The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. MINUTES City Commission, Sanford, Florida June 22, 19 87 The City Clerk reported Notice was sent to owner, Eliezer Choc, on May 19, 1987. Robert Seigler, Seigler Realty, 2524 South Park Drive, representing the owner, appeared to report the rezoning of the property conforms with the City's Comprehensive Plan, and the property will require a great deal of engineering after rezoning and before development plans can be finalized. Lonnie Groot, Assistant County Attorney, appeared to report the property was presently under a condemnation suit with Seminole County. Charles Thorn, 108 West Crystal Drive, Loch Arbor, and President of the Loch Arbor Homeowners Association, appeared to report the owner had not submitted proposed site plans for the property. The property is unable to hold any type of structure. The rezoning request was strictly speculative, and the property owners in the area wished the property to stay in Single Family Residential Dwelling District. Major L. R. Rice, 203 Forrest Drive, Loch Arbor, appeared to report the property is a low area and used for a perculation pond, and the property is in accident-prone area. If the property is rezoned to Multiple Family Residential Dwelling District, it will not be compatiable - it will be spot zoning. Mr. Seigler reported the County started their condemnation suite two or three years ago. The County has done nothing to settle the suit, therefore, he was not aware the property was under condemnation, and thought the suit had been dropped. Commissioner McClanahan moved to table the Public Hearing to July 13, 1987 pending determination of the status of the condemnation suit on the property by the Seminole Board Seconded by Commissioner Thomas and carried by the vote of the of County Commissioners. Lonnie Greet, Assistant County Attorney, appeared in opposition to the annexation ordinance and to make a report as follows: There is a misconception that the County opposes all City of Sanford annexations. The County does not oppose every annexation proposed by the City. According to the records in the County Property Appraiser's Office, since 1977 over one hundred annexation ordiances have been adopted by the City of Sanford, many of which deal with more than one parcel. There has been six of these ordinances which the County has challanged. Secondedly, there is a misconception regarding the obligation to the individual submitting an annexation application. The County submits to this Commission that the real obligation is to insure that the provisions of Chapter 171, Florida Statutes, are complied with. Also, the obligation to listen to and respect the views of another governmental entity. Thirdly, there is a misconception regarding the notion that individuals petiton to annex at their own risk. Section 171.081, Florida Statutes, provides that in any action institute pursuant to this section, the complainant (which the County is in several current lawsuits) should he prevail, shall be provided with reasonable costs and attorney's fees. So in cases where the County should prevail in an annexation suit, the law would have it that the City of Sanford would pay the County's legal expenses, including attorney's fees. So the real risk is not upon the individual applicant, but upon the taxpaying public. Regarding Ordinance No. 1869, Mr. Greet referred to his "Exhibit A" and "Exhibit B", and reported the parcel creates a clear, large and jurisdictional unsound enclave to the North of the parcel; and the parcel is not substantially contiguous to the City of Sanford. The City Attorney reported no knowledge prior to this meeting of any objections from the County regarding Ordinance No. 1869. Commissioner Mercer moved on the passage and adoption of Ordinance No. 1869. The City Manager submitted a memorandum from the Director of Engineering and Planning as follows: MEMORANDUM JUNE 17, 1987 TO: City Manager FROM: Director of Engineering and Planning SUBJECT: Easterly Extension of City Water Main Along North Boundary of Airport Mr. Faison: This memorandum is an update of my June 12, memorandum and incorporates discussion at and developments since the worksession meeting of Junel5. As a result of discussions at that meeting, the water main extension has been placed on the agenda for action at the June 22 City Commission meeting. Based on discussions with the owners of Sanford Auto Auction, the attached map has been modified slightly to show the water line extending eastward as far as the south branch of Cameron Avenue, a total of approximately 8000' from Brisson Avenue where our water and sewer lines now exist. The owners of Sanford Auto Auction have proposed that the City pay all costs for extending the water line to Beardall Avenue, a distance of approximately 5300' and that they pay all costs for the City to install the water line from Beardall Avenue to Cameron Avenue, a distance of approximately 2700'. This proposal is based on the costs of an 8" water line, in order to provide necessary fire flow. If the line is installed it is recommended that the City also pay necessary costs to increase the water line size to 10" in order to provide for additional future service in the area. Under this proposal the cost to the City would be approximately $50,200 for an 8" line plus approximately $6,600 to increase the size of the entire line from 8" to 10" diameter. The cost to Sanford Auto Auction for its share would be approximately $25,578. Included in the attached drawing is information recently received from Sanford Airport Authority regarding property east of Beardall Avenue now under purchase contract. Although this property is not contiguous MINUTES City Commission, Sanford, Florida June 22, 419 19 87 with the Auto Auction property it is very close, and if additional property were acquired by the Airport to adequately protect the approach to Runway 27, additional land acquired could be contiguous with the Auto Auction property. Because of significant'potential for development, with resulting expansion of utilities rate base and potential City tax base, it is recommended that the requested water line be approved and that the City execute an appropriate developer's agreement with Sanford Auto Auction to provide for installation of the proposed water main. After discussion, Commissioner Mercer moved to authorize further negotiations for an appropriate developer's agreement with Sanford Auto Auction to provide for installation of the proposed water main along the North boundary of the Airport, subject to the developer paying for materials and the City providing the labor. So we were unable to talk to him, but we did contact the Governor's office, Ms. Linthicum in the Governor's office, she indicated that a letter had been received, no decision had been made, and stated that until a decision had been made, the letter would stay in the file and a copy would not be available.
