121784-Regular Session MINUTES City Commission, Sanford, Florida December 17 at 7:00 P. M. 1984 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on December 17, 1984. Present: Absent: Acting Mayor-Commissioner Edwin O. Keith Commissioner Milton E. Smith Commissioner Edward A. Yancey Commissioner David T. Farr Acting City Attorney Thomas E. Whigham City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Mayor-Commissioner Lee P. Moore City Attorney William L. Colbert The meeting was called to order by the Chairman. A public hearing was held in accordance with notice published in the Evening Herald on November 20 and 30, 1984, as follows: NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND < AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on December 17, 1984, to consider changes and amendments to the Zoning Ordinance, and amending the Future Land Use Element of the Comprehensive Plan of the City of Sanford, Florida, as follows: A portion of that certain property lying between First Street and Second Street and between Pomegranite Avenue and Jessamine Avenue is proposed to be rezoned from RMOI (Multiple-Family Residential, Office and Institutional) District to GC-2 (General Commercial) District. Said property being more particularly described as follows: That property described as the West 34 feet of North 117 feet of Block 3, Tier 19 AND all of Block 3, Tier 20, Florida Land Colonization Company Limited Map of the St. Gertrude Addition to the Town of Sanford (less roads) according to the plat thereof as recorded in Platbook 1, Page 116 of the Public Records of Seminole County, Florida. Ail parties in interest and citizens shall have an opportunity to be heard at said hearing. By order of the City Commission of the City of Sanford, Florida. ADVICE TO THE PUBLIC: If a person decides to appeal a decision made with respect to any matter considered at the above meeting or hearing, he may need a verbatim record of the proceedings, including the testimony and evidence, which record is not provided by the City of Sanford. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. The City Clerk reported that notices were sent to the owners, Mr. and Mrs. Manuel Almeida and Mr. Larry R. Teague, on November 16, 1984 and the property was posted on November 21, 1984. Larry Teague appeared to support the rezoning and reported he plans to open a travel agency on his portion of the property. On recommendation of the Planning and Zoning Commission, Commissioner Smith moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. 518 MINUTES City Commission, Sanford, Florida December 17 at 7:00 P. M. 19 84 Seconded by Commissioner Yancey and carried. The Commission next discussed regulation of TV dish antennas. Commissioner Smith moved to authorize the City Attorney to prepare the proper ordinance to adopt regulations proposed by the City Manager. Seconded by Commissioner Yancey and carried over dissenting vote of Commissioner Farr. On motion of Commissioner Farr, seconded by Commissioner Smith and carried, Minutes of December 10, 1984, were approved. On recommendation of the City Manager, Commissioner Yancey moved to accept payment in amount of $300.00 in lieu of open space, from W. T. Austin, for a duplex at 1110 West Eighth Street. Seconded by Commissioner Smith and carried. The City Manager reported that Sid Levy, owner of Flea World on 17-92, has inquired about annexation of the property in order to obtain city water and sewer service, and has asked the Commission to review the occupational license fee for flea markets, currently $150.00 base amount plus $6.00 per table, further, Mr. Levy has over 1,000 tables. Commissioner Smith moved to table discussion of the license fee until meeting of January 14, 1985. Seconded by Commissioner Farr and carried. On recommendation of the City Manager, Commissioner Yancey moved to authorize the City Attorney to prepare the proper ordinance to set an annual occupational license fee for coin operated vending machines, including copiers, pulse and blood pressure, etc., at $11.25 per machine. Seconded by Commissioner Smith and carried. The City Manager reported that Seminole County has moved up on their time schedule the extension and reconstruction of Lake Mary Boulevard between I-4 and SR 427, at an estimated cost of $1,997,000.00, and requests the City to contribute for this joint project. Further, the City had previously agreed to assist with this project, using a portion of the local option gas tax revenue. Commissioner Smith moved to authorize City Staff to meet with staffs of Seminole County and Lake Mary to come up with proposed formulas for municipal participation. Seconded by Commissioner Yancey and carried. The City Manager reported that the 201 Program, under the U. S. Environmental Protection Agency, requires a sewer use ordinance to control the strength of materials entering the sewer and to control the dumping of materials which could be hazardous to the treatment process. On motion of Commissioner Farr, seconded by Commissioner Yancey and carried, Ordinance No. 1735, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ESTABLISHING THE REQUIREMENTS AND PROCEDURES TO REGULATE THE USE OF SANITARy AND STORM SEWERS: PROVIDING FOR PROPER DISCHARGE OF WATERS AND WASTES INTO THE CITY SEWER SYSTEMS: REGULATING DISCHARGE OF CERTAIN WASTES: PROVIDING PENALTIES: PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. was introduced and placed on first reading. On recommendation of the City Manager, Commissioner Smith moved to authorize salary reclassifications as follows: ~ Steven D. Harriett, City Manager's Staff Office, from Assistant City Manager D to E, $36,356.02 annual. James E. Hansen, Public Works Department, Maintenance Division, from ' MINUTES City Commission, Sanford, Florida December 17 at 7:00 P. M. 5'19 19 84 (full/part time) Custodial Worker C to D, $7,519.40 annual. Tommie White, Public Works Department, Street Division, from Equipment Operator II C to D, $14,004.70 annual. Charles E. Miller, Public Works Department, Street Division, from Equipment Operator I D to E, $14,385.16 annual. Bertis Herring, Public Works Department, Maintenance Division, from Trades Worker E to F, $16,992.43 annual. Mark Morgan, Fire Department, from Firefighter D to E, $19,971.27 annual. Seconded by Commissioner Yancey and carried. On recommendation of the City Manager, Commissioner Smith moved to authorize payment of statement in amount of $1,981.76, from the City Attorney, for the month of November. Seconded by Commissioner Yancey and carried. Commissioner Smith moved to approve the City Manager's appointment of Curtis Moore to the local Public Employees Relations Commission to fill the unexpired term of Russell Kitner, until December, 1985. Seconded by Commissioner Yancey and carried. The City Manager reported the Indian Mound Water Association has requested to increase their allowed water connections by two new connections over their quota. Further, they will pay the required connection fees for same. Commissioner Smith moved to authorize the two additional water connections, upon payment of the proper utility connection fees. Seconded by Commissioner Yancey and carried. The City Manager reported that the federal deregulation of the American Telephone and Telegraph Company has caused cities to lose revenue on franchise fees and utility tax, which will result in other taxes having to make-up the difference and thus cause increased tax loads on local taxpayers. On recommendation of the City Manager, Commissioner Yancey moved to authorize the City Manager to draft a telegram from the City Commission to the Governor requesting support to provide inclusion of municipalities into a legislative action for the 1985 session, regarding said taxes. Seconded by Commissioner Smith and carried. The City Manager reported that the Final Plat of Sanford Commerce Park, Bob McKee's industrial tract on the East side of Airport Boulevard, is ready for approval. On recommendation of the City Manager, Commissioner Farr moved to authorize the Mayor and City Clerk to execute same. Seconded by Commissioner Smith and carried. On recommendation of the City Manager, Commissioner Smith moved to authorize a public hearing to be held February 11, 1985 to consider the Sanford Facilities Plan for the 201 Program, and authorization to advertise same. Seconded by Commissioner Yancey and carried. On motion of Commissioner Farr, seconded by Commissioner Yancey and carried, Ordinance No. 1736, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY; SAID ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT CHANGING THE ZONING OF A PORTION OF THAT CERTAIN PROPERTY LYING BETWEEN FIRST STREET AND SECOND STREET AND BETWEEN POMEGRANITE AVENUE AND JESSAMINE AVENUE FROM RMOI (MULTIPLE-FAMILY RESIDENTIAL, OFFICE AND INSTITUTIONAL) DISTRICT TO GC-2 (GENERAL COMMERCIAL) DISTRICT; PROVIDING FOR SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE. MINUTES City Commission, Sanford, Florida December 17 at 7:00 P. M. 19 84 was introduced and placed on first reading. The City Manager reported that the most recent actions on payment in lieu of open space would require the money to be produced prior to or at the time the building permit is pulled; however, the policy in the past had been that the money must be produced prior to the final Certificate of Occupancy, provided the City has a committment "up front" and in writing. The Commission affirmed that Commissioner Smith's motion was to continue under the policy of the funds to be paid prior to the final Certificate of occUpancy. Commissioner Keith reported that CALNO and Seminole County Commissioner William E. Kirchoff are requesting toll-free telephone service between Sanford and Orlando, and requested the City to support same. Commissioner Farr moved to authorize the City Attorney to prepare the proper resolution to support same. Seconded by Commissioner Smith and carried. Commissioner Keith requested Oak Avenue be closed between I3th Street and 14th Street on Wednesday and Thursday from 7:00 P. M. to 9:00 P. M., for the Central Baptist Church to present a living nativity scene, and the Commission authorized same. There being no further business, the meeting was adjourned. ATTEST: j$
