAS, public support for a project of this nature is needed,
NOW, THEREFORE, BE IT RESOLVED BY THE GREATER SANFORD CHAMBER OF COMMERCE BOARD
OF DIRECTORS THAT IT supports and urges the con'struction of the Lake Mary Boulevard
extension, posthaste.

Request submitted from John P. Belperche and Wilfred B. Turnbull, Townhouses at
Hidden Lake, Inc., developers of 36 dwelling units, apartments, on Hidden Lake, to pay
$5,400.00 in lieu of donating open space. On recommendation of the City Manager,
Commissioner Smith moved to authorize same. Seconded by Commissioner Yancey and carried.
On recommendation of the City Manager, Commissioner Farr moved to approve the
Florida Game and Fresh Water Fish Commission placing fish attractors at the lakefront by
the old piers. Seconded by Commissioner Yancey and carried.
Request submitted from T. Duncan Rose, III, Seminole County Administrator, for
Sanford to enter into an interlocal agreement with the County, in order for Seminole County
to qualify for a Community Development Grant Program. On recommendation of the City
Manager, Commissioner Smith moved to support the County's application. Seconded by
Commissioner Yancey and carried.
Commissioner Yancey moved to authorize Cardinal Industries to use the civic
Center, with alcoholic beverages, on September 8, 1984, after payment of the proper fee.
Seconded by Commissioner Farr and carried.
The City Manager reported on the City Hall air conditioning system, that it is
expensive to operate and does not work as it should, and submitted a memo from the Assistant
City Manager, as follows:

Attached is the final.proposal from Mr. Hayes of Hayes Engineering
and Contracting, Inc'. for the revamping of the City Hall air condi-
tioning system.
I have studied all of the proposals. I have discounted proposals
1. and 2. because they involve a large cash outlay of $78,5'67'. and there
is no need to do this if you consider proposal 3. Proposal 3. is a
simple pay back plan that works as a pay as you go system.
Proposal 3. is a no lose proposition for the City. After the initial
down payment of $19,641.75 or 25% of the total job ($78,567) , City
pays the balance of $5~,925.25 off in 27% months based only on the
electrical bill savings achieved per month. The monthly saving is
estimated at $2,142/month. If the saving is less than $2,142, then
all the City pays that month iS the amount saved. If the saving is
greater than $2,142. for the month, then we split the savings over
and above the $2,142 with Hayes Engineering & Contracting, Inc.
(75% of the excess savings plus the $2,142. to Hayes and 25% of the
excess savings to the City.) But note that no interest is charged
to the City for the outstanding balance during the 27% months.
After the 27% months have passed, no further payments are due,
irregardless of whether the payments during this 27% month period
amounted to $58,925.25 or n6t. Hayes Engineering & Contracting, Inc.
is banking on the monthly savings exceeding $2,142/month and ~aking
their profit from the excess savings.
Proposal 3. also allows the City to adjust the. payments to Hayes
Engineering and Contracting, Inc. according to the savings achieved
relative to the occupancy/sq, footage used rate of the City Hall.
This is because the energy demand will decrease when downstairs
tenants move. This savings is not related to anything Hayes
Engineering and Contracting, Inc. does to save energy.
Bottom line: The City might as well pay~Hayes Engineering & Contracting,
Inc. as Florida PoQer & Light Co. After three years we will have
recouped our investment, which was spread out at that.
($78,567 + $2,142 avg. mo..savings = 36.68 months or 3.06 yrs). After
this, all the. savings go.to the'City; approximately $~25,704/year
based on current projection's.
Recommend we negotiate a contract with Hayes Engineering & Contracting,
Inc. to:"revamp, retrofit, modify and etc. the City Hall air condi-
tioning system so that it will operate efficiently and economically
according to the Hayes Engineering an~ Contracting, Inc. findings
and recommendations, contained within their report dated July 24, 1984
and attached hereto. I further recommend that the contract be drawn
according to Proposal 3. with ~he payments for the service to be
made monthly. ; .
Further, that Hayes EnGineerinG and Contracting Inc., Orlando, have made an inspection and
submitted a proposal to correct. On recommendation of the City ManaGer, Commissioner Smith
moved to accept Proposal No. 3. Seconded by Commissioner Farr and carried.
The City Manager submitted a proposed amendment to the Subdivision Regulations to
require all residential construction to connect to the City's sewer system, as follows:
Sanita~ Sewer' System: All residential construction,
constructed under the subdivision regulations after
September 1, 1984, shall connect to the municipal public
sewer system to serve all the lots within the subdivision.
Where it is determined by the Planning and Zoning
Commission, with the advice of the City Engineer, that
a subdivision cannot be connected to the central municipal
sewer system in a feasible manner, then a developer of

Street projects under the local
option gasoline tax
Seminole County adopted a ten (10) year local option gasoline
tax to generate revenue for transportation projects. From this, the
City of Sanford has received $281,708.05 from November, 1983 through
July, 1984. This averages $31,300.89 per month.
On May 15, 1984, the Sanford City Commission approved a
recommended list of street projects from these funds. The acutal
work to be done as the funds, are available. The entire list of
projects totaled an estimated $723,733-. From this list, the City
Commission selected:

The total bids were $286,590.30. This is just over the current
fund balance.
However, by the time the work can be completed, another $93,902.67
should have been received by the City; making a fund balance of
$375,610.72. A fourth month's revenue will be on its way by the end of
November (end of work) but not received until December, 1984.

The City Manager reported on water service to Lake Mary. The Mayor reported that
on Friday, Lake Mary Mayor Sorenson had asked to meet with him and the City Attorney that
day, to discuss the water service, but the City Attorney had been unavailable on such short
notice. Further, if Lake Mary wants to negotiate, they can sign the agreement Sanford
presented, and the Commission agreed.
The Mayor reported receipt of an invitation to celebrate the 90th b~rthday of E.
B. Stowe. Commissioner Smith moved to authorize the City Attorney to prepare a resolution
commending Mr. Stowe for his community service. Seconded by Commissioner Yancey and
carried.
