The next item of business was consideration of an appeal, by Seminole National Bank, of the Historic Preservation Board's denial to install a sign at the bank's new location at First Street and Myrtle Avenue. Mr. Philip H. Chestnut, President, Seminole National Bank, i17 Oaks Court, Sanford, Florida, appeared to support the appeal. He reported their Site Plan had shown a pylon sign, which the Historic Preservation Board denied, and suggested it be reduced in size. Mr. Ed Eptein, Sr., Vice President, Seminole National Bank, appeared and reported the sign was reduced in size betweem one-third to one-half of the 150 square feet allowed by Code, and the Historic Preservation Board still did not issue a Certificate of Appropriateness. Mr. Don Moore, 818 South Palmetto Avenue, Sanford, Florida, Historic Preservation Board member, appeared and reported that the signs did meet physical requirements, but the board questioned whether the size and design were appropriate. After discussion, Commissioner consideration of the appeal until January 23, 1989. and carried. the sign as presented. Seconded by Eckstein moved to table further Seconded by Commissioner McClanahan Letter submitted from Mr. Paul Hoyer, President, Lake Mary Rotary Club, for free use of the Sanford Civic Center for a concert and dance on January 30, 1989. The Director of Recreation and Parks submitted a recommendation to waive the use fee, since the organization will present free concerts to Sanford area nursing homes. Commissioner Eckstein moved to waive the use fee, provided the organization makes a contribution to local charity. Seconded by Commissioner Mercer and carried over the dissenting vote of Mayor Smith. Consideration was next given to Petition for Annexation submitted from Louis Wolff, Trustee, for a portion of the property lying between U.S. 17-92 and Cherokee Circle and between Woodson Avenue and Lake Mary Boulevard extended easterly, further described as follows: S 242.4' of N 523 1/2' of the NW 1/4 of the NE 1/4, Section 14, Township 20 S, Range 30 E. Seminole County, Florida, lying E. of S.R. 15 & 600 (U.S. Hwy. 17-92) On recommendation of the City Manager, Commissioner Mercer moved to authorize the City Attorney to prepare the proper ordinance to annex said property. Seconded by Commissioner McClanahan and carried. On recommendation of the City Manager, Commissioner McClanahan moved to authorize settlement with Starline, for payment in amount of $10,000.00. Seconded by Commissioner Mercer and carried. The Commission next considered funding for replacement of the Master Wastewater Pump Station. On recommendation of the City Manager, Commissioner Mercer moved to authorize to use an SRF Loan and authorize a Rate Coverage Study to determine utility rates necessary to repay the SRF loan, to repay the 1987 BANs, and to maintain the required debt service coverage, as discussed at Work Session December 19, 1988; with the decision in the future as to whether or not the loan should be used. Seconded by Commissioner Eckstein and carried. On recommendation of the city Manager, Commissioner Mercer moved to proceed with storm drainage improvements at the intersection of French Avenue and 24th Place, as discussed at Work Session Deoember 19, 1988. WHEREAS, the administrative processes and procedures necessary for the City to regulate land development activities involves considerable manpower and resources of various City departments; and, WHEREAS, application, processing and inspection fees are a customary cost to applicants and developers who initiate land development activities; and, WHEREAS, fees established by the City for activities regulated by the City's Land Development Regulations should be reasonable in deferring a portion, though not necessarily all of the costs incurred by the City in administering such regulations; and, WHEREAS, Section 8.0 of Ordinance No. 1990, known as the "City of Sanford Land Development Regulations", provides the authority for establishing fees for permits, certificates, applications, inspections and/or any other authorization required by said Ordinance.
