The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on September 24, 1984.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notices authorized at meeting of
September 10, 1984, to consider condemnation of structures or buildings on Condemnation
Group No. 77, Reports Nos. 84-1119 through 84-1123. The Chairman announced that the
Commission would hear from property owners or representatives thereof. A review of the
reports were as follows:

Oak Avenue, Sanford, Florida, appeared and reported he represents Tucker Construction,
owners of property at 2850 Orlando Drive, Condemnation Report No. 84-1119. Further, they
will immediately take care of the grass and shrubs, have the electrical service
disconnected, and fix the loose flashing, etc. on the building. Also, 30 days will be
sufficient time to complete same.
Jerry L. Givens, owner, 1129½ West 13th Street, Condemnation Report No. 84.-1121,
appeared and reported he wants to bring the property up to code, and that 90 days will be
sufficient time for same.
After consideration, Commissioner Ygncey moved that finding the buildings under
condemnation Reports Numbers 84-1119 through 84-1123 'to be unsanitary, unsafe and
delapidated, that said structures be condemned and the owners given 90 days in which to
repair or demolish said structures; and if the structures are not repaired or demolished
within 90 days, to authorize the City to demolish same and levy a lien against the property.
Seconded by Commissioner Smith and carried.
Mrs. William Painter appeared and reported the Local Quilters organization had
rented the Civic Center Auditorium for $1,123.50, for the Central Florida Quilters Guild
meeting to be held on October 3 through 7, 1984, and thought they were renting the Civic
Center including the Annex for that amount. They have now been informed that the Annex will
be an additional $519.75, which they cannot afford because their admission fee has already

moved to lease the Civic Center and Annex to the Central Florida Quilters Guild for
$1,281.52, since the customer did not understand what they were getting, and transfer from
City Commission funds the difference of $361.73 to Civic Center Rent. Seconded by
Commissioner Yancey and carried.
A public hearing was held in accordance with Notice published in the Evening
Herald on September 4 and 14, 1984, as follows:

Notice is hereby given that a Public Hearing will be held at the
Commission ~Room in the City Hall in the City of Sanford, Florida,

and amendments to the Zoning Ordinance, and amending the Future
Land Use Element of the Comprehensive Plan of'the City of
Sanford, Florida, as follows:
A portion of that certain property lying North of and
abutting Krider Road and between McVay Drive extended
Northerly and Sanora Boulevard is proposed to be
rezoned from SR-1AA (Single-Family Residential)
District to MR-2 (Multiple-Family Residential Dwelling)
District. Said property being more particularly
described as follows:

On recommendation of the Planning and Zoning Commission, Commissioner Yancey moved

it necessary, expedient, and for the best interest of said City that
any unexpended cash surplus as of Sept~nxber 30, 1984, of the operating
revenues of said City for the fiscal year 1983-1984 be appropriated for the
ordinary purposes and operating expenses of said City in the budget for the
fiscal year 1984-1985.
NOW, ~RE, BE IT RESOLVED BY TH~ CITY ~SSION OF THE
CITY OF SANFORD, FLORIDA, t_hat any unexpended cash surplus as of September 30,
1984, of operating revenues of said City for the fiscal year 1983-1984 be
and the same is hereby appropriated to the DeparUr~nt of General Government

DETERMINING THE AMOUNT AND FIXING THE RATE OF
TAXATION AND MAKING THE ANNUAL TAX LEVY FOR
THE FISCAL YEAR 1984-1985 FOR THE' CITY OF
WHEREAS, the City Ca'mission of the City of Sanford, Florida,
has determined a budget for the operation of the municipal g~ve~t of the
City for the fiscal year 1984-1985; and
WHEREAS, the City Ccnmission of the City of Sanford, Florida, has
determined that a tax levy on all taxable real and personal property of
3.4466 mills should be levied by the City of Sanford, Florida, for the fiscal
year 1984-1985, from which levy the total sum of $1,110,900.00 is estimated

1. That the amount determined necessary to be raised by taxation
in the City of Sanford, Florida, for the year 1984-1985 for the ordinary

2. That the millage for the year 1984-1985 to be assessed upon
each dollar of the assessed valuation of all the taxable property, except
hamesteads to the extent that the laws of the State of Florida provide for
various hc~estead exemptions, within the corporate limits of the City of
Sanford, Florida, is hereby fixed at 3.4466 mills, to be allocated as follc~s:

David Brent Carli, 402 Terrace Court, Sanford, Florida, appeared and reported
there is already light industrial use in the area of Silver Lake and Airport Boulevard, and
he thinks the City should consider how the area will be developed, and further, a lot of
people would like the area to remain residential.
Commissioner Farr moved on the passage and adoption of Ordinance No. 1720.
Seconded by Commissioner Smith. Motion failed to carry over dissenting votes of
Commissioner Keith and Commissioner Yancey.
Dwight Black appeared a reported he owns six acres of property at the Northeast
corner of Pineway and Mellonville Avenue, which he bought for his daughter, Susie Chunat,
and her husband. Further, that he is there to support a request from his daughter to put a
mobile home on the property, due to industrial park development proposed by Mr. William
Hutchison, Attorney, and Mr. and. Mrs.. Smith.
The Commission noted that the ordinance rezoning Mr. Hutchison's adjacent property
to industrial, which had prompted this request, had not passed on second reading. Mr. Black
acknowledged same and withdrew his request for a mobile home.
Petition for Annexation submitted from James E. Lee and David E. Lee, for a
portion of the property lying between West 28th Street and East 28th Place extended Westerly
and between Oak Avenue extended Southerly and Park Avenue, further described as follows:
Lots 1, 2, 3 and 4, 1st Addition to Parkview, Plat Book 3, Page 96,
Public Records of Seminole County, Florida.
The Acting City Manager reported that City Staff had just received a copy of the plans for
the property, and had not had time to review them and make a recommendation. Commissioner
Smith moved to table same. Seconded by Commissioner Yancey and carried.
On motion of Commissioner Farr, seconded by Commissioner Smith and carried,

The Acting City Manager reported that Seminole County is increasing landfill
disposal rates from $9.75 per ton to $18.00 per ton at the transfer station, and from $7.75
per ton to $15.00 per ton for direct disposal at Osceola, effective December 1, 1984.
Further, the City will need to increase residential collection fees from $8.50 per month to
$9.66 per month and increase commercial collection fees 13.6412% to cover the increased

The Acting City Manager reported that the Florida League of Cities is working to
sponsor legislation to allow cities the option to withdraw from the Florida Retirement
System, and reconunended adoption of a resolution supporting same. Commissioner Farr moved
to adopt Resolution No. 1383. Seconded by Commissioner Smith and carried. Said resolution
being in words and figures as follows:

A RESOLUTION OF THE CITY OF SAN-FORD REQUESTING
THAT TIIE 1985 SESSION OF THE FLORIDA LEGISLATURE ENACT LEGIS-
LATION WHICH WOULD ~I.LOW MUNICIPALITIES TO WITHDRAW FROM THE
FLORIDA RETIREMENT SYSTEM.
WHEREAS, the Florida Legislature in 1970 adopted legislation
which allowed municipalities of the State to join the Florida Retirement
System; and
WHEREAS, at the time ween many systems entered the Florida Retire-
ment System, the cities' contributions were 4% of the employee's salary and
the employee was required to contribute 4%; ~nd
WHEREAS, the Florida Legislature made said Florida Retirement System
noncontributory for city employees without the consent of member cities, and;
WHEREAS, as effective October l, 1984, all cities will be required to
contribute 12.24% of gross salary for regular employees and 14.67% for special
risk employees; and
WHEREAS, the city governing bodies have no control over additional
~increases and benefits and additional contributions; and "
WHEREAS, said increases and benefits and contributions may result in
additional tax burden on the citizens of the municipality; and
WHEREAS, cities individually mayprovide benefits that are
actuarially equivalent to the Florida Retirement System at less cost; and
WHEREAS, many city employees are forced to forfeit the entire city's
contributions to the Florida Retirement System without vesting in such system;
and
WHEREAS, much of the city contributions are now being allocated to pay
for actuarial defecits and unfunded liability created prior to the cities
enrollment into the State program; and
WHEREAS, the State's own independent actuarial valuations indicate
that allowing cities to withdraw from t~e system for all future employees would
result in an insignificant effect on the remaining members of the Florida
Retirement System;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SANFORD THAT:
