The City Commission of the City of Sanford, Florida met in Regular Meeting on
October 22, 1990 at 7:00 P.M. in the City Commission Room, City Hall, Sanford, Florida.

The Chairman called the meeting to order.
Mayor Smith announced that the week of October 20 through 28, 1990, has been
designated as "Red Ribbon Week", and read a Proclamation regarding same, and directed Staff
to post said Proclamation in City Hall for viewing.
Mayor Smith reported that earlier in the day, the City of Sanford received awards
from JSAC and the American Legion in recognition for employing people with disabilities.
The first item of business was continuation of a public hearing to consider
rezoning a portion of property lying between Palmetto Avenue and Sanford Avenue and between
East 25th Place and East 16th Place, from MR-2, Multiple Family to RC-1, Restricted
Commercial, tabled at the Regular Meeting of October 8, 1990, pending receipt of Planning and
Zoning Commission recommendation.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning. No one appeared.

Unanimously recommended the approval of the request to rezone

Commissioner Thomas moved to authorize City Attorney to prepare the proper
ordinance to rezone said property.
Bill Simmons, Director of Engineering and Planning, reported that there is a sewer
line that runs behind the two lots, that there is no utility easement covering said sewer
line, and recommended that rezoning be approved subject to owner providing a 7.5 foot wide
utility easement.

The next item of business was consideration of request from the Lions Club for
reduction of Sanford Civic Center rental amount, for annual fund raiser held Saturday,
September 29, 1990.
Director of Parks reported that the Rotary and Kiwanis Clubs receive one free use
of the Civic Center each year, for the purpose of a charity event because they lease the
Civic Center on a monthly basis. Also, the Civic Center rental rates were raised in mid-
year, after the Lions Club had made its plans.
Commissioner Eckstein moved' to authorize a 50% reduction of Civic Center lease,
from $611.50 to $305.75, for Lions Club Charity Fund Raiser held Saturday, September 29,
1990. Seconded by Commissioner Howell and carried by the vote of the Commission as follows:

Mayor Smith abstained from voting and announced that she would fill out a conflict of
interest form regarding same.
The Commission next considered request from W. G. Lassitor, Flagler Development
Corporation, to use a portion of Cypress Avenue street right-of-way for twenty-four existing
parking spaces, between First Street and Second Street.
Director of Engineering and Planning reported that the request is to formalize
approval for utilization of st.reet right-of-way for parking, which was authorized by the City
in the late 1960's through site plan approval and that there is no record specifically
authorizing the street right-of-way use. Further, that a portion of the right-of-way appears
to be within the parking lot of Winn Dixie, that it does not look like on-street parking,
that the curbing is in, that no changes need to be made, but rather, the request is continued
use of something that already exists.
Commissioner Eckstein moved to authorize continued use of right-of-way as shown on
site plan approved in 1967. Seconded by Commissioner Thomas.
Commissioner McClanahan reported that he is opposed to setting a precedent relative
to allowing utilization of right-of- way for parking by referring to something that was done
in 1967, which is not on the record.
Commissioner Eckstein withdrew the foregoing motion, and Commissioner Thomas
withdrew the second of said motion.

a 'utility easement over a portion of the northeast corner of the Oregon Avenue wellfield site
and adjacent to Rinehart Road right-of-way, to facilitate installation of County wastewater
force main. On recommendation of the City Manager, Commissioner Thomas moved to authorize
the Mayor and City Clerk to execute the Utility Easement as requested. Seconded by
Commissioner Howell and carried by the vote of the Commission as follows:

AND EVALUATE ALL ALTERNATIVE ROUTES AND
CORRIDORS AND RECOMMENDING THAT THE
AUTHORITY AVOID ADVERSE IMPACT AND
DISRUPTION UPON SANFORD NEIGHBORHOODS.
WHEREAS, in 1989 the Florida Legislature created the Central'Florida Commuter
Rail Authority (CFCRA)to assist Central Florida in est.ab.h;'s~g a viable rail transit
alternative; and "' -;'
WHEREAS, the City of Sanford desires to support and participate in the future
development of commuter rail service in Central Florida; and
WHEREAS, the CFCRA Ls to consider several commuter rail alternatives including
the I-4 Highway Corridor, the present CSX Main Line Rail Corridor and/or the Oviedo Line
Connector; and
WHEREAS, both City of Orlando and Orlando Utilities Commission have prepared
prelim/nary smd/es that were directed toward the specific objectives of removing freight
trains from downtown Orlando and iraproving coal train routing for the Orlando Utilities
Electric Plant east of Orlando rather than toward furthering commuter rail in Central
Florida; and

WHEREAS, both the City of Orlando's and Orlando Utilities Commission's
preliminary studies recommend further study of alignments that would: 1) displace
substantial existing residential housing in Sanford's oldest neighborhoods north of 25th Street
(State Road 46 East) including historic traditional neighborhoods with grid patterned, oak
lined streets, 2) severely disrupt said neighborhoods with grade-separated intersections and
closed local streets, and 3) require significant revisions to Sanford Airport's runways and
flight patterns, with potential long term adverse effect; and
WHEREAS, review of these preliminary studies reveals that one or more apparently
viable alternatives simply-were not considered because of limitations to the scope and
purpose of such studies; and
WHEREAS, the Central Florida Commuter Rail Authority's Initial Work Program
adopted in August, 1990 proposes to utilize the above-mentioned preliminary studies as a
foundation and basis for additional study.
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION. !: That the City Commission of the City of Sanford strongly recommends
that the Central Florida Commuter Rail Authority start at "square one" in the development
of a comprehensive commuter raft study.
SECTION..2: That the City Commission of the City of S,anford strongly recommends
that the Central Florida Commuter Raft Authority insure thai..the scope of consultant
services and related work programs develop, evaluate and analyze any and all reasonable
alternatives directed toward the goal of commuter rail service, with any relocation of the
present CSX Main Line as a strictly secondary consideration.
SECTION 3: That the City Commission of the City of Sanford, Florida authorizes
and directs the City Manager to insure that City staff participate in all appropriate aetMties
of the Central Florida Commuter Rail Authority and that staff be directed to work towards
implementation of commuter rail in Central Florida while protecting Sanford's
neighborhoods fi.om encroachment and disruption from transportation facilities.

The next item oi Duslness was consideration of request ~rom SoutHern Bell ior an
exclusive perpetual easement for the installation of telecommunications equipment in the
northeast quadrant of the intersection of Americana Boulevard and U.S. Highway 17-92.
City Manager reported that City Engineer has recommended selection of a different
location, and that the word "exclusive" be eliminated, which'will allow for better control.
On recommendation of City Manager, Commissioner McClanahan moved to approve non-
exclusive easement, City Engineer to designate site, and authorize Staff to execute Standard
Option to Obtain Easement Form, directing Staff to coordinate specific location for easement
to avoid existing utilities, keeping the easement east of Highway 17-92 right-of-way, and a
reasonable distance from American Boulevard pavement. Seconded by Commissioner Eckstein and
carried by the vote of the Commission as follows:

The Commission next considered change order to existing contract with Florida
Petroleum Services, Inc.
Commissioner Eckst'ein referred to Director of Engineering and Planning's
recommendation that funding for same come from General Reserves, and stated that Staff was
going to look into utilization of Law Enforcement Trust Funds for needed engineering costs
at Police Station, and asked what the status was regarding same.
Steve Harriett, Police Chief, reported that Law Enforcement Trust Funds cannot be
used for maintenance or repair purposes.
On recommendation of the City Manager, Commissioner Howell moved to authorize Staff
to execute proposed change order with Florida Petroleum Services, Inc. in amount of
$3,366.11, for removal of underground storage tank at Civic Center, and unit price costs for
removal and disposal of contaminated product and sludge or waste oil from said tank to be
funded from General Reserves. Seconded by Commissioner McClanahan and carried by the vote
of the Commission as follows:

Seminole County, for Intersection Improvements on Upsala Road/Central Park Drive. On
recommendation of City Manager, Commissioner McClanahan moved to authorize Staff to execute
Interlocal Agreement for Upsala Road/Central Park Drive Intersection Improvements in an
amount not to exceed $30,000.00 for materials, to be funded from Local Option Gas Tax
Revenues, Seminole County to fund engineering, labor and equipment costs. Seconded by

Utility Building located at 412 W 14th Street. The old sliding
doors are in poor condition and need to be replaced with roll-up
type doors.
Bid packages were mailed to eight (8) vendors with four (4)
responses. Two (2) of the responses were "No Bids."

Bids were opened on 10/9/90 for the replacement of a high service
pump motor located at the Main Water Treatment Plant. The
existing motor is a variable speed type. Due to the recent
expansion of the water plant the existing motor was to be
modified as a constant speed motor. After discussions with our
electrical consultant it was decided to purchase a new constant
speed motor and either sell the old motor or keep it as a spare.
Variable speed motors are expensive. It is hoped that we could
sell the old motor and recoup a major portion of the cost for the
new motor.

bid of $1,865.28 for three portable generators from
Tri-W-Rental-Orlando. The units bid, Winco-DX-
3200,meet specifications with one exception. The
exception is the outlets provided are straight blade
instead of twist-lock type. This is a minor exception
and modification can be accomplished at a minimal cost
by the department.

1960's and the Amendment in 1973, that pursuant to said lease, the Jaycee Club, also
referred to as Seminole County Junior Chamber of Commerce, was permitted use of City owned
property, and allowed to construct buildings on said property conditioned upon utilization
of said property for the purpose of a tourist information center and some club activities.
Further, the City has the right to cancel the lease if the premises are not utilized as
intended, which appears to be the case, that if a group would like to utilize said property
as the City intended, the City has two alternatives: 1. Seminole County Junior Chamber of
Commerce could consent to 'entering into an agreement with the City whereby a new group would
take over the lease, or 2. The City could exercise its reversionary powers under the lease
and terminate said lease, that if the City so chooses, Seminole County Jr. Chamber of
Commerce should be given public notice that the City is going to look into matter, that a
public hearing be held to afford interested parties the opportunity to respond, and to make
a fact finding determination to ascertain whether or not terms and conditions of the lease
have been breached. Further, if the Commission concludes that said lease has been breached,
the City could have the buildings appraised by three appraisers, and purchase said buildings
at an appraised value not to exceed $10,000.00.

George Wallace, P.O. Box 2279, 312 west First Street, Suite 401, representative for
Rotaract, appeared and asked if the Commission will determine rental based on the condition
of the building at the time it was abandoned, or will consideration be given to the work that
has been done in the past few months to restore the property. '
City Attorney reported that it would be premature for the Commission to commit to
a particular position this evening relative to how the City would determine the value of the
property.
Commissioner HowelI requested that Mr. Wallaceprovide repair figures and.the hours
of labor involved to restore the building.
On the advice of city Attorney, Commissioner Howell moved to advertise a public
hearing for November 12, 1990, to consider whether or not the Jaycees have breached their
lease of Fourth Street Park/Jaycee Park, and possible alternatives regarding Jaycee Park

Commissioner Eckstein asked City Engineer to address the possible Changing of
Airport Boulevard and Country Club Drive from a four-way stop to a two-way stop. City
Engineer reported that this particular alternative was proposed by Seminole County Traffic
Engineer, that traffic'is very unbalanced, that normally a 4-way stop would be utilized when
traffic is relatively balanced, that pursuant to the expressway plan, Country Club would not
be a through street between Airport Boulevard and 25th Street, and that the ultimate decision
will be up to Seminole County because Airport Boulevard is a County Road.
Commissioner Eckstein reported that the Henry Shelton Library/Museum hours have
been reduced, and suggested that the Library/Museum remain open on Saturday or Sunday.
Commissioner Howell reported that the Library/Museum should be open both Saturday
and Sunday, and suggested that it be closed on Monday and Tuesday.
Director of Parks stated that he would discuss the matter with the Library/Museum
curator.
Commissioner Thomas asked if Staff has taken any additional steps to resolve the
mosquito Problem.,
City Manager reported that Staff has increased spraying in residential
neighborhoods, and that larvaCide has been applied to ditches and ponding areas.
Commissioner Thomas reported that citizens in District 3 have voiced their concerns
regarding open ditches at 16th Street through Middle Creek and the Project, and 25th Street
near Goldsboro Elementary School, and asked if Staff has plans to close said ditches.
city Manager reported that there are very extensive Plans on the drawing board,
which were authorized by the Commission for Conklin Porter & Holmes to prepare, that
additionally, because of the expense involved with storm sewer work, the City Commission
authorized Conklin Porter and Holmes to investigate a stormwaterutilit¥, which would develop
a mechanism to raise money to provide better ditch work, that pipe is being placed in some
of the shallow ditches and covered over, however, all ditches are not designed to be covered
over, and that Staff expects to receive Conklin Porter and Holmes' proposal within the next
few months.

Commissioner Thomas asked what the status is with Seminole County School Board
relative to expansion of recreational facilities, and possible swimming pool facility.
City Manager reported that there has been significant headway, that a format was
developed, and that both plans were implemeted at Seminole High School and adjacent middle
school in October, 1990. Also, the Commission authorized Staff to investigate possible land
acquisition, that acreage between high school and cemetery is being considered, that an
appraisal has been requested, and that upon receipt of said appraisal, Staff will report back
to the Commission.
Director of Recreation reported that after school recreation program is about to
start at Seminole High School, which will offer baseball and basketball.
Commissioner Eckstein reported that he spoke with Greg Robinson, basketball coach,
who offered to work with 5th and 6th graders on Saturdays at Crooms Gym.
Julia Gahn appeared and reported that she represents Louise Beasley with rega~d to
property located at 1118 West 4th Street, that on October 17, 1990 the paper stated that said
dwelling was a drug house, that it is not a drug home, that she lives two blocks from said
dwelling, that the house has been boarded up, that a permit was pulled a year ago, and that
repairs are being done as money is available.
Police Chief reported that said dwelling was inadvertently connected with three
other structures, which had evidence of drug activity, and that the Commission authorized
demolition of the structure.
City Manager reported that the condemnation process dates back about a year, was
identified by inspection department, moved through condemnation process during the spring,
that When Staff authorized demolition of said structure, the owner requested a 90 day time
extension to complete repairs, that said request was approved, that the 90 days ran through
the August/September timeframe, that subsequently the structure was placed on the demolition
list, that Staff received a letter dated October 18, 1990 requesting that demolition be
postponed to allow owner to begin repairs, that based on the inspection report, the structure
is uninhabitable, that plumbing and electrical permits are required, and that repairs to make
structure habitable will be costly.
Louise Beasley appeared and reported that her mother owns the house, that repairs
could be completed by the end of November or beginning of December, and that she plans to
live in the house.
Director of Engineering and Planning reported that there is no indication that the
owner has a clear idea of what it will cost to complete the necessary repairs, that the
dwelling needs carpentry, plumbing and electrical work, that he is not sure the owner is
financially capable of paying said repairs in a reasonable timeframe, and recommended that
due consideration be given to determine whether it is financially feasible to rehabilitate
the structure, as well as, is it within the owner's means, and suggested that the owner
obtain an estimate to determine the cost to complete repairs before spending additional
monies.
