The meeting was called to order by the Chairman.
The first item of business was the continuation of a Public Hearing, refer~

In the past, the City has annually conducted its own auction
of surplus property. We feel that our surplus property will
receive broader exposure (and generate increased revenue) by
joining with Seminole County's auction.
Florida Statute $274, requires that the City Commission
authorize the sale of surplus property listed on Attachment
1 for public auction to be held in conjunction with Seminole
County on November 15, 1986.

The next item of business was the continuation of a Public Hearing to cons
)urchase of a site for land application of treated wastewater effluent, located East
fessup and South of State Road 46 in Seminole County, comprising approximately 2,200
tnd lying East of the City of Sanford.
The City Manager reported the City's counter offer of $1,872,000 had been
:ejected, and the owners had withdrawn their rejection late this afternoon and a pti,
;4,000,00 was offered.
Commissioner Mercer moved to counter offer with $2,200,000. Seconded by

The City Manager submitted a memorandum from the Police Chief as follows:
MEMORANDUM
November 7, 1986
TO:

SUBJECT: Police Telephone System
After extensive study and consideration of various telephone systems,
I am recommending that our current AT&T "Horizon" system be replaced
with a Jarvis "EZ-1/96" system/
Our current system is completely "maxed" out and no room for growth
exists without costly modifications to the system.
Due to budgetary constraints prohibiting the outright purchase of the
Jarvis system at $20,400., I am recommending a lease/purchase
arrangement with monthly payments of $963.99/month for equipment,
lines and 24 hr. a day, 7 days a week maintenance and service. Our
current lease/purchase cost for the AT&T system is $1,186./mo. with
$90.00 service charges billed when service is requested. The savings
is $222.01/mo. with our line capacity doubled, maintenance contract
included, system expansion available and system adjustment
capabilities.
From studying and receiving presentations from Jarvis, AT&T and United
Telephone, we believe Jarvis is the best system for our needs. It is
the lowest quote and also the most suitable system for the police
department.
I recommend emergency procurement due to the fact the police
department's telephone system is at its maximum use. With new
positions being filled in Investigations and the Vice Unit,'additional
phones are necessary. Currently, officers are sharing extensions.
This is time consuming and decreases productivity.
AT&T has quoted a buy-out cost of $5,118. to sever the existing
contract. There is a possibility that this will not be necessary.
This is a legal question that needs to be pursued. In any event,
should the buy-out be required, sufficient surplus funds are available
in the police department's capital budget to cover this cost. Other
one time conversion costs consist of $171. to Southern Bell for line
connection charges and $50. for the necessary electrical connections.
Respectfully recommend authorization for emergency procurement of the
Jarvis system and authorization for line item budget transfers to
cover AT&T contract buy-out cost if necessary.

Mr. Faison:
In response to the question raised by Commissioner Mercer on
November 3, I have compared the present street paving contract list
with the resurfacing program approved by City Commission on January
28, 1985. A copy of that original list is attached. Several streets
or street segments included on the original list are not currently
included on our existing contract. Temporary deferral of most of
those streets resulted from projected major utility work, especially
combined sewer separation projects. I believe City Commission was
briefed on these proposals. These streets included the following from
the 1985 list:
3. 3rd Street - Sanford Avenue to Persimmon Avenue
4. West 13th Street - that portion between Mulberry and
Dixie Way (West 13th between Mulberry and Dixie Way
requires new storm drain culvert.)
5. 9th Street - Sanford Avenue to Poplar Avenue
7. 6th Street - U.S. 17-92 to Pecan Avenue
13. Park Avenue - Seminole Blvd. to 25th Street
18. Florida Street - U.S. 17-92 to Georgia Avenue (Included
in recommended change order).
1st Street between Oak and French Avenue has also been deferred for
reconstruction until after Christmas Holidays.
Most streets above were recommended for deferral because of a
significant probability that the combined sewer separation project
would involve placing new sanitary sewers and possibly also storm
drain lines in a number of north-south streets between French Avenue
and Sanford Avenue, as well as cutting most of the east-west streets
between 2nd Street and 13th Street. We are now considering
alternative technology for correction of the combined sewer problem
which may not require laying large diameter gravity sewers in the
street rights-of-way. This could allow us to move forward with
significant street paving in the "combined Sewer area" within the next
6 to 12 months, without the prospect of doing significant excavation
on newly resurfaced streets. I therefore recommend that we continue
to defer resurfacings, generally, in the "combined sewer area" until
approximately October 1987. This would coincide with a follow-on
phase of street resurfacing program which could be financed with gas
tax revenues received subsequent to September 30, 1986.
My memorandum of October 23, 1986 recommended that we move
forward with a new approximate $500,000 street resurfacing contract
utilizing a combination of gas tax money and "reserves". A
recommended list of streets for inclusion in this contract is
attached. It is requested that City Commission approve the
advertisement of this contract for the listed streets at their
November 10 meeting in order that we may advertise this contract as
well as the contract for 1st Street reconstruction with bid opening in
mid December. I feel it will be especially beneficial to determine
the low bidder on these contracts prior to completion of our ongoing
street resurfacing contract.

Mr. Faison:
The attached letter from Ms. Peggy Nestor requests a waiver for
the requirement to install fire doors pursuant to the 1983 rezoning
and associated resolution by City Commission requiring installation of
appropriate fire walls and fire doors. Attachments to her letter
include a signed copy of a contract for installation of a complete
fire sprinkler system for the structure. Also attached is a statement
from the Fire Prevention Officer that states that the existing doors
are acceptable under the Life Safety Code provided that the doors
close tightly, are provided with latches, and that a complete
automatic sprinkler system is installed.
The subject property has been cited by the Building Official for
not having fire doors installed. This citation grew out of the 1983
resolution and enforcement of certain aspects of the Southern Building
Code, for protection of building occupants. The Southern Building
Code does not address automatic sprinkler systems, nor does it address
any elimination of fire door requirements as a result of automatic
sprinkler installation.
Since the Life Safety Code, utilized by the Fire Department,
deals almost exclusively with protection from hazards of fire while
the Southern Building Code treats a wide spectrum of structural and
construction considerations, it would appear appropriate in the case
of conflict to give greater weight to the Life Safety Code
requirements. I would therefore recommend that City Commission give
the requested waiver.
The nomination of 500 Oak Avenue to the National Register of
Historic Places has been promised, but up until now I have seen no
"hard copy" reflecting the progress of this nomination. Attached is a
copy of a letter of October 29, 1986 from the Florida Division of
Historic Resources. This letter, to Ms. Nester, indicates that the
nomination proposal has been received, and appears to be complete and
properly documented. It further states that this nomination is
tentatively scheduled to go before the Florida National Register
Review Board in February 1987. It is requested that this letter be
accepted as sufficiently documenting the progress and potential for
designation of this property as a historic place, to as a minimum
justify deferral of any action, such as replacement of existing doors,
pending final registration or rejection of the request for
registration. If City Commission agrees then I recommend that a
temporary waiver of the requirement for installation of fire doors be
considered.
It is requested that this item be placed on the first available
City Commission meeting agenda because of pending Code Enforcement
Board action regarding the fire doors and the issuance of a City
license which has been held up pending compliance with the fire
wall/fire door requirement.

RECOMMENDATIONS
After a motion to recommend denial of the request, by owner
Caroline Zull, to rezone from SR 1-A to GC-2, property located
east of Hwy 17-92, west of Cherokee Circle and north of Fairmont
Drive, was defeated by a vote of four to two, a motion to
recommend approval of the request was approved by a vote of four
to one. Mrs. Hutchins and Mrs. Zull, representative and owner,
in speaking for the request, felt that mini-warehouses, the
intended use, would be the best use for the land. The homeowners
who objected to the rezone felt that the request would evolve
into a highly developed commercial area abutting their single
family area.
Recommended the denial of the request to rezone from MR-1 to
RMOI, property located on the east side of Park Avenue from 21st
Street to 24th Street for Dr. Runge, Mr. and Mrs. Clendening, Mr.
and Mrs. Bartnett, Mr. and Mrs. Tomlinson, Mr. and Mrs.
McClanahan and the Church of Latter Day Saints.
Although they were sympathetic to Dr. Runge and spoke highly of
the quality and character of his non-conforming use, the
neighbors objected to any change in zoning that could affect the
character of the neighborhood as a hole.
Mr. Knowles, representative for the request, explained that 'Dr.
Runge wishes to rezone in order to protect his non-conforming
status. He is concerned that, if he sells to another dentist, he
would be unable to complete the transaction within the six
months' time limitation and that his use would expire. The
chairman felt sure that the City would be receptive to resolving
any difficulties that could arise from this constraint.
The City Clerk reported a Public Hearing had been advertised for November 24, i!
ards to Item No. 2.
Commissioner Mercer reported that the Scenic Improvement Board has suggested th~

to do so. The Commission authorized same to be placed on a future Workshop agenda.
Commissioner Mercer reported of having received a letter from Mildred Caskey of
