The City Commission of the City of Sanford, Florida, met in Work Session in the
City Commission Room, City Hall, Sanford, Florida, at 4:30 o'clock P.M. on February 12, 1990.
Present:

The meeting was called to order by the Chairman, who announced the purpose of the
meeting was to hear a presentation by Tom Schneider, Melvin Simon and Associates, Inc.
Mr. Tom Schneider, Development Director, Melvin Simon and Associates, Inc.,
appeared to introduce and review his company's activities. He gave a video and slide
presentation, and reported Melvin Simon and Associates, Inc. was founded in 1960, when Melvin
and Herbert Simon began developing strip shopping centers, then, beginning in the late 60~s,
and since then in the 70's and 80's, they began developing shopping malls. Further, Melvin
Simon and Associates, Inc., manage's over 200 properties in 37 states. They develop and
manage the malls, and sell very few. Mr. Schneider also reported the company is well known
for its development of shopping malls and mixed use (hotel and/or offices in conjunction with
a shopping mall) malls.
Commissioner Howell asked the City Manager the cost, by department, of new
employees the City will need when the Mall is developed. The Chairman asked what the new job
projection is for the Mall. The City Manager reported that Staff is working with the
developer to develop both these'figures.
The City Manager further reported that Staff has a lot of questions and will have
a lot of questions about the DRI, and Staff is quite heavily involved, and is working
directly with, Mr. Schneider's team.
There being no further business, the meeting was adjourned.

James Willard, Swann and Haddock., appeared and reported he represents the
developer of the property. He requested that the adoption of the annexation ordinance be
simultaneous with the DRI Development Order. Further, that between now and April 9th,
there are a great number of issues involving the project to be heard by the East Central
Florida Regional Planning Council, by the City of Sanford, and by Seminole County, and the
developer or the City may not be pleased with all the conditions attached to a Development
of Regional Impact of this size, and it may be to the developer's or the City's advantage
not to proceed with this project.

C. Board of Adjustment: The City Clerk reported the term of Steve
Richards expires February, 1990, and he is willing to serve another
three-year term.
Resignation submitted from Joseph Schaffer, effective March 1, 1990.
Commissioner McClanahan moved to re-appoint Steve Richards to the Board
of Adjustment, and to accept Joseph Schaffer's resignation with
regrets. Seconded by Commissioner Howell and carried by the vote of

Seminole County for Program Year 1988, for a $102,000.00 allocation from Seminole County
for Rental Rehabilitation in Sanford. Commissioner McClanahan moved to authorize the Mayor
and City Clerk to execute said agreement. Seconded by Commissioner Thomas and carried by
the vote of the Commission as follows:

Bid #89/90-21 Pipe Installation Leveling Systems
Mr. Faison -
On 01/18/90, bids were opened for the purchase of a pipe
installation leveling system. This equipment will be used in the
Sewer Division to aid the installation of 9ravity sewer pipe.
The system utilizes a laser beam that sets the proper 9rade for
the pipe installation crew to follow. This system allows for
quicker and more accurate pipe alignment.
Bids were mailed out to five (5) vendors with four (4) responses.
The attached bid tabulation lists the various vendors with their
associated equipment costs.
All bidders met specifications except the bid submitted by Huuhes
Supply. The Huuhes Supply unit did not meet the proper beam
strength as specified in the bid documents.
The low bid was submitted by Surveyor's Supply in Orlando at~a

The Commission next considered Recreational (Skate Board) Ramp Regulations,
tabled at meeting of January 8, 1990. Memo dated February 9, 1990, submitted from the City
Attorney, excerpts of which are as follows:
o "...the noise problems presented by the skateboard ramp located at 2423
South Lake Avenue may be currently controlled by the existing provision of
Section 18-18 of the City Code...",
· "...Section 1-8(c) of the City Code states that any condition permitted to
exist in violation of any provision of this Code shall be deemed a public
nuisance and shall be subject to abatement by the City."
· "...the property owner of 2423 South Lake Avenue may be able to bring an
appropriate cause of action in the circuit court against his neighbors
through the private nuisance laws of the State of Florida."
· If previously considered land use regulations either banning or requiring
setbacks of skateboard ramps were adopted, "...all existing skateboard
ramps would be grandfathered into the City as non-conforming uses. On the
other hand, amendments to the noise ordinance, Section 18-18, of the City
Code may be applied to the use of all existing recreational ramps in the
City, including the ramp located at 2423 South Lake Avenue."
· "...recommend that the City consider adoption of an ordinance which
establishes reasonable setback requirements and a reasonable height
limitation of recreational ramps. In addition, we recommend that the City
amend Section 18-18 of the City Code to specifically establish reasonable
hours of operation which could read as follows:
"18-18(b) Except as otherwise provided in this section the following acts
among others are declared to-be loud, disturbing and unnecessary noises in
violation of this section, but such enumeration shall not be deemed to be
exclusive:
(17) Recreational Ramps. The use of any recreational ramp by a person
upon a skateboard, roller skates, bicycle, coaster, toy vehicle or
similar device other than between the hours of 2:00 p.m. through 8:00
p.m., Sunday throughFriday, and from 12:00 noon through 8:00 p.m. on
Saturdays, during daylight savings time. During standard time the
hours of use shall not be later than 6:00 p.m."
The Police Chief appeared and reported that he had tried to utilize a Citizen's
Dispute Settlement Board to mediate the situation between Mr. Hood and his neighbor, Ms.
Beron. Further, he was informed Mr. Hood would attend the mediation meeting, but Ms. Beron
would not participate, and that she had informed the Settlement Board Coordinator that she
is selling her house and moving, and moving the skate board ramp.
Commissioner Eckstein moved to authorize the City Attorney to prepare the proper
ordinance to allow recreational (skate board) ramps in residential areas, with conditions
as follows:

Conditional Use.

of Altamonte Springs at $350,000.
City Attorney memorandum of February 5, 1990 addresses a bid protest letter
dated January 18, 1990 received from Z United Constructors, sixth low bidder with
a base bid of $446,360. City Attorney notes that the City reserved the right to
waive informalities or irregularities in a bid received, and to accept the bid
which in the City's judgement, is in the City's best interest. He opines that
waiver of informalities in this case is appropriate.

Schemmer Associates, Inc., our architectural consultant for this project
has carefully reviewed information concerning the low bidder (both the firm and
principals of the firm) With respect to experience and perceived ability to
satisfactorily complete the contract. They have similarly reviewed the
credentials of the second low bidder. Although Holley Construction, Inc. is a
newly formed company, both of the principals have extensive experience in the
construction industry and appear technically competent. Contract specifications
require a performance bond and payment bond payable to the City, in the full
amount of the contract. Although Schemmer Associates indicates the potential for
some limited increase in construction administrative costs, relatSd to the
newness of the company ~tself, this potential cost increase is believed
considerably less than the $25,811 spread between low bidder and second low
bidder.
It is reco~nended that City Commission direct Staff to respond to Z United
Constructors, Inc. that the City will waive informalities specified in the
protest letter, and award the contract for construction of Fire Station No. 3 to
the low bidder. It is further recommended that City Commission authorize award
of the contract for Bid 89/90-17 to Holley Construction Company at a base bid of
$350,000, subject to receipt of satisfactory bonds, insurance and other documents
required by the specifications.

Mr. Faison -
On 01/30/90, bids were opened for the Sewer Department to
purchase test plugs. These test plugs are to be used in gravity
sewer lines to block the flow while repairs and/or testing are
being performed.
Bids were mailed to seven (7) vendors with five (5) responses.
Three (3) of the five (5) bidders did not meet specifications
(American Logiball, Inc., Ferguson Underground, and Noland
Company). The other two (2), Shamrock Pipe Tools and Plug It
Products did meet specifications.
It is recommended that the bid be awarded to the low bidder
meeting specifications, Shamrock Pipe Tools, in the amount of
$6,457. Funds for these items are available in account number
451-4540-536-64-06.

I recommend that the City Commission reject all bids as not meeting specifications
regarding the above referenced bid.
Initially, all six (6) vendors requested to bid except Lawman and Shooters Supply,
responded with a "No Bid" on the requested pistols. Lawman and Shooters Supply
originally bid a blued finish version of the pistol that did not meet specifications.
An electroless nickel finish was specified. It turns out that Lawman and Shooters
Supply is the authorized Sig Sauer representative and distributor for our area.
They appear to be the only vendor who can provide the desired product.
Upon checking with the Sig Sauer corporate offices, we find that the electroless
nickel finish is still available. Lawman and Shooters Supply had mistakenly thought
that the electroless nickel finish was no longer available. The electroless nickel
finish is required to match our existing service weapons and also the finish is
more durable for extended duty and intense wear.
Lawman and Shooters Supply still desires to fill our order according to specifi-
cations and projects a delivery date of 60 - 90 days.
The recommended action is to:
1) Reject all bids for Bid #89/90-33.
2)
Accept revised sole source quotation from Lawman and Shooters
Supply for nine (9) pistols at $573.23 ea. or $5,159.07 total
to meet the minimum specifications.
Note that the police department has budgeted to purchase six (6) pistols at $595.
ea. or $3,439.38 total. The quote is within budget. The remaining three (3) pistols
are to be purchased by the Sanford Airport Authority for their airport police officers.
The Sanford Airport Authority will issue a separate purchase order for their pistols.

Commissioner Thomas reported receipt of a letter from Herbert Cherry regarding a
request from Hilda Johnson for a grant for CDBG funds for home improvements, and asked if
the City could do anything to help her obtain the funds. The City Manager reported the
City won't know who will receive funds until the project office checks the projects and the
requests. The Commission authorized the City Manager to review the matter with the City's
Community Development Officer.
The Chairman asked the status of the improvements to the intersection of
McCracken Road and Airport Boulevard. The Director of Engineering and Planning reported
that the railroad has removed the spur track that .was encumbering Airport Boulevard at said
intersection, now the culvert needs to be extended to the east where it crosses Airport
Boulevard, to improve the turning radius. Further, Seminole County is working on the
design, and the total cost is estimated to be $5,000.00 to $6,000.00 for said culvert, a
new head wall, and backfilling. Commissioner McClanahan moved to authorize Staff to
