OF THE CITY; PROVIDING FOR LEGISLATIVE FINDINGS/INTENT; PROVIDING FOR THE REPEAL OF THE FOLLOWING SECTIONS OF THE CODE OF ORDINANCES OF TIME CITY OF SANFORD: 2 -231, 2 -232, 2 -234, 2 -311, 2 -312, 2 -313, 2- 401, 2 -402, 2 403, 2 -404, 2406, 2 -407, 6 -101, 6 -102, 6 -103, 6 -104, 6- 106, 6 -107, 6 -108, 6 -109, 6 -110, 6 -111, 6 -112, 6 -113, 6 -114, 6 -115, 6- 116, 6 -117, 6 -918, 6 -119, 6 -120, 6 -121, 6 -122, APPENDIX "A ", ARTICLE III, SECTION 3.4 (LAND DEVELOPMENT REGULATIONS), 2 -111, 2- 112, 2 -113, 2 -114, CDBG AND APPENDIX "A ", ARTICLE Ili, SECTION 3.3 (LAND DEVELOPMENT REGULATIONS), RELATING TO THE HUMAN RELATIONS ADVISORY BOARD, THE CEMETERY BOARD, THE WATERFRONT MASTER PLAN STEERING COMMITTEE, THE SANFORD CENTRAL CONTRACTORS EXAMINING BOARD, THE SANFORD AIRPORT ZONING COMMISSION, THE SCENIC IMPROVEMENT BOARD, THE CDBG ADVISORY BOARDS OR COMMITTEES, AND THE BOARD OF ADJUSTMENT; PROVIDING FOR DELEGATION TO THE CITY MANAGER; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING FOR EFFECTIVE DATES. WHEREAS, the Mayor and the City Commission of the City of Sanford are committed to ensuring the citizens of the City of Sanford a high quality standard of life; and WHEREAS, it is the desire of the Mayor and the City Commission to provide a local government to the citizens of the City of Sanford that is understandable, responsive and coherent to the average citizen doing business with or desiring services from the City of Sanford; and WHEREAS, it is a priority of the Mayor and City Commission to define and prioritize opportunities for improvement in the delivery of programs and services to the citizens of the City of Sanford; and WHEREAS, a primary purpose of this Ordinance is to improve the performance of the Government of the City of Sanford and reduce costs and expenses by ascertaining whether certain agencies of the City are necessary to address needs or whether existing programs are adequate to address such needs; and WHEREAS, a primary purpose of this Ordinance is to eliminate duplication of effort and abolishing boards and commissions that do not provide cost - effective benefits to the citizens of the City of Sanford and which require the dedication of City staff time that would be better directed toward other efforts; and WHEREAS, the Mayor and the City Commission have determined that the multiplicity of City boards and commissions existing with the Government of the City of Sanford is not conducive to the citizens of the City having adequate access to their public officials and to express their concerns and comments to their governmental officials; and WHEREAS, the Mayor and the City Commission have determined that the multiplicity of City boards and commissions within Sanford City Government interferes with the ability of the City to deliver timely services to the citizens of the City; and WHEREAS, the Mayor and the City Commission have determined that the multiplicity of board and commissions within the Government of the City of Sanford interferes with smooth and meaningful communications between the City officials tasked with oversight and the citizens requiring requisite public services; and WHEREAS, the Mayor and the City Commission desire to provide the citizens of the City of Sanford with a responsive and accountable local government that meets the needs and expectations of the citizens while operating in a streamlined and economical manner; and WHEREAS, it is the best interests of the citizens of the City of Sanford and will benefit the citizens of the City for the Government of the City of Sanford to operate in an effective and coordinated manner and the enactment of this Ordinance is directed at accomplishing that goal in the public interest. NOW, THEREFORE, BE IT ENACTED BY THE CITIZENS OF THE CITY OF SANFORD, FLORIDA: PART I. GENERAL PROVISIONS SECTION 1. LEGISLATIVE FINDINGSIINTENT. (a). The above recitals are adopted by the Mayor and the City Commission as legislative findings relating to the enactment of this Ordinance. (b). It is the intent of the Mayor and the City Commission of the City of Sanford to serve the citizens of the City with a well organized, efficient and responsive local government in order to focus on the provision of vital public services to the citizens of the City. The Mayor and the City Commission hereby find and determine that a streamlined and soundly structured system of boards, commissions and committees will best serve the interests of the citizens of the City of Sanford. (c). It is the intent of the Mayor and the City Commission that City of Sanford boards, commissions and committees be created, to the maximum extent practicable, 2 by means of resolutions and not ordinances in order to avoid the codification of matters thai are, by and large, administrative in nature. The resolutions creating the various boards, commissions and committees of the City of Sanford that may be necessary and expedient to establish from time -to -time shall identify, at a minimum, the scope of authority, the membership, the term of existence and the processes and procedures to be implemented for the particular body. All such bodies shall be subject to the ethics laws of the State of Florida as well as the provisions of State law relating to public meetings and public records. Absent a specific provision set forth in a resolution creating such a body, the body shall not adopt dependent bylaws or rules of procedure. PART II. HUMAN RELATIONS ADVISORY BOARD SECTION 2. REPEALER/HUMAN RELATIONS ADVISORY BOARD. (a). The following specific sections of the Code of Ordinances of the City of Sanford are hereby repealed: 2 -231, 2 -232, and 2 -234. (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford consistent herewith. PART III. CEMETERY ADVISORY COMMITTEE SECTION 3. REPEALERICEMETERY ADVISORY COMMITTEE. (a). The following specific sections of the Code of Ordinances of the City of Sanford are hereby repealed: 2-311, 2 -312, and 2 -313. (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford consistent herewith. PART IV. WATERFRONT MASTER PLAN STEERING COMMITTEE SECTION 4. REPEALERNVATERFRONT MASTER PLAN STEERING COMMITTEE. (a). The following specific sections of the Code of Ordinances of the City of Sanford are hereby repealed: 2-401, 2 -402, 2-403, 2-404, 2 -406 and 2 -407. (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford consistent herewith. PART V. SANFORD CENTRAL CONTRACTORS EXAMINING BOARD SECTION 5. REP EALERISANFORD CENTRAL CONTRACTORS EXAMINING 3 (a). The following specific sections of the Code of Ordinances of the City of Sanford are hereby repealed: 6 -101, 6 -102, 6 -103, 6 -104, 6 -106, 6 -107, 6 -108, 6 -109, 6-110, 6 -111, 6 -112, 6 -113, 6 -114, 6 -115, 6 -116, 6 -117, 6 -118, 6 -119, 6 -120, 6 -121, and 6-'22, (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford consistent herewith. PART VL SANFORD AIRPORT ZONING COMMISSION SECTION 6. REPEALERISAN FORD AIRPORT ZONING COMMISSION. (a). The following specific sections of the Code of Ordinances of the City of Sanford are hereby repealed: Appendix "A ", Article III, Section 3.4 (Land Development Regulations). (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford consistent herewith. PART VII. SCENIC IMPROVEMENT BOARD SECTION 7. REPEALER/- SCENIC IMPROVEMENT BOARD. (a). The following specific sections of the Code of Ordinances of the City of Sanford are hereby repealed: 2-111, 2 -112, 2 -113, and 2 -114. (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford consistent herewith. PART VIII. CDBG ADVISORY BOARDSICOMMITTEES SECTION 8. REPEALER/ CDBG ADVISORY BOARDS OR COMMITTEES. (a). All sections of the Code of Ordinances of the City of Sanford creating, establishing or assigning duties to the CDBG Advisory Board are hereby repealed as well as any and all related resolutions or actions of the City Commission relating to the creation of such boards or committees. (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford consistent herewith. PART IX. BOARD OF ADJUSTMENT 4 SECTION 9. REPEALER/ BOARD OF ADJUSTMENT. (a). The following specific sections of the Code of Ordinances of the City of Sanford are hereby repealed: Appendix "A ", Article lil, Section 3.3 (Land Development ReguL- Aions). (b). The Code codifier is hereby authorized to make revisions to the Code of Ordinances of the City of Sanford of the City of Sanford consistent herewith. PART X. ADMINISTRATIVE AND STANDARD PROVISIONS SECTION 10. DELEGATION TO CITY MANAGER. The Mayor and the City Commission of the City of Sanford hereby delegates to the City Manager the authority to take any and all actions necessary and expedient, as may be appropriate in his sound and professional discretion, in order to implement the provisions of this Ordinance. The City Manager shall consult with the City Attorney in terms of developing implementing actions. The City Manager shall report to the Mayor and the City Commission from time -to -time with regard to the need to establish boards, commissions or committees with the Government of the City of Sanford or whether it would be appropriate to reduce the number of such bodies based upon the needs of the City. SECTION 11. CONFLICTS. In the event of any conflict with any other provision of the Code of Ordinances of the City of Sanford, the provisions of this Ordinance shall prevail. SECTION 12. SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, the invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are declared severable. SECTION 13. CODIFICATION. The provisions of this Ordinance shall not be codified. The City's Code codifier is, however, authorized to take any and all appropriate actions deemed necessary, appropriate or convenient to implement the provisions of this Ordinance. SECTION 14. EFFECTIVE DATE. This Ordinance shall become effective immediately upon its enactment except that Section 9 shall become effective on September 1, 2005. 5 PASSED and ADOPTED this i day of d4lam%,kZ66Y'-2005.
