032486-Regular Session MINUTES City Commission, Sanford, Florida March 24: 385 19 86 The City Commission of the City of Sanford, Florida, met in Regular Sessio~ ~i~' the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. The first item of business was the continuation of a consideration of a request from McLain, Pierce and Associates for an addition to a non-conforming use of an office building located at 720 South Park Avenue. The City Clerk reported Notices had been sent to owners within 100 feet on March 12, 1986. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the addition to a non-conforming use. Daryl McLain, Vice President, McLain, Pierce and Associates, appeared to report he had contacted eight of't'he 'eleven ~residenCes within 100 feet of the non-conforming use, six of whom approved and/or had no objections to the addition, two of whom had no opinion, and three were out of town. Harold Christensen, 1718 Magnolia Avenue, appeared in opposition. Lon Howell, 1109 Park Avenue, appeared to support the addition, stating the plans show an improvement for the neighborhood. R. 15 & 600) and vacated State Street and between Airport Boulevard and vacated "The Crossing" Street. John V. Childers, 2714 Orlando Drive, petitioner, appeared to explain he would like to construct an office building overlooking Lake Jennie. Commissioner Mercer moved to deny the request. Greene, 104 Mayfair Court, appeared to report he had received notice from Mayfair Country Club stating his membership had been cancelled and upon consulting with his attorney, who wrote a letter to Mr. Daniels, the lessee of Mayfair Country Club, Mr. 386 MINUTES City Commission, Sanford, Florida March 24, 19 86 Daniels had reinstated Mr. Greene at this time. William J. Craig, 166 Mayfair Court, appeared to reqUest the Commission to investigate certain conditions at Mayfair Country Club, such as the operation of the Pro Shop, conditions and operation of the Club House, annual maintenance, use and care of restrooms, removal of buildings, annual audit of the 5-year improvement program. Mr. Craig stated Mayfair management is in breach of their lease, and no where in the lease does the lease quarantee Mr. Daniels a profit. John "Jack" K. Daniels, lessee of the Mayfair Country Club and Golf Course, appeared to report he met with Mr. Greene and members of the Men's Golf Association. The results of which were to make the golf course more public in that walking will be allowed from 7:00 A.M. to 7:56 A.M. and after 2:00 P.M. The PGA sanction requires two inch tires on pull. carts, therefore pull carts will be required to use cart pat~s..w~.~~ in use. Mr. Greene has offered his services as Ranger in exchange for lower cart fees. Mr. Daniels repgrted the Club House is open five days a week (Wednesday and Thursday from 3:00 P.M. to closing about 7:00 or 8:00 P.M., Friday from 2:00 P.M. to closing, and Saturday and Sunday from.-ll:00 A.M. to closing), also, food and beverage is served 100 hours a week (Monday and Tuesday, 7:00 A.M. to 6:00 P.M., and Wednesday through Sunday, 7:00 A.M. to 8:00 P.M). Mr. Daniels stated the restrooms are cleaned on a daily basis. Commissioner Smith stated the Commission appreciates Mayfair's management changing their attitude and rules. Discussion of an advisory committee was placed on a future Workshop agenda. June C. Porzig, June Porzig Realty, appeared to request a variance for required parking lot paving at 219 French Avenue and 510 West Third Street. The Commission referred same to the Planning and Zoning Commission for site plan approval. On recommendation of the City Manager and Director of Recreation and Parks, Commissioner Farr moved to approve the request from the Celery City Elks Lodge for the use of the Civic Center with alcoholic beverage on April 4, 1986 for a scholarship ball at the Seconded by Commissioner Thomas and carried by the vote of the rate of $450. plus tax. Berrien, Clerk of the Circuit Court, to install a "Drop Box" on the sidewalk on the Park Avenue side .of the Seminole County Courthouse. Commissioner Farr moved to authorize the City Attorney to prepare an agreement for same with stipulations as follows: 1. The Clerk of the Circuit Court agrees to indemnify the City from any litigation arising out of the use of the box, or the loss of any of the contents of the box. 2. The agreement should be clear that the City has no responsibility to guard .~,~ . the box or its contents beyond its general police duty to preserve the peace and protect property. Mr. Smith is attempting to obtain financing for the purpose of constructing the improvements which have been approved by the City Commission. The lender, as a condition of the financing, is requesting that Mr. Smith obtain an agreement from the City of Sanford to subordinate its ground lease to Freedom's mortgage, and to include a notice of default and right to cure clause in the lease. Commissioner Fart moved to approve the modification of the lease! to include a notice of default and right to cure clause. Said resolution entitled as follows: RESOLUTION NO. 1447 A RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $8,000,000 GRANT ANTICIPATION NOTES, SERIES 1986, OF THE CITY OF SANFORD, FLORIDA; PROVIDING FOR THE PAYMENT THEREOF; ENTERING INTO CERTAIN COVENANTS AND AGREEMENTS WITH THE HOLDERS THEREOF; PROVIDING CERTAIN OTHER MATTERS IN CONNECTION THEREWITH AND PROVIDING AN EFFECTIVE DATE. Said resolution entitled as follows: RESOLUTION NO. 1448 A RESOLUTION AUTHORIZING AND APPROVING THE NEGOTIATED AND PRIVATE SALE OF NOT TO EXCEED $8,000,000 CITY OF SANFORD GRANT ANTICIPATION NOTES, SERIES 1986; AWARDING SAID NOTES TO THE PURCHASER THEREOF; PROVIDING FOR THE DELIVERY OF SAID NOTES TO THE PURCHASER; AND SETTING FORTH THE EFFECTIVE DATE OF THIS RESOLUTION. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA; SECTION 1: That the property described below situated in Seminole County, Florida, be and the same is hereby annexed to and made a part of the City of Sanford, Florida, pursuant to the voluntary annexation provisions of Section 171.044, Florida Statutues: The North 200 feet of the SE 1/4 of the SE 1/4 of Section 12, Township 20 South, Range 30 East, lying South of State Road No. 427, less the North 200 feet of the East 180 feet of the SE 1/4 of the SE 1/4 of Section 12, Township 20 South, Range 30 East, Seminole County, Florida. B. Peterson Jr., representing C. W. Davis, appeared to report a garbage problem on a 32 acre lot between 25th Street and Celery Avenue. Mr. Peterson stated that in 1985 the lot was covered with used cars, discarded concrete, and garbage and he hired heavy equipment to clean it. The situation in Washington Oaks Subdivision is there are buildings built across the property lines; there are gardens that have been planted on this acreage by the surrounding residents; and there is more garbage on the lot this year. Mr. Peterson suggested mowing around the major obstructions and set up a depth factor for mowing. The Commission directed same to Staff to determine the proposed depth factor for mowing, and directed Staff to review the refuse regulations and submit recommendations. Commissioner Farr reported the resignation of Reverend Connelly from the Historic Preservation Board, and moved to appoint Ricardo Loar to fill the unexpired term. Sara Jacobson reported Bill Abernathy of the Sanford Downtown Business Association would make recommendations for the benches and tables. The City Mananger reported receipt of notice from State of Florida that Sanford had been awarded $50,000 for a Park Grant for the development of Lee Moore Park. Adrian Boyd appeared to request a plaque in the memory of his great-great- grandfather, Seth French, and his residence located at Third Street and Elm Avenue be considered by the Historic Preservation Board.
