M. 19 85 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on January 28, 1985. Present: Mayor-Commissioner Bettye D. Smith Commissioner John Y. Mercer Commissioner Milton E. Smith Commissioner David T. Farr Commissioner Bob Thomas City Attorney William L. The first item of business was presentation of Resolution No. 1390, and a wallet with a badge to Fire Chief W. C. "Sid" Gailey, retiring from the City on January 30, 1985 with 33 years and two months of service. The Commission adopted Resolution No. 1390. Addison Gary & Betty Williams After consideration, Commissioner Farr moved that finding the buildings under ~ondemnation Reports Numbers 84-1124 through 84-1130 to be unsanitary, unsafe and delapidated, that said structures be condemned and the owners given 90 days in which to repair or demolish said structures; and if the structures are not repaired or demolished within 90 days, to authorize the City to demolish same and levy a lien against the property. MEMORANDUM DATE: TO: FROM: SUBJECT: January 16, 1985 City Manager Building Official Request for Home Occupational License In reference to your memo about a home occupational license for Mr. Robert Newman, Jr., I checked the zoning for 2001 Lily Court and it is in an SR-1AA zone which does not allow home occupations. Planning and Zoning has turned the home occupational licenses over to me for approval. I cannot approve this one. I recommend he re- quest a variance from our City Commission. I will send Mr. Newman a letter explaining the problem to him and suggest how he should proceed. Also, for information, Mr. Newman would be required to be approved by the health department for his cooking facilities for his home occupation. MINUTES City Commission, Sanford, Florida January 28 at 7:00 P. M. Robert A. Newman, 2001 Kily Court, Sanford, Florida, appeared to support the request and reported he plans to purchase cleaned fish at the coast and smoke 50 to 100 mullet and perhaps some turkeYs in his back-yard smoker, and there will be no merchandise or traffic at his house. Further, his neighbors have no objections. Commissioner Mercer moved to deny the request. Seconded by Commissioner Smith and carried over dissenting vote of Commissioner Farr. follows Commissioner Smith moved to appoint members to the Scenic Improvement Board as Mrs. John Wimbish Mrs. Harry Lee Ms. Sara L. Request submitted from the East Central Florida Regional Planning Council for payment of FY 1985 dues in amount of $3,699.00. The City Manager reported that said amount had been appropriated in the 1984-85 budget. Commissioner Thomas moved to authorize payment of same. Seconded by Commissioner Farr and carried. Commissioner Smith moved to approve the revised street resurfacing program list as follows: SEE BEGIN PAGE 556 Seconded by Commissioner Farr and carried. The City Manager reported that Seminole County Staff has developed a participation formula for the Lake Mary Boulevard Corridor work based on front footage within each governmental jurisdiction, as follows: Seminole County 53.7% City of Lake 'Mary 25.7% City of Sanford 20.6% Commissioner Farr moved to authorize the City Manager to direct a letter to the Seminole County Board of County Commissioners, reaffirming the City's committment to participate in this project. Seconded by Commissioner Thomas and carried. The next item of business was discussion of a proposed Arbor Ordinance. Bruce Tipple, Geneva, Florida~ appeared and reported he does tree work and doesn't feel the ordinance is fair to homeowners. Commissioner Mercer moved to amend SECTION ONE, 4. b. 4., to read Location of all trees which are a minimum of six (6) inches in diameter.~.'.',.. Seconded by Commissioner Smith and carried over dissenting vote of Commissioner Farr. M. __19 85 the dissenting vote of Commissioner Farr, Ordinance No. 1706, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, REGULATING TREES WITHIN THE CITY LIMITS BY REQUIRING PERMITS FOR REMOVAL OF TREES, PROVIDING APPLICATION PROCEDURES, EXEMPTIONS AND EXCEPTIONS, REQUIRING THE PRESERVATION OF TREES DURING DEVELOPMENT AND CONSTRUCTION, PROVIDING REGULATIONS PERTAINING TO UTILITY COMPANIES, DEFINING REPLACEMENT STOCK, PROVIDING AN APPEALS PROCEDURE, PENALTIES, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. was introduced and placed on first readinG. Pat Sentell, 2215 Cordova Drive, Sanford, appeared and reported she is Vice- President of SISTERS, and also represents the Garden Club and the Woman's Club, and they all support the proposed ordinance. The next item of business was consideration of a tabulation of bids for a bucket truck, submitted at meeting of January 14, 1985, and consideration of the tree trimming policy. Commissioner Farr moved to continue the present policy of aiding abutting property owners with trees on the riGht-of-ways when personnel and equipment are available, and to accept low bid in amount of $31,000.00 from TECO, Inc., for a 1984 GMC demonstration unit with a 35 foot aerial lift device. Seconded by Commissioner Smith and carried. The'next item of business was discussion of traffic around flower beds in the Downtown Improvement Project. Commissioner Smith reported that five to six feet off the corners of the planters would increase the area for vehicular traffic. The City Attorney reported that the Downtown Improvement Project had been litigated in the courts, and the plans for same had been approved by the Court after the City had demonstrated that the vehicular traffic areas were sufficient for cars, trucks and even fire trucks to make the turns. The Commission declined to amend the plans. On motion of Commissioner Farr, seconded by Commissioner Smith and carried, Minutes of January 14 and 21, 1985 were approved. The City Manager submitted a proposed new water purchase contract for the City of Lake Mary, to comply with Lake Mary's request for an additional 200 connections, over the cap set by the court; stipulating the growth impact fee payment, the escrow account, and return of all escrow account funds to Lake Mary, provided Lake Mary disconnects from the 554 MINUTES City Commission, Sanford, Florida January 28 at 7:00 P. Lake Mary Mayor Dick Fess appeared and reported he is satisfied with the proposed contract, with certain stipulations, and he will take it to the Lake Mary Commission at their meeting on January 29, 1985. Commissioner Farr moved to approve the contract, and authorize the Mayor to execute same upon acceptance and approval by the City Commission of the City of Lake Mary, with a stipulation for Lake Mary to accept developers participation in paying to the City of Lake Mary fees for reserved capacity for their water plant which revenue will not be included as connection fees to the City of Sanford. Seconded by Commissioner Mercer and carried. The City Manager submitted information on the request submitted by Sid Levy, owner, for annexation of Flea World on Highway 17-92. Commissioner Smith moved to table same until February 11, 1985. Seconded by Commissioner Farr and carried. The City Manager submitted a request from Ronald T. Livsey for a water connection at Lot 24, Wolfer's Lakeview Terrace, outside the City. Ronald T. Livsey, 10860 SE 52nd Avenue, Bellevue, Florida, appeared to support the request and reported he plans to construct his home on the property. Further, he will pay all costs necessary for the connection. The City Manager reported all the homes in the area are outside the City and have City water, and are on septic tanks. Commissioner Mercer moved to approve the connection, provided Mr. Livsey pays all costs. Seconded by Commissioner Smith and carried. On recommendation of the City Manager, Commissioner Smith moved to authorize transfer in amount of $50,445.00 from general government unappropriated funds account to Operating Equipment Replacement account No. 2-01-47643-9, for the balance due on the purchase of a new excavator. Seconded by Commissioner Thomas and carried. The City Manager reported there are 97 eligible applications for the City Manager's position, however, the City and County Manager's Association screening committee has declined to screen the applications since a Citizens Review Committee has been appointed to make suggestions on the top five of the top ten to be recommended to the City Commission by said Manager's screening committee. Each commissioner appointed a member of the Citizen's Screening Committee, as follows: Commissioner Smith appointed Edwin O. Keith. Commissioner Mercer appointed Shirley Shilke. Commissioner Farr appointed Judge Joe Davi~. Commissioner Thomas appointed Lenora Mobley. Mayor Smith appointed Sara Jacobson. The Commission designated Sara Jacobson Chairman of the committee to recommend the top ten applicants. J. Q. Galloway appeared and reported he is opposed to a committee doing the work he feels should be done by the Commission. The Commission authorized to advertise the position of City Engineer, in MINUTES City Commission, Sanford, Florida January 28 at 7200 P. M. 555 1985~ accordance with Civil Service Rules and Regulations, so that the new City Manager can interview and select the City Engineer. The City Manager reported that the Civil Service Board had concluded a hearing on the appeal of Mr. Joe Dillard from his termination from the Police Department, and had voted three to one to overturn the dismissal and to reinstate Mr. Dillard to city employment in the police department. Further, the City Attorney feels the Civil Service Board erred legally when they made a decision based on the guilt or innocense of Mr. Dillard, and not on whether or not there was cause for the police chief to take disciplinary action. Therefore, there is a basis to appeal the decision to the court, and the Police Chief and the City Attorney feel it should be appealed. The City Attorney reported the Civil Service Board indicated the City followed all the rules applicable, but when they voted, they stepped outside their Rules and Regulations and tried to find Mr. Dillard guilty or not guilty. Tom Greene appeared and presented a petition which he said contained approximately 588 signatures in favor or in support of Sergeant Joe Dillard. Commissioner Thomas moved to deny the appeal of the Civil Service Board decision. Seconded by Commissioner Mercer and carried over dissenting votes of Commissioner Smith and Commissioner Farr. The City Manager reported that the development of a parking lot on the Senkarik property had been discussed with the Downtown Improvement Project. The Commission authorized to discuss same at Workshop meeting FebrUary 4, 1985. Commissioner Smith moved to authorize salary reclassification for Wallace Crumity, Utility Department, Sewer Division, from Maintenance Worker I C to D, $12,031.11 annual. Seconded by Commissioner Mercer and carried. The City Manager reported there is a Seminole County Legislative Delegation meeting February 19, 1985 at 5:00 P. M. at the County Services Building, East First Street, and asked if the Commission wanted him to plan to go to Tallahassee, to work with the Florida League of Cities on legislation for municipalities, to inform legislators of municipal interest and concerns, and to review proposed legislative drafts as to impact, costs, etc. Commissioner Mercer moved to authorize the City Manager to continue with efforts to obtain legislation to allow municipalities to opt out of the Florida Retirement System. Seconded by Commissioner Thomas and carried. The Commission authorized the City Manager to contact Seminole County to obtain permission to put in a sidewalk on west 25th Street in the area of Geneva Gardens apartments. The Commission authorized to discuss junk cars and parking on sidewalks at Workshop Session February 4, 1985. ATTEST: There being no further business, the meeting was adjourned.
