042087-Workshop SessionMINUTES City Commission, Sanford, Florida April 20, 321 19 87 The City Commission of the City of Sanford, Florida, met in Workshop Session in the City Manager's Conference Room of the City Hall in the City of Sanford,.Florida, at 4:.30 o'clock P. Faison City Clerk H. N. Tamm, Jr. Absent: City Attorney William L. Colbert The meeting was called to order by the Chairman. Mrs. Doris Thomas, President of the Academy Manor Homeowners' Association, appeared to report problems with traffic in Academy Manor Subdivision and on Airport Boulevard. The Commission directed staff to investigate another entrance into Academy Manor. Mrs. Thomas reported Mr. Deoreo, a developer, has plans to add seventeen houses, and construct restrooms for Academy Manor Park, and requested the restrooms not be kept open all the time, but allow the neighbors to have the keys to control access. The Commission asked Mrs. Thomas to talk with Jim Jernigan, Director of Recreation and Parks, regarding the key for the restrooms. A letter dated April 7, 1987 from A. B. ABPJP,/mgs let' s see h~.: they / · . _eterson, J~. ]22 MINUTES City Commission, Sanford, Florida __ April 20, 19 87 Mr. Peterson and Judge Joe Davis appeared to support the request for a curator for the General Henry Shelton Sanford Memorial Library and Museum. The Commission authorized same to be considered at the next regular meeting. Wes Rinker, leasee of the Municipal Stadium, stated he was appearing to .respond to recent editorials in the local newspaper regarding discussion of the exchange of the stadium for School Board property. Mr. Rinker stated he was not willing to vacate the stadium, and in fact, had expansion plans in the future. Ted Edwards, attorney for Mr. Rinker, appeared to opine that upon such transfer, the School Board could condemn the leasehold interest of Mr. Rinker. The Commission next reviewed a resolution registering strong opposition to the routing of an expressway through the City of Sanford, and authorized Resolution No. 1478 to be considered at the next regular meeting. The City Manager submitted a memorandum from the Director of Engineering and Planning as follows: MEMORANDUM APRIL 3, 1987 TO: FROM: SUBJECT: City Manager Director of Engineering and Planning French Avenue Railroad Crossing Reconstruction Mr. Faison: The attached FDOT letter of March 25, 1987 is the most recent chapter in our ongoing efforts to have the railroad crossings on French Avenue at 13th Street and 6th Street improved. We are still moving toward installation of high grade rubber railroad crossings. FDOT is now showing a prospective schedule of August to October, 1987 for accomplishment of both these cross-ings. Since the Railroad requires complete closure of the street during installation of a rubber crossing, concurrent installation of both crossings is planned. Actual time for installation and associated road closing should be approximately 1-week. One change from prior reports is that the requirement is now seen for installation of a complete rubber crossing at French Avenue and 13th Street, instead of a composite crossing consisting of rubber for French Avenue and timber for 13th Street. Review of turning patterns in the French Avenue - 13th Street intersection has revealed significant left turning traffic in various directions which creates a problem with regard to locating an acceptable transition point from rubber to tember crossing construction. FDOT and the Railroad are therefore pushing for installation of an all rubber crossing, rather than a composite. This will increase the cost estimate of City of Sanford's share from approximately $20,000, now included in the FY 86/87 budget to a new cost estimate of approximately $41,000. I feel we have no choice in this matter, if we are committed to the rubber crossing on French Avenue. I highly recommend that we install the rubber crossing because of longer life and smoother riding characteristics. I recommend that the additional approximate $21,000 be earmarked from current year gas tax revenues. The Commission authorized same to be considered at the next regular meeting. The City Manager submitted a memorandum as follows: MEMORANDUM DATE: APRIL 17, 1987 TO: CITY COMMISSION FROM: CITY MANAGER SUBJECT: NEW SALARY SCHEDULE MINUTES City Commission, Sanford, Florida April 20, 19 87 As part of budget preparation, I am proposing a change in the existing City Salary Schedules. There are several reasons that necessitate such a change in our present system. This new schedule is an improved administrative tool providing management flexibility. New personnel/payroll software to be introduced this year will implement a need for schedules that can be computerized utilizing regular arithmetic deltas. These new schedules also integrate several separate pay incentives into established pay grades, thus eliminating accounting "nightmares". Some positive aspects of the new schedule are the ability to effect promotions giving consistent increases and an improved longevity system. The cost over and above what would have been, had we kept the old schedules, with a C.O.L.A. of 1.1% for FY 87/88, is $129,511.00. Recommend approval of these new schedules. attached.) (Sample page The City Manager submitted a memorandum recommending increasing the City's contribution to a structured "Cafeteria Plan" to be contracted through a Third Party Administrator and implementation to be incumbent upon software replacement. The Commission requested more information. The Commission next reviewed the Code Enforcement Board's pending charges against property at 500 Oak Avenue. Faison, City Manager City of Sanford, Florida 3~' Sanford City Hall Post Office Box 1778 Sanford, Florida 32772-1778 RE: STATUS OF PENDING CODE ENFORCEMENT BOARD CASES AT 500 OAK AVENUE Dear Frank: Upon researching the minutes of the Code Enforcement Board and Commission meetings, I have determined the status of the three ~'3) cases to be as follows: (1) CEB Case No. 86-55 - Violation of Resolution 1364A: T,~e Code Enforcement Board found Mrs. Nestor in non- compliance of the City Codes, specifically the firewall rating due to the transoms and the doors, and a fine of $25.00 per day was assessed immediately. The Code Enforcement Board Order was signed and hence became effective on September 17, 1986. The property was brought into compliance when the Commission granted a waiver of the fire doors on November 10, 1986. The Code Enfcrcement Board fine runs from September 18, 1986, until November 9, 1986, which is 53 days at 525.00 per day for a fine of $1,325.00. 32 4 MINUTES City Commission, Sanford, Florida April 20, 19 87 (2) CEB Case No. 86-168 - Violation of Parking: On September 30, 1986, the Code Enforcement Board found Mrs. Nestor had electria! wiring and parking violations on her property and "gave her till October 15th to comply and if she was still in violation, a fine of ~250.00 per day be imposed". On October 13, 1986, the Commission granted a waiver of the parking requirements, on a slx month trial basis, with the stipulations as follows: 1. Four inches of lime rock base and three inches of mulch for seven parking spaces and the alley. 2. Curb along the South property line and parking spaces to be surrounded with curbing to hold the substance. 3. A site-proof fence to be installed on the South property line. On October 30, 1986, Mr. Florian, Code Enforcement Officer, reported the electrial violation was in compliance and the Engineering Department had accepted the par~i, ng. The ACode EnforCement Board agreed to' table the issue until there was clarification on the curbing in reference to wooden curbs versus concrete. Subsequently the Commission accepted the wooden curbing~ The fine ran from October' 15, 1986, until October 29, 1986, at a ~ate of $550.00 per day for a total of $3,500.00 unless Mrs. Nessor has evidence she complied with the Code Enforcement Board's Order as to both the parking and electrical violations prior to October 30, 1986. (3) CEB Case No. 86-189 - Violation for No Occupational License On October 30, 1986, the Code Enforcement Board found the property "in violation of Section 16-1 cf Chapter 16 cf the Sanford City Code at this stage and at the next City Commission meeting, if she (Z4rs. Nestor) is not granted a waiver, a fine of $50.00 per day would start immediately." On November 10, 1986, the Commission granted a waiver of the fire-door requirements. The Code Enforcement Board fine was conditioned on Mrs. Nestor not securing a waiver of the fire door requirements. As Mrs. Nestor -did obtain a waiver of the fire doors, the fine never began running. If you should have questions, please feel free to call me. The Commissidn next reviewed a letter dated April 14, 1987 from the City Attorney regarding a proposed settlement with Seminole ~P.unty.on the annexation litigation. MINUTES City Commission, Sanford, Florida April 20, 325 19 87 The City Manager submitted a memorandum from the Director of Engineering and Planning as follows: MEMORANDUM APRIL 16, 1987 TO: FROM: SUBJECT: City Manager Director of Engineering and Planning Purchase option for R. S. Futch Property (1700 Acres) Mr. Faison: The attached contract for sale and purchase/option for the subject property is forwarded herewith. As noted by City Attorney it appears to be an acceptable form, other than Paragraph 3 of the Addendum which specifies that the buyer agrees to submit a plan for wastewater effluent disposal to proper authorities on or before April 25, 1987. At this late date it is essentially impossible to comply with this provision. If the option is to be executed by the City, this paragraph should be crossed out and initialled. Based on information received at our meeting with Department of Environmental Regulation (Orlando) on April 16 it appears that no decision could be reached within a period of approximately 2-years regarding any possible use of this site for effluent treatmetn or disposal. This is not a question of how much effluent the site could handle but rather whether or not the site could handle any effluent. Under these circumstances I certainly could not recommend purchase of the property. If no decision to purchase could be reasonably made within the next 2-years it would appear fruitless to execute an option which will expire on May 25, 1987. It is therefore recommended that City Commission not authorize the execution of the attached contract. No action was taken by the Commission. The Commission next reviewed a DOT permit application and plans for median improvements along S. Ri 15-600 (17 & 92). The Chairman announced the Sanford Women's Club __Ww~ ..... iorganizing a civic project, with proceeds to go to this project. The Commission directed the City Manager to process the application. There being no further business, the meeting was adjourned. ATTEST
