091384-Special Session380 MINUTES City Commission, Sanford, Florida September 13 at 12:00 Noon 1984 The City Commission of the City of Sanford, Florida, met in Special Session in the City Manager's Conference Room in the City Hall in the City of Sanford, Florida, at 12:00 o'clock Noon on September 13, 1984. Present: Mayor-Commissioner Lee P. Moore Commissioner Milton E. Smith Commissioner Edward A. Yancey Commissioner David T. Farr Commissioner Edwin O. Keith City Attorney William L. Colbert Acting City Manager Steven D. Harriett City Clerk H. N. Tamm, Jr. Absent: City Manager W. E. Knowles The meeting was called to order by the Chairman. The Mayor announced that at the request of the Mayor of Lake Mary, the City Attorney and he had met with Mayor Sorensen and the Lake Mary City Attorney, to discuss Lake Mary's problems with the U. S. Farmer's Home Administration in seeking an additional loan in the amount of $1,400,000 to build a well field and processing facility, and to tie into the present water system. Lake Mary had obtained an original loan of $650,000 from said administration, and to obtain the additional loan, someone must guarantee it and assume the liability in case of default. No action was taken by the Commission. The Mayor announced that he had discussed with the City Attorney the apparent lack of clarity of the resident requirement in the districting court order, and expressed that if no action were taken by the Commission that the Commission may find inself in contempt of court, and if there was an error in someone qualifying, that it could be corrected before the qualifying period ends, and avoid a challenge in 1985 to the election. : The City Attorney suggested that he be authorized for action as follows: 1. Research the legal precedence and definition of legal resident/residency. 2. Research the facts. 3. If steps 1 and 2 are not conclusive, to take the facts and the law to the Federal District Judge and petition for a declaratory order to help define the requirement of resident/residency. Commissioner Smith moved to authorize the City Attorney to take the aforesaid action. Seconded by Commissioner Yancey and carried. There being no further business, the meeting was adjourned.
