021185-Regular Session MINUTES City Commission, 559 Februar 11 at 7-00 P M 19.835_ The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. Tamm, Jr. The meeting was called to order by the Chairman. The first item of business was a presentation by Mr. Larry Strickler, Southern Telephone and Telegraph Company, of the 1985-86 telephone directories, with the front cover picture taken by City Manager W. E. Knowles. A public hearing was held in accordance with notice published in the Evening Herald on December 21 and 23, 1984, as follows: NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the City of Sanford will hold a public hearing on Monday, February 11, 1985, at 7:00 P.M. in Commission Chambers, City Hall, 300 North Park Avenue, Sanford, Florida. In accordance with the Federal Water Pollution Control Act, as amended and Chapter 17-50, Florida Administrative Code, the City of Sanford has completed wastewater planning activities. As part of these activities, the City has investigated potential wastewater management plans for Sanford and North Seminole County. This study is called the Sanford 201 Facilities Plan. The study includes an investigation of wastewater effluent disposal options other than continued discharge into Lake Monroe. The recommended effluent disposal option involves the use of rapid infiltration basins at a site located approximately 3.2 miles west of Inter- State 4 and 0.5 miles north of State Road 46. The purpose of this public hearing is to present the wastewater management alter- natives considered, reasons for selecting the recommended plan, the recommended plan, the associated environmental impact, pro- ject costs, and the estimated user charges necessary for the implementation of the plan. The hearin~ will provide interested parties an opportunity to better understand the project and grant interested citizens, environmental groups, and representatives from local and state agencies the opportunity to ask questions and express opinions regarding the alternatives studied and the recommended plan. A draft copy of the 201 Facilities Plan and other pertinent documents will be available for public review on or about the middle of January, 1985, at the Public Information Depository located adjacent to.the Utility Director's office in Sanford City Hall. This notice is given pursuant to 40 CFR 25 and Chapter 17-50 FAC. Ail interested parties are hereby notified that if a person decides to appeal any decision made by the City Commission with respect to any matter considered at such public hearing, he or she may need-to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. MINUTE S City Commission, Sanford, Florida February 11 at 7:00 P. M. 19 85 Paul E. Porter, Vice President, and Chris Ferraro and Mike Deverall of the firm of Conklin, Porter and Holmes-Engineers, Inc., appeared to submit a report entitled: Discussion Outline City of Sanford 201 Facility Plan and Site Specific Studies Public Hearing Sanford City Commission Chambers February 11, 1985 7:00 p.m. Dr. John Garlinger, Vice President and Chief Engineer of Ardaman and Associates, Orlando, appeared and reported on the soil characteristics and on an archaeological study performed for Site 1, North of Yankee Lake. Mike Deverall reported that the proposed site is considered adequate for the next 20 years, for an estimated population in 2005 of 51,000, and will handle 8.2 million gallons per day of treated effluent. Richard Hathaway, 3510 South Park Avenue, Sanford, appeared and reported he supports discharging treated effluent into Lake Monroe and/or using it to water parks and other open areas. The City Clerk reported that notice was sent to Walter N. King and Thomas L. Largen, et al, owners, on January 10, 1985 and the property was posted on January 23, 1985. Walter King, 405 East 14th Street, appeared and reported he is one of the owners of the property, and they plan to build a strip shopping center on this site. On recommendation of the Planning and Zoning Commission, Commissioner Smith moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. Seconded by Commissioner Thomas and carried. Harry Rucker appeared and reported he is Pastor of the First Shiloh Missionary Baptist Church, Inc., owner of the surrounding property, and they want the alley closed so they can construct a new building on their property. Further, they understand if they build over the easement, they will have to encase or replace the sewer line with ductile iron, and encase or re-route the water line in the easement. Commissioner Smith moved to authorize the City Attorney to prepare the proper ordinance to close the alley and retain same as a utility easement. Seconded by Commissioner Farr and carried. Petition for ~Annexation submitted from Hillard Ramsey and Thomas Ratliff, Jr., for a portion of the property lying North of and abutting Lake Mary Boulevard and between Sir Lawr'ence Drive and Art Lane, further described as follows: The East 10 Chains of Government Lot 2, Section 10, Township 20 South, Range 30 East, (Less Beginning at the Northeast corner of said Government Lot 2, run South 200 feet, thence run West 661.75 feet, thence run North to Sanford Grant Line, thence run South 65° East, to the Point of Beginning.) M.1985 Petition for Annexation submitted from Frank Brockerman, Joseph Sherer and Ingrid Peterson, for a portion of Art Lane, and a portion of the property lying at the Northwest corner of the intersection of Lake Mary Boulevard and Art Lane, further described as follows: The North 208.71 feet of the South 283.42 of the East 208.71 feet of the West 741 feet of Government Lot 3, Section 10, Township 20 South, Range 30 East, Public Records of Seminole County, Florida. MP. Willson of the health depszdmmnt advised me that the well has bacteria and showed high coloform and-that well should be uncapped and chlorinated. This is impossible as well is a~tesian. I have contacted Culligan fop wate~ tests. The notes of this meeting and a copy of their findings a~e attached. M~'. Spell ~s quite honest and told me that spending money for a wate~ softene~ and a unit to r~move sulphu~ and iron would not solve the p~obl~. I would have to have a desalination unit. This is approximately $7,000 and would include everythLng. The deta~l~ are I have dutifully t~ied to find a solution on my c~n and to no avail. My health has suffered as a result of the high salt content. The wate~ has caused f~equent d~wahea and nausea. I conside~ myself to be a healthy person. M. 19 85 January a9, 1985 ATTENTION: City Manager We, Donald and Phyllis Hupp, of 453Palm Drive, Lot #55 Wolfers Lake View Terrace, are requesting city water from Sanford because of a salt well. We relocated in Florida two months ago because of Phyllis' health, and were not informed that the existing well was salt water, which has aggravated Phyllis' condition. After investing over $2400.00 in a water treatment system, we were informed that the well contained salt water and that the new system would not help. The water is not fit for consumption and will eventually destroy the hot water tank, plumbing, and all other appliances which use water. In good faith, we are submitting a petition for an annexation to the city of Sanford,.to be considered in the future. M. 19 85 Commissioner Mercer moved to authorize the City Attorney to prepare the proper resolution to declare March, 1985 "Clean Up/Fix Up Month". Seconded by Commissioner Thomas and carried. The City Manager submitted a proposed License with Gerald Gross, for Use of air rights over City Property for that portion of Rand Mall lying North of First Street and South of the East-West alley between Park Avenue and Palmetto Avenue. On recommendation of the City Manager, Commissioner Farr moved to authorize the Mayor and City Clerk to execute said Agreement. Seconded by Commissioner Smith and carried. Bruce Tipple, Geneva, appeared and presented a petition which he said contained approximately 500 signatures of persons opposed to the ordinance. Commissioner Mercer moved on the passage and adoption of Ordinance No. 1706. Seconded by Commissioner Smith and carried over the dissenting vote of Commissioner Farr. Ordinance No. 1740, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ESTABLISHING REGULATIONS FOR THE INSTALLATION OF ALL TELEVISION DISH ANTENNAE AND/OR SATELLITE ANTENNAE IN THE CITY; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. introduced and placed on first reading at meeting of January 28, 1985, was next placed on final reading. After being read by title, the Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed adoption of Ordinance No. 1740. Sam Robard, ESSR Satellites, 2220 South French Avenue, appeared and reported he agrees that regulations are needed, but does not agree with having to hire an engineer to certify that a building can safely support the specific antenna with a minimum wind loading of 100 miles per hour. The City Manager reported that the dealer can obtain a certificate from the manufacturer's engineer, and use it for all installations of that type. Commissioner Mercer moved on the passage and adoption of Ordinance No. 1740. Seconded by Commissioner Smith and carried. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1740, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ESTABLISHING REGULATIONS FOR THE INSTALLATION OF ALL TELEVISION DISH ANTENNAE AND/OR SATELLITE ANTENNAE IN THE CITY; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. The Commission discussed phasing in the Arbor Inspector's job. The City Manager recommended to phase the job in using present personnel in the Engineering Division, and to include an additional Building Inspector/Arbor Inspector in the 1985-86 Budget. The Commission authorized to discuss same at Workshop Session to be held on February 18, 1985. On motion of Commissioner Smith, seconded by Commissioner Mercer and carried, Minutes of January 28 and February 4, 1985 were approved. Black to use the Veterans Memorial Park for an Easter Sunrise Service, erect a temporary cross in the park for one month before Easter, and to install a Resurrection Celebration '85 banner across First Street one week prior to Easter. Hulon Black, 105 Forrest Drive, Sanford, appeared to support the request and reported he would like to erect the cross three weeks prior to Easter and leave it up for one week after Easter. Further, about 25 churches support the Easter Sunrise Service and the cross in Memorial Park. Commissioner Farr moved to approve same. Seconded by Commissioner Thomas and Carried. The City Manager reported that Mr. Joe Baker is proposing to develop property South of the City Limits, on the West side of the Old Orlando Highway, the City has requested an easement across his property to relocate the sewer force main from the South Sanford lift station, and he has agreed to grant said easement, with stipulations as follows: 1. He will be assured of the right by the City to connect to City water and sewer lines, even if Seminole County does not approve his request for annexation. 3. He agrees to pay all connection charges at the time he does connect to the City utility lines. The City Manager reported this is a very fair deal for the City and the City cannot lose either way. On recommendation of the City Manager, Commissioner Smith moved to authorize the annexation of said property. Seconded by Commissioner Farr and carried. The City Manager reported that Mrs. Wanda Bankowski, 801 Santa Barbara Drive has requested authorization to replace an old 31½ foot trailer located in her yard with a 48' trailer for herself and her husband to live in after they sell their house. Further, the property is in an SR-1 zone, and mobile homes are not permitted in the City, outside of trailer parks. Also, this mobile home was "grandfathered in" because it was on the property before the law was enacted to permit mobile homes only in mobile home parks. The City Manager recommended the request be approved. Commissioner Mercer moved to table same until the Commission can look at the property. Seconded by Commissioner Smith and carried. The City Manager offered to be available as a consultant after his retirement on April 30, 1985, and reported he will need to know if the Commission wants him available on specific dates and times. Commissioner Smith moved to authorize the City Attorney to prepare the proper contract for the City Manager as a consultant on an as needed, if needed and as available basis, if the new City Manager desires. Further, the compensation not to exceed the budgeted amount for next year, and the consultant service is not to be on a retainer basis. Seconded by Commissioner Mercer and carried. M. 19 85 ~emorandum February 7, 1985 FROM' RE: City Manager Utility Director /~/~ Rands Mall Area - Odor Complaints Mr. Knowles: You had earlier talked to Mr. Jerry Gross concerning odor problems at Rand Mall. At that time I had mentioned three possible sewer lines tied into the storm line under McCrory's on 1st Street. After further investigation, the three connections appear to be floor drains or roof drains and not sanitary sewer connections. This would be normal and not the source of the odor problems. What appears to be the problem is the combined sewer system behind the Atlantic Bank to 2nd Street. There is an existing vault in the parking lot of the Bank where the combined lines come together. Under low flows the sanitary sewer goes south to the leaping weir on 2nd Street. During storm events, the flow goes north through Rands Mall to the lake. During rainy seasons the overflow line is flushed more often probably resulting in little odor problems. During normal periods the system is basically a sanitary sewer and odor problems will occur. Because the systems are connected, the storm sewer will experience the same odor problems as the sanitary system. The gas fumes have a common system to travel and escape. Unlike the sanitary system, the storm sewer has a number of open grates when the f.umes may be vented. To solve the odor problems in this area you would need to separate the sewer systems completely. We have discussed this possibility with our consultants. This is a costly project and involves major construction. The City may be able to control the odor problem with added maintenance. The line could be flushed periodically, removing the build-up of materials that accumulate. Chemicals could be added to the system to try and mask the odors. These are measures the City could do immediately to try to alleviate the odor problems. You will never be able to completely eliminate the problem with oUr existing system. The City Manager reported that the City is including in the 201 Program a request for separation of the storm sewer and sanitary sewer lines.
