The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on January 14, 1985.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notice published in the Evening
Herald on December 24, 1984 and January 4, 1985, as follows:

AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND

Notice is hereby given that a Public Hearing will be held at

The City Clerk reported that notice was sent to Joe T. Caruso, Lake Minnie, Inc.,
owner, on December 4, 1984 and the property was posted on December 5, 1984.
John Sundheim, U.S. Home Corporation, 924 North Magnolia, appeared and reported
his company has purchased approximately 40 acres from Lake Minnie, Inc., and the Phase I
site plan for residential use has been approved. Further, commercial property 250 feet in
depth for about 700 feet along U.S. Highway 17-92 will be a buffer between U.S. Highway 17-
92 and the residential use of the rest of the property.
On recommendation of the Planning and Zoning Commission, Commissioner Smith moved
to authorize the City Attorney to prepare the proper ordinance to rezone the property.
Seconded by Commissioner Thomas and carried.
A public hearing was held in accordance with notice published in the Evening

to speak in favor of, or in opposition to, the proposed rezoning.
The City Clerk reported that notice was sent to Eugene Chorozy, Trustee, owner, on
December 12, 1984 and the property was posted on December 19, 1984.
Those appearing in support of the proposed rezoning were as follows:
Jim Branch, Conklin, Porter & Holmes, Engineers, Inc., 500 West Fulton Street,
appeared and reported plans to construct 20 Units per acre on the 12½ acres, and they have
no problem with the committments required by Seminole County.
Eugene Chorozy appeared and reported there will be a minimum of 1200 square feet
for each unit, and the final plans should be completed within 12 to 18 months.
On recommendation of the Planning and Zoning Commission, Commissioner Mercer moved
to authorize the City Attorney to prepare the proper ordinance to rezone the property.
Seconded by Commissioner Smith and carried.
The next item of business was the continuation of a public hearing, tabled
November 26, 1984 upon request of the owner, Joost P. Zyderveld, to consider rezoning a
portion of the property lying between Airport Boulevard and West 25th Street and between the
Seaboard Coastline Railroad Right-of-Way and U.S. 17-92 (Orlando Drive) from SR-2 (Mobile
Home Residential Dwelling) District and MR-1 (Multiple-Family Residential Dwelling) District
to GC-2 (General Commercial) District; and from SR-2 (Mobile Home Residential Dwelling)
District, GC-2 (General Commercial) District and MR-1 (Multiple-Family Residential Dwelling)
District to MR-2 (Multiple-Family Residential Dwelling) District.
Letter dated December 13, 1984 submitted from J. P. Zyderveld, owner of the
property, deleting a portion of the property in Tract 2.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning.
Those appearing in favor were as follows:
John Moseler, ZOM Realty, Inc., 2265 Lee Road, Winter Park, appeared and
introduced Bill Kercher, Engineer with the firm of Glatting, Sellen, Lopez and Anglin, 33
East Pine Street, Orlando.
Mr. Kercher reported they propose to develop the property with zero-lot line
homes, townhouses, and multi-family units, also shopping and business/warehouse centers.
Philip Hollis, Hollis Engineering, 114 East Concord, Orlando, appeared and
presented preliminary drawings and plans.
On recommendation of the Planning and Zoning Commission, Commissioner Smith moved
to authorize the City Attorney to prepare the proper ordinance to rezone the property, less
the requested deletion for Tract 2. Seconded by Commissioner Thomas and carried.

ORDINANCE, A PORTION OF THAT CERTAIN PROPERTY
LYING BETWEEN SILVER LAKE DRIVE AND NORTH
WAY AND BETWEEN SANFORD AVENUE AND
MELLONVILLE AVENUE; SAID PROPERTY BEING
SITUATED IN SEMINOLE COUNTY, FLORIDA,
IN ACCORDANCE WITH THE VOLUNTARY ANNEXATION
PROVISIONS OF SECTION 171.044, FLORIDA

WHEREAS, there has been filed with the City Clerk of
the City of Sanford, Florida, a petition containing the names

Florida, having certified that there is one owner in the area

effective, the property owners and any resident on the property
described herein shall be entitled to all the rights and
privileges and immunities as are from time to time granted to
residents and property owners of the City of Sanford, Florida,
as as further provided in Chapter 171, Florida Statutes,
and shall further be subject to the responsibilities of
residence or ownership as may from time to time be determined
by the governing authority of the City of Sanford, Florida, and
the provisions of said Chapter 171, Florida Statutes.
SECTION 3: If any section or portion of a section of
this ordinance proves to be invalid, unlawful, or unconstitutional,

it shall not be held to invalidate or impair the validity,
force or effect of any other section or part of this ordinance.
SECTION 4: That all ordinances or parts of ordinances
in conflict herewith, be and the same are hereby revoked.

The City Manager reported street projects numbers 3, 11, 12 and 24 have been completed, and
number 10 had been set by the Commission as the next priority, but funds were not available.

The City Manager reported Seminole County has aSked Sanford to determine the
amount of funds to be contributed to the Lake Mary Boulevard Corridor extension, and that
whatever Sanford pledges will have to be deducted from the funds available for the above
street resurfacing projects.

The City Manager submitted a copy of Ordinance No. 1706, the "Arbor Ordinance",
and reported same was tabled July 23, 1984, at the request of the Garden Club, who
originally asked for an arbor ordinance, and no further report had been received from them.

The City Manager reported on lot mowing, debris removal, etc., private property
rights, and the laws involved in same.
The City Manager submitted information on the Sunshine Law.
The City Manager reported the Scenic Improvement Board, City Code Sections 2-111
through 2-114, was created to prepare a master plan for the overall beautification of the
City, the board developed such a plan, "Sanford's Form and Appearance", and has not
functioned after presenting the plan. Further, no action has been taken to remove the
Scenic Improvement Board sections from the City Code.
Commissioner Mercer moved to disband the prior Scenic Improvement Board and re-
activate a new board by appointment of seven new members. Seconded by Commissioner Smith
and carried.
The City Manager reported that the surveying, mapping, and research of ownership,
of low lots is being started, and Staff will try to have the list completed for the February
11, 1985 meeting.
The City Manager reported on the timeframe and additional manpower needed to
conduct the inspections to make a list of all residential and non-residential structures in
violation of any building code, and also those that are in such condition as to be placed on
the condemnation list. The Commission authorized Staff to pursue same with diligence,
without additional staff personnel.
The City Manager reported he had asked Mr. Tony Shoemaker, President of the
Florida City and County Management Association, for a three-party screening committee of
experienced, professional managers to screen the applications for City Manager's position,
and he is trying to set up the screening committee meeting for January 23-24 or 30-31, 1985.
Commissioner Farr moved to appoint a five-member citizens committee to review the
applications for City Manager, after the Florida City and County Manager's Association
screening committee has recommended the top ten, and give their thoughts of those ten and
recommend the top five. Seconded by Commissioner Thomas and carried over dissenting vote of
Commissioner Smith.
The City Manager reported that City personnel are cleaning up the debris on the
McCracken Road right-of-way, and that notices have been sent to the property owners to clean
and maintain their property in the McCracken Road area.
The City Manager reported that the Department of Environmental Regulation has
relieved Sanford of doing the 201 Program work for Seminole County and the City of Lake

Mary, and further, that Seminole County and Lake Mary have been instructed to contract

The City Manager requested the Commission to consider amendments to the Sanford
City Code, as follows:
a. Prohibit parking cars on streets and/or parkways for purpose of
repairing same.
b. Prohibit driving over curbs and parking vehicles on parkways and
sideways.
c. Prohibit parking vehicles on any sidewalk.
d. Prohibit any and all types of signs within the public right-of-way.
e. Require peddlers to keep all materials on their vehicle and require
them to move to a new location at least 1,000 feet away every two
hours, and not occupy the same location in any 24 hour period.
The Commission authorized to discuss same at a Workshop Session.
The City Manager reported there is a vacancy on the Planning and Zonin~
Commission for a term to expire July 1, 1987.
Commissioner Mercer moved to appoint Eddie O. Keith to the Planning and Zoning
Commission to fill said unexpired term. Seconded by Commissioner Farr and carried.
The City Manager reported there is no City policy on continuation in the health
insurance, for elected officials who retire. On recommendation of the City Manager,
Commissioner Mercer moved that elected officials who retire under the Florida Retirement
System regulations receive the same benefits as general employees. Seconded by Commissioner
Farr and carried.
Commissioner Smith reported that he had received a complaint that someone has
illegally opened a dirt street North of 25th Street to the South end of Grandview Avenue.
The City Manager reported this is a platted, but unopened right-of-way, and the proper
action will be taken to stop it being used.
