082487-Regular SessionMINUTES City Commission, Sanford, Florida August 24, 19 87 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 24, 1987. Present: Commissioner John Y. Mercer, Acting Mayor Commissioner Whitey Eckstein Commissioner Bob Thomas City Attorney William L. Colbert City Manager Frank A. Faison City Clerk H.N. Tamm, Jr. Absent: Mayor-Commissioner Bettye D. Smith Commissioner A. A. McClanahan The meeting was called to order by the Chairman. Steve Harriett, Police Chief, accepted a contribution from the Mothers Against Drunk Drivers in the amount of $1333.00 to purchase a cellular phone for the BAT Mobile. Chief Harriett presented a Certificate of Appreciation to Beth Bridges and Pam Tucker. .The next item of business was the continuation of a Public Hearing, tabled from the meeting of August 10, 1987 to consider closing, vacating and abandoning a portion of an East/West utility easement lying East of and abutting Hidden Lake. Drive and lying between Ramblewood Drive and Eastwind Court. .... The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed closing. The City Engineer requested that said Public Hearing be tabled until September 14, 1987 because Mr. Llopiz had not forwarded the necessary approval letters from the utility companies. Commissioner Thomas moved to table said Public Hearing to September 14, 1987. The City Engineer stated he had met with Centex Engineers and they have not come back with a solution in the existing utilities and recommended this be tabled. M. on August 24, 1987 to consider proposed amendments as follows: 1. Richard Woods reported that the Citizens Advisory Committee recommended approval of said amendment. Commissioner Thomas moved to authorize said amendments to the City of Sanford Seconded by Commissioner Eckstein and carried by the Community Development Block Grant. vote of the Commission, as follows: Commissioner Eckstein Commissioner Thomas Commissioner Mercer Yea Yea Yea The Commission next reviewed the Seminole County's proposed litigation on the Whittle Annexation, tabled from the meeting of August 10, 1987. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed litigation. The City Attorney reported that this was originally tabled on August 10, 1987 on his recommendation because the legislature passed an act which he wanted to review with the County Attorney. Mr. Colbert stated he received a letter from the County Attorney and they are both in agreement that at this time the law is not applicable and recommended no action. The continuation of a request for a home occupation license, tabled from the meeting of August 10, 1987. MINUTES City Commission, Sanford, Florida 521 Auqust 24, _19 87 The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed occupation license. Commissioner Eckstein stated he would like the input of the rest of the Commissioners. -The City Manager reported that he felt it was reasonable to permit the occupation license in this case and noted it is permitted in other similar areas but not in PUD. The City Manager recommended the City Attorney draft an ordinance changing the zoning and then send said ordinance to the Planning and Zoning Commission. The City Attorney stated he supported the City Manager and agreed that this should not be an exception but change the ordinance. If the Commission does authorize the ordinance to be changed to permit an occupational license as conditional use in SR-1A and PUD-A Zones this would be handled by the Planning and Zoning Commission and only an appeal would come before the Commission. Commissioner Eckstein moved to authorize the City Attorney to prepare the proper ordinance to permit a conditional use in SR-1A, PUD-A, and SR-1AA Districts and submit same to Planning and Zoning Commission for their recommendations. The City Manager recommended this be continued for six months, as the new owner is hesitant to rezone at this time. The City Attorney stated a continuation for six months is the prerogative of the Commission. The City Attorney noted that part of the reason for the delay is the route of the new expressway, and this kind of delay is not unreasonable. Commissioner Eckstein moved to continue the first reading of said ordinance for six months. Sandefur, Trustee, et al for annexation tabled from the meeting of July 27, 1987 for a portion of that certain property lying between State Road 46 (Geneva Avenue) and vacated Seaboard Coastline Railroad and lying west of and abutting Brisson Avenue. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed annexation. The City Attorney stated he met with the property owner and reviewed this annexation request, and the property owner agreed with the option of postponing for sixty days. Commissioner Thomas moved said annexation be tabled for sixty days. On motion by Commissioner Thomas said agreements were approved for the Traffic Signal Agreement with Seminole County. Commissioner Thomas moved to authorize approval of said grant. Commissioner Eckstein and carried by the vote of the Commission as follows: Commissioner Eckstein Yea Commissioner Mercer Yea Commissioner Thomas Yea Seconded by The Commission reviewed the request from Ernie Cavallaro, representing Sanford Central Park, for reimbursement for value of "oversized" lift station. The City Manager recommended a trade-off between the City and the Developer of Sanford Central Park involving the cost of installation of street lights, and the "cost avoidance" benefit to the City by the availability and future use of the wastewater lift station. The Utility Director identified the potential benefit to the City of $20,552 from the future use of the lift station. Since the lift station would be totally for future growth, funds should come out of the Sewer System Trust Fund (Impact Fees). Commissioner Thomas moved to authorize payment to Sanford Central Park in the amount of $20,552. The draft transportation element of our new Comprehensive Plan identifies a number of arterial and collector roads within the North Central Urban Service Area which are either currently inade- quate or are projected to become inadequate between now and 1997. These include the following: Sanford Avenue - CR 427 to Airport Blvd. - Presently Inadequate U.S. 17-92 - Lake Mary Blvd. to Airport Blvd. - Presently Inadequate U.S. 17-92 - CR 427 to SR-46A and from SR 46 to Volusia County Line - Inadequate in 1992 CR 46A - Country 'Club 'Road to U.S. 17-92-- Inadequate in 1992 Airport Btvd. --SR 46 to_CR 46A - Inadequate in 1992 CR 15 - U.$. 17-92 to SR-46 - Inadequate in 1997 U.S. 17-92-- CR 46 A to SR 46 - Inadequate in t997 Although no roadways which are the responsibility of the City of Sanford ar.e identified as becoming inadquate, the above lis% inclu- des those roads in the North Central Urban Service Area, which are the responsibility of other jurisdictions, which will require improvement to keep up with growth. Most of the County roads listed above are included in the lis~ of roads to-be improved by the County-road impa~t fee, however, there is no specific schedule for improvements included in the Ordinance. It is therefore not possible to determine the time~ liness of projected improvements and whether these improvements are therefore responsive to the needs of the City. To date, there have been no discussions between the City and County to fix specific schedules, or to otherwise respond to the City's proposal for discussions as contained in the North Central Urban Service Area proposal. The Transportation Element Study essentially validates all road segment'~improvements contained in the County Transportation Impact Study for the Sanford Urban Area. Based on this information the City Commission could feel justified in not extending the Transportation Impact Fee Moratorium, even though specific schedu- les for improvements are not in hand, and other concerns of the City contained in the North Central Urban Service Area proposal copy attached, have not been responded to. First reading on an ordinance to extend the moratorium must be approved on August 24 if a moratorium extension ordinance is to be adopted before expiration of the present moratorium. Commissioner Thomas reported that an Eagle Scout had requested to construct and place a "Welcome to Sanford" sign in the Right-of-Way of Highway 17-92 and Park Drive, and same was referred to the City Staff to obtain proper permits from the Florida Department of Transportation. Acting Mayor Mercer announced there would be no work sessions on August 31 nor September 7, 1987. The City Engineer next submitted information for Seminole County to act as agent and Sanford Housing Authority as Administrator for a. rental rehabilation grant in the amount of $108,000 under Section 8. Commissioner Thomas moved to authorize the City Manager to investigate and Seconded 'by Commissioner Eckstein and carried by the vote of the support the program.
