The City Commission of the City of Sanford, Florida, met in Regular Meeting on
Monday, July 9, 1990 at 7:00 P.M. in the Commission Room, City Hall, City of Sanford,
Florida.

The meeting was called to order by the Chairman.
A public hearing was heid in accordance with Notice published in the Sanford Herald
on June 19, and 29, 1990, as follows:
NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE

Notice is hereby given that a Public Hearing will be held in the
Commission Room at the City Hall in the City of Sanford, Florida, at
7:00 o'clock P.M. on July 9, 1990, to consider changes and amendments to
the Zoning Ordinance of the City of Sanford, Florida, as follows:
A portion of that certain property lying east of
Beardall Avenue and between State Road 46 and
Moores Station Road is proposed to be rezoned from
AG, Agriculture to RI-i, Restricted Industrial.
Said property being more particularly described as

City Clerk reported that Notice was sent to owners on May 31, 1990.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning.
Earl Showers, 833 Grove Avenue, Altamonte Springs appeared in support of the
rezoning.
Commissioner McClanahan stated that he was concerned regarding the noise level, and
the close proximity of the property to the airport, and that petitioner has been forwarned
regarding same.
Director of Engineering and Planning appeared and reported that Staff made its
recommendation to approve the rezoning based on the fact that, the zoning request is for
restricted industrial facility land uses, which is considered compatible with the noise
factor.

On recommendation of the Planning and Zoning Commission, Commissioner Thomas moved
to authorize the City Attorney to prepare the proper ordinance to rezone the property as

On recommendation of City Manager, Commissioner Howell moved to authorize City
Attorney to prepare the proper ordinance to vacate the street, as advertised, and that the
right-of-way be retained as an easement, and that petitioner be required to provide evidence
of appropriate ingress/egress easements prior to second reading of the ordinance, to be
recorded following adoption of the ordinance. Seconded by Commissioner McClanahan and

undergoing development of regional impact review. The development's
general location is identified on the map in this advertisement as
Seminole Properties Development of Regional Impact (Site).
A public hearing on the proposal will be held on Monday, July 9, 1990 at
7:00 P.M. or as soon thereafter as possible, by the City Commission of
Sanford, Florida, in the City Commission Room, City Hall, Sanford,
Florida. The City Commission, acting as the City of Sanford's elected
body, will consider an amendment to the Future Land Use Plan Element of

Director of Engineering and Planning, acting for City Planner, appeared and read
excerpts from a letter dated July 3, 1990, from the Department of Community Affairs, which
was received July 9, 1990. He stated that. receipt of said letter is required by Florida
Statutes before the Commission can take final action to approve, that the Commission should
acknowledge receipt of the letter and comments, that said letter does not contain any
specific information that the City needs to address, and, therefore, recommended that the
Commission adopt the proposed ordinance, and direct Staff to forward the necessary documents
to the Department of Community Affairs.
Commissioner McClanahan asked who the owner of record is.
Peggy Teton, 3511 S. Park Avenue, appeared and asked who the owners of the property
are, and if Director of Engineering and Planning was referring to low cost housing.

The next item of business was the continuation of a public hearing to consider a
small scale comprehensive plan amendment for a portion of property east of U.S. 17-92
(Orlando Drive) and between Airport Boulevard and Americana Boulevard, tabled June 25, 1990,
pending receipt of recommendation from Planning and Zoning Commission.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the.proposed small scale comprehensive plan
amendment. No one appeared.

The next item of business was consideration of a request to continue Contract with
Personal Performance Consultants, for E.A.P. Services. On recommendation of City Manager,
Commissioner Thomas moved to authorize the renewal of said contract with Personal
Performance Consultants, for FY 90-91, at annual premium of $10,155.00. Seconded by
Commissioner Howell and carried by the vote of the Commission as follows:

The Commission next considered request to amend City Code Chapter 3, Alcoholic
Beverages. On recommendation of City Manager, Commissioner Eckstein moved to approve concept
and authorize City Attorney to prepare the proper ordinance to amend City Code Section 3-14;
age limit from nineteen (19) to twenty-one (21) as it relates to the purchase and consumption
of alcoholic beverages. Seconded by Commissioner Howell and carried by the vote of the
Commission as follows:

Mayor Smith presented a plaque to the departing Chairman, John Morris in
honor of his nine and one-half years of service on the Planning and Zoning
Commission with four and one-half of those years as chairman.
Unanimously approved the conditional use request for an Automobile and
Truck Service use (four gasoline dispensing islands) for property located at
2502 Laurel Avenue in a GC-2 General Commercial District for a Speedway-
Starvin Marvin Convenience Store subject to separate City approval for the
use of the alley related to the development of the two parcels of the site.

After considerable discussion regarding multiple-family housing in a single-
family area and the problems that transient rentals can bring into an area,
unanimously approved the conditional use request for a Duplex use for
property located at 718 E. 7th Street in a SR-1, Single-Family Dwelling
Residential District. The Commission felt that they were not setting a
precedence in the area because they had prev/ously approved duplex uses
within several blocks and the building across the street appears to be a
multiple-famOy use.

The Commission next considered a Petition for Annexation for a portion of that

Commissioner Eckstein asked why petitioner is requesting annexation. City Manager
stated that petitioner is requesting water service.
On recommendation of the City Manager, Commissioner Thomas moved to authorize the
City Attorney to prepare the proper ordinance to annex said property. Seconded by

Director of Engineering and Planning appeared regarding the Comprehensive Plan
Amendment (Ordinance No. 2095) public hearing, and the rezoning (Ordinance No. 3006) public
hearing, both tabled earlier in the meeting, and reported that the applicant of record for
the rezoning is Sanford Interstate Properties, a Florida Joint Venture, in care of Sanford
Venture, Ltd., 2301 Lucien Way, Suite 360, Maitland, Florida, that the authorized agent is
Mr. James G. Willard, of Swann and Haddock, and the applicant for Development of Regional
Impact is Seminole Properties, that said application is consistent with information
contained in printouts, which were provided by the Court House, and that he does not have a
list of additional persons involved in either venture.
City Attorney reported that the standard procedure when an application for
annexation or rezoning is filed, is to acquire certification of ownership, which is obtained
through information contained in the application and computer printouts provided by the Court
House, that the information contained in said application and printouts appears to be
consistent, and therefore, the next step would be to remove items from the table, act on the
matter this evening, or the Commission could pose a specific question, and table the public
hearings until additional information is obtained.
Director of Engineering and Planning reported that the application for
Comprehensive Plan Amendment is a result of the Development of Regional Impact process, that
the request for rezoning has been made by the owner of the property, and therefore, believes
it to be appropriate that there is a difference between entities making the requests.
Further, the rezoning action should not be taken prior to adoption of Ordinance No. 2095.
Commissioner Thomas moved to remove said public hearings from the table, to
consider second reading and adoption of Ordinance No. 2095, and Ordinance No. 3006, tabled
earlier in the meeting. Seconded by Commissioner Eckstein and carried by the vote of the
Commission as follows:

City Attorney gave a brief report regarding Sanford Gassification Plant site. He
stated that Director of Engineering and Planning and Michael Gray attended a meeting in
Orlando on Friday, June 6, 1990, which was a fact gathering meeting regarding same, that no
decisions were made, that the site needs further work and study, that he will review report
submitted by Michael Gray, and recommended that City Commission authorize Staff to continue
monitoring, to attend future meetings, as necessary, and to report back to Commission.

Lyle Willis, City employee, appeared a submitted a petition which he reported was
signed by approximately 85 City employees offering to forego their COLA to reinstate
terminated employees' positions..Mr. Willis stated that he would like to convey to the
Commission, on behalf of the fifteen (15) terminated employees, their sincere concern and
desire to work with the City of Sanford for a balanced budget, and asked that the Commission
consider additional options such as interdepartmental transfers, and the filling of vacancies
as ~hey become available.
The Mayor asked for a show of hands of employees represented by Mr. Willis, and
approximately 7 or 8 hands were raised.
City Manager reported that lateral transfers are an option, when available, that
there are openings in the Utilities Department, and anyone interested should contact the
Personnel Director, who would be happy to share information.
Pat Lee, Account Clerk 1, appeared and reported that her position is one of the
positions proposed to be cut, that she is appealing to the Commission to find a remedy, to
allow employees to keep their jobs, and offered some cost saving measures such as, reducing
electricity bills, the reduction of department head seminars, and the elimination of COLA.
Ms. Lee also stated, that some employees will lose benefits as a result of said termination,
that she, as well as other fellow employees, have been dedicated employees.
Martha Yancey, 2100 Cordova Drive, appeared on behalf of the terminated City
employees, and asked if management and the ~ity Manager would receive 3% COLA, and stated
that she deplores what City government has done for loyal employees, that it shows a lack of
leadership, and that, if she were a Commissioner, the City would not be in shape it's in now.
Commissioner Howell moved to direct City Manager to permit department heads to
relieve terminated employees of their workload, as and when their work can be performed by
remaining employees, and to continue to pay said "relieved of duty" employees until October
1, 199~, which would give said employees the opportunity to procure new employment. Seconded
