M. 19 85 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on February 25, 1985. Requests submitted for water service, and annexation when the property becomes contiguous to the City Limits, as follows: Lot 60, Wolfer's Lake View Terrace, Plat Book 10, Page 66, Public Records of Seminole County, Florida. Edward I. and Norma J. Reed, owners. Lot 39 and the South 40 feet of Lot 40, Wolfer's Lake View Terrace, Plat Book 10, Page 66, Public Records of Seminole County, Florida. Victoria A. and Richard D. Fordham, owners. Lot 58, Wolfer's Lake View Terrace, Plat Book 10, Page 66, Public Records of Seminole County, Florida. Eduardo Urgelles, owner. The City Manager submitted a recommendation to approve the annexations, if the City Commission approves the water connections. Commissioner Mercer moved to authorize the water connections, provided the petitioners pay all costs for extension of the water lines, and all'applicable connection fees with proper annexation petitions. Seconded by Commissioner Smith .and carried. On motion of Commissioner Farr, seconded by Commissioner Smith and carried, Ordinance No. 1743, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A NORTH-SOUTH ALLEY LYING BETWEEN llTH STREET AND 12TH STREET AND BETWEEN HOLLY AVENUE AND MAPLE AVENUE, RESERVING A UTILITY EASEMENT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. was introduced and placed on first reading. On motion of Commissioner Smith, seconded by Commissioner Farr and carried, Minutes of February 11, 18, 20 and 21, 1985 were approved. Commissioner Mercer moved to remove from table, consideration of request from Mr. Sid Levy for water service and annexation of the Flea World property lying between Highway 17-92 and Sunland Estates. Seconded by Commissioner Smith and crried. Commissioner Mercer moved to deny Mr. Levy's request. Seconded by Commissioner Smith and carried. Commissioner Mercer moved to remove from table, consideration of request from Mrs. Wanda Bankowski, 801 Santa Barbara Drive, Sanford, Florida, for a waiver to permit them to replace a mobile home, which is a non-conforming use, on their property, for her and her husband to live in after they sell their house, which is on the same property. Seconded by Commissioner Farr and carried. Commissioner Mercer moved to deny the request. Seconded by Commissioner Smith and carried. 5~2 MINUTES City Commission, Sanford, Florida February 25 at 7:00 P. M. 19 85 The City Manager reported that Mr. Elliott Smith, Director of the Sanford Housing Authority, declined the invitation to meet with the City Commission to discuss his request for the City's concurrance on the existing need and financial feasibility of the Authority's 1985 Application for Federal Comprehensive Improvement Assistance Program Funding for modernizing five projects, submitted at meeting of February 11, 1985. Further, Mr. Smith has said all he wants is a letter from the City that the Sanford Housing Authority's program would not conflict with any municipal program. Commissioner Mercer moved to authorizet he City Manager to write said letter. Seconded by Commissioner Farr and carried. Request submitted from the Sanford Airport Authority for transfers in the FY 1985 Budget in amount of $91,500.00, for Water and Sewer System Installation. On recommendation of the City Manager, Commissioner Smith moved to authorize same. Seconded by Commissioner Mercer and carried. Request submitted for two street lights, one at the intersection of Wylly Avenue and Depot Avenue and one at an un-named street one block West of said intersection. On recommendation of the City Manager, Commissioner Farr moved to authorize same. Seconded by Commissioner Smith and carried. Letter submitted from Mr. A. B. Peterson, III, St. Johns Realty Company, that his client has expressed an interest in purchasing certain City property lying North of Lake Mary Boulevard and between Hidden Lake Drive and Art Lane, further described as follows: Begin 36.95 feet South of Northwest corner of Lot 25, run South 65° East 297.91 feet South 11° East 620.36 feet North 65° West 422.14 feet North 556.49 feet to Beginning. LAKE MINNIE ESTATES, Plat Book 6, Page 92, according to the Public Records of Seminole County, Florida. (4± acres) The City Manager reported this is the East end of an old borrow pit owned by the City, which the City has been filling with organic material, and the City plans to construct an elevated water tank on the West end of the borrow pit. Commissioner Farr moved to declare the property surplus and authorized Staff to obtain an appraisal of the property. 'Seconded by Commissioner Smith and carried.. The City Manager submitted an Arbor Permit Fee Survey of Seminole County, Altamonte Springs, Winter Park and Casselberry. On recommendation of the City Manager, Commissioner Mercer moved to authorize the City Attorney to prepare the proper resolution to set the fee at $5.00 per acre or fraction thereof, up to a maximum of $200.00, with a minimum fee of $5.00. Seconded by Commissioner Smith and carried over dissenting vote of Commissioner Farr. On recommendation of the City Manager, Commissioner Farr moved to authorize the Seminole County Ducks Unlimited to use the Civic Center, with alcoholic beverages, on March 23, 1985, after payment of the proper fee. Seconded by Commissioner Thomas and carried. The City Manager reported that the Planning and Zoning Commission is reviewing the Comprehensive Development Plan and needs $125.00 for materials. On recommendation of the City Manager, Commissioner Smith moved to authorize transfer in amount of $125.00 from Contingency to Account No. 2-01-11529-2, Non-classified Supplies. Seconded by Commissioner Thomas and carried. MINUTES City Commission, Sanford, Florida February 25 at 7:00 P. M. 1985 The City Manager reported that T. J. Sierputowski, d/b/a Future Property Services, the present contractor for maintenance of the municipal cemeteries, has not performed in a satisfactory manner. On recommendation of the City Manager, Commissioner Smith moved to authorize the City Manager to advertise for sealed bids for an annual contract for same effective April 30, 1985. Seconded by Commissioner Farr and carried. Commissioner Farr moved to authorize salary reclassifications as follows: Jeff Monson, Recreation Department, from Recreation Superintendent D to E, $22,002.11 annual. Mike Kirby, Recreation Department, from Recreation Supervisor C to D, $17,506.52 annual. Seconded by Commissioner Smith and carried. On recommendation of the City Manager, Commissioner Smith moved to accept low bid from Macasphalt, Inc. Seconded by Commissioner Mercer and carried. Mr. Edwin Shinholser, Attorney, P. O. Box 2279, 312 West First Street, First Federal Building, Sanford, Florida, appeared and reported he supports President Reagan's plan to cut the subsidy for Amtrack oUt of the Federal Budget. Further, Amtrack is not a successful operation, and to subsidize it is to tax the successful so the unsuccessful can continue to operate, and this is socialism. Rick Fordham appeared and reported he has worked for the railroad for 14 years, is a union member, and further, if the ~mt.~¢ksubsidy is cut, many people will lose their jobs, and Auto Train will also be cut. After discussion, Commissioner Smith moved to authorize the City Attorney to prepare the proper resolution to support retaining the Auto Train service between Sanford and Lorton, Virginia, as long as the operation is profitable. Seconded by Commissioner 584 MINUTES City Commission, Sanford, Florida February 25 at 7:00 P. M. 19 85 Thomas. Commissioner ~Mercer moved to amend the foregoing motion to include supporting the President in his attempt to balance the budget and reduce subsidization of free enterprise. Seconded by Commissioner Farr and carried over dissenting votes of Commissioner Smith and Commissioner Thomas. The Mayor called for the vote on the original motion, as amended, and same was carried over dissenting vote of Commissioner Smith. Request submitted from Dr. William H. Runge, DDS, for waiver of the City Code to permit him to erect a two by three foot professional sign for his practice at 2105 Park Avenue. The City Manager reported the property is zoned MR-l, the dentist office is a non- conforming use, and a sign is not permitted. Commissioner Mercer moved to deny the request. Seconded by Commissioner Thomas and carried over dissenting vote of Commissioner Farr. The City Manager submitted a request from the Sanford Rotary Club to use the Civic Center, with alcoholic beverages, on March 29, .1985. Commissioner Mercer moved to authorize same, after payment of the proper fee. Seconded by Commissioner Thomas and carried. The City Manager reported that the Florida Department of Environmental Regulation's residual chlorine requirements conflict with the Federal Environmental Protection Agency's requirements for same, and he has written a letter to the Department of Environmental Regulation asking how they have resolved the conflict. On recommendation of the City Manager, Commissioner Smith moved to authorize salary reclassification for Debbie Boston, Police Department, from Clerk Typist E to F, $14,511.15 annual. Seconded by Commissioner Farr and carried. The City Manager submitted a memo regarding transportation costs for the new City Manager and new City Engineer as follows: M~MORAN DUM To: From Sanford City Commission City Manager February 25, 1985 With the appointment of a new city manager and a city engineer, the new IRS rules will force an early decision on city-owned car use vs car allowance. It appears the City should take steps now to have transportation ready. This would be to purchase two cars, get a radio transferred to one and the purchase of a new radio and its installation in the other. Commissioner Farr moved to purchase the two cars and one radio, and to authorize budget transfers as recommended by the City Manager. Seconded by Commissioner Thomas and carried over the dissenting vote of Commissioner Mercer. Commissioner Thomas reported that Elmer Brooken, 100 Academy Avenue, had reported to him that someone had thrown a bag of garbage in his yard. Further, requested the police to patrol the area more frequently and watch for people illegally disposing of litter. The Commission referred the request to the Police Liason Commissioner, Commissioner Smith. On motion of Commissioner Farr, seconded by Commissioner Smith and carried, Resolution No. 1393 was read in full and adopted. Said resolution being in words and figures as follows: RESOLUTION NO. 1393 A RESOI//fION OF THE CITY OF SANFORD, FLORIDA, ADOPTING MARCH, 1985, AS "CLFAN UP - FIX UP 5X~H" IN THE CITY OF WHE~3~, it is the intent of the City of Sanford, Florida, to maintain all public areas of the City in a clean and healthy manner; and WHEREAS, the City urges its citizens to maintain their private property in a clean and healthy manner and to assist the City in maintaining the public areas of the City in a similar condition, and ~{F~%S, the City Ccmxnission believes that a clean and healthy a~aosphere fosters civic pride and that it is in the best interest of the citizens of the City of Sanford, Florida to keep our City clean. NOW, THEREFORE, BE IT RESOLVED BY THE P~OPLE OF THE CITY OF S~CTION 1: That the City of Sanford, Florida, adopts March, 1985, as "Clean Up - Fix Up Month" in the City of Sanford, Florida, and urges all of its citizens to help maintain private and public areas of the City in a clean and healthy manner.
