The City Commission of the City of Sanford, Florida, met in Regular Meeting on
Monday, October 8, 1990 at 7:00 P.M. in the City Commission Room, City Hall, Sanford,

The Chairman called the meeting to order.

to the Zoning Ordinance of the City of Sanford, Florida, as follows:
A portion of that certain property lying north of
and abutting Lake Mary Boulevard and between Art
Lane and Sir Lawrence Drive is proposed to be
rezoned from AG, Agricultural, to GC-2, General
Commercial. Said property being more particularly
described as follows:

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning.
James Crews, Lake Mary, owner, appeared in support of said rezoning, and reported
that he would like to utilize said property as a car lot, that there is good exposure on Lake
Mary Boulevard regarding same, that the land is not condusive to structures, and that he is
aware that Planning and Zoning Commission recommends denial of request to rezone to GC-2, and
recommends approval to rezone to RC-1.
Commissioner Eckstein and Commissioner Howell stated that they are opposed to
another car lot on Lake Mary Boulevard.
Commissioner McClanahan reported that a car lot would be acceptable if proper
restrictions were placed on the site plan.
Director of Engineering and Planning reported that GC-2 zoning would not be in
compliance with present comprehensive plan.
Recommendation submitted by City Planner to deny request to rezone from AG to GC-2,
and recommends approval to rezone to RC-1.

On recommendation of Planning and Zoning Commission, Commissioner Howell moved to
deny request to rezone from AG, Agricultural to GC-2, General Commercial, and authorize City
Attorney to prepare the proper ordinance to rezone the property from AG, Agricultural to RC-
1, Restricted Commercial. Seconded by Commissioner Eckstein and carried by the vote of the

The next item of business was consideration of Petition to Annex a portion of
property lying west of and abutting Upsala Road and between SR 46 (West 1st Street) and CR
46 A (West 25th Street), John & Zoryada Poland, owners. On recommendation of City Manager,
Commissioner Thomas moved to authorize City Attorney to prepare the proper ordinance to
annex said property. Seconded by Commissioner Howell and carried by the vote of the
Commission as follows:

The Commission next considered request from George Gordon to use 10 feet of 25th
Place street right-of-way at 2535 South Magnolia Avenue, for a carport.
Mr. Gordon, 2535 South Magnolia Avenue, appeared and reported that the carport was
attached to the house when he purchased the home, that there are 25 feet from the end of the
carport to the road, and that said carport does not protrude into the right-of-way.
Mayor Smith advised Mr. Gordon that Staff recommends that the free-standing carport
be relocated to the east side of the existing carport.

October 8,
Director of Engineering and Planning reported that he has observed the property,
that the structure appears to be barely attached to the house without slab, or driveway
connecting it to the pavement, that a building permit was pulled in 1981 to construct the
carport in accordance with approved variance, however, no final inspection was requested, and
that the carport does not comply with said variance. Also, there is ample space on the east
side of the house to relocate said carport without any adverse effect to the structure, that
the house faces Magnolia Avenue, and that it is a side yard situation.
Commissioner Eckstein asked if the City would be liable should the City Commission
allow the carport to remain .in the right-of-way.
City Attorney reported that right-of-ways are in the City's control, that if the
carport is left in the right-of-way without the City Commission's approval, it would
constitute trespassing, if the City gives permission for an obstruction to remain in the
righ~-of-way, and an accident occurs as a result of said obstruction, the City could be held
liable.
City Attorney reported that Mr. Gordon could have recourse through title insurance,
or, if the property was conveyed by Warranty Deed, Mr. Gordon could seek costs to cure the
problem from the previous owner. City Attorney recommended that the City Commission deny
request to use City right-of-way.
On recommendation of City Manager, Commissioner Eckstein moved to deny right-of-
way use permit, and authorized relocation of free-standing aluminum carport to the east side
of the existing carport as shown on the plat. Seconded by Commisssioner McClanahan and

Jammal and Associates in estimated amount of $57,908.00, for Soil Initial Remedial Action at
Utility Department Booster Station. On recommendation of City Manager, Commissioner Thomas
moved to authorize execution of contract with Jammal and Associates, Inc. in an amount not
to exceed $57,908.00 for field professional services, and soil excavation disposal and

Seminole County for pro-rata cost sharing of Travel Time and Delay Studies on State roads

Agreement with Seminole County, to share cost of Travel Time and Delay Studies for State
Roads in estimated amount between $2,218.00 and $2,655.00 per year, for a period of three

The next item of business was consideration of request to execute FY 90-91 School
Resource Office Contract. On recommendation of City Manager, Commissioner Thomas moved to
authorize Mayor and City C].erk to execute School Resource Officer Agreement with Seminole
County School Board, School Board to reimburse the City of Sanford in the amount of
$57,247.00, for 1/2 of the personnel and equipment costs. Seconded by Commissioner Howell

The Commission next considered request to modify Invoice Approval Procedures for
Lump Sum Construction Contracts. On recommendation of City Manager, Commissioner Eckstein
moved to authorize modification of Invoice Approval Procedure for payment of Lump Sum
Construction Contracts, whereby appropriate pay application for such contracts is processed
and paid according to regular Finance Department payment procefures, said proposal would not
be applicable to any "non-lump sum contract", such as professional services contracts for

The next item of business was consideration of requests from Sanford Historic Trust
as follows: 1. Utilization of Centennial Park for sale and dispensing of food on December
2 and 3, 1990; 2. Utilization of Cultural Arts Center for Headquarters of the Annual Holiday
Tour of Homes on December 2, and 3, 1990, said use to be at the rate of $18.00 per hour.
Commissioner Thomas moved to approve requests as follows: 1. Authorization for Sanford
Historic Trust to use Centennial Park for sale and dispensing food on December 2, 3, 1990 as
requested, and 2. Authorization to use Cultural Arts Center for Headquarters of the Annual
Holiday Tour of Homes on December 2, 3, 1990 as requested, said use to be at the rate of

The next item of business was consideration of request from Sanford-Seminole Art
Association to waive City Code Section 3-23, which prohibits the consumption of alcoholic
beverages in public areas/parks, for St. John's River Festival on March 2, 3, 1991 in Fort
Mellon Park.
Police Chief reported that he does not believe there is much of a difference
between parks and Civic Center, and.that both would require two police officers on site while
alcoholic beverages are being dispensed.
Janis Mcgee, Chairperson for festival, appeared and reported that David's Food,
which is a 'master concessionaire, will be responsible for proper dispensing of alcoholic
beverages, and that security will be provided because valuable art will be displayed. Also,
they will receive a percentage of the concessions, and that they would be willing to hire
police officers as recommended by Police Chief.
Commissioner Howell moved to authorize sale and consumption of alcoholics beverages
for St. John's River Festival on March 2, 3, 1991 in Fort Mellon Park, subject to proper
security being provided as recommended by Police Chief. Seconded by Commissioner Eckstein
and carried by the vote of the Commission as follows:

The Commission next considered request to execute proposed Interlocal Agreement
with Seminole County regarding Utility Service Areas, which was discussed at tonight's Work
Session. On recommendation of City Manager, Commissioner Thomas moved to authorize execution
of Interlocal Agreement with Seminole County including definition of City of Sanford Utility
Service Areas, and pro-rated reimbursement in amount of $185,720.00, for that portion of Lake
Monroe Utility Service Area being acquired by City of Sanford, with funds for pro-rated
reimbursement of Seminole County to be taken from Utility Bond Proceeds Trust Fund. Seconded

Historic PreServation Board: City Clerk reported that the terms of William
E. "Duke" Adamson and Edward L. Blacksheare expire October 28, 1990.

Due to the lack of a representative, unanimously retabled the
Public Hearing to consider the request to rezone from MR-2
Multiple-family Residential District to RC-1, Restricted
Commercial District, property located at 2590 Sanford Avenue.

After unanimously recommending the denial of the request to
rezone from AG, Agriculture District to GC-2, General
Commercial District, unanimously recommended the approval of
a rezone to RC-1, Restricted Commercial District for property
located in the 1100 block of Lake Mary Boulevard.
Mr. Crews had requested GC-2 zoning in order to use the
property as a car lot since the majority of the property was
filled land and he felt that it would not support structures.
The Commission felt that GC-2 zoning was inconsistent with the
Comprehensive Land Use Plan, but RC-1 was not.

Memo and bid
This is a re-bid of refuse dumpster service utilized by the Parks Department for
several years. A re-bid was necessary because of need of larger capacity
dumpster than was previously used.
The Parks Department utilizes dumpster service to deposit the daily refuse clean-
up in our parks system. It is more economical to lease the dumpster-s.ervice to
deposit the daily park refuse. Staff found it to be a saving in time, manpower
and fuel for the City of Sanford.
Director of Parks recommends award of bid for refuse dumpster rental to Waste
Management of Orlando in the amount of $2,076.00 as low bidder and meeting
qualifications.

Mr. Faison-
Bids were opened 09/26/90 for the purchase of electrical parts
for a panel board with meter can. These materials will be used
by City personnel for the construction of an electrical control
panel for the new Twin Lakes Wellfield.
Bid packages were mailed to ten (10) Vendors with six (6)
responses. Attached is the bid tabulation sheet which shows
Jones Electric of Sanford as the low bidder. Their materials
meet specifications.
It is recommended that this bid be awarded to Jones Electric in
the amount of $1,350. Funds for this project are available in
Account No. 451-4525-536-63-00 for FY 90/91.

Bob Ball appeared and reported he owns property at 2600 Orlando Avenue, that two
years ago his tenant closed out, that he was approached by Mr. Martin, Martin Motors, who
took over the lease in 1989, that lessee was cited by Code Enforcement Board for violations,
that notice regarding same was addressed to lessee, that violations were not rectified, that
fines were assessed and liens were placed against the property for said Code Enforcement
violations, and that Mr. Martin vacated the premises in April of 1990. Mr. Ball further
stated that Mr. Martin signed an agreement whereby he would be liable for any violations
incurred, that the City could pursue Mr. Martin, who has trucks and equipment, which could
satisfy the debt, that he Was aware that the property can be seized as a result of a
judgment being entered, and requested financial relief from the City.
City Attorney reported that relative to Code Enforcement Board matters, Florida
Statutes provides that property owner and tenant are served notice of violation, that both
are responsible, that the best way to enforce a lien is to attach real estate through
foreclosure proceedings. Also, that the Code Enforcement Board has the authority to
reduce/waive fines, and recommended that Mr. Ball request that the matter be placed on the
Code Enforcement Board Agenda for consideration, and that the City Commission could review
Code Enforcement Board's action.
The Commission referred Mr. Ball to the Code Enforcement Board, and advised that
further action would be held in abeyance pending response from Code Enforcement Board.
Mayor Smith informed Mr. Balzer that the Commission is going to wait until the
Copper Penny issue is decided before consideration is given to his request to install
emergency "ham" radio at the Police Department.
