101386-Regular SessionMINUTES City Commission, Sanford, Florida 045 October 13, 19 ~ The City Conmmission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 13, 1986. Present: Mayor-Commissioner Bettye D. Smith Conmmissioner John Y. Mercer Commissioner Milton E. Smith Commissioner David T. Buzz Petsos, Lake Mary City Commissioner, appeared to submit a letter as follows: 323 - '7910 September 30, 1986 To: Seminole County Commission City of Sanford, Mayor 5 Commission We, the Lake Mary City Commission, wish to formally protest the realignment of the proposed center line of Lake Mary Boulevard, as it passes Groveview Villa Apartments. This realignment obviously favors a commercial project over the ecology of Big Lake Mary and its residential homeowners. When'this project was built, ignoring the proposed setbacks that Lake Mary, Sanford, and Seminole County had agreed upon; we s.tated grave concerns that the widening would be forced on the South side by this project. We were told that this would not be the case, that no one project or building would decide the alignment of Lake Mary Boulevard. Itowever, it is totally obvious from looking at the plans that our concerns were well taken. As the center line approaches Groveview Villas from C-15, it is obvious that the center line shifts abruptly-SOuth tO accommodate this project and take further land from our citizens. We are also concerned about the ecology of Big Lake Mary and again, it seems as though this has taken a back seat to Groveview Villas. We have been assured that every effort would be made to keep the widening project as far from the lake as possible, so as to afford the maximum protection for the ecology of the lake from runoff and pollutants, but, again, these concerns were put on a lower priority. In summation, we unanimously protest this center tine shift, which obviously favors Groveview Villas and has no consideration for the property values and damage to the ecology of our citizens. We urge that whatever steps are necessary be taken to correct this action and urge your support to help us see that justice is served. Commissioner Farr moved to request Seminole County to withhold action approving the alignment until the three entities can review and work with each other on the proposed alignment. Those in support of the rezoning were as follows: Polly Hutchins, Navarra-Hutchins, Inc., 350 Melody Lane, Casselberry, Florida. Bob Seigler, Seigler Realty, Inc. Mrs. Henry Taylor, 1265 Myrtle Drive, representing the Sanford Garden Club, appeared to oppose the zoning. Commissioner Farr moved to request the Planning and Zoning Commission reconsider their recommendation to deny the rezoning from SR-1 to GC-2 for use of mini-warehouses. Seconded by Commissioner Thomas and carried by the vote of the Commission as follows: Commissioner Mercer Commissioner Smith Commissioner Fart Commissioner Thomas Mayor Smith Naye Yea Yea Yea Naye Charles Cameron appeared to request a special exception to the zoning ordinance to have an adult congregate living facility in an area which is zoned SR-1A, located at 2005 South Oak Avenue. Alice Bowen, 2000 South Park Avenue, appeared to support the request. Mrs. Pat Hardin, 2009 South Oak Avenue, appeared in opposition. Leroy Townes, 2100 South Oak Avenue, appeared in opposition. The City Attorney reported that there is no conditional use permitted by the Zoning Ordinance in the Single-Family District for this type of operation. After discussion, Commissioner Smith moved to hold a Public Hearing because the neighbors do not know about the living facility, and for the purpose of allowing the people to know what is happening in the neighborhood. Judy Sanders, 510 Oak Avenue, appeared to request that a site proof fence be installed~on the South property line to keep the automobile headlights out of her house and the traffic off her property. Commissioner Mercer moved to approve said request, on a six month trial basis, with the stipulations'as follows: Four inches of lime rock base and three inches of mulch for seven parking spaces and the alley. Curb along the South property line and parking spaces to be surrounded with curbing to hold the substance. A site-proof fence to be installed on the South property line. The Commission declined to approve the request for re-consideration. 052 MINUTES City Commission, Sanford, Florida October 13, 19 86 The City Manager submitted a memorandum from the Director of Engineering and Planning as follows: MEMORANDUM TO: City Manager~ October 7, 1986 FROM: Director of Engineering and Planning SUBJECT: Amendments #13 and $14 to Conklin, Porter and Holmes Engineering Contract Mr. Faison: I have reviewed the subject amendments forwarded to you formally on October 3, 1986. These amendments are for final design of effluent filtration, disinfection, storage, pumping and transmission facilities, and final design of wastewater effluent spray irrigation systems, respectively. The contracts in their present form are the result of prior meetings and negotiations between myself and Paul Porter, and are, I feel, in the best interest of City of Sanford. The "not to exceed" dollar amounts of these two contracts are $347,460.97 and $193,618.27, respectively. While these costs appear large, it must be recognized that these contracts will produce final design, plans and specifications for the complete "fix" of our wastewater effluent problem. The bulk of the costs of these contracts will be grant eligible, howevers, some percentage, where facilities for additional capacity is being provided, will not be grant eligible. Additional capacity is being provided in those plant and system elements where logical to produce a "balanced" system. It is requested aPProval of these contracts be placed on the agenda for the October 13 City Commission meeting. On recommendation of the City Manager, Commissioner Farr moved to approve amendments to the Conklin, Porter and Holmes contract as follows: Amendment $13 Final Engineering Design of Effluent Filtration, Disinfection, Storage, Pumping and Transmission Facilities. Commissioner Farr moved to authorize the City Attorney to prepare the proper ordinance to amend Ordinance No. 1784, regarding Water and Sewer Impact Fee. Commissioner Smith moved to authorize transfer of funds from contingency to reinstate funds in the 1986/87 Recreation Department budget for after school centers and gym programs for 1/4 of the year for a trial basis in the amount of $6,755.00. The event will start with an antique auto show beginning at 8:00 a.m. and closing at 4:00 p.m. They are requesting that Park Avenue be blocked off from traffic from Seminole Blvd. to First Street plus block traffic entry from Commercial and Fulton to prevent traffic entering Park Ave. any place between Seminole Blvd. and First Street. They plan to display all the antique autos along the blocked portion of Park Avenue from 8:00 a.m. to 4:00 p.m. at which time the street would be open for normal traffic. The second part of the promotion would be a "cruise" or parade of old cars in a route through town beginning on East First Street after 5:00 p.m. and heading west to Myrtle; north to Seminole; east to Mellonville; south to First Street and continually loop the downtown area for 30 to 40 minutes. Director recommends approval of street barricade from 8:00 a.m. to 4:00 p.m. and also recommends that City Commission instruct Mr. Mitch Carroll of Radio WUEZ (Z-14) to coordinate the "cruise" around town with Chief of Police in regard to needs. MINUTES City Commission, Sanford, Florida October 13, RECOMMENDATIONS Recommended the denial of the request to rezone property located east of 17-92, north of Fairmont Drive and west of Cherokee Circle from SR-1A to GC-2 for the purpose of mini-warehouses. The proponent chose only to respond to any objections instead of presenting arguments for the rezone. The only objection was one of property devaluation. An adjacent property owner did request the placement of conditions upon the development of the site 1. a buffer wall 2. lighting to be directed away from the residential property 3. prohibition of any on-site burning 4. ban of any outside storage The initial motion to recommend approval of the request failed by a vote of 3 to 4. The motion to recommend denial of the request passed by a vote of 4 to 3. The Public Hearing to consider the request for a rezoning from SR-1A and AD to RC-1, property located north of CR 427 and west of the south Carriage Cove entrance was tabled until October 16, 1986 for lack of representation. Recommendation that the City Commission change the licensing procedure by ordinance so that a new owner of an existing business (not a renewal) be required to bring that business up to the applicable codes through the site plan procedure. The Commission felt that 1.) non-conforming structures, 2.) sites in existence before the existing codes were in effect, 3.) sites that have lapsed into non-compliance (i.e.: removal of landscaping, change in parking layout, etc.) are now exempt from the review procedure with only a change in ownership. Only a change of use that has different site requirements, starts the site plan procedure on existing buildings.
