A Public Hearing was held in accordance with Notice published in the EveninG Herald on January 16, 1987, as follows: NOTICE OF PROCEEDING FOR USE OF STREET RIGHT-OF-WAY TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on January 26, 1987, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will permit the use of parkinG by the New Salem Primitive Baptist Church of Oleander Avenue lying South of 12th Street and between Block 6 and Block 7 of Meisch's Subdivision. Persons interested may appear and be heard at the time and place specified. John KniGht, 1817 Harding Avenue, representing the New Salem Primitive Baptist Church, appeared to answer inquires. Rosa Coachman, 1502 Williams Avenue, appeared in favor of the permitted use. Commissioner Mercer moved to approve the permitted use with stipulations as follows: The residents along Oleander Avenue may use the parking lot also. Subject to site plan review by the Department of EnGineerinG and PlanninG and the Planning and ZoninG Commission. Subject to the surface treatment for pavinG and drainage is approved by the City Staff before any improvements are made. Seconded by Commissioner Thomas and carried by the vote of the Commission as follows: Commissioner Eckstein Commissioner Mercer Commissioner Thomas Commissioner McClanahan Mayor Smith Yea Yea Yea Yea Yea The Commission next considered an appeal of a site plan denial from the PlanninG and Zoning Commission for Shoney's Restaurant to be located at 3200 Orlando Drive. Gary Sharp, representing Shoney's Restaurant, appeared to report the franchise MINUTES City Commission, Sanford, Florida January 26, 19 87 required seventy (70) parkinG spaces and the PlanninG and ZoninG Commission would allow only forty-six (46) spaces in an effort to save various pine trees. Mr. Sharp submitted a plan to save some of the trees and proposed to plant numerous oak trees at the site. The restaurant would be a 1.2 million dollar construction project, includinG approximately $15,000 for landscapinG, and when completed would seat 166 patrons, employ 70 to 80 people with a payroll of $250,000/$300,000 a year. Commissioner Thomas moved to approve said site plan. Seconded by Commissioner McClanahan and carried by the vote of the Commission as follows: Commissioner Eckstein Commissioner Mercer Commissioner Thomas Commissioner McClanahan Mayor Smith Yea Yea Yea Yea Yea The City ManaGer submitted a memorandum from the Director of Utilities as follows: MEMORANDUM JANUARY 8, 1987 TO: FROM: SUBJECT: City ManaGer Utility Director Pinewood Trail Apartments (Kimmins Corporation) Mr. Faison: We have received a letter from Kimmins Corp., the developer for Pinewood Trail Apartments, requesting a refund on the water and sewer impact fees which were recently lowered. Kimmins Corp. has paid to date a total of $457,500. The total amount due for the entire project at the reduced rates is $421,825. I am requesting the authorization to refund Kimmins Corp. $35,675 from the Utility Trust Fund. Commissioner Mercer moved to authorize the refund and to authorize Staff to make any other refunds as lonG as Staff can calculate and agree on the appropriate refund in accordance with Ordinance No. 1845. Unanimously recommended the approval of the request to rezone from MR-2 to PUD for Placid Lake Patio Homes, property located on proposed Placid Lake Blvd., north of Airport Blvd., west of Reservior Lake and east of Old Lake Mary Rd. subject to the resolution of: 1. John Moseler, representative for ZOM-Sanford, proposed to offer moneys in lieu of park dedication because the 1.6 acre requirement of open space is below the guidelines for usable park acreage. They would like to give money to purchase necessary property to add to Hovanian Park. The Board wishes to see the open area within the development. Although effluent irrigation and its required committed takeback requirement of 270 GPD is not well suited to a zero lot-line single family development, ZOM-Sanford would agree to installing a treated effluent line that would facilitate its use in the multi-family and commercial areas of the plat. The Commission next considered Change Orders for First Street Phase II Streetscape and Reconstruction, discussed at the January 19, 1987 Workshop Session. Director of Engineering and Planning, reported receipt of verbal proposal from the low bidder, having not reviewed a written proposal, their dollar proposal for the Streetscape work would be not to exceed $27,350, and reported cost seem reasonable with previous Streetscape work recommended Commission consider to authorize the City Manager to execute a contract not to exceed the $27,350 and upon Staff review, award contract and proceed with the work. Commissioner McClanahan moved to hold consideration of awarding of contract until contract has been received and reviewed. We applied for this grant in December 1986 with the commitment to utilize $5,000 from the Historic Preservation Board budget for FY 86/87 for "matching funds".
