A Public Hearing was held in accordance with Notice published in the Sanford Herald on September 19, 1990, as follows: NOTICE OF TAX INCREASE The City of Sanford has tentatively adopted a measure to increase its property tax levy by 4.1739 percent. All concerned citizens are invited to attend a public hearing on the tax increase to be held on September 24, 1990 at 7:00 o'clock P.M. in the City Commission Room at the City Hall, 300 North Park Avenue, Sanford, Florida. A FINAL DECISION on the proposed tax increase and the budget will be made at this hearing. Publish: September 19, 1990 The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed Fiscal Year 1990-91 millage rate of 6.8759 mills, which exceeds the rolled-back millage by 4.1739%. Commissioner Thomas moved to approve millage rate of 6.8759 mills for FY 1990/91. Said resolution being in words and figures as follows: RESOLUTION NO. 1588 A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, DETERMINING THE AMOUNT AND FIXING THE RATE OF MAKING THE ANNUAL TAX LEVY FOR THE 1990-1991, FOR THE CITY OF SANFORD, TAXATION AND FISCAL YEAR FLORIDA. WHEREAS, the City Commission of the City of Sanford, Florida, has determined a budget for the operation of the municipal government of the City for the fiscal year 1990-1991; and WHEREAS, the City Commission of the City of Sanford, Florida, has determined that a tax levy on all taxable real and personal property of 6.8759 mills should be levied by the City of Sanford, Florida, for the fiscal year 1990-1991, from which levy the total sum of $4,064,472 is estimated to be collected. NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That the amount determined necessary to be raised by taxation in the City of Sanford, Florida for the fiscal year 1990-1991, for the ordinary purposes of the municipality is the sum of $4,064,472. SECTION 2~ That the millage for the fiscal year 1990-1991, to be assessed upon each dollar of the assessed valuation of all_the taxable property, except homesteads to the extent that the laws of the State of Florida provide for various homestead exemptions, within the corporate limites of the City of Sanford, Florida, is hereby fixed at 6.8759 mills, which exceeds the roll back rate by 4.1739 percent. SECTION 3: That there shall be and is hereby levied for the fiscal year 1990-1991, upon each dollar of the assessed valuation of all taxable property, except homesteads to the extent that the laws of the State of Florida provide for various homestead exemptions, within the corporate limits of the City of Sanford, Florida, a tax of 6.8759 mills for the purpose of realizing a sum sufficient to meet and defray the necessary and ordinary running and operating expenses of the City of Sanford, Florida, for the fiscal year beginning October 1, 1990, and ending September 30, 1991. Commissioner McClalnahan moved to table public hearing to consider proposed alley vacating, for lack of representation. Seconded by commissioner Thomas. Commissioner McClanahan withdrew motion to table. Man appeared in support of said alley vacating, and stated that he represents the owner~ Bernice Beverly, 417 East 2nd Street, who has attempted to obtain permits to renovate a two story house in the rear, that the last contract regarding same was turned down for lack of required space. (Northgate, Viola Kastner, owner.) The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. Minimum landscape requirements for Rinehart Road shall be the same as set forth in the Land Development Regulations for roads designated as Arterials. If construction has not commenced within five years of the effective date of approval of PD, Planned Development Zbning, then the PD, Planned Development Zoning shall expire unless extended by prior approval by the City. Mathews Company of Orlando, FL in the amount of $3,702.00 for the following reasons: 1. J.B. Mathews Co. has previously installed two doors at #2 Fire station and two doors at Central Fire Station, therefore purchasing from them would provide uniformity in the tyPe and Style of doors to be installed. 2. J.B. Mathews Co. has provided us with efficient servi~e to repair the existing doors, therefore purchasing the doors from them would eliminate confusion as to which company to call for repairs to any of the doors. 3. J.B. Mathews Co.'s bid was only. S220.00 more than the low bid, which meets specifications, from American Roll-up Door Co. Inc. of Orlando, FL. 4. J.B. 'The Commission authorized Staff to purchase and place Christmas lights on the Cedar tree in the corner of the public parking lot at northwest Corner of Park Avenue and First Street for "Light Up Sanford"week''. City Manager reported that Staff has received three labor management legal filings regarding charges filed against the City of Sanford with PERC, EEOC, and Orlando Human Relations Department, and recommended that special counsel be retained to work with City Attorney regarding said filings, and that David Kornreich has Worked with the City in similar matters. Commissioner Eckstein stated that legal fees could be expensive, and asked City Attorney what the City's options are; should special counsel be retained, or could the matter be resolved by providing Ms. Wierzbowski with a Letter of Recommendation. City Attorney reported that he is not prepared to answer the question at this time, that he just received the documents this afternoon, and that he has not had an opportunity to review said documents in_detail, that no suit has been filed, that the matter may be out of the City's hands, and that he would research and report back to the Commission. City Manager reported that City must file a response to federal EEOC charges by October 3, 1990. Commissioner Eckstein asked Ms. Wierzbowski if she would forego said filings if she was provided a Letter of Recommendation. Ms. Wierzbowski stated that a Letter of Recommendation is all she wants, and that she would be willing to drop the charges if she received such a letter. Commissioner Howell asked City Clerk if she would write a Letter of Recommendation, if Ms. Wierzbowski made an appointment to meet with her tomorrow. City Clerk reported that she would be willing to discuss the matter with Ms. Wierzbowski, and since legal~filings have been made, would'act in accordance with advice of City Attorney. City Attorney reported that he could prepare a release and dismissal of complaints and in exchange, give Ms. Wierzbowski a Letter of Recommendation, if Ms. Wierzbowski is agreeable. Ms. Wierzbowski stated that she would be agreeable to said release and dismissal of complaints in exchange for a Letter of Recommendation. Commissioner McClanahan reported that the Commission should not dictate day to day operations to Staff, which is prohibited by Charter, however, the Commission unanimously voted to do everything possible to help reduction in force employees procure new employment, which, in his opinion, would include a Letter of Recommendation. City Attorney reported that if the Commission passes said motion establishing City Policy, which is appropriate, that said policy would not be directed towards any individual or any-particular set of facts. Further, said policy would not preclude a prospective employer from requesting copies of an employee's work product, evaluations, and terms of employment, which are public<record, however, said policy would remove the subjeCtiveness. Mr. Kirk further state~ that he is writing a letter to the editor regarding "tulips" in the right-of-way, that there is an ordinance which prohibits campaign signs in the right-of-way, and asked how the City plans to enforce said ordinance. Mayor Smith provided Mr. Kirk with memorandum rega:rding Lake Gem, and stated that same will be discussed at October 8, 1990 Work Session. Further, City would do its best to enforce proper placement of Campaign Signs, with limited Staff. William Balzer, 222 Bradshaw Drive, appeared and reported that a few years ago he met with the Mayor, Director of Engineering and Planning, and'the Police Chief to'discuss the possibility of installing an emergency "ham" radio station in the City of Sanford, and asked what the status was regarding same. Mayor Smith directed City Manager and Staff to prepare their suggestions/recommendations regarding same, and report back to the Commission. Richard Middleton, 1406 Bellair Boulevard, appeared and presented photographs of Little Lake Gem, and stated that he has complained about the mosquito problem, and asked why the City has spent thousands of dollars for irrigation when it cannot afford to mow the grass; if property was privately owned, a fine would be imposed. Mr. Middleton also asked when the City is going to stop raising taxes, and where are his tax dollars going. Mayor Smith reported that the City did not raise kaxes, that public hearings were held for public input regarding the budget, and that she would be happy to provide him with a copy of the budget. Commissioner McClanahan requested that Mr. Middleton accompany a police officer for one shift. Ms. Wierzbowski stated that she has to pick her son up from school at 3:00 P.M. City Attorney asked if Thursday, September 27, 1990 at 9:00 A.M. would be acceptable. Ms. Wierzbowski stated that 9:00 A.M. Thursday would be fine. Man, representative for several senior citizens in the audience, appeared regarding bus schedules.
