The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 26, 1985.
Present:

The meeting was called to order by the Chairman.
The first item of business was the continuation, from meeting of August 12, 1985,
of a public hearing to consider closing, vacating and abandoning a portion of Georgia Avenue
between West 25th Street and West 24th Street and a portion of West 24th Place between
Georgia Avenue and Hartwell Avenue.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed closing.
Cris Crismond, G & C Engineering Consultants, Inc., appeared and reported that
he would agree to meet all of the recommedation of the City Staff, if Commission approved
the closing.
The City Manager reported that the developer had changed the entrance from 25th
Street to Hartwell Avenue, and further, had agreed to pave Hartwell Avenue from 24th Street
to 25th Street.
William Balser, 222 Bradshaw Drive, appeared in opposition of the proposed
closing, and reported vacating of these streets would ~reate a traffic hazzard trying to get
to the emergency shelter at Seminole High School.
Commissioner Farr moved to approve the closing, vacating and abandoning of same.
Seconded by Commissioner Mercer and carried.
Commissioner Mercer moved to approve the request for amendments to the FY 1985
Budget of the Sanford Airport Authority. Seconded by Commissioner Thomas and carried.
Request submitted from the Rotary Breakfast Club of Sanford, for use of streets,
parking lot and Civic Center for the Annual Blue Ribbon Classic and Antique Show, March 28
and 29, 1986.
Mr. Jim Jernigan, President of the Rotary Club, appeared to support the request.
The Commission discussed the policy of Civic Center use.
Commissioner Mercer moved to table consideration pending research of the rules
regarding the use of the Civic Center. Seconded by Commissioner Farr and carried.
Request submitted for reconsideration of permit for sale of Beer and Wine for
consumption on the premises at Hampton Confectionerie, Inc., at 112 East First Street.
Mr. Joseph Pertz, 930 Raymond Avenue, Altamonte Springs, appeared to support the
request.
Commissioner Mercer moved to approve the request for consumption on premises.
Seconded by Commissioner Thomas and carried over the dissenting vote of Commissioner Farr.
Recommendation submitted by the City Manager for consideration of removal of 20
additiOnal trees by AAA Tree Service. Commissioner Farr reported that it appeared that some

trees may have had some useful life left in them if they were properly trimmed and treated,
and moved to table discussion until additional expert advice could be obtained. Seconded by
Commissioner Mercer and carried.
On motion of Commissioner Farr, seconded by Commissioner Thomas and carried,
Resolution No. 1417 was read in full and adopted. Said resolution being in words and
figures as follows:

WHEREAS, the City of Sanford, Florida wishes to provide
Lee P. Moore Park for the public to use for recreation purposes;
and
WHEREAS, the City of Sanford, Florida wishes to submit
a FRDAP grant application for Lee P. Moore Park in the amount of
$50,000.00 with the City of Sanford providing a cash match of
$18,850.00, In-Kind service match of $7,900.00 and Land Value of
$73,250.00 for a total project cost of $150,000.00, and a LWCF
application for the Lee Moore Park with a cash match of $18,500.00
and an In-Kind service match of $21,246.00 and Land Match of
$10,254.00 for a total project cost of $100,000.00; and
WHEREAS, the City of Sanford, Florida certifies that it
does have a Comprehensive Plan including a Recreation and Open
Space Element pursuant to the Local Government Comprehensive
Planning Act of 1975, Chapter 163.3161, F.S. as adopted by Ordinance
$1327; and
WHEREAS, the City of Sanford did develop and complete
the said Comprehensive Plan through experiences of Public Hearin§s
as a vital part of public participation in completion of the final
document, including equal opportunities for all segments of the
community both minority and disadvantaged to participate in the
planning process; and
WHEREAS, the City of Sanford has an on-going program of
public participation for the development ~of parks and recreation
facilities by providing neighborhood meetin§s and holding official
public hearings at scheduled and advertised City Commission meetings°
posted as a definite agenda item; and

WHEREAS, the City of Sanford has committed the amounts
and types listed above for required matching of both FRDAP and
LWCF and that the City of Sanford fiscally and legally has
responsible power to satisfactorily develop, operate and maintain
the project site of Lee P. Moore Park in accordance with FRDAP
and LWCF program guidelines and requirements; and
WHEREAS, James R. Jernigan is appointed Official Liaison
Agent with the authority to conduct proper project business;
NOW THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
That the Staff of the City of Sanford, Florida, be authorized
to submit an application for FRDAP and LWCF grants in the amounts of
$50,000.00 and $50,000.00, respectively, for the Lee P. Moore Park.
That this Resolution shall become effective immediately
upon its adoption and passage.

Commissioner Thomas moved to authorize the City Attorney to prepare proper
ordinance establishing a Human Relation Committee. Seconded by Commissioner Mercer and
carried.
Petition submitted from residents of Academy Manor Subdivision requesting the City
to grant a variance and requesting the owner of the abutting industrial park to install a
chain link fence in lieu of a block fence and further, to set the fence away from the
property line.
Mr. Willie King, 141 Bethune Circle, appeared as representative of the Academy
Manor Subdivision.
Commissioner Farr moved to table discussing until residents were unanimous of the
action desired. Seconded by Commissioner Mercer and carried.
Fair Labor Standards Act recommendations submitted by the City Manager as follows:

FLSA Recommendations:
A)
Recommend immediate action by the City to meet all requirements set forth in
the Fair Labor Standards Act.
B)
Recommend that City Manager send memorandum for bulletin board posting to all
departments stating the City Manager must give prior approval for all
overtime activities for all non-exempt employees except in specified City
emergencies.
c)
Recommend establishing permanent work periods for General, Fire and Police
employees.
D) Recommend all exempt employees be worded as such in job classifications.
E)
Recommend Finance Department meet all record keeping requirements with
emphasis that each department head keep careful record of their individual
work periods and submit them to the Finance Department within three (3) days
of the work period.
F)
Recommend quarterly review of time cards by personnel officer and internal
auditor/budget analyst to see that employees and departments are meeting FLSA
requirements to insure minimal problems with the Department of Labor.
G)
Recommend computing liability account for period of April 15, 1985 to July 1,
1985 to cover any potential problems from individual suits.
SUBJECT: Fair Labor Standards Act
Policy:
The City of Sanford will conform with all requirements set forth in
the Fair Labor Standards Act.
SUBJECT: OVERTIME
Policy:
Ail overtime must be approved in advance by the City Manager except
in emergency situations. (Water breaks, Fire, Hurricane, etc.)
Employees may not clock-in earlier than five (5) minutes prior to
their scheduled work times and must clock-out within five (5)
minutes after the end of their work schedule. No employee will be
allowed to work prior to clocking-in or after clocking-out. This
will be closely monitored by audit of time cards.
The City will meet all overtime requirements stated in the Fair
Labor Standards Act.

General Employees (Salary Schedules II & III)
(1) Overtime is not permitted unless authorized by the
City Manager.
(2)
Compensatory time is not to be used as a form of
compensation unless used as allowed in the Fair
Labor Standards Act.
(3)
Employees will be paid overtime at 1 1/2 times base
pay, as authorized by the City Manager.
(4)
Each employee of any department is subject for call
on any emergency at any time as determined by their
superintendent, department head, or the City
Manager.

Public Safety Employees (Salary Schedules IV and V)
(1) Overtime work is not permitted unless authorized by
the City Manager.
(2)

The Commission confirmed that the funds for the City Hall Planting project would
be transferred from Public Projects unappropriated funds not from the open space funds.
On recommendation of the City Manager, Commissioner Mercer moved to approve
regrades of pay range changes as follows:

Notice is hereby given that a Public Hearing will be held at
the Commission Room in the City Hall in the City of Sanford,
Florida, at 7:00 o'clock P. M. on AuGust 26, 1985, to consider
the adoption of an ordinance by the City of Sanford, Florida,

WHEREAS, there has been filed with the City Clerk ol
the City of Sanford, Florida, a petition containing the names ot
the property owners in the area described hereinafter requestin
annexation to the corporate area of the City of Sanford, Florida
and requesting to be included therein; and
WHEREAS, the Property Appraiser of Seminole County
Florida, having certified that there are two property owners i~
the area to be annexed and that said property owners have signe¢
the Petition for Annexation; and
WHEREAS, it has been determined that the propert
described hereinafter is reasonably compact and contiguous to th
corporate areas of the City of Sanford, Florida, and it ha
further been determined that the annexation of said property wil
not result in the creation of any enclave; and
WHEREAS, the City of Sanford, Florida, is in a positio

FOR SANFORD'S PROPOSED BOND ISSUE.
The Committee appointed by the City Commisison, composed of City Com-
missioner John Mercer, City Manager Frank Faison, Finance Director
Henry Tamm and City Attorney Bill Colbert, with Administrative Services
Director Kim Smith attending, has met and interviewed several firms
responding to the RFP (Request for Proposal).
Your Committee is pleased to recommend unanimously that the City Com-
mission appoint an Investment Banker/Underwriter group as follows:
Senior Manager:
Co-Managers:
William R. Hough and Company
Smith Barney, Harris Upham and Company, Inc.
Southeastern Municipal Bonds, Inc.
Each of these firms are well established in Florida and bring a par-
ticular expertise to this project. The Hough firm will be primarily
responsible for structuring and timing the bond sale as Senior Manager,
with the other two firms assisting and all providing their expertise
in the marketing effort for the sale of the issue or issues.

We are now in the process of reviewing firms to be engaged as Bond
Council to work with the City Attorney on these issues.

Commissioner Thomas moved to declare a state of emergency due to the infestation
of mosquitos and to authorize the emergency purchase of equipment and materials and to
proceed with the mosquito spraying for the finish of the season at a total cost of
$8,153.75. Seconded by Commissioner Mercer and carried.
On recommedation of the City Manager, Commissioner Fart moved to approve! the new
job classification of computer operator. Seconded by Commissioner Thomas and carried.
On recommendation of the City Manager, the Commission reviewed proposed budget for
the Scenic Improvement Board. '
On motion of Commissioner Farr, seconded by Commissioner Thomas and carried,
Minutes of the July 22 and 29, 1985 meetings were approved.
The Chairman announced a public auction of surplus property to be held on
September 7, 1985, 10:00 o'clock A. M. at the Public Works Complex. Surplus property as

consider a proposed h~azardous waste disposal site along Silver Lake Drive.
Commissioner Mercer moved to inform the proper authorities of the City's support
of the home owners against the h~azardous waste disposal site. Seconded by Commissioner
Thomas and carried.
