The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on March 25, 1985.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with Notice published in the Evening
Herald on March 5 and 15, 1985, as follows:

THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND

Notice is hereby given that a Public Hearing will be held at
the Commission Room in the City Hall in the City of Sanford,
Florida, at 7:00 o'clock P. M. on March 25, 1985, to consider
changes and amendments to the Zoning Ordinance, and amending the
Future Land Use Element of the Comprehensive Plan of the City of
Sanford, Florida, as follows:
A portion of that certain property lying between Celery
Avenue and North Street and East of Summerlin Avenue
is proposed to be rezoned from AD (Agricultural)
District to MR-1 (Multiple-Family Residential Dwelling)
District. Said property being more particularly
described as follows:
The West one-half of the East one-half of the
Northeast one-quarter of the Northeast one-
quarter (less RY) and the East one-half of
the West one-half of the Northeast one-
quarter of the Northeast one-quarter (less
the South 25 feet) and the West one-quarter
of the Northeast one-quarter of the Northeast

On recommendation of the Planning and Zoning Commission, Commissioner Farr moved
to deny the rezoning. Seconded by Commissioner Smith and carried.

Those appearing in opposition were as follows:
Robert Keith, 808 Clinton Street, Sanford, appeared and reported he is opposed
to the proposed amendments, which will "water down" the SR-1AA restrictions.
Ernie Horrell, 2026 Elizabeth Court, Sanford, appeared and reported the existing
regulations are good, and they should be left "as is".
On recommendation of the Planning and Zoning Commission, Commissioner Mercer moved
to deny the amendment. Seconded by Commissioner Smith and carried upon Roll Call Vote as

Petition for Annexation submitted from John Harder, Alex Browmand and Don
Sanderson for a portion of the property lying East of and abutting U.S. 17-92 and South of
Collins Drive, further described as follows:
The South 250 feet of the North 484 feet of the NE ¼ of the SW¼ of
Section 14, Township 20 South, Range 30 East, Seminole County, Florida,
lying East of State Road 15 & 600.
On recommendation of the City Manager, Commissioner Smith moved to authorize the City
Attorney to prepare the proper ordinance to annex said property. Seconded by Commissioner
Farr and carried.
The City Attorney reported that if the City Commission wants to increase the
number of persons on the Scenic Improvement Board, it can authorize an amendment to the City
Code for same. Commissioner Smith moved to authorize the City Attorney to prepare the
proper ordinance to amend the City Code, Chapter 2, ARTICLE VII. SCENIC IMPROVEMENT BOARD,
to change the number of members from seven (7) to nine (9) persons. Seconded by
Commissioner Thomas and carried.
Commissioner Farr moved to purchase a used copier with a maintenance contract from
the Police Benevolent Association, for use in the Police Department, and to authorize
transfer in amount of $6,346.00 from Contingency for same. Seconded by Commissioner Smith
and carried.
Commissioner Smith moved to authorize termite treatment for the Chamber of
Commerce Building, in amount of $825.00, and transfer from Contingency to provide for same.
Seconded by Commissioner Mercer and carried.
Commissioner Smith moved to authorize to advertise for bids for drilling four
additional wells at the Oregon Avenue well field site, with funds to be provided from the
Utility Trust Fund. Seconded by Commission Thomas and carried.
Commissioner Farr moved to authorize the City Attorney to prepare the proper
resolution to deny funds for dues or travel to any State Association supporting legislative
action contrary to the Florida League of Cities Program supported by the City. Seconded by
Commissioner Thomas and carried.
Commissioner Mercer moved to support and instruct the Police Department to proceed
with due diligence, the removal of junk cars in accordance with the City Code. Seconded by
Commissioner Thomas and carried.
Joe Schaeffer, 219 Woodmere Boulevard, Sanford, appeared to support said removal
of junk cars.
Commissioner Smith moved to authorize transfer in amount of $500.00 from
Contingency, for advertising the City's Clean-up Program. Seconded by Commissioner Thomas
and carried.
Commissioner Mercer moved to authorize payment of annual dues in amount of $575.16
to the Tri-County League of Cities, and to authorize transfer from Contingency to provide
for. same. Seconded by Commissioner Farr and carried. The Commission designated the Mayor

as the City Commission's representative on said board.
On motion of Commissioner Mercer, seconded by Commissioner Smith and carried,
Minutes of March 8, 11 and 18, 1985 were approved.
Commissioner Smith moved to authorize the City Manager to execute an Easement to
Florida Power & Light Company, for power lines at the Oregon Avenue well field site. Said
Easement over property described as follows:
The South 1212.4 feet of Lot 7, Pine Lake Groves, according to the Plat
thereof as recorded in Plat Book 9, Page 27 of the Public Records of
Seminole County, Florida; subject to easement of record. Containing
24.4935 Acres.
Seconded by Commissioner Thomas and carried.
The City Manager submitted a proposed Agreement with Seminole County and the
cities of Altamonte Springs, Casselberry, LonDwood, Winter Springs, Lake Mary and Oviedo,
providing notification to any other party whose mutual boundaries abut one another of any
annexation, contraction, density change, rezoning, or other change in land use which might
have an adverse impact on the abutting party, said notification to be before formal action
is taken by the County or Cities. Further, that this has been done, and the City Manager
recommends approval. The Mayor announced that CALNO is going to consider the agreement at
the next meeting. Commissioner Farr moved to approve the intent of the Agreement. Seconded
by Commissioner Thomas and carried.
The City Manager reported that a signed Appraisal must accompany the grant
application for the Lee P. Moore Park in the Hidden Lake Subdivision. On recommendation of
the City Manager, Commissioner Farr moved to authorize transfer of up to $1,200.00 from
Contingency for said Appraisal. Seconded by Commissioner Smith and carried.
On recommendation of the City Manager, Commissioner Farr moved to authorize the
application for said grant. Seconded by Commissioner Thomas and carried.
On recommendation of the City Manager, Commissioner Farr moved that the City will
comply with all the Grant Administration guidelines as required by the State of Florida.
Seconded by Commissioner Smith and carried.
On recommendation of the City Manager, Commissioner Farr moved to authorize public
hearings to be held March 25 and April 8, 1985, for said grant. Seconded by Commissioner
Thomas and carried.
On recommendation of the City Manager, Commissioner Farr moved to authorize salary
reclassification for Milton Smith, Jr., Utility Department, Sewer Division, from Maintenance
Worker I E to F, $13,605.14 annual. Seconded by Commissioner Smith and carried.
On recommendation of the City Manager, Commissioner Mercer moved to authorize the
City Attorney to prepare the proper ordinance to amend the City Code, Chapter 9, Fire
Prevention and Protection, ARTICLE II.STANDARD FIRE PREVENTION CODE, Sec. 9-12.1.
Amendments, to amend Sec. 18.106, Access to Buildings by Fire Apparatus, to read as follows:

Access to Buildings by Fire Apparatus
All premises within the city limits shall be provided with
fire access roads so that all portions of any building is accessible
to fire apparatus.

Fire access roads shall be provided by the property owner
when any portion of a building is set back more than 150 feet
from any property line or, when a building exceeds 30 feet in
height above the ground, when set back in excess of 50 feet from
a property line.
Fire access roads shall be at least 15 feet wide; of stabilized
materials; and at least 10 feet away from any building.
Combustible materials, that are deemed hazardous by the
Fire Chief; shall not be brought onto or stored on the construction
site.of any under construction.
No fire access road shall be blocked at any time.

The City Manager reported that the Special Refuse Collection Fees need to be
increased to cover the increased cost of disposal at the County facilities. On
recommendation of the City Manager, Commissioner Mercer moved to authorize the City Attorney
to prepare the proper resolution to adopt the fee schedule, effective April 1, 1985, as

Brent Carli, 300 Larkwood Drive, appeared and asked if the City has'tried
everything possible to get the people to pay. The Mayor reported the City Attorney and
Staff have tried every method available to contact the people and obtain payment.
On recommendation of the City Manager, Commissioner Thomas moved to write off the
13 uncollectable accounts in total amount of $2,369.20. Seconded by Commissioner Smith and
carried.

The Commission authorized the Scenic Improvement Board to make a recommendation on same.
The City Manager reported there are no city utilities in the street and alley
requested to be closed by Donald Huber, said street and alley being that portion of Laurel
Avenue and a North-South alley lying between U.S. 17-92 and Elm Avenue and between West 15th
Street and West 18th Street.
Commissioner Farr moved to authorize a public hearing to be held April 22, 1985 to
consider said request. Seconded by Commissioner Smith and carried.
The City Attorney submitted a Letter of Intent to Frank Faison. Commissioner Farr
moved to authorize the Mayor and City Clerk to execute said Letter of Intent. Seconded by
Commissioner Smith and carried. Said Letter of Intent being in words and figures as

The City Manager submitted a report of locations where there is merchandise on
sidewalks without a permit, signs on the sidewalk, cars on the parkway, etc., and asked if
the Commission wants the laws enforced to remove the violations. The Commission authorized
the enforcement of said laws.
The City Manager submitted a letter of commendation from Karen Rauth, Guidance
Counselor, Goldsboro Elementary School, for Police Officer Philip Wright for his
participation in their Career Awareness Program.
The City Manager reported Staff has completed a survey of the property within the
City, of parcels of land which are in violation of the City Code, Section 13-7, and a map
has been prepared showing all locations, the County property records have been researched to
establish ownership, owner's address, and the legal description of each parcel. The

Commission authorized to discuss same at a Workshop Session.
The City Manager submitted a request from Violetta Williams to waive the off-
street parking requirements for a duplex at 101 West Ninth Street. He reported she is being
required to bring the existing duplex to code, but the small lot size will not accommodate
the four required off-street parking spaces. Commissioner Mercer moved to deny the request.
Seconded by Commissioner Smith and carried.
On recommendation of the City Manager, Commissioner Farr moved to authorize a 4%
Cost of Living pay increase to be used in the preparation of the 1985-86 budget. Seconded
by Commissioner Mercer and carried.

The City Manager submitted a resolution from Seminole County requesting Southern
Bell Telephone Company to provide local-area, toll-free service between northern Seminole
County and the Orange County-Orlando area. Commissioner Farr moved to authorize the City
Attorney to prepare the proper resolution to support same. Seconded by Commissioner Mercer
and carried.
The City Manager reported the City has been unofficially approached regarding any
interest to sell the Cultural Arts Building at Fifth Street and Oak Avenue. The Commission
reported no interest in selling the property.

The City Clerk reported Item (2) has been advertised for public hearing on April
On recommendation of the Planning and Zoning Commission, Commissioner Farr moved
to authorize the sale of Beer and Wine for consumption on the premises at 3842 Orlando
Drive, at the Greek Delites Deli. Seconded by Commissioner Smith and carried.
The City Clerk submitted Condemnation Group 79, Reports Nos. 85-1131 through 85-
1137. Commissioner Mercer moved to authorize a public hearing to be held April 8, 1985 to
consider same, and proper notice. Seconded by Commissioner Smith and carried.
Commissioner Farr moved to authorize the City Manager to direct a letter to
Southeast Bank, asking them to remove a billboard sign on the West side of U.S. 17-92
(French Avenue) between the Seventh Street and Eighth Street. Seconded by Commissioner
Thomas and carried.
A public hearing was held to consider the application for a state grant for the
development of Lee P. Moore Park. The Chairman announced that the Commission would hear
from those persons present to speak in favor of, or in opposition to, the said application.
No one appeared.

RESOLUTION ADOPTED BY THE BOARD OF CITY COMMISSIONERS
OF SANFORD, FLORIDA, AT THEIR REGULARLY SCHEDULED
MEETING OF MARCH 25, A.D., 1985
WHEREAS, residents of the City of Sanford are serviced by SOUTHERN
BELL TELEPHONE COMPANY and do not have the ability to make and receive
toll-free calls to and from Orlando and Orange County; and
WHEREAS, many residents of the City of Sanford work in or conduct
business in Orlando and Orange County; and
WHEREAS, SOUTHERN BELL'S lack of toll-free service from the City
of Sanford to Orlando and Orange County inhibits the growth of business
and industry in the City of Sanford; and
WHEREAS, generally, the Seminole-Orlando-Orange County area is
rapidly emerging as a single large metropolitan area; and
WHEREAS, there is no apparent justifiable cause why there is no
uniform toll-free calling to Orlando and Orange County for Sanford residents
NOW, THEREFORE, BE IT RESOLVED By THE SANFORD CITY COMMISSION,
that it respectfully requests and strongly recommends to SOUTHERN BELL
TELEPHONE COMPANY as follows:
1. That SOUTHERN BELL take necessary measures to provide
local area toll-free service for all Seminole residents for calls to
and from the City of Orlando and Orange County without the necessity
of request or petition to the Public Service Commission.
2. That, if SOUTHERN BELL refuses to take such action as
stated in paragraph one above, the Sanford City Commission will' petition
the Public Service Commission for such expansion of service.
BE IT FURTHER RESOLVED that this Resolution be sent to SOUTHERN
BELL TELEPHONE COMPANY as representing the official position of the
Sanford City Commission.
