The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 12, 1984.

The meeting was called to order by the Chairman.
The first item of business was presentation of service awards to employees as

A public hearing was held in accordance with Notice published in the Evening
Herald on October 23 and November 2, 1984, as follows:

AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND

Notice is hereby given that a Public Hearing will be held at
the Commission Room in the City Hall in the City of Sanford,
Florida, at 7:00 o'clock P. M. on November 12, 1984, to consider
changes and amendments to the Zoning Ordinance, and amending the
Future Land Use Element of the Comprehensive Plan of the City of
Sanford, Florida, as follows:
A portion of that certain property lying between 20th
Street and Bel-Air Boulevard and between Jefferson
Avenue and Adams Avenue is proposed to be rezoned from
SR-1A (Single-Family Residential Dwelling) District to
SR-1 (Single-Family Residential Dwelling) District.

The City Clerk reported that Notice was sent to Kenneth W. McIntosh, Trustee,
owner, on October 9, 1984 and the property was posted on October 3, 1984.
Those appearing in opposition were as follows:
Robert Thomas, 129 Bethune Circle, Sanford, Florida, appeared and reported they
are trying to upgrade the area and make it a beautiful community. Also, they want more
homes on the property proposed to be rezoned.
Carolyn Johnson, 127 Academy, Sanford, Florida, appeared and read a letter which
she reported was from residents on Academy Avenue and neighbors, that they want the property
to be used for construction of affordable homes.
Eula D. Martin, 101 Academy Avenue, Sanford, Florida, appeared and reported
they are being crowded out and want the property left for homes.

Tom Ball, 308 West 24th Street, Sanford, Florida, appeared and reported plans to
divide the property into five lots to sell to individual developers. Further, he would
provide a sight-proof fence between developments on the property and properties in Academy
Manor, and offered $1,000.00 to furnish equipment for the new park South of Academy Manor.
Ann Wallace, Realtor-Broker, appeared and reported she has not been able to
interest any residential developer in this property and there is a need in this area for
locations for small manufacturer/distributor type businesses.
On recommendation of the Planning and Zoning Commission, Commissioner Farr moved to
authorize the City Attorney to prepare the proper ordinance to rezone the property.
Seconded by Commissioner Smith and carried over dissenting votes of Commissioner Yancey and
Commissioner Keith.
The City Manager reported that on September 24, 1984 the motion to adopt Ordinance
No. 1720 failed to pass because of a tie vote, and that Attorney William Hutchison has
requested a review and discussion of same. Commissioner Smith moved to reconsider the
adoption of Ordinance No. 1720. Seconded by Commissioner Farr and carried over dissenting
votes of Commissioner Yancey and Commissioner Keith. Commissioner Farr moved to authorize a
public hearing to be held December 10, 1984, to consider the second reading and adoption of
Ordinance No. 1720, to authorize notice similar to Planning and Zoning notice to owners of
property inside and outside the City, within 200 feet of the subject property to be notified
at least 14 days prior to the public hearing, and to authorize notice of the public hearing
to be published in the Evening Herald. Seconded by Commissioner Yancey and carried.
The City Manager submitted a request from Attorney W. C. Hutchison, Jr. for the
City as Lessor, to subordinate its interests as the fee simple owner of the property at the
Marina to NCNB National Bank, as an inducement to make a loan to Seminole Isle Properties in
amount of $350,000.00 to finance further expansion. The City Manager reported this is the
same as the subordination approved on the other parcel to assist the owner to finance the
original motel. Commissioner Farr moved to authorize the Mayor and City Clerk to execute a
Subordination of Lease to Mortgage to NCNB National Bank for the Holiday Inn property.
Seconded by Commissioner Smith and carried.
Request submitted from The American Legion for exempt licenses for Turkey Shoots
November 17, 18 and 21, 1984, and for a carnival November 19 through 25, 1984, at their
property on 17-92. A representative appeared and requested the dates for the carnival be
changed to November 16 through 25, 1984. Commissioner Keith moved to authorize exempt
licenses for same, with the provision that the American Legion provide and erect "No
Parking" signs on 17-92 and have at least two police officers on duty during the carnival to
prevent parking on the shoulders and median of Highway 17-92. Seconded by Commissioner
Yancey and carried.
Letter of resignation from the Board of Adjustment submitted from Robert E. Karns.
Commissioner Keith moved to accept same with regrets and to authorize a letter to Mr. Karns,
thanking him for his service on the Board of Adjustment and on the Planning and Zoning
Commission. Seconded by Commissioner Smith and carried.

The City Manager reported that the adoption of Ordinance No. 1702 was tabled on
June 25, 1984, pending Seminole County approval of a density change for the property being
rezoned by said ordinance. Further, Seminole County has now approved the density change.

The City Manager reported that the Florida Division of American Television and
Communications Corporation, Cablevision of Central F16rida, paid the remainder of the annual
franchise fee, for a total amount of $44,053.76. Further, they request to no longer have to
provide annual financial statements as required by Franchise Ordinance No. 1510, SECTION
10., adopted on May 12, 1980. On recommendation of the City Manager, Commissioner Smith
moved to no longer require said financial statements. Seconded by Commissioner Yancey and
carried.
The City Manager reported that Conklin, Porter & Holmes-Engineers, Inc., have
contracted with Water and Air Research, Inc. for Biological and Archaeological Studies on
the City's Yankee Lake project, and as a sub-contractor, Water and Air Research, Inc. is
required to provide liability insurance in the amount of $1,000,000.00, they do not carry
professional liability insurance because the nature of their work is not engineering design
or architectural design, and the cost of such insurance would be about equal the total amount
of their contract. Further, Conklin, Porter & Holmes contract with the City covers their
sub-contractors general liability up to $2,000,000.00. On recommendation of the City
Manager, Commissioner Yancey moved to not require Water and Air Research, Inc. to provide
the liability insurance, since the City has the coverage from Conklin, Porter & Holmes-
Engineers, Inc. as required by our contract with them dated December 7, 1983. Seconded by
Commissioner Keith and carried.
On recommendation of the City Manager, Commissioner Smith moved to authorize the
City Attorney to prepare the proper ordinance to amend City Code Chapter 11, Article 1,
Section 11-12, to increase the refuse fees 15% to cover the cost of increased Seminole
County landfill fees. Seconded by Commissioner Yancey and carried.
On recommendation of the City Manager, Commissioner Smith moved to authorize
Salary Reclassifications as follows:
Billy Raines, Public Works Department, Street Division, from Maintenance
Worker I C to D, $12,031.11 annual.
Agee Campbell, Public Works Department, Street Division, from
Maintenance Worker I C to D, $12,031.11 annual.
Donald E. Major, Utility Department, Sewer Collection Division, from
Maintenance Worker I D to E, $12,794.59 annual.
Sammie L. Myles, Utility Department, Sewer Collection Division, from
Equipment Operator I D to E, $14,385.16 annual.
John Shea, Police Department, from Police Communication Operator C to D,

On recommendation of the City Manager, Commissioner Smith moved to accept low bid as
indicated. Seconded by Commissioner Yancey and carried.
The City Manager reported that bids submitted October 22, 1984, for the boiler and
folding partitions at the Civic Center were less than budgeted and recommended transfer in
amount of $5,200.00 from Account 2-01-50622-7, Building Improvements, to Contingency
Account. Commissioner Smith moved to authorize said transfer. Seconded by Commissioner
Yancey and carried.
The Commission authorized the City Manager to prepare proposed regulations for
control of TV dish antennas.
The City Manager reported the Indian Mound Water Association now has a full quota
of water connections, 56, and no more are to be added.
The City Manager submitted letters of commendation for Police Detectives Fontana
and Hasson and Officers Don Anderson and Darrell Brewer.
On motion of Commissioner Keith, seconded by Commissioner Smith and carried,

The City Manager'submitted a request to vacate West Fourth Street from Jessamine
Avenue to a point 127.5 feet East of the Easterly Right-of-Way line of Pomegranite Avenue,
which is now used as part of Starke Park. Commissioner Farr moved to authorize a public
hearing to be held December 10, 1984 to consider same. Seconded by Commissioner Keith and
carried.
The City Manager submitted a request from W. L. Kirk, Jr. to exchange Quit-Claim
Deeds for property involving the Jenkins Circle park in Pinecrest. Commissioner Farr moved
to authorize the Mayor and City Clerk to execute a Quit-Claim Deed to W. L. Kirk, Jr. and J.
Scott Kirk for the North 50 feet of the South 542 feet of the North 657 feet of the East 200
feet of the West 1155 feet of the South half of the Northeast quarter of Section 12,
Township 20 South, Range 30 East, in exchange for an executed Quit-Claim Deed from W. L.
Kirk, Jr. and J. Scott Kirk for the South 50 feet of the North 707 feet of the East 200
feet of the West 1155 feet of the South half of the Northeast quarter of Section 12,
Township 20 South, Range 30 East. Seconded by Commissioner Yancey and carried.
The Commission authorized the City Manager to advertise for applications for the
position of City Manager, and to arrange for a team of Managers from the ICMA to screen
applications for the City Manager's position.
On motion of Commissioner Farr, seconded by Commissioner Yancey and carried,
Ordinance No. 1728, entitled:

On recommendation of the CitY Manager, Commissioner Farr moved to accept low bid meeting
specifications as indicated. Seconded by Commissioner Smith and carried.
The City Manager submitted a request from Reverend Alden Reed, 1st Assembly of
God, 304 West 27th Street, for an exempt license to sell Christmas Trees to solicit
donations for the Church, December 2 through 24, 1984 in the parking lot of Fairway Market, .~
2690 Orlando Drive. Commissioner Farr moved to waive the license fee for the sale of
Christmas Trees by all non-profit, community service type, local organizations. Seconded by
Commissioner Yancey and carried.
The City Manager reported that Suda, Inc., developer of 61 units in Hazel Glen
subdivision located at the Northwest corner of the intersection of Lake Mary Boulevard and
Sir Lawrence Drive, has requested to pay money in lieu of providing open space. On
recommendation of the City Manager, Commissioner Farr moved to accept payment in amount of
$19,912.74 for same. Seconded by Commissioner Smith and carried.
