The City Clerk reported Notice had been sent to abutting property owners on March
Jack and Melanie Elkins, 312 Hidden Lake Drive, owners and petitioners, appeared
to report his house set on 8.16' into the 14' utility easement alonG the Northerly lot line
of Lot 49 and 4' in the the 10' utility easement lyinG along the Southerly lot line of Lot
49, and requested the utility easement on the North side be reduced from 14' to 5' and the
utility easement on the South side be reduced from 10' to 5', to allow his house and air
conditioning condensing unit to be totally free and clear of the easements.
Commissioner McCianahan moved to authorize the City Attorney to prepare the
proper ordinance to close, vacate, and abandon the Southerly 9' of that certain 14' utility

The Commission next considered the establishment of an Adult Congregate Living
Facilities Advisory Committee, appointment of members, and review of the City Attorney and
staff recommendations regarding ordinance changes.
Commissioner Mercer reported his opposition to the establishment of more advisory
committees, and moved to appoint the Planning and Zoning Commission to act as committee, to
recommend and report back to this Commission on this matter. Seconded by Commissioner
McClanahan and failed to carry by the vote of the Commission as follows:

RESOLUTION NO. 1476
A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
ESTABLISHING A GROUP HOMES AND FOSTER CARE
FACILITIES ADVISORY COMMITTEE.
WHEREAS, the City of Sanford, Florida recognizes that it
has the duty to plan for adequate sites in residential areas for group
homes and foster care facilities licensed or funded by the Florida
Department of Health and Rehabilitative Services; and
WHEREAS, the City recognizes that it is appropriate to
review the current regulations contained within the City Code
concerning group homes and foster care facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
SECTION 1. CREATED.
There is hereby created and constituted a Group Homes and
Foster Care Facilities Advisory Committee to be appointed and
confirmed by the City Commission.
SECTION 2. TERM.
The members of the Group Homes and Foster Care Facilities
Advisory Committee created by this Resolution shall be appointed for a

term of sixty (60) days and said term shall expire at the end of said
sixty (60) days from date of appointment unless specifically extended
by further action of the Sanford City Commission.
SECTION 3. DUTIES.
The Group Homes and Foster Care Facilities Advisory
Committee is empowered and directed to consider and study the current
City Code, together with Staff recommendations and to advise, counsel,
and report to the City Commission in writing its findsings,
recommendations, and conclustions within sixth (60) days from date of
appointment.
SECTION 4. EXPENDITURES.
The members of the Group Homes and Foster Care Facilities
Advisory Committee shall receive no compensation and may expend only
such sums as may be authorized and appropriated by the City
Commission.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed conditional use.
W. E. "Pete" Knowles, Pete Knowles and Associates, Inc., representing the owner,
Joe Gazil, appeared and-reported the property is presently undeveloped property and the
request is for used cars only - there will be no repairs, no servicing, no mobile homes.
Also there are used car lots located at Second Street and Palmetto Avenue, and at First
Street and Elm Avenue; both are less in size than what is being considered tonight. Mr.
Knowles presented a slide presentation of the visual view around the site and if this
application is approved Mr. Gazil has offered to put landscaping around the lot and to fence
the vacant lot, so there will be no question of trespass, and completely pave the unpaved
portion that is under his control.
Those persons appearing in opposition to the conditional use were as follows:

a Public Hearing continued from the Meeting of March 9, 1987, was removed from the table
regarding the second reading and adoption of Ordinance No. 1856, establishing a six-month
moratorium on all Transportation Impact Fees, and establishing a Transportation Impact Fee
Study.
The Chairman announced .that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed adoption of Ordinance No. 1856.
Fred Streetman, Chairman of the Seminole County Board of Commissioners, appeared
to thank the City Commission and City staff for their committed and consistent consideration
of the County Transportation Impact Fee ordinance as it has evolved to its current state;
the City staff has been most available to the County staff and other cities' staff who have,
in many ways, come to a meeting of the minds. Mr. Streetmen stated he was here to address a
request that evolved from City staff to County staff; Mr. Streetmen reported that County
staff had entered into discussion period with other city staffs with an open mind to try to
reach some accommodations with certain priorities that the cities might have that were
outside of the purview of the impact fee so that even though projects may not qualify for
impact fees, that maybe the county could move ahead some of its activity to both financial

and planning state, to meet some of the desires of some of the cities might have. One of
the ideas that was presented to the Board was the inclusion of Rhinehart Road as a collector
- that section from 46A to State Road 46. His staff looked into the request and found that
Rinehart Road did not qualify as a collector in term of the impact ordinance. However, his
staff went to work on evaluating this project and has directed County Public Works
Department to come forward with information and some estimates which are in hand on a rough
basis and beleive that the construction costs $600,000 per mile, totaling $1.2 million. The
Right-of-Way that would be for a two-lane rural section road; Right-of-Way acquisition would
take about 8 months; design of Rhinehart Road, 6 months; 4 months involved in permitting;
and construction about 10 months. A project about 2% years in duration, providing they hit
no great snags in funding and extended condemnations to obtain the Right-of-Way. Funding
will come from the County's Constitutional Gas Tax and/or Local Option Gas Tax and/or
County-wide Tax. Mr. Streetmman reported he and his staff are personally committed to the
project as an inclusion in the interlocal agreement that we submit for the City of Sanford
to entertain.
Some discussion has arisen regarding extending Lake Mary Boulevard East from
County Road 427 to State Road 46; this is something that the County staff has been thinking
about; has been in the planning stages over the years; this is a long range goal - he is not
able at this time to give any definite information, it is something they are not putting on
the back burner but it is a long range goal.
Mr. Streetman reported on recent changes in the currently proposed Transportation
Impact Fee Ordinance - (1) City technical staff should have greater input into the process
of the annual updates, they have included in their ordinance a formation of a technical
committee to be made up of technical representatives of the cities who will evaluate the
situation as to what may have changed in the course of the year as far as estimated growth,
growth projeCtions, and income; will be monitoring the County's physical position and
income; and will make recommendations on a technical standpoint to the advisory committee;
each city will have technical representation; (2) the County looked at the strucutre of
their advisory committee, they were cautioned not to dissolve the advisory committee and
then come back and reform it with a bunch of new people because it would loose its
continuity. The Board of County Commissioner did appoint the current 17 members of the
advisory committee - many of the people are current residents of the cities. Any ordinance
will be a statement that each city will appoint one additional member to go on this advisory
committee of 17.
Also, as part of a final action of the Board of County Commissioners, in the final
draft of the ordinance, the original ordinance was set to become effective ten days after
its passage, the Board has been very sentitive to the possibility of a given city or
municipality may feel something was trying to be forced down their throat and they were
hitting a deadline that required a quick action necessary; in order to avoid that, they have
made the effective date of the ordinance as far as municipalities are concerned, would be 90
days after its passage. This gives everybody substantial breathing time and hopefully
eliminates the need to take some drastic reactions prior to having the opportunity to

discuss and resolve any disagreements that might be appearing. In summary, there are two
collectors in the Eastern part of the county; four districts proposed for this ordinance, a
Northern District, a Western District, a South-Central District, and an Eastern District.
The recommendation that would be coming from County staff is that the impact fees, based
upon a residential fee, for the three Southern Districts - West, South-Central, and East,
would be $529.00 per residential unit, and in the Northern District (including City of
Sanford and City of Lake Mary) would be $445.00 per residential unit. $404.00 of each of
these fees everywhere is applied to roads categorized as arterials roads, such as Lake Mary
Boulevard, County Road 427, Sanford Avenue, Airport Boulevard. The remainder of that fee
would be used on designated collectors, in the case of the Northern District that would be a
fee of $41.00 per residential unit that would go toward the designated collectors. The
collectors in the Northern District are (1) 46A from Rinehart Road to 431 (Orange
Boulevard), and (2) Lake Mary Boulevard from I-4 west to Markham Woods Road.
Mr. Streetman stated that the County and the City have demonstrated the ability to
work together on this concept and he believes all share the viewpoint that one thing the
county needs above everything else is improved transportation. They tried to originate an
ordinance that would be fair and aquitable. We do have the support of the people who will
be most impacted and that's the builders and the developers - they have endorsed this
concept and have endorsed the current structure, and we are pleased to have worked so well
with the City up to this point. Mr. Streetman requested that the City Council consider
withdrawing the second reading of this ordinance or at the very lease to table it
indefinitely.

The Commission recessed at 7:25 P. M. and re-assembled at 7:35 P. M.
The Commission next considered a proposed contract from the Florida Center as the
performing agent for the University of South Florida for a consultant design plan for "The
Westside NeighborhOod Strategy", a revitalization of a westside neighborhood, as presented
to the Commission at the Workshop Session of March 23, 1987.
David T. Fart, Executive Director of the Greater Sanford Chamber of Commerce.~
appeared to encourage the municipal endeavor of the Westside project, and presented the
Commission with a check in the amount of $3,000 to begin the effort for funding the
feasibility study for the Westside/Goldsboro redevelopment project, and same was accepted by
the Commission.
Commissioner Thomas moved to approve the contract for Phases I and II (design
phases) for an amount not to exceed $47,100, with option to consider Phases III and IV at a

Commissioner Mercer reported the Commission's Minutes of October 13, 1986,
reflected a request from the Planning and Zoning Commission on changes and licensing of site
plan procedures having to do with change of ownership rather than change of the type of
business. At that time, the Commission asked the City Attorney to review and report, and
Commissioner Mercer asked the City Attorney on the progress in that regard.
The City Attorney reported he would check with his staff on the progress.
Commissioner Mercer reported that once a site plan has been approved, there is
no requirement to keep that site plan maintained, and requested the Planning and Zoning
Commission to make a recommendation to amend the code to require the site to be maintained.
Commissioner Mercer reported receipt from Mr. Benford of the Contractor Sale and
Purchase for approximately 1,700 acres on State Road 46, East of the City, for a possible
site for effluent disposal. The contract was for ninety (90) days and stipulated it could
be renewed for another ninety (90) days for $1.00. Commissioner Mercer stated he would pay
both of those $1.00. The contract is for $1,615,000.00.
Bill Simmons reported his receipt of the same contract - appearing to be a sales
contract opposed to a option contract, and requested the Commission table any action until
staff has reviewed the document.

The City Manager reported a Public Hearing to consider Mr. Stumps' Appeal of a
Conditional Use of a Denial by the Planning and Zoning Commission has been set for April 13,
1987.
