092688-Workshop Session MINUTES City Commission, Sanford, Florida September 26, 423 19 88 The City Commission of the City of Sanford, Florida, met in Workshop session in the City Hall in the City of Sanford, Florida, at 4:00 o'clock P.M. on September 26, 1988. Present: Mayor-Commissioner Bettye D. Smith Commissioner Whitey Eckstein Commissioner John Y. Mercer Commissioner Robert Thomas Commissioner A. A. McClanahan City Attorney William L. Colbert City Manager Frank A. Faison City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. The Chairman announced that this was a work session for the City Commissioners to consider alleged problems of some type or another at the Sanford Housing Authority. There have been accusations of wrong doing, operating out of sunshine law, that should be referred to the State Attorney's office to clear up once and for all. The City Attorney explained that the State Attorney's Office has the authority to investigate the Sunshine Law, neglect of duty, misconduct in office, or misappropriation of funds and can be requested to gather the facts and requested to report findings back to the City Commission. The City Commission can then determine whether they will sit in a quasi-judicial capacity to hear testimony, interpret any evidence represented and make conclusions concerning whether or not cause exists to remove a housing authority commissioner:' from office after a public hearing. The City Attorney suggested that the City Commission not be the ones to gather the facts. Commissioner Thomas stated that the misappropriation of funds and violation of the Sunshine Law should be addressed by the City Commission proceeding with the public hearing. Commissioner McClanahan stated that we are talking about allegations not convictions and they should be investigated first. The Chairman stated the welfare of the tenants was the first concern of the City Commission and to proceed correctly as well as swiftly.
