The City Commission of the City of SanfOrd, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on September 28, 1987.
Present:

The meeting was called to order by the Chairman.
David Farr and Mrs. Karen Corigan presented the City Commission a copy of the
United States Constitution with 5,000 to 6,000 signatures and suggested that this be put in
a time capsule in the corner stone of the proposed Bandshell building or some other
suitable building. Mr. & Mrs. John and Neda Gray, visitors from England were introduced
and were the last two persons to sign this copy of the Constitution. The Mayor accepted
same and expressed the Commissions appreciation for this patriotic contribution to the
bicentennial celebration of the constitution.
The next item of business was a continuation of a Public Hearing tabled from the
regular meeting .of August 24, 1987, to consider closing, vacating and abandoning a portion
of a North/South utility easement lying South of and abutting Anthony Drive.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed closing.
The City Clerk reported Notice had been sent to owner,
July 10, 1987.
Commissioner Eckstein moved to deny said request.

The City. Clerk reported Notice had been sent to owner, The True Church of God, on
September 1, 1987.
.B.D. Simson, True Church of God 1700 North Highway 17-92, Longwood requested the
closing of said portion of Mulberry Avenue and a Right-ofJWay Use Permit for parking on the
aforesaid avenue, and approval of the site plan.
The City Manager reported that the staff recommended the City retain an easement
of 15 .ft. along the existing utility line.
Bill Simmons, City Engineer, .reported that this is recommended by Planning and
Zoning Commission.
Commission Thomas moved to authorize the City Attorney to prepare the proper
ordinance for said closing; authorize a Right-of-Way Use permit for the aforesaid Mulberry
Avenue, pending adoption of the Ordinance; and approve a Right-of-Way Use Permit of 6th
Street for a period of 12 months, upon approval by the City Staff of the site plan; and
also agreed that if the Church bought the materials for the seWer and water lines, the City

Reverend Rucker, 700 Elm Avenue, Sanford primarily requested the rezoning for a
Day Care Center for their members.
Bill Simmons reported that the Planning and Zoning Commission recommended denial
of said request and also reported that the Planning and Zoning Commission unanimously
recommended that the City Commission grant a special exception to the First Shiloh
Missionary Baptist Church to allow the conditional use of a day care center for their
congregation only.
Commissioner Eckstein moved to deny said request for rezoning and to authorize
approval of a "special exception" for use as a day care center for the congregation only.

The City Manager recommended the amendments to the Comprehensive Plan and the
Evaluation and Appraisal Report and any additional revisions be included whether they are
programmed at this time or not.

WHEREAS, the City Commission of the City of Sanford,
has determined a budget for the operation of the
government of the. City for the fiscal year 1987-1988;
WHEREAS, the City Commission of the City of Sanford,
Florida, has determined that a tax levy on all taxable real and
personal property of 4.8459 mills should be levied by the City of
Sanford, Florida, for the fiscal year 1987-1988, from which levy
the total sum of $2,253,440 is estimated to be collected.
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE
CITY OF SANFORD, FLORIDA, AS FOLLOWS:
1. That the amount determined necessary to be raised

The Commission next considered the utility rate increase and the billing
procedures. The City Manager stated that he recommended approval of the increase and the
billing procedure and submitted a memo from the Utility Director, as follows:

Attached is a revised rate ordinance and the corresponding
City Code pertaining to the proposed utility rate increase
with information on the utility billing procedures. An
increase in utility rates is necessary due to the planned
water and sewer improvements as outlined by our consulting
engineers. The recently completed engineering report for the
Bond Anticipation Notes (BANS) demonstrated the need for the
rate increase for adequate bond coverage.
The City's engineering consultants have performed a rate
analysis of our current utility data base to determine the
effect of a rate increase on projected revenues. Using this
information coupled with historical revenue data, it is
recommended that an increase of approximately 5% be
implemented for the utility consumption charge and customer
charge. This increase would result in a change of the water
consumption charge from $t.00 to $1.05 per 1,000 gallons (5%
increase). The sewer flow charge would increase from $1.65
to $1.74 per 1,000 gallons (5.45% increase).
The rate increase will also effect the customer base 'charge.
The customer charges are based on water meter size. For a
typical residential customer with a 3/4 inch meter, the water
customer charge would increase from $1.50 per month to $1.58
per month (5.33% increase). Larger size meter charges would
increase accordingly. The base sewer customer charge would
increase from $2.00 per month to $2.10 per month (5%
increase).
These utility rate increases are expected to raise an
additional $220,000 over the first full year of
implementation. These funds would be used to construct the
various utility improvements as required by the State of
Florida Department of Environmental Regulation.
The results of the rate increase on a typical residential
customer that uses 8,000 gallons of water per month is:

Corrections have been made to our existing utility rate
ordinance, which is attached, to show the changes as
recommended.
Changes are also recommended in our utility billing
procedures. Last year's audit by Coopers & Lybrand
recommended a more timely due date with a delinquent fee

assessed earlier in the process.
Attached is a typical billing schedule comparing the current
method with the proposed changes recommended by the auditors.
The main difference involves moving the assessment date of
the delinquent fee up from approximately thirty-eight (38)
days after billing to approximately twenty-one (21) days.
The delinquent fee remains the same ($4.00).
One other change which is recommended involves increasing the
reconnection fee from $3.00 to $10.00. This fee covers the
City's expense incurred for the reconnection of service due
to the non-payment of the utility bill. The current $3.00
reconnection fee has been in effect since 1978 and does not
reflect the actual cost associated with service
reconnections.

City Commisszon action and new legislation mandated
that the City contact all City retirees, allowing them
to purchase the same health insurance as any active
employee. This has been done, effective October 1,
1987.
The City presently issues monthly checks in the amount
of $73.91 to all retirees over age 65 by action of the
City Commission last May, 198~, for a period up to
October 1, 1987. A copy of the City Commission minutes
detailing this action is attached for your review.
Many of these employees have opted for single coverage
in our latest insurance enrollment, effective 10/01/87.
Cost for single coverage on the Blue Cross/Blue Shield
Inde~ty/PPO is $91.82 monthlp. Cost for single
coverage on Health Options (HMO) is $78.12 monthly.
Retirees actions resulted in the following:
· 22 retirees opted for the BC/BS Indemnity/PPO
· 12 retirees opted for Health Options
· 16 have declined coverage
· 9 are undecided, but have the option to decide
by 12/31/87
Therefore, as of October 1st, most will be covered -
some will not and all pay supplements cease.

provides for monies to be issued by FRS in January,
1988 to retirees for the purpose of defraying health
insurance costs. Monies issued will depend on years of
service under FRS. The City has no way to determine
what amoun= FRS will be paying at that time. It will

The City will begin paying to FRS on October 1 an
additional .24% to FRS per employee to supplement this
payment to retirees.

Secretary III to meet this need. In addition, an
analysis of Arlene Davison's job duties reveals a need
for reclassification from Secretary I to Secretary II,
and is requested. Total additinal cost to fund these
reclassifications for FY 1987-88 budget year will be

RECOMMENDATIONS
By a unanimous vote, recommended the approval of the prelimi-
nary draft of the Comprehensive Plan and the Evaluation and
Appraisal Report to the City Commission for transmittal to the
Florida Department of Community Affairs with the Plan being
subject to additional review during October, November and
December.
2. After discussion regarding:
1. The provision of daycare as a ministry for only the
members of First Shiloh Missionary Baptist Church,
2. The fact that HRS would not require a license of
First Shiloh Missionary Baptist Church if they did
not charge a fee. (They could receive a donation),
3. The additional traffic that the care of 30 %o 40
children would generate,
4. The fact that if the church outgrew the site and
left, the zoning would remain and would be a detri-
ment to the residents in the neighborhood,
unanimously recommended the denial of the request to rezone the
property located at 700 Elm Avenue from SR-1 to RC-1 for the
purpose of a daycare center for the First Shiloh Missionary
Baptist Church.
Planning and Zoning then unanimously recommended that the City
Commission grant a special exception to the First Shiloh
Missionary Baptist Church to allow the conditional use of a
daycare center at 700 Elm Avenue for their congregation only.
(Precedence for this type of special exception has been set by
the City Commission on September 22, 1986 for the Freedom
Assembly of God, 1515 West 5th Street. - See attached.)

based on the staff recommendation to deny.

The City Attorney reported that he has filed a response to the Petition of the
Whittle Annexation, and the County is to respond within twenty (20) days. The City also
was served a summons regarding the Howell Place, Adult Living. The City was asked to
utilize its ability under the statutes to assist in the financing of this with First
Mortgage Revenue Bonds, none of the financial obligation belong to the City and
the City is not in any way liable, however, the City Attorney requested that he be able to
consult with Bryant, Miller, the City's Bond Council as needed and to authorize a defensive
pursuit.
Commissioner McClanahan moved to authorize said request. Seconded by Commissioner
