The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on September 23, 1985.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with Notices published in the Evening
Merald on September 18, 1985, as follows:

Notice is hereby given in accordance with Chapter
129.03(3)(b), Florida Statutes, that a Public Hearing will be
held in the Commission Room at the City Hall in the City of
Sanford, Florida, at 7:00 o'clock P. M. on September 23, 1985 to
consider the Annual Budget for the fiscal year of October 1, 1985
to September 30, 1986.
THE PROPOSED OPERATING BUDGET EXPENDITURES OF THE CITY OF
SANFORD, FLORIDA ARE 18.7 PER CENT MORE THAN LAST YEAR'S TOTAL

NOTICE OF TAX INCREASE
The City of Sanford has tentatively adopted a measure to increase
its property tax levy by 38.17 percent, all concerned citizens
are invited to attend a public hearing on the tax increase to be
held on September 23, 1985 at 7:00 o'clock P. M. in the City
Commission Room at the City Hall, 300 North Park Avenue, Sanford,
Florida.
A FINAL DECISION on the proposed tax increase will be made at
this hearing.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed budgets and millage levy.
Mr. Dick Barnett, 2070 Grandview Avenue, appeared to object to the increase in the
millage rate.
The Chairman submitted a letter from Mr. Clyde Hayes objecting to any increase in
the millage rate.
On motion of Commissioner Farr, seconded by Commissioner Smith and carried,
Resolution No. 1420 was read and adopted. Said resolution being in words and figures as
follows:
RESOLUTION NO. 1420
A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
APPROPRIATING UNEXPENDED CASH SURPLUS ON HAND
AT THE END OF THE FISCAL YEAR 1984-1985 TO
THE DEPARTMENT OF GENERAL GOVERNMENT OF SAID
CITY FOR THE FISCAL YEAR 1985-1986 FOR USE
OF ORDINARY PURPOSES IN OPERATING EXPENSES OF
SAID CITY.
WHEREAS, the City Commission of the City of Sanford,
Florida, deems it necessary, expedient, and for the best interest of
said City that any unexpended cash surplus as of September 30, 1985,
of the operating revenues of said City for the fiscal year 1984-1985
be appropriated for the ordinary purposes and operating expenses of
said City in the budget for the fiscal year 1985-1986.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SANFORD, FLORIDA:
1. That any unexpended cash surplus as of September 30,
1985, of operating revenues of said City for the fiscal year 1984-1985
be and the same is hereby appropriated to the Department of General
Government of said City for the ordinary purposes and operating
expenses of said City for the fiscal year 1985-1986 and said cash
surplus shall be incorporated in the budget of revenues and

2. That this Resolution shall become effective as of the

WHEREAS, in accordance with Article VI of the Charter, as
of the City of Sanford, Florida, the City Manager of the
Sanford, Florida, has made and submitted to the City
Commission of the City of Sanford, Florida, for the fiscal year
beginning October 1, 1985, and ending September 30, 1986, and a
Capital budget, such estimates or budget having been made with
particular application to the various departments of the City, a
true copy of which is hereto attached and by reference made a part
of this Resolution; and
WHEREAS, each
said budgets prepared
and every item contained and set forth in

considered by this Commission,
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA, AS FOLLOWS:
1. That said budget, as prepared and submitted by the
City Manager to the City Commission, be and the same is hereby
adopted as the budget for the City of Sanford, Florida, for the
fiscal year beginning October 1, 1985, and ending September 30,
1986; and the Capital budget as prepared and submitted by the City
Manager to the City Commission, be and the same is hereby adopted.
2. That upon collection of any revenues of said City,
the City Clerk shall allocate from each dollar collected and
received, the several amounts to the respective funds for purposes
for which the same are hereby authorized and approved.
3. That this Resolution shall become effective as of
the first day of October, 1985.

WHEREAS, the City Commission of the City of

3. That there shall be and is hereby levied for the
fiscal year 1985-1986, upon each dollar of the assessed valuation

Florida, a tax of 4.38 mills for the purpose of realizing a sum
sufficient to meet and defray the necessary and ordinary running
and operating expenses of the City of Sanford, Florida, for the
fiscal year beginning October 1, 1985, and ending September 30,
1986.
4. This Resolution shall become effective October 1,

The City Manager submitted and recommended approval of consent order 85-0613 from
the Florida Department of Environmental Regulation to separate the combined sanitary and
storm water sewer system effective 6/1/1993. Commissioner Fart moved to authorize the Mayor
and City Clerk execute said consent order. Seconded by Commissioner Mercer and carried.
Mr. Alex Alexander, P. E. District Manager, Department of Environmental
Regulation, appeared to commend the city in its efforts towards waste water land spreading
and offered the cooperation of his office with the above consent order.
Mr. Russell Fisher expressed the appreciation of the Audobon Society and the
Friends of the St. Johns for the city's work to remove these water problems.
Mr. Richard Deas appeared to express his concern about the combined sewer system.

conflict herewith be and the same are hereby revoked.
SECTION 5: That this ordinance shall become effective
immediately upon its passage and adoption.

After being read by title, the Chairman announced that the Chairman would hear from those
persons present to speak in favor of, or in opposition to, the adoption of the oridnance.
Mr. Lonny Groot, Seminole County Assistant Attorney, representing Ken Hooper,
Seminole County Administrator, appeared in opposition.
The City Manager submitted a report from the City Engineer regarding services to
said tract as follows:

Item 1: Sewer Service - The current Sanford Comprehensive
Plan includes installation of a minimum 15" gravity sewer line located
on the west and a portion of the north side of the subject property.
This sewer line is also a part of the "201 Plan" toward which Sanford is
presently single handedly progressing. Construction of this gravity
line will be financed from sewer impact fees although portions of it may
be earlier financed in cooperation with developers. There is present
service capability available in the main sewage treatment plant to
provide some allocation. Additional wastewater treatment plant capacity
is planned for development in a time frame compatible.with the needs
within the annexation area.
Item 2: Water Service - The Sanford Comprehensive Plan
includes installation of water lines in excess of 10" to the west, north
and east of the subject parcel. (An application for permit is now being
prepared which will provide 16" water service up to the eastern most
property line of the subject parcel.) The Sanford Comprehensive Plan
provides for two major water loops adjacent to the subject property
connected by main lines running along S.R. 46 and C.R. 46A. Additional
well capacity has been recently installed. Installation of these water
lines will be by present cooperative installations in the area, water
system impact fees, possibly by future cooperative efforts with
developers in the area. (It should be noted that the City of Sanford is
presently preparing a water/sewer system bond issue which will, in part
provide funds for the near term expansion of certain elements of the
water and sewer system as well as sewer effluent disposal and sewage
plant improvements.)
Item 3: Fire Protection - The City FY 86 Capital Budget
include funds for purchase of land for a third City fire station. This
City fire station is to be located in the vicinity of Upsala Road
between S.R. 46 and C.R. 46A. It will provide excellent fire protection
for the vicinity including the parcel being considered for annexation.
An elevated water storage tank will in all probability be colocated ~with
this fire station.
Item 4: Police Protection - Additional police officers are
included in the FY 86 City Budget. The City police department will be
able to provide necessary police service in this area, commensurate with
its development.
Item 5: Traffic - The subject property is contiguous with
S.R. 46 on the north and touches Upsala Road which is maintained by
Seminole County. There are several other unpaved dedicated streets and
roads which touch the property. Additional road planning will occur at
the time that developments within the annexed property are planned.
This network will be funded by a combination of developer funds, County
road impact fees, City road impact fees if established and Florida
Department of Transportation. The nonused Seaboard Coastline Railroad
right-of-way lying slightly to the south of the annexation parcel has
been discussed for a new eastwest arterial road. If developed by the
State/County/City this would provide an excellent additional
transportation corridor of benefit to the subject parcel.
Item 6: Drainage - No significant changes in drainage are
anticipated from present conditions. As areas are developed drainage
and storm water management ordinances will be applied as appropriate.
Item 7: Groundwater Recharge - Some groundwater recharge
areas for the Floridan Aquifer lie in and along the southern boundary of

the subject parcel. Consideration will be given to groundwater recharge
protection in the planning for development of the annexation parcel.
Item 8: Solid Waste - The City has been acqUiring additional
solid waste handling equipment as necessary through the years both for
replacement and additional capacity. Additional units will be acquired
as necessary to support new developments. Solid Waste will continue to
be disposed of at the County landfills.
Item 9: Recreation and Open Space - Appropriate recreation
and open space areas will be identified as development of the annexation
parcel is planned.
Item 10: Intergovernmental Coordination - The City of Sanford
will continue in its efforts to coordinate with Seminole County
Government with respect to all matters of mutual concern relative to the
annexatin parcel, and adjacent unincorporated areas.
Commissioner Mercer moved on the passage and adoption of Ordinance No. 1772.

provide municipal services to the property described herein, and that
the City Commission of the City of Sanford, Florida, deems it in the
best interest of the City to accept said petition and to annex said
property.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF

SECTION 1: That the property described below situated in
Seminole County, Florida, be and the same is hereby annexed to and
made a part of the City of Sanford, Florida, pursuant to the voluntary

residence or ownership as may from time to time be determined by the

SECTION 3: If any section or portion of a section of this
ordinance proves to be invalid, unlawful or unconstitutional, it shall
not be held to impair the validity, force or effect of any other

conflict herewith be and the same are hereby revoked.
SECTION 5: That this ordinance shall become effective
immediately upon its passage and adoption.

On recommendation of the City Manager, Commissioner Smith moved to accept low bid
meeting specifications in amount of $2,250. from Sanford Irrigation & Sprinkler Systems,
Inc., for Installation and Modification of City Hall Irrigation System. Seconded by
Commissioner Thomas and carried.
On recommendation of the City Manager, Commissioner Smith moved to accept low bid
meeting specifications in amount of $69,164.74 from Florida Contractors Equipment Company,
for a front-end wheel loader. Seconded by Commissioner Thomas and carried.
Memorandum was submitted from the Acting Director of Recreation and Parks
Department stating Allen Roofing Company had withdrawn their bid and recommended accepting
the next lowest bid meeting specifications from Expert Roofing Company.
On recommendation of the City Manager, Commissioner Smith moved to accept low bid
meeting specifications in the amount of $17,000.00 from Expert Roofing Company, for Re-roof
Westside Recreation Center and Restroom Roof on Tourist Club. Seconded by Commissioner
Thomas and carried.
The next item of business was a consideration of one year lease renewal with
Seminole County for use of part of first floor of City Hall.
On recommendation of the City Manager and the City Engineer, Commissioner Mercer
moved to authorize the Mayor to execute same. Seconded by Commissioner Thomas and carried.
The Commission considered a request to lease Lot 1, Sanford Riverfront Project at
the Marina, for Beda Marine, 1.8 acres submitted by Gerald Gross and John Smith.
Commissioner Smith moved to authorize the City Attorney to prepare a lease draft
for same. Seconded by Commissioner Farr and carried. The Mayor abstained from vote.
Mr. Wallace Schoettelkotte, co-owner of the Holiday Inn, appeared and reported he
would like to present the City Commission with an alternate plan for the same.
The Commission considered rate review for system development charges.
CommiSsioner Farr moved to authorize the City Attorney to prepare proper ordinance
for rate review including system development charges. Seconded by Commissioner Thomas and
carried. ~
The Commission next considered names for the park in Academy Manor.
Mr. Evan Barnes, 142 Bethune Circle, representative of Academy Manor Subdivision
Association, appeared with suggestions, as follows:

Attorney, authorize a $1,000 contribution to the National Institute of Municipal Law
Officers Fair Labor Standards Act Litigation Trust Fund, and authorize the City Attorney to
execute agreement of same. Seconded by Commissioner Thomas and carried over the dissenting
vote of Commissioner Mercer.
Consideration of first reading of Ordinance No. 1783 amending the various building
regulatory codes was tabled by motion of Commissioner Smith. Seconded by Commissioner

The City Attorney reported a scrivener's error in the title of Ordinance No. 1775,
passed and adopted September 9, 1985. On motion of Commissioner Mercer the title of
Ordinance No. 1775 was amended to read as follows:
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING A PORTION
OF AMERICANA BOULEVARD LYING EAST OF ORLANDO
DRIVE (HIGHWAY 17 & 92) AND BETWEEN THE
EASTERLY EXTENSION OF LAKE MARY BOULEVARD AND
AIRPORT BOULEVARD; PROVIDING FOR

RECOMMENDATION
Asked the City Commission to consider establishing an a~Chitectural
review board to assist Planning & Zoning in its evaluation and review
of site plans and their comparability with Sanford existing architecture.
After discussion same was tabled for consideration at a work session.
The City Manager submitted a letter from Charles W. Hardwick, M. D. requesting 14
foot easement across city property in Lake Monroe Industrial Park and offering to the city
an easement to Seminole Boulevard. The City Manager recommended same to be referred to
Staff for recommendation.

Mrs. Doreen L. Freeman appeared to request a 60-day extension for 819 West Third
Street, Condemnation Report 80-960, Group 59, stating she has a default judgement against
the lessee and is waiting for final judgement before she has the building removed.
Commissioner Mercer moved to grant a 60-day extension to Mrs. Freeman. Seconded
by Commissioner Smith and carried.
Mrs. Coreen Duval appeared to request an extension for 1003½ West 7 Street,
Condemnation Report 84-1114, Group 75.
Commissioner Farr moved to approve request of 90-day extension for Mrs. Duval.
Seconded by Commissioner Thomas and carried.
On recommendation of the City Manager, Commissioner Mercer moved to approve job
classifications recommended by the Recreation and Parks Director and the Scenic Improvement
Board for gardening personnel catagories and salary ranges. Seconded by Commissioner Thomas
and carried.
On recommendation of the City Manager, Commissioner Farr moved to approve request
for use of Lake Carolla from the Boy Scouts of American, Central Florida Council, Seminole
District, for their 3rd Annual Fishing Rodeo on October 19, 1985 from 9:00 A. M. to 2:00 P.
M. Seconded by Commissioner Mercer and carried.
Commissioner Mercer requested discussion of Phase II of Downtown Improvements at
the next Workshop Meeting.
Commissioner Mercer moved to remove from table the request for bids for the sale
of the Art Lane landfill. Seconded by Commissioner Fart and carried.
Commissioner Farr moved to take the Art Lane landfill off the Surplus property
list. Seconded by Commissioner Smith and carried.
The Chairman requested three names from each commissioner to be appointed to the
Human Relations Committee upon the acceptance of the ordinance by the Commission.
Sara Jacobsen, representative of the Scenic Improvement Board, reported the City
Hall planting project should be completed by mid October and commended the Park Department
personnel for their cooperation.
There being no further business, the meeting was adjourned.
