110287-Workshop Session024 MINUTES City Commission, Sanford, Florida November 2, 19 87 The City Commission of the City of Sanford, Florida, met in Workshop Session in the City Manager's Conference Room of the City Hall in the City of Sanford, Florida, at 4:00 o'clock P. M, on November 2, 1987. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner John Y. Mercer Commissioner Bob Thomas Commissioner A. A. McClanahan City Manager Frank A. Faison City Attorney William L. Colbert City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. The City Manager announced that the slide presentation and progress report on the work in the Georgetown area by the Westside Neighborhood Strategy Program Committee had been postponed to a later date. The Commission next considered the request from Marion Cameron to use a detached unit at 1019 Magnolia Avenue as rental property. The City Attorney stated that the occupational license was issued in 1985 in error based on information from the real estate personnel and had been revoked by the Building Department when the City learned that the unit had not been used as a multiple family dwelling. The attorney explained that there are provisions for non-conforming uses such as lots, land and structure. This particular structure had not been rented prior to 1985 as a non-conforming use. Mr. Colbert noted that if the Commission allowed a non-conforming use, a precedent would be set. The City Manager noted that the procedures were done verbally at the time, however, at present written reports are required before licenses are issued. The City Commission authorized same to be placed on the Agenda for November 9, 1987. The City Engineer submitted a proposal to acquire' the Indian Mound Water Association, Inc. water distribution system as follows: MEMORANDUM OCTOBER'28, 1987 TO: FROM: City Manager,~,~ Director of Engineering and Planning SUBJECT: Indian Mound Water System Mr. Faison: The attached letter has been received from Kenneth W. McIntosh, representing the Indian Mound Water System Association. It is the result of my informal discussions with members of the Association relative to the possibility of City of Sanford acquiring the Indian Mound Water System. The attached drawing shows the general location and extent of the present water system. City of Sanford presently sells water to the Indian Mound. Association through a master meter, at the "outside of City" rate. MINUTES City Commission, Sanford, Florida November 2, 025 19 87. Under the proposed action, City of Sanford would acquire the system as it exists, and accept the existing 53 customers as retail City water customers. The only cash involved in the purchase would be approximately $1,000 for purchase of spare parts previously recommended for acquisition by City of Sanford, and the waiver of customary water system deposits totaling approximately $2,729.50. A total of $2,650 of this amount ($50 per customer) would nor- mally be refunded to customers at the time accounts are closed, however, this would not appear to be appropriate in this case. As specified in the proposal, annexation would not be a require- ment for the existing customers, however, it would appear appropriate that any new connections on this water line, if acquired, should be required to execute recordable annexation petitions as is now routinely required. Acquisition of this existing system is recommended as a means of expanding our utility capability toward the east at virtually no cash cost. An immediate benefit would be the capability to loop the south end of this system located at the intersection of Cameron Avenue and State Route 46, with our new t0-inch line to be installed along the southside of State Route 46. This looping would provide greater reliability for all concerned at very little cost. State Statutes prescribe certain actions which must be taken by a municipality in acquiring a private utility system. We would also need to insure that the proposed loan assumption is allowable by the mortgage holder and that it would be acceptable within our sewer and water bond covenants. It is recommended that City Commission approve, in concept, the proposed acquisition of this system, and authorize staff to do necessary additional investiga- tion and schedule the public hearing required by statutes. The City Engineer submitted a memo as follows: staff to further evaluate the proposal a Bandshell in the MEMORANDUM OCTOBER 23, 1987 TO: FROM: SUBJECT: City Manage~ Director of Engineering and Planning State Grant for Band Shell Mr. Faison: As requested by Mayor Smith, I have discussed the grant with Representative Grindle. .I advised him that I anticipated following the Consultant's Competitive Negotiation Act in seeking statements of interest and general design concepts from interested architects, advising them up front regarding the funds available. I advised that only then would I have a reasonable handle on the adequacy of the $150,000 grant for construction of a suitable band shell. and to report amount of 026 MINUTES City Commission, Sanford, Florida November 2, 19 87 Mr. Grindle advised that there was rather wide flexibility in the use of this money, and that there was some potential for obtaining additional funds if required to construct a suitable facility. I advised him that at present the City Commission appeared to be leaning toward construction of the Band Shell in Fort Mellon Park instead of at its previous location in Memorial Park. He commented that it might be appropriate to consider use of the grant for some other type of a "cultural facility" for the "arts", possibly some type of an indoor facility. I commented that we had a senior's center in the Capital Budget for next year and that perhaps the grant could be utilized for the "arts" part of a multi-purpose facility to serve the seniors as well as the per- forming arts. He indicated receptivity to any such utilization of the funds as' chosen by the City and that he would obtain the necessary support from Department of State. He also indicate a willingness to Seek additional funds if deemed necessary. This information is provided for consideration by City Commission prior to any advertisement for a design contract speci- fically for a band shell, in case City Commission .wishes to con- sider a different utilization of grant funds. The Commission authorized staff to continue to proceed with details and to report back with recommendations. Mayor Smith reported that the Ballet Guild would like to present three performances of "We the people..." on March 16 through 20, 1988 on the City Hall grounds. The City Manager and Commissioner Mercer were authorized to work with Miss Caskey of the Guild for this event. There being no further business, the meeting was adjourned. ATTEST: Act
