The City Commission of the City of Sanford, Florida, met in Regular Meeting on
Monday, September 10, 1990 at 7:00 P.M. in the Commission Room, City Hall, Sanford, Florida.

The Chairman called the meeting to order.
Commissioner Howell presented Alex Serreas with a $1,000.00 donation for the Good
Samaritan Home.
A public hearing was held in accordance with Notice published in the Sanford Herald
on August 27, 1990, as follows:
NOTICE OF A PUBLIC HEARING FOR THE PROPOSED
ANNUAL BUDGET AND CAPITAL PROGRAM
FOR THE CITY OF SANFORD, FLORIDA
Notice is hereby given that a Public Hearing will be held at the
Commission Room in the City Hall in the City of Sanford, Florida at 7:00
o'clock P.M. on September 10, 1990 to consider the Annual Budget for the
fiscal year of October 1, 1990 to September 30, 1991.
A copy of said budget and capital program shall be available at the
office of the City Clerk for all persons desiring to examine the same.
Ail parties in interest and citizens shall have an opportunity to be
heard at said hearing.
ADVICE TO THE PUBLIC: If a person decides to appeal a
decision made with respect to any matter considered at the

The Chairman announced that the proposed millage rate is 6.8759 mills, and that a
public hearing will be held on September 24, 1990, to consider the final Budget, and to adopt
the millage.

Notice is hereby given that a Public Hearing will be held in the
Commission Room at the City Hall in the City of Sanford, Florida at 7:00
o'clock P.M. on September 10, 1990, to consider changes and amendments
to the Zoning Ordinance of the City of Sanford, Florida, as follows:
A portion of that certain property lying between
Silver Lake Road extended westerly and North Way
extended westerly and between S.C.L. Railroad
right-of-way and Sipes Avenue is proposed to be
rezoned from AG-Agricultural to that of MI-2 Medium
Industrial. Said property being more particularly
described as follows:
The South 1/2 of the Southwest 1/4 of Sec 8, Twn 20
S, Range 31 E; as recorded in the Public Records of
Seminole County, Florida.
Ail parties in interest and citizens shall have an opportunity to be
heard at said hearing.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to the proposed rezoning.
Thomas McDonald, Trustee, owner, appeared in support of said rezoning, and reported
that in the early 1970's the property was annexed into the City as industrial, that there was
some opposition in 1982 when the western 88 acres of the 160 acre parcel was rezoned to
industrial, and that he believes said proposed rezoning is in the best interest of the City
of Sanford.
Recommendation submitted by City Planner to approve said rezoning.
On recommendation of Planning and Zoning Commission, Commissioner Eckstein moved
to authorize City Attorney to prepare the proper ordinance to rezone said property as
advertised. Seconded by Commissioner Howell and carried by the vote of the Commission as
follows:

Planning Services Agreement with Solin and Associates, Inc. in amount of $15,000.00. On
recommendation of City Manager, Commissioner Thomas moved to approve said Addendum No. 2 to
Professional Planning Services Agreement with Solin and Associates, Inc. in amount of
$15,000.00, plus reimbursable costs, and authorization for Mayor to execute said contract.

The Commission next considered Amendment to Development Order for Seminole
Properties Development of Regional Impact regarding Affordable Housing, as set forth in
Settlement Agreement dated August 28, 1990, between State of Florida Department of Community
Affairs, Sanford Interstate Properties, Developer of Seminole Mall, and City of Sanford.
Thomas A. Cloud, attorney, representative for the City of Lake Mary, appeared and
announced that Forrest Fields, Steve Precourt, and Matt West, Lake Mary City Planner, were
present to answer questions. Mr. Cloud reported that the City of Lake Mary is not opposed
to the Mall, but is concerned that the traffic on Rinehart Road will have a significant
adverse impact on the City of Lake Mary, that there is no provision for four-laning in the
Development Order conditions, and that there is no commitment prior to 40,000 trips being
generated prior to Phase 1. Further, the City of Lake Mary would like to work with the City
of Sanford, that other Developments of Regional Impact in Lake Mary have made similar
commitments for Rinehart Road, that the City of Lake Mary has filed an appeal with the Fifth
District Court of Appeals today, and recommended that the Commission stay action on Amended
Development Order, and requested that Commission consider the inclusion of an additional
condition in said Development Order whereby developer would pay its fare share in estimated
amount of $520,000.00, for the four-laning of Rinehart Road from SR 46-A to Lake Mary
Boulevard.
Mayor Smith reported that no one from Lake Mary has contacted her advising that
there was a problem, and that unless the Cit~)s attorney advises otherwise, she will proceed
with the adoption of said Amended Development Order.
Commissioner McClanahan stated that Lake Mary has a viable concern, which needs to
be addressed, and suggested that a meeting regarding same be scheduled.
Commissioner Eckstein reported that the City of Lake Mary signed an Interlocal
Agreement referred to as the "Good Neighbor Policy", which was adopted to mediate grievances
between the seven Cities in Seminole County, and avoid exposure to costly legal expenses, and
that Lake Mary has circumvented said process. Also, that the City of Sanford has not had a
chance to respond to the complaint.
Mr. Cloud stated that he is not aware of said agreement, that Lake Mary has filed
an appeal in a lawsuit, and that representatives have attempted to resolve the matter with
City Manager, to no avail.
Commissioner McClanahan stated that he was not sure that Lake Mary had sufficient
opportunity to pursue said grievance procedure, and moved to table consideration of said
Amendment, and to pursue a meeting with representatives for Lake Mary and Developer to reach
a reasonable solution. Motion died for lack of second.

City Manager reported that the motion made by Lake Mary at the East Central Florida
Regional Planning Counsel meeting was denied, that no representatives for Lake Mary have
requested changes to said Development Order at any of the public hearings, that the City of
Sanford has proceeded correctly to this point, and that the Amendment deals with affordable
housing, not the issue of Rinehart Road.
Jim Willard, attorney with the law firm of Swann and Haddock, representative for
the developer, and counsel for the City of Sanford for the purposes of the Department of
Community Affairs Appeal, appeared and reported that he is pleased that an agreement has been
reached with the Department of Community Affairs whereby the Development Order incorporates
an affordable housing amendment~that the Department of Community Affairs will not withdraw
its appeal until said Development Order has been amended, and, therefore, recommended that
the Commission amend said Development Order and adopt language as set forth in revised
paragraph 34. Further, the original Development Order application contained a traffic study,
that funding was available for four-laning Rinehart Road, however, after application was
submitted and reviewed, funding was no longer available, that the Regional planning Counsel
deemed to approve project contingent upon the 46 InterChange being built prior to Phase 1,
that Simon and Associates hired people to reevaluate traffic analysis, which concluded that
traffic will not have an adverse impact on Rinehart Road, and that representatives for Simon
and Associates have authorized him to provide and discuss results of same with representa-
tives for Lake Mary.
Thomas Cloud reported that a copy of said study was requested a month ago, but has
not been received to date, and that the Commission should use caution before acting tonight.
On recommendation of City Manager, Commissioner Howell moved to approve Amendment
to the Seminole Properties Development of Regional Impact Development Order, to be consistent

The fire department recommends that the City accept the
bid from Ten-8 Fire Equipment Inc. for the hydraulic
rescue tool in the amount of $13,936.05. The reasons
are as follows:
It is the only tool that meets specifications
because the spreader from Code-3 is too heavy (59
lbs.) and the cutters only open 3.9 inches.
Another major concern is service. Since we expect
the tool to have at least a ten (10) year"service
life, it is vitally important that we have access
to fast, efficient service. Code-3 Res Q. has no
distributors or dealers in the state of Florida.
At this time the closest repair point is the
factory in St.Louis, MO. We do not feel that this
is an acceptable arrangement.

Frank Aranza, proprietor of Tex Mex Restaurant, 1532 South French Avenue, appeared
and requested approval to sell alcoholic beverages for consumption on the premises at said
restaurant, and stated that the Planning and Zoning Commission has recommended approval of

The Mayor reported that Mr. Frank Frana of Tube Tec has requested permission to
place a "Say No To Drugs" sign on the billboard at the south side of the overpass at First
Street, which he will pay for. The Commission had no objections.
The Mayor reported that the City of Sanford entrance sign near southeast corner of
Lake Mary Boulevard, and 17-92, near Gregory Mobile Homes, is hidden by over growth, and
requested that same be trimmed.
Commissioner Howell requested that the field at L. P. Moore Park be graded.
Director of Parks stated that he would check into the matter.
Patti Wierzbowski, 1690 Park Road, Geneva, appeared and requested that the
Commission make a motion directing City Manager's Office to provide her a Letter of
Recommendation based on her past three excellent evaluations.
City Attorney reported that City Charter prohibits the Commission from engaging in
administrative dutieS, that request for same is a personnel matter, and that it is not
appropriate for the City Commission to get involved in the personnel side of City business.
Further, there are administrative procedures in the Personnel Rules & Regulations, and in the
Civil Service Rules and Regulations, and these should be utilized, if they have not been
already. Also, that many private businesses are doing away with Letters of Recommendation
because said businesses are subject to potential lawsuits, that evaluations are public
record, and are the best evidence of an employee's work history.
Commissioner McClanahan reported that the Commission instructed Staff to do
everything in its power to procure employment for reduction Jn force employees, and that
several Letters of Recommendation have already been given.

City Manager reported that Personnel Director issued letters of verification for
all 15 employees, that some department heads, at their own discretion, wrote Letters of
Recommendation for employeesunder their direct supervision, that the City has done numerous
things to assist employees in obtaining employment, and that City Attorney has advised that
Letters of Recommendation are not an appropriate vehicle.
Patti Wierzbowski stated that Cindy Williams received a Letter of Recommendation,
and that she did not personally ask City Clerk for same.
City Clerk reported that Ms. Wierzbowski did not contact her directly regarding a
Letter of Recommendation, that Ms. Wierzbowski has stated that she did not want to talk with
her, and avoided her as well. Further, that if Ms. Wierzbowski had requested a letter, she
would have attempted to work it out with her. Also, an employee has recourse through
grievance procedures should he/she have a complaint about something his/her supervisor has
done.
City Manager reported that this is a sensitive issue, that in view of City
Attorney's advice, he strongly recommended that the City establish a policy whereby Letters
of Recommendation would no longer be provided.
The Mayor advised that there are two or three committees to deal with administra-
tive remedies.
Conrad DePinto, 2617 Hartwell Avenue, appeared and stated that he is opposed to
proposed increase in property taxes, school taxes, and City taxes.
The Mayor stated that the City has not increased taxes.
There being no further business, the meeting was adjourned.
