112387-Regular Session044 MINUTES City Commission, Sanford, Florida NovemBer 23. 19 87 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 23, 1987. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner A. A. McClanahan Commissioner John Y. Colbert The meeting was called to order by the Chairman. Request submitted from Stanley H. Sandefur, Trustee, i.e., to consider annexation of a portion of that certain property lying between State Road 46 (Geneva Avenue) and vacated Seaboard Coastline Railroad and lying West of and abutting Brisson Avenue. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed annexation. No one appeared. Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance for said annexation. Commissioner Mercer moved to authorize the Mayor, City Attorney, Director of Finance and representatives from Coopers and Lybrand, C.P.,A.to enter Safe Deposit Box 177 at First Union Bank of Seminole to perform annual audit. The City Manager stated there is a philosophical question whether or not the County has a right to impose a transportation fee on the City. Commissioner Phyllis Sheppard of Casselberry was introduced by the Mayor. Commissioner Sheppard reported that she expected Casselberry to extend their moratorium to February 1, 1988. The Commission next considered the proposal to acquire the Indian Mound Water Commissioner Thomas moved to authorize staff to proceed with' appropriate analysis of the Indian Mound Water System and to advertise a public hearing to consider the purchase of said system. Seconded by Commissioner Mercer and carried by the vote of the Commission as follows: Commissioner EckStein Commissioner Mercer Commissioner Thomas Commissioner McClanahan Mayor Smith Yea Yea Yea Yea Yea The Commission next discussed the city park~leased to Ail Souls Parish, between · Park Avenue and Oak Avenue and between Eighth Street and Ninth Street. Martha Yancey, 2100 Cordova Drive, Chairman of the Scenic Improvement Board appeared and reported that the SIB had developed a plan to improve said park which was not accepted by the church. If the church did not introduce plans, then SIB would be willing to submit a plan and together with the church work on its implementation. The City manager reported that he met with Father Czarnecki and at this time the church desires to use the park as a playground for the school and maybe in the future they might improvement the park, but there are no commitments in near future. Ned Julian, Acting City Attorney, explained this is a non-exclusive lease and the the park, also noting the City transfers liability to All Souls public could still use Church. Commissioner Eckstein moved to notify Ail Souls Church that the lease for the said City park would not be renewed. Staff should also pursue in the next thirty days a reasonable alternative to improving said park. Commissioner Eckstein also authorized SIB to come up with a conceptual plan for a sports oriented park and to submit the plans at the next worksesson on December 7, 1987, and for SIB to explore the concept of "Pick-A-Park". Ail of the Commissioners expressed opposition to the expressway dividing Sanford. The Acting City Attorney, Ned Julian explained that a suit that might challenge the route could be extremely costly, but it would not stop the expressway from being built, explaining the Expressway Authority has been granted discretion to act, just so each action is not in an arbitrary and capricious manner.
