112190-special meeing336 MINUTES City Commission, Sanford, Florida NOVEMBER 21. Special Meeting between Mayor Bettye D. Smith and the Representatives for the 0ayeees aha ttotaract on Wednesday, November 21, 1990 at 9:00 A.M. in the City Manager's Conference Room, City Hall, Sanford Florida. Present: Mayor-Commissioner Bettye D. Smith Acting City Attorney Donna Mclntosh Rotaraet President Sheldon Chang Jaycee President Pamela Rymniak Jaycee Member Blair Kitner The Chairman called the meeting to order. Mayor Smith announced that this meeting was scheduled to achieve a tentative affeeement regarding joint use of the Jaycee Park facilities, which will satisfy everyone present as 'well as the Commission. Assistant City Attorney Donna McIntosh reported that because Jaycee Park is public property, the City can only enter into a lease with a private corporation whose primary goal is to serve the public's benefit, that any lease the City may enter into would contain a clause whereby the City would be able to cancel said lease at any time, and that the City will retain complete control over the activities of said property. Rotaract President Sheldon Chang reported that Rotaract would like to use the Jaycee Park facilities for a club house, and possibly charitable activities. Assistant City Attorney reported that utilization of said facility for a club house or meeting place would not constitute a public purpose. Jaycee Member Blair Kitner reported that he was not prepared to submit possible uses for said facilities at today's meeting, that he was under the impression that his organization already has a lease with the City, that the Commission found the Jaycees in breach of the lease, but that he was not aware that said lease had been terminated. Mayor Smith reported that neither the Jaycees nor Rotaract will acquire sole use/control of the property, and that both organizations will have access to said facilities, as well as other organizations. She asked if it would be acceptable to both organizations if each were allowed to utilize said facilities for their meetings. Mr. Chang reported that he would be agreeable to joint utilization of said facilities, and asked if the City would maintain control of the building, and if there would be a lease involved. Jaycee President, Pamela Rymniak reported that she intended to use the building for a meeting place as well as other activities. Assistant City Attorney reported that at the Regular Meeting of November 12, 1990, the City Commission determined that the Jaycees breached their lease, that the City exercised its reversionary powers thereby terminating said lease, that the City has the option of obtaining three appraisals, and to purchase said property at an appraised value not to exceed $10,000.00, that said appraisals have not been done, and, therefore, termination of said lease has not been completely executed. Further, the Commission requested that a meeting be held with both organizations to reach a mutual agreement, and that she would be happy to provide the Jaycees with a formal document of what transpired at said meeting. Also, the City can enter into a lease with one or both organizations if a concrete, primary, public purpose exists. Ms. Rymniak stated that she did not realize that the lease was terminated, and that she thought the Jaycee Board of Directors would be given the opportunity to come up with an appropriate use of said facilities. Mayor Smith requested that the keys to the Jaycee Building be returned. Ms. 'Rymniak reported that the Jaycees have furniture and miscellaneous items stored at said facilities. Assistant City Attorney asked Ms. Rymniak if the Jaycees would consider leaving the furniture for joint utilization, and suggested that valuable items be removed from the premises. Ms. Rymniak stated that she would discuss same with the Jaycee Board of Directors. Mr. Chang proposed that two officers from both organizations coordinate events on a monthly basis, and that any other clubs wanting to use the building be required to check with said representatives. Sanford, Florida 337 NOVEMBER 21, 1990 Ms. Rymniak proposed that the Jaycees be the primary user of the building, that the Recreation Department maintain control over said premises, and coordinate with whomever wants to use the facilities for other activities or special events. Assistant City Attorney reported that use of said facilities would have to be on a first come first served basis, and that representatives for both organizations could meet to coordinate monthly activities. Mayor Smith reported that there needs to be a compromise on the part of both organizations, that possibly the Woman's Club would be interested in holding its meetings at the Jaycee facilities for a nominal rental fee, that said facilities could be the headquarters for the Golden Age Games, Soap Box Derby, or the Martin Luther King Committee, which would serve public purpose, that the Parks Department maintain control over the activities that occur on the property, and that other organizations be allowed to use said facilities, with Mondays and Tuesdays being reserved for the Jaycees and Rotaract. Ms. Rymniak reported that she cannot commit the gaycees to a particular project without authorization from the Board of Directors, and requested that she be permitted to meet with the Jaycees to discuss possible uses. Mr. Kitner requested that cancellation of the lease be tabled until appraisals are completed, that he be given the opportunity to meet with the Jaycee Board of Directors to come up with an appropriate proposal, which would address the requirement that the use be for the public good, and utilization of said facilities by other organizations, and that said proposal be presented to the City Commission for consideration of possibly entering into a new lease. Mayor Smith reported that Rotaract would have to be afforded the same opportunity, that she could only foresee additional problems between the two organizations, and that she was not willing to present such a proposal to the Commission. Assistant City Attorney reported that the Jaycees no longer have a binding lease with the City. Mayor Smith asked representatives for both organizations if they would consider working together on a joint project to repair the Jaycee Building, and proposed that the Jaycees donate the $10,000.00 to the Golden Age Games or a similar project instead of the City paying the Jaycees $10,000.00 for the purchase of said facilities. Both representatives were agreeable to said project. Mr. Kitner reported that he would be willing to consult with the Jaycee Board of Directors regarding possible donation of said $10,000.00. Assistant City Attorney reported that upon notification from Jaycee Board of Directors that said organization is willing to allow the furniture to remain on the premises, and that they are agreeable to donating said $10,000.00 to the City, a formal letter will be provided to the Jaycees and Rotaract regarding said breach, and details regarding the tentative agreement reached today.
