The Bill Simmons, City Engineer, submitted information and documents as follows: TO: FROM: SUBJECT: DATE: MEMORANbUM Director of Engineering and Planning Acquisition of Indian Mound Water Association, Inc. December 10, 1987 Mr. Faison: Pursuant to Florida Statutes, a Public Hearing will be held on December 14, 1987 regarding acquisition of the Indian Mound Water Association, and to make a determination if said purchase is in the public interest. Florida Statutes prescribe a number of matters to be addressed prior to making such a determination. The attached report has been prepared to appropriately address the various requirements of the Statute. It is believed that this report fully 19 87 058 MINUTES City Commission, Sanford, Florida __19 87 supports the appropriateness of the proposed acquisition. It is therefore recommended that following the Public Hearing on December 14, that City Commission approve the acquisition of the Indian Mound Water Association, to be effective on, or about, December 31, 1987. Utility Director indicates that it is feasible to have a reading of all individual meters and the master meter, jointly with a representative of the Indian Mound Water Association for purposes of termination of bulk rate billing and commencement of individual billing, on or about December 31. Individual accounts will need to be set up for each customer. City Attorney will need to coordinate with Kenneth W. McIntosh, Attorney for Indian Mound Water Association, in the preparation of necessary documents for transfer of ownership of the water system and associated easements/rights- of-way, and in the transfer of the existing loan. By copy of this memorandum, City Attorney, Utility Director, and Finance Director are requested to provide any comments regarding the proposed course of action and schedule. PURCHASE OF INDIAN MOUND WATER SYSTEM Section 180.301 Florida Statutes prescribes a set procedure to be followed in the acquisition of a public utility by a municipa- lity. Attachment No. 1 is a copy of this Section. The Public Hearing prescribed has been scheduled for December 14, 1987, for the purpose of determining that the proposed purchase is in the public interest. Each of the nine (9) items prescribed by the Statute for determining if the purchase is in the public interest will be addressed in the following paragraphs. The most recent income and expense statement for Indian Mound Water Association is Attachment No. 2. This includes both income and expense statement and. balance sheet which lists assets and liabilities and shOws the accumulated depreciation. Notes on this financial statement indicate that the facility was constructed uti- lizing a Farmer's Home Administration loan and does not mention any "contributions in aid of construction". Attachment No. 3 is a summary of the rates charged by Indian Mound Water Association. The physical condition of the utility facilities is believed to be appropriate for that of an approximately twenty (20) year old water system. Actual determination of existing pipes would require excavation which is not recommended. Attachment No. 4 includes the recent maintenance and repair history, dating back to 1984. The system consists only of water main piping, fire hydrants, and customer meters. The association buys potable water from City of Sanford, and therefore does not maintain and operate we!tfields pumping or treatment facilities. The financial statement shows the initial cost of plant and equipment as $59,400 with accumulated depreciation of $22,.448. The undepreciated portion of initial acquisition cost is $36,952. Estimated current replacement cost is $100,000. The proposed acquisition cost for the system is equal to the unpaid balance of the mortgage, $23,915.15 as of June 30, 1987. .Other proposed terms of the sale are that the City would acquire, at cost, spare parts inventory totaling $1,195.45, and waive the customary utility customer deposit ($50.00) and customer account start up fee ($1.50) for each of the approximately 53 present customers of the Indian Mound's system. The existing debt to General Electric Credit Corporation is to be acquired by City of Sanford, with payments to continue at the current rate of $334 per month or $4,008 per year. This note is at 5% interst which is included in these specified payments. These proposed terms of purchase are believed reaso- nable, satisfactory, and fair to both parties. No additional investment is believed required on the part of the City as a part of this acquisition. The existing master meter, whereby the City bills the Indian Mound Water Association, will be removed from the line, and the City will henceforth read all indi- vidual meters and bill customers directly. At some time, following acquisition of the system, it is likely that the south end of the Cameron Avenue branch will be connected, across S.R. 46, to the City water main now under construction. This connection will pro- vide looping{ of benefit to the present system as well as the new City line, however, it is not a necessary improvement to the pre- sent system. : MINUTES City Commission, Sanfor&' Florida Decembe_ r 14, The alternative to purchase of Indian hound Water System by the City of Sanford, is for the Indian Mound Water System to con- tinue to operate independently, buying water from the City, and in most cases also acquiring necessary maintenance and repair service, at cost, from the City. If the purchase/sale is not made, the Indian Mound Association customers will continue to receive the same service, and pay the same or similar rates, impacted by any change in water costs or maintenance and repair requirements. If the purchase/sale is consummated the present Indian Mound customers will be billed directly by the City and will pay for water services directly to the City. There will be no new impact fees levied against present customers of the Indian Mound system. Sanford retail water rates, plus 25%, will be charged directly to indivi- dual customers. (City of Sanford current bulk sale rate to Indian Mound Water Association includes the same 25% surcharge.) If the utility is purchased by the City the present costs of duplicating administrative, legal, and accounting functions presently done by Indian Mound Water Association will be eliminated. The result will be a general decrease in bills received by customers of the Indian Mound.system. Annexation petitions will not be required as a con- dition for service to present customers but should be required as a condition for service for any new customers. (City water impact fees will also be chargeable for new customers.) City of Sanford has been Providing potable water to the Indian Mound Water system'on a "bulk rate" since its inception. At least in recent years, City of Sanford has also been providing main- tenance and repair service, as required for the system, at cost. The City Utility Department maintains and operates the complete water system for City of Sanford, with over 9,000 individual customer accounts. The proposed addition of 53 new billing accounts, with no direct change in the water delivery requirement will cause no significant impact on the City utility operation.
