042787-Regular Session MINUTES City Commission, Sanford, Florida April 27, 19 87 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on April 27, 1987. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner John Y. Mercer Commissioner Bob Thomas City Attorney William L. Colbert City Manager Frank A. Faison City Clerk H. N. Tamm, Jr. Absent: Commissioner A. A. McClanahan The meeting was called to order by the Chairman. The first item of business was the presentation of the Third Annual Warren E. "Pete" Knowles Service Award. Mr. Knowles presented Mildred M. Caskey with a plaque. On motion of Commissioner Mercer, seconded by Commissioner Thomas and carried by the vote of the Commission as follows: Commissioner Eckstein Commissioner Mercer Commissioner Thomas ,Mayor Smith Yea Yea Yea Yea Resolution No. 1479 was read in full and adopted. Said resolution being in words and figures as follows: RESOLUTION NO. 1479 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, THANKING AND COMMENDING MILDRED M. CASKEY FOR HER YEARS OF SERVICE TO THE CITY OF SANFORD AS CURATOR OF THE HENRY SHELTON SANFORD LIBRARY MUSEUM, THE COMMUNITY BALLET GUILD OF SANFORD AND ANY ORGANIZATION THAT NEEDS HER ASSISTANCE, AND AWARDING.HER THE THIRD ANNUAL WARREN E. "PETE" KNOWLES SERVICE AWARD. WHEREAS, Mildred M. Caskey moved to Deltona, Florida, in the early 1970's after receiving her education, operating a successful School of Ballet for thirty-five years in Springfield, Illinois and being associated with the New York City Ballet, the Cornstock Theatre of Bradley University and the Springfield Municipal Opera and Theatre Guild; WHEREAS, after her move to Deltona, Mildred M. Caskey became involved in the community of Central Florida by serving on the Bram Towers Construction Advisory Board and moving to Bram Towers in the City of Sanf6rd, Florida, in 1973; WHEREAS, Mildred M. Caskey accepted the part-time, low- paying position of Curator of the Henry Shelton Sanford Museum Library and immediately donated long hours to improving the library, implementing the seasonal exhibit concept and establishing one of the most respected and used research centers for General Sanford's period of history; WHEREAS, in addition to her work with the museum and other orgainzations, Mildred M. Caskey for her outstanding service to the City of Sanford, Florida over the years as Curator of the Henry Shelton Sanford Library Museum, the Community Ballet Guild and other organizations and extends to her its best wishes for the future; SECTION 2: That in recognition of her outstanding service to the community, the City Commission awards to Mildred M. Caskey the Third Annual W. E. WHEREAS, there have been numerous public meetings amoung routing of an the citizens of the City of Sanford concerning the expressway through the City; expressed and Seconded by Commissioner Eckstein WHEREAS, the citizens of the City of Sanford have strong opposition to an expressway route through the City; disruptive little benefit to the overall expressway project; WHEREAS, routing through the City of Sanford would be to homes and businesses, extremely costly and provide cons ider vicinity extended first terminating the North end of the expressway in the of County Road 427/Sanford Avenue and Lake Mary Boulevard or to follow an Easterly route around the City of Sanford aand the expressway authority is encouraged to make the route East of the Sanford Airport and into and intersecting with Interstate 4 in Volusia County; NOW, THEREFORE, OF SANFORD, FLORIDA: 1. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed alley closing. The City Clerk reported Notices had sent to owners within the block on April 9, 1987. Harris Turner, attorney, representing the owners of Lot 22, appeared to oppose said alley closing, and reported while Lot 22 is undeveloped, should it be developed the alley would be needed to service that lot. Closing of the alley would take away from the access for utility service, and would create a "taking without compensation". Pierre A. Leveque, Jr., owner and petitioner, appeared to support the request, and reported a number of burglaries in the neighbor effecting him personally and his tenants. His objective in closing the alley was to install a fence to prohibit unauthorized entry into the alley. The pay for this position is $19,265 to $26,200. (Salary Schedule III19). If this position is to be effective June 15, 1987, an amount of $8,890.75 will be needed to cover salary and benefits. An additional amount of $3,000 will be needed to cover office furniture, phones, advertising, office supplies and equipment to effect the duties of the position. Recommend that the City Commission approve the job description and budget transfer in the amount of $11,890.75 from the Contingency Reserve. A. B. Peterson, Jr., President of the General Henry Shelton Sanford Memorial Library and Museum, appeared to support the staffing of a curator. After discussion, Commissioner Thomas moved to approve the job description, and to authorize the transfer of $11,890.75 from the unappropriated surplus. Carl Schlike, President of Harcar Aluminum Products, Inc., appeared in opposition. Commissioner Mercer moved to continue the tabled action until May 11, 1987. The City ManaGer submitted a memorandum from the Police Chief as follows: April 22, 1987 TO: City ManaGer FROM: Police Chief SUBJECT: Acquisition of Additional Radio Frequency ThrouGhout its existence, the Sanford Police Department has operated with a simplex (sinGle channel) radio communications system. We have done the best we can to safely function with a single channel as Growth within the community and department has occurred. Our primary channel is now very crowded. We have reached out limit and relief is needed. Currently, durinG emergency situations, or system failure, the Sanford Police Department is forced to operate on what is known as the inter- city channel. This is a channel that is shared by all Central Florida law enforcement agencies. The inter-city channel is reserved for inter-departmental communications and emergency situations that require coordination between law enforcement agencies. Needless to say, this channel has also become very crowded with radio communications traffic. The other agencies have been tolerant of our emergency use of the inter-city channel. However, our utilization extends beyond the appropriate use of this channel. One of the obstacles that has prevented channel expansion in the past is the lack of available frequencies that can be assigned by the F.C.C. I believe that we have overcome this obstacle. A few years back, the Sanford Fire Department acquired two (2) new radio frequencies in addition of the mutual aid channel they had. The fire department now has three (3) channels. One of the fire department channels is infrequently used. The fire chief has Graciously agreed to share this available channel with the police department. MINUTES City Commission, Sanford, Florida April 27, 335 19 87 Allowing police use of the fire channel is necessary because: Police used a back-up channel to use during emergency situations and/or primary channel system failure. Police need an administrative talk around channel to conduct general police business thereby reserving the primary channel for emergency police calls and priority communications. Police need the capability of a stake-out/surveillance channel that would not interfere with other required police operations. Police and fire departments need inter-departmental radio communications during major disasters where both departments share common responsibility. The cost to retrofit the police mobile radios with the new channel and to install a base radio at the police emergency communications center is $13,701. This type of expenditure is exactly why the Law Enforcement Trust Fund (assets from drug and crime seizures) was created. The fund has a more than adequate balance to cover the cost of the radio system modification. No monies will be required from the General Fund. I recommend that the radio system enhancement be paid for out of the Law Enforcement Trust Fund. I respectfully request that the City Manager and City Commission approve this request in the interest of efficiency and officer safety. A group of retirees met with me on April 20, 1987, for the purpose of sharing their concerns with the City's current health plans. Their main concern was that they are not at present furnished with the same insurance as regular employees, as is presently mandated by FS 112.0801. See attached letters. The City currently offers two health plans to its employees: Health Options. This HMO offers identical coverage for both current and retired employees, regardless of age, thus meeting the requirements of FS 112.0801. Florida MunicipaHealth Trust (FMHT). The City has utilized this "major medical 80-20" plan for several years. Comparison coverages are listed as follows: "Active" employees and retirees under 65 - Major Medical "80-20" Plan, stipulated $1,000,000 life- time maximum. As can be readily seen, coverages are inconsistant between the groups listed above . . . and FS 112.0801 is designed to provide consistent coverages for all employee groups. While we are hopeful that Florida Municipal Health Trust will provide identical health plans for both current and retired employees as mandated in FS 112.0801, we recommend going to bid for health plans to include identical coverage for both groups and enable the City to comply with the State Statute requirements. The Mayor recommended the City offer the same benefits to the retirees as offered to employees and the City pay for benefits for the retirees as the City does for employees. Pete Knowles, representing the City's retirees, appeared to discuss the requests of the retirees as follows: That the retirees are furnished the same insurance as regular employees, including prescription drugs which is in their policy. The retirees are requesting the City to pay for same insurance benefits as regular employees. The City .Attorney reported the City had received this date from Great Southern Federal Savings Bank a certified letter concerning the Holiday Inn lease with the City of Sanford. In 1967 the City leased the property for the construction and long-term lease of the Holiday Inn. There was a sub-ordination agreement contained in the original 1967 lease which basically sub-ordinated the lease to the improvements which were placed on the City land. There was additional construction in 1985 which resulted in additional buildings, again the City was approached, and in order to allow the improvements~to be placed on the property, agreed to sub-ordinate the lease to a mortgage to be loaned for the imprOvement. The letter received today indicates that the those mortgage payments are'~in arrears and is placing both the mortgage holder and the City on notice that the payment is in arrears. The leaseholder still has the opportunity for the remainder of a 30-day period, which began on April 23, to pay it. The City under that sub-ordination agreement also has some rights, and in order to protect the rights of the City, the City Attorney recommended the following: Since the City has received the notice, which puts the City on notice of the non-payment of the mortgage, the City Commission to declare, on that basis, that the mortgage to be in default and to authorize a letter to be written the leaseholder demanding that they cure the default within the 30-day period. If it is not done within that time, the City would have the option of making the payment and cancelling the lease.
